Job PACKAGE 11A: CIVIL, STRUCTURAL & ARCHITECTURAL WORKS FOR INDUCED DRAFT COOLING TOWER FOR 2X660 MW MAITREE RAMPAL PROJECT, BANGLADESH.

With reference to above, following points/ documents, relevant to tender, may please be noted and complied with while submitting offer. 1) Extension of DDS of submission of offer from 24-01-2019 up to 30-01-2019, 15:00 Hrs.

2) Clarification to bidder’s queries vide Annexure-A to TCN-01.

3) Issuance of Tender Drawing of IDCT (Schematic Views, General Arrangements and Layout for Cooling

Tower) vide this TCN-01.

4) Reference to www.jantermanter.com in Sl No 1 (iv) of NIT is hereby deleted. 5) Sl No 1 (xi) may be read as “ Latest updates on the important dates, Amendments, Correspondences, Corrigenda,

Clarifications, Changes, Errata, Modifications, Revisions, etc to Tender Specifications will be hosted in BHEL webpage (www.bhel.com →Tender Notifications →View Corrigendums & CPP portal →Tender Notice) & E-Procurement Site https://bhel.abcprocure.com and not in the newspapers or www.jantermanter.com. 6) For this procurement, Public Procurement (Preference to Make in India), Order 2017 dated 15.06.2017 & 28.05.2018 and subsequent Orders issued by the respective Nodal Ministry shall be applicable even if issued after issue of this NIT but before finalization of contract/ PO/ WO against this NIT. In the event of any Nodal Ministry prescribing higher or lower percentage of purchase preference and/ or local content in respect of this procurement, same shall be applicable

7) Revised `No deviation certificate’ as per enclosed Annexure-2. Bidder shall submit no deviation certificate as per enclosed format only.

2 Notice Inviting Tender Cl. No. 35 The contractor shall at all stages of work deploy skilled/ semi‐skilled tradesmen who are qualified and possess certificate in particular trade from CPWD Training Institute/ Industrial Training Institute/National Institute of Construction Management and Research (NICMAR), National Academy of Construction, CIDC or any similar reputed and recognized Institute managed/ certified by State/ Central Government. The number of such qualified tradesmen shall not be less than 20% of total skilled/ semiskilledworkers required in each trade at any stage of work.

We propose to deploy skilled / semi‐skilled workers at site based on their experience and expertise in cooling tower works. We request to delete the requirement of qualification / certification from CPWD Training Institute/ Industrial Training Institute/ National Institute of Construction Management and Research (NICMAR), National Academy of Construction, CIDC or any similar reputed or recognized Institute managed/ certified by State/ Central Government.

3 Annexure – A to NIT Sr. no. 14: GCC clause: 2.7.2.2

In case Contractor fails to deploy the resources as per requirement, BHEL can deploy own/hired/otherwise

arranged resources at the risk and cost of the contractor and recover the expenses incurred from the dues payable

to contractor.

Any risk purchase should be made only after giving necessary chance to the contractor and after obtaining written confirmation from

them.


4 TECHNICAL CONDITIONS OF CONTRACT

Clause # 5.0 MATERIAL HANDLING (BHEL ISSUED MATERIAL) We understand that items which have been explicitly mentioned in BOQ are in the scope of bidder.

Bidder will be supplied all the materials as per requirement of the work and price schedule except Free issue materials of BHEL. Refer description of the items of Price schedule for details.

Clause # 12.0 TERMS OF PAYMENT We will expect 10% of total contract value as interest‐free advance with order against equivalent ABG on reducing balance basis.



Clause # 14.7 New tax & duties, if imposed subsequent to latest due date of offer submission, as per NIT & TCN, as applicable, by statutory authority after due date of submission of latest

price offer and within the contract period including extension, if any (provided reason for extension is not attributable to vendor), shall be reimbursed by BHEL at actual on production of relevant supporting document to the satisfaction of BHEL. However, the vendor shall obtain prior approval from BHEL before depositing new taxes &

duties. Benefits and/or abolition of all existing taxes must be

passed on to BHEL against new Taxes, if any, proposed to be introduced at a later date.

Statutory variation / Imposition of new levies shall be extended till contract period and any extension thereof irrespective of the party attributable for the delay.



Clause # 22.0 OVER RUN CHARGES We expect ORC for delays for reasons not solely attributable to the contractor.

Clause # 25.1 Milestones L/D We understand that if the project is completed within scheduled completion date (including extension for reasons not attributable to Bidder) in spite of slippage in Milestone, no LD will be applicable.



Clause # 25.2 If Completion of work goes beyond specified contract period of 20 (Twenty) months from date of start of work, as certified by Construction Manager, BHEL, LD will be imposed with maximum LD amount shall be 10 % of total contract value.

We understand that the zero date shall be counted from the date of handling over of unhindered access to site.

Clause # 25.2 LD will be imposed with maximum LD amount shall be 10 % of total contract value.

We expect the LD for delay at following rate

0.5% of the contract value per week of delay or part thereof subject to maximum of 5% of the contract value.


11 GENERAL CONDITIONS OF CONTRACT

Clause # 2.7.8 BHEL at its discretion may consider contractor’s request to short close the contract…

We understand that in the event of short closing, all costs incurred by Contractor till the date of short‐closing including cancellation charges, if any; payable to the sub‐contractors will be reimbursed by BHEL.


12 FORMS & PROCEDURES FORM NO. F‐26 ANALYSIS OF UNIT RATES We understand that since percentage weightage of each BOQ items w.r.t the total amount has been assigned by BHEL themselves in the BOQ cum Rate Schedule, analysis of unit rate as per Form No F‐26 should not applicable for this tender.

13 Preamble to Price Schedule Sr. no. 07 We understand that in the event of comparison of finally executed order value to determine standing L1, Price / BOQ quoted by the unsuccessful bidders will be rationalized based on the executed quantity of work and the tender conditions have become applicable during the course of execution.

14 Preamble to Price Schedule Sr. no. 07 Since item wise price break‐up / weightage is already defined in the tender specification we understand that this provision will not be applicable for this tender.

15 Price Schedule,SCH‐1:Total Price Sr. no. 08 Bidders to note that this is an item rate contract. Payment shall be made for the actual quantities of work executed at the unit rate arrived at as per Sl No.9 below.

Since item wise price break‐up / weightage is already defined in the tender specification we understand that this provision will not be applicable for this tender.

16 Price Schedule SCH – 1; Sr#2.0: Non‐Schedule Item We understand that rates quoted in 1a, 1b and 1c for Non‐Schedule items will not be taken into account for evaluation.

Rates quoted at Sl No 1a,1b,1c shall not taken into account for evaluation.Sl No 1 a , 1b , 1c may be read as as Sl No 2 a , 2 b , 2c .

In case Sealed /Paper Price Bids are opened for finalisation of the tender, for any Item Rate/BOQ based contract, possibility of variation of quantity/ addition/deletion of items can not be ruled out. Under such circumstances, after execution of work, if it is observed that standing as L‐1 is changed based on actual quantity executed, the bidder shall give suitable rebate to maintain your standing as L‐1. Since this aspect can be assessed at the end of execution, necessary adjustment will be effected at the end of execution in final bill.This condition shall not be applicable where the tender is finalised through Reverse Auction.
