Government.

ORDER:In the Government Order first read above, among others, orders were

issued that the maximum qualifying service reduced from 33 years to 30,years to become eligible for full pension by the Government employeesafter retirement in cases of Government Employees retiring on or after01-07-1996.

2. All Pensioners Federation, Cheranmahadevi challenged the cut-offdate stipulated in the Government Order first read above and filedO.A.No.6705/1997 in the erstwhile Tamil Nadu Administrative Tribunal(TNAT) which was transferred as W.P.No.36651 of 2005 (T) to the Hon’bleHigh Court of Madras and the Writ Petition was dismissed by the Hon’bleHigh Court of Madras in its order dated 13-03-2006 as follows:

All the court orders normally used to have only prospective effect,since the date of issue of the Government orders with effect from. 01-07-1996, the same has been given effect to those who have retired on or after01.07.1996. As such prayer sought for In this writ petition cannot be granted.Hence this writ petition is dismissed.

3. Aggrieved by the orders issued in the above Writ Petition, AllPensioners Federation, Cheranmahadevi was preferred appeal in

W.A.No.789 of 2007 against the orders of the Hon’ble High Court, dated13-03-2006 in W.P.No.36651 of 2005. The Writ Appeal was alsodismissed by the First Bench of the Madras High Court in its order on18-06-2007 as follows:-

“It has, been held in a catena of judgment that fixing of a cut off datefor granting of benefits is well within the powers of the Government as longas the reasons therefore are not arbitrary and are based on some rationalconsidemnon.

Taking the present case on the above said principles enunciated bythe supreme Court, the fixation of cut off dates as 01.07.1996 stating thatthe benefit of Government order ts available to the persons who haveretired after 01.07.1996 due to the reason that the qualifying service forpension has been, reduced from 33 years to 30 years as the maximumage limit for entenng into Government Department in Tamil Nadu has beenraised from 24 years to, 28 years, we do not see any arbitrariness orillegality in the same. In mew of the same, the finding of the learned singleJudge dated 13.03.2006, made m W.P.No.36651 of 2005, is confirmed.Consequently, the writ appeal fails and the same is dismissed.

4. Aggrieved by the orders of the Hon’ble High Court in the said ap-peal, All Pensioners Federation, Cheranmahadevi also preferred appeal inCivil Appeal No.6116 of 2014 (@ Special Leave Petition (C) No.22870/2007) in the Supreme Court of India. The Government in Finance Depart-ment had filed counter affidavit against the appeal filed by the AllPensioners Federation, Cheranmahadevi and defended the case byappointing Advocate on Record in Supreme Court of India.

5. The Hon'ble Supreme Court in its order dated 08-07-2014 hasordered as follows:-

“While not accepting the said submissions, we are inclined to statethe benefit that has been granted in The Principal Secretary toGovernment Finance Department versus A.P. Pensioners Samaj & Ors.by the three- Judge Bench shall be made available to all the members ofthe appellant- Federation within a period of eight weeks. It is submitted bythe learned senior counsel for the appellant that, some of the employeesmight have expired in the meantime. In that case, the benefits have to becomputed as per the aforesaid position and be paid to the legal represen-tatives. The said exercise shall also be carried within a period of eightweeks. We hope and trust the State shall not get into slumber and not dothe needful within the time fixed and seek extension. In the result, theappeals are allowed in part. There shall be no order as to costs.”

6. The order of the Government is questioning the cut-off date of01-07-1996 imposed on employees eligible for full pension on completionof 30 years of service. Considering the sensitiveness of the case and thevolume of financial burden that would be caused to the State Exchequerwhile implementation of the order of the Hon’ble Supreme Court of India, aReview Petition was preferred by the Government in R.P. (C) No.1044/

2017 in C.A.No.6116/2014 in the Hon’ble Supreme Court of India.7. The Hon’ble Supreme Court in its order dated 11-10-2017 has

ordered as “We do not find any merit in the same. The Review Petition isdismissed on the ground of delay as well as merits.”

