Galav iz Charter School (101-852)Dear Mr. Mena and Ms. Cano:As you are aware in a Juty 19, 2013 correspondence, the commissioner of education communicated hisintent to revoke the open-enrollment contract for charter with Galaviz Academy, Incorporated. Thecommiss ioner reviewed the response and request for a hearing submitted by the charter school on July25, 2013, and on August 12, 2013 determined that The Texas Education Agency (TEA)will proceed withthe revocation of the contract for charter.This letter is in regards to a recent phone conversation between Ms. Victoria Cano and Eric Marin,Ass is tan t Legal Counsel at the TEA. In that August 16, 2013 conversation, Ms. Cano stated that theboard of the charter had decided to suspend operations effective immediately. Mr. Marin was alsoinformed that parents were being notified of the suspension by telephone on August 16 and August 19,2013.

    Please be advised that a charter may not suspend operations for longer than 21 days without anamendment to its open-enrollment charter adopted by the commissioner of education. See 19 TAC100,1213 {attached}. In order to obtain commissioner approval for such action, the charter schoolwould need to submit to the TEA an amendment request, including a board resolution adopted at a dulyco nvened public meeting of the board, to suspend operations. Additional information anddocumentation for such an amendment request may include the agenda and subsequent minutes of theboard meeting that reflect the item and actions of the board regarding the proposed suspension ofcharter operations. Suspension of operations in violation of the procedures set forth in the ruleconstitutes abandonment of the open-enrollment charter. See 19 TAC100.1213(d).
