LOCAL OPTION ELECTIONS

There have been fifty-five local option elections during the fiscal year ending August 31) 1973. Nineteen elections were called to ]egalize the sale of all alcoholic beverages for off-premise consumption only; fifteen remained lIDry P and foUl' became IIWetll

; however, one of these elections was invalidated and the area reverted to a 11 Dry" status. Two elections were called to legalize the sale of all alcoholic beverages except mixed beverages; both areas became IIWet". MONTGOMERY COUNTY

Justice Precinct No.1, Montgomery County, on September 9, 1972, voted 1, 434 "For the legal sale of all alcoholic beverages including mixed beverages" and 836 "Against the legal sale of all alcoholic bev­erages including mixed beverages. 1I This precinct was "Wet" for the legal sale of beer before the election was held and became "Wet" for the legal sale of all alcoholic beverages including mixed beverages.

NAVARRO COUNTY

The Incorporated City of Angus, Navarro County, on October 28, 1972, voted 73 II For the legal sale of wine and beer for off-premise con­sumption only" and 70 II Against the legal sale of wine and beer for off­premise consumption only. " Angus was "Dry" before the election was held and became "WetJ l for the legal sale of wine and beer for off­premise consumption only. Within thirty days after this election a suit was filed in the District Court of Navarro County, 13th Judicial District, to contest this election and to have same declared void on the grounds that the election involved an alcoholic beverage classified as liquor, namely wine, and was held within a period of less than eighteen months after incorporation, as prohibited in Article 666- 40b of the Penal Code of the State of Texas. In a judgment dated January 29, 1973, the District Court of Navarro County ruled and declared the election held in the Incorporated City of Angus, Navarro County, on October 28, 1972, void, invalid and of no force and effect, and Angus reverted to a "Dry" status.

The City of Angus, Navarro County, on July 7,1973, voted 95 "For the legal sale of beer for off-premise consumption only" and 82 IIAgainst the legal sale of beer for off-premise consumption only. " Angus was "Dryl! before the election was held and became "Wet" for the legal sale of beer for off-premise consumption only.

NEWTON COUNTY

The Incorporated City of Newton, Newton County, on October 7, 1972 voted 289 11 For prohibiting the legal sale of all alcoholic beverages for off-premise consumotiononlyl! and 280 I! Against prohibiting the legal sale of all alcoholic beverages for off-premise consumption only. 11

Newton was lTWet" for the legal sale of all alcoholic beverages for off-premise consumption only before the election was held and be­came IIDry". This election was contested in the District Court of New­ton County, as the ballots used in the election read "For the legal sale of all alcoholic beverages for off-premise consumption only" and II Against the sale of all alcoholic beverage s for off-premise consump­tion only. II The District Court of Newton County ruled the election was valid. The ruling was appealed to the Court of Civil Appeals of the Ninth Supreme Judicial District of Texas and that court affirmed the decision of the trial court Appellant made a motion for rehearing in the Court of Civil Appeals which resulted in an opinion delivered May 17, 1973, in which the Court of Civil Appeals of the Ninth Supreme Judicial District reversed the judgment of the trial court and declared Lhe election to be invalid because the word "legall! was missing from the second statement on the ballot. The order canvassing and declar­int the resulLs of said election was set aside and held for naught by the Court and Newton reverted to a IIWet ll status for the legal sale of all alcoholic beverages for off-premise consumption only.

NUECES COUNTY

Justice Precinct No.6, Nueces County, on November 7, 1972, voted 1,951 11 For the legal sale of all alcoholic beverages including mixed beverages ll and 1,895 "Against the legal sale of all alcoholic bever­ages including mixed beverages." This precinct was ·'Dry" before the election was held and became "Wet" for the legal sale of all alco­holic beverages including mixed beverages.

PANOLA COUNTY

The City of Carthage, Panola County, on November 4, 1972, voted 722 I' For the legal sale of all alcoholic beverages for off-premise con­sumption only" and 1,140 "Against the legal sale of all alcoholic bev­erages for off-premise consumption only. II Carthage was "Dry" be­fore the election was held and remained "Dry".

East Tawakoni was IIWet ll for the legal sale of all alcoholic beverages for off-premise consumption only be­fore the election was held and remained IIWet" for the legal sale of all alcoholic beverages for off-premise consumption only.

RANDALL COUNTY

Justice Precinct No.3, Randall County, on July '7, 1973, voted 72 "For the legal sale of all alcoholic beverages including mixed bever­ages II and 33 II Against the legal sale of all alcoholic beverages includ­ing mixed beverages. 11 This precinct was llDry" before the election was held andbecame "Wet'l for the legal sale of all alcoholic beverages including mixed beverages.