8. In the meantime, the Hon’ble Madurai Bench of Madras Hish Courthas also passed orders in the W.P. (MD) No.6366 of 2016 filed by ThiruK.P.K. Syed Mohamed Masooth on 22-11-2016 as follows :

Going by the above said decision it is clear that when the Govern-ment Order is providing for additional benefits the petitioner is also entitledto the same same, as he would be the member of the very same class ofpensioners. The benefit, according to the said decision, cannot be deniedto him on the ground that he had retired prior to the date on which theaforesaid additional benefits was conferred on all the members of the sameclass of pensioners who had survived by the time the scheme grantingadditional benefit to those pensioners came into force.

10. Under such circumstances, the first respondent is directed toconsider the claim of the petitioner, in the light of the judgment of theHon’ble Supreme Court in Civil Appeal No.5048 of 1998 dated 09.10.1998(V.Kasturi Vs. Managing Director, State Bank of india, Bombay and An-other) and in the light of the order passed by the division Nench of thiscourt in WP (MD) No. 29946 of 2014 along with Rule 43(2) (a) (3) of theTamil Nadu Pension Rules, 1978 and to pass appropriate orders within aperiod of eight weeks from the date of receipt of a copy of this order.

11. The Writ Petition is ordered accordingly. No Costs.9. While delivering the above judgement, the Hon’ble Madurai Bench

of Madras High Court has also made the following observations :8. The Learned Counsel for the petitioner has relied upon the judgement ofthe Hon’ble Supreme Court Civil Appeal No.5048 of 1998, dated 09-10-1998 (V.Kasturi Vs.Managing Director, State Bank of India, Bombay andAnother) it has been held as follows.

If the person retiring is eligible for pension at the time of hisretirement and if he suroives till the time by subsequent amendment of therelevant pension scheme, he would be eligible to get enhanced pension orwould become eligible to get more pension as per the new formula ofcomputation of pension subsequently brought into force, he would beentitled to get the benefit of the amended pension provision from the dateof such order as he would -be a member of the very same class ofpensioners when the additional'benefit is being conferred on all of them. Insuch a situation the additional benefit available to the same class ofpensioners cannot be denied to him on the ground that he had retiredprior to the date on which the aforesaid additional benefit was conferred onall the members of the same class of pensioners who had survived by thetime the scheme granting additional benefit to these pensioners cameinto force.

10. After careful consicierution, the Government has in pursuance ofthe orders of the Hon’ble Supreme Court of India decided to extend thebenefit of the Government order first read above, to those who retired be-tween and 01-07-1996.

11. Accordingly, Government direct that the benefit of the maximumqualifying service being reduced from 33 years to 30 years to becomeeligible for full pension shall also be extended to those who had retiredbetween 01-10-1979 and 01-07-1996.

12. In the case of employees who retired between 01-10-1979 and01-07 - 1996 and those who had not rendered maximum qualifying serviceof 33 years to become eligible for full pension / enhanced family pensionat the level of full pension to their advantage, such Pensioner / FamilyPensioner may apply to the authority in the department in which the Gov-ernment employee last served who is competent to process and forwardpension proposal to the Account General, Tamil Nadu in the prescribedform as at Annexure appended to this order in triplicate. In case of Pen-sioners who have died the life time arrears shall be paid to the legal heirson their claim. For this purpose, the legal heir shall apply through properchannel for revision of pension / enhanced family pension along with DeathCertificate and relevant documents.

13. On receipt of application in triplicate, the competent authorityshall verify the net qualifying service already certified / communicated bythe Principal Accountant General, Tarnil Nadu at the time of initial sanc-tion of pension and shall forward the application directly to the Office ofthe Accountant General for authorising the revised entitled pension andenhanced family pension as ordered in G.O.Ms.No.371, Finance(Pension) Department, dated 30-04-1986, G.O.Ms.No.174, Finance (PayCell) Department, dated 21-04-1998, G.O.Ms.No.272, Finance (Pension)Department, dated 15-06-1998, G.O.Ms.No.579, Finance (Pension)Department, dated 15-09-2006, G.O.Ms.No.446, Finance (Pay Cell)Department, dated 18-09-2007, G.O.Ms.No.235, Finance (Pay Cell)Department dated 01-06-2009, G.O.Ms.No.363, Finance (PGCDepartment, dated 23-08-2013 and G.O.Ms.No.313, Finance (Pay Cell)Department, dated 25-10-2017.

14. The Principal Accountant General, Tamil Nadu is requested torecalculate the revised pension / enhanced family pension only on receiptof application and issue authorization to the Pension Pay Officer, Chennai/ Treasury Officer / Sub-Treasury Officers concerned as the case may bewhere the Pensioner / Family Pensioner is drawing his pension / familyPension. A Copy of the authorization shall also be sent by the Office ofAccountant General to the departmental officer concerned and to the Pen-sioner / Family Pensioner for information.

15. On receipt of the authorisation from the Office of the AccountantGeneral the Pension Disbursing Authority i.e. Pension Pay Officer, Chennai/ Treasury Officers / Sub-Treasury Officers and in respect of Pensioners

drawing pension / family pension through Banks the Banks concernedshall workout the arrears based on the revised pension / enhanced familypension and disburse the arrears amount to the Pensioners / Family Pen-sioners / Legal heirs concerned within a month period.16. Necssary amendment to the Tamil Nadu Pension Rules 1978 will beissued separately.

I submit that the Government in their order cited have sanctioned revi-

sion of pay scales and allowances for the teachers and equivalent cadres

working in Government / Government Aided Colleges who are governed by

UGC scales of pay. I enclose a copy of the same for your ready reference.

In the proceedings 2nd cited the Government order has been communi-

cated to all colleges and in the proceedings 3rd cited, the Regional Joint

Directors of Collegiate Education and Principals of Government Colleges

have been instructed to revise the scales of pay and implement the 7th

UGC Revision of Pay scales from the month of August 2018.

In this connection, I submit that certain principals of Government Col-

leges have brought it to my notice that necessary changes have to be

made in the software of the e-pay Roll so as to enable the drawing officers

of the colleges to present the bills to PAOs and Treasuries for revision of

UGC scales to the college teachers and the equivalent cadres.

In this connection, I request you to arrange to make necessary modi-

fications in the Software of the e-Pay Roll system urgently, so as to ac-

commodate all changes in the Pay Matrix pertaining to UGC scales of

Pay as stipulated in the G.O 1st cited and also request you to issue

MADURAI UNITProf.  C.K.  Madhuram  presided  over  the  meeting  of  TANRECTA,

Madurai Unit at MUTA Office. The members submitted their condolences tothe death of Active member Prof. M. Ramasubramanian and others by making 2minutes silence. While Dr. S. Sethu Rakkayee read out the names of Birth Daybabies in the meeting, they (6) were greeted and worn shawls with them. Twonew members have  introduced  themselves and  joined in  this movement. 75members attended the Meeting.

Prof. G. Ramamoorthy, Secretary in his address, said that work pendingfor the members in the Treasury office were attended and finished successfully.He briefed that he along with state president prof. T.N. Gokulnath Babu andsome members of the unit met the Treasury officer and JDCE with regard torevision  of  Pension  based  on  new  UGC  scales  of  pay  to  working  teachersannounced by the Gove. of  Tamilnadu. As the Dept. of Income Tax extendedthe date of  filing of  I.T.  returns,  the  members, who have not yet  filed  theirReturns, can file their Returns immediately. The members represented our unitin New Delhi Dharma were appreciated. The Book on “ New Health InsuranceScheme” was issued among the members. Dr. Chelladurai was rejected by thesupreme court was informed and the Retired Professors, who involved in thistask were very much appreciated. 18th Annual conference of TANRECTA to beheld at Erode in large numbers.

They  are  requested  to  send  the Articles  and Advertisement  to    bepublished in souvenir. Prof.G. Ramamoorthy introduced the book on “” written by our member Dr.V. Swaminathan and requested themembers to know about the steps to curtail  the rights of Food habits of theparticular section of people by the cow terrorists. The state should know thatthe India was formed united only by historical emergence. Secularity rules thecountry. The following Resolutions were Passed unanimously in the meeting.1. The  Association  moved  resolution  for  the  death  of  Prof.  M.

Ramasubramanian, Active member of the unit, Dr. M. Karunanithi, formerchief minister, Tamilnadu, Com. Somnath Chatterjee Former speaker of IndianParliament and the persons, who lost their lives in the Floods of Kerala.

2. The Association appealed to release the reader Basker and with draw thecases against him, who promoted natural medicine and natural foods forthe sake of people.

3. The Assn. felt very much for the death of the student, who failed in theNEET Exam in Andhara Pradesh for the medical education.

4. It  also  resolved  to  request  the Govt.  of Tamilnadu  to  pass  the  suitableGovt. order to revise the new pension for the retired college Teachers (Preand Post Retirees of the year 2016 and 2006) immediately.

5. If was decided to send the Flood Relief Fund Collected from the membersto the chief minister’s Emergency Fund, Govt. of Kerala, Trivandrum.

DINDIGUL UNITThe Meeting of our unit was held in the residence of Prof. Mahalakshmi

at  5p.m  on  14.8.2018  Mrs.  Mahalakshmi  hosted  the  participants.  Prof.Sivasubramanian, the President of our unit welcomed the gathering. The memberswho retired prior to 2006 were asked to submit their applications for the fixationof the revised UGC scales of pay. The unit decided to attend our conference tobe held in Erode on 29.9.2018. The meeting came to an end with the vote ofthanks proposed by Dr. R. Mummatchi, the secretary of our unit.

POLLACHI UNITWednesday, August 22, 2018, was a  red-letter day  in  the annals of

TNRECTA. Its 33rd Unit was Commissioned at NGM College, Pollachi. On thatday  in  the august presence of  its  top  ten  luminaries; The new Pollachi UnitComprises TANRECTA Members from NGM College, Pollachi,  Govt. ArtsCollege, Udumalpet and Sri GVG Visalakshi College for women, Udumalpet. ThePollachi Unit of TANRECTA was the brainchild of its  president – designate,Dr.P. Sundaram, former principal of NGM College with the solid support of theoffice bearers of the Coimbatore Nilgiris Unit.

The Solemn, but colourful function, got off to a smart start with aninvocation by prof. R. Padmanabhan. The felicitation addresses started with abenign and meaningful introduction by Dr.P.M. Palanisamy, Principal NGMCollege. The galaxy of felicitators including M/s TN Gokulnath Babu (StatePresident) E.P. Perumal, (Gen. Secretary), M. Balasubramanian (Treasurer),N. Marisamy (Vice President), M. Rajagopal (Vice President), Mrs. S. Chandra(Woman Co – ordinator), M. Chakrapani (President, Coimbatore – Nilgiris Unit)S. Balasubramanian (Secretary, Coimbatore, Nilgiris), and G. Sangameswaran(Treasurer Coimbatore – Nilagiris  Unit).

The  ebullient  speeches,  especially  by  Prof.  Gokulnath  and  Prof.Perumal mesmerised the audience and enlightened them on the social obligationsof TANRECTA, besides  it  being a  fighting  front  for  rightful demands. Themeeting  then  endorsed  the  following  nominations  for  the  Pollachi  Unit  ofTANRECTA.

CHENNAI UNIT154 members were present. Dr V Swaminathan presided. The meeting

condoled the demise of Dr Karunanidhi, former Chief Minister of Tamilnadu.Tributes were paid by the various speakers about the rich contributions madeby him to the development of Tamilnadu, Tamil language and his welfare mea-sures for the state government employees and teachers. Issues relating to thesecond stage of Pension revision, the Health Insurance Scheme, the conversionfrom Banking  Scheme  to  the  Pilot  Scheme and  MHRD  orders  on  Pay  andPension revision were discussed. For the annual conference at Erode, memberswere  requested  to  contribute  by  way of  articles  and  advertisements  for  thesouvenir to be released on 29th of September. The meeting ended with a vote ofthanks by the Vice President of the unit.
