Rates herein are limited for each carrier for the handling of household goods in intrastate commerce as described in eacl.l i.ndividnal carriers operating authoritY. However, caniers may· handle within their territory at through rate.s shown, shipments moving to or from points beyond the scope oft)l.Qir omrent operating certificates on :file with the ourrent and succeeding P.R.C., by arrangement with lawfully qualified oOll1lecting oalriers, provicimg such interchange is made at commollpoints and all carriers are parties thereto. RULE 1

BILL OF LADING AND RATES

• A. Unless otherwise providoo'in fhis tariff, When property is transported or stored subject to the provisions of this tariff, 01' as amended, the aoceptanoe end us~ of the Uniform Household Goods Bill of Wing as described herein end in Rule 2 is required.

Any alteration, or erasUl'e on a bill oflading which shall be made wifuout the sPecial notation thereon of the agent of the carriex issuing same, will be without effect and the bill of lading shall be enforceable according to its original tenor.

B. Rates andoharges in this tariff are conditioned upon the Ulle ofllie Uniform Household Goods Bill of Lading, A shiPlJer may elect not to accept the terms fuexein, and in lieu thereof, have the caJ.1·iel'transport the properly with carrier' a.liability limited only as provided by common law, aild byfue laws of the United States end the State of New Mexico as they may apply, but subjeot to fue terms and conditions of the Bill of Ladmg in so far as snch t=s and oonditions are not inconsistent with the CO).11ll1on carrier's liability. Unless the !IDipper expressly releases the shipment to a value not exceeding 60 cents pex poun~ per article, the Carriers maximum liability for loss and damage is provided in Section V oftlrls tariff. (pages 41 & 42).

When the shipper elects not to accept any ofllie terms of such bill oflading, he must give 110tice to the initial carrier of such election prior to loading, end the carrier may refuse transpOl'tatioll of said property end shall be held harmless frO:l)1 any action fuat may arise.

C. All rates and char'ges in this tariff are depeu~ent upOll'the shipment being released in . accordance with the provisions of Rule 3 herein. When a shi;ppe.t' declines to rfOlease'a shipment in Rule 3, or when the released value exceeds $10.00 pel.' pound per article, a shipliient will be accepted only at the individual carriers option.

DECLARATION OF VALUE· LIABILITY LIMITATION

As used in this tadff, the unifonn Household 00'0& Bm ofl.ading, the phraSes "released value", "declared value", and "value declared by .shipper", sl\all have the same meaning,

A) A s~pper must declare the value of a shipment in terms of dollars and cents per potmd per article, in the space provided all the bill onading, If shipper fails or declines to make such a declaration, OJ' If the declaration exceeds $1.50 per pound per article the shipment will only be accepted at option of the cattier,

DEFINITION OF A SHIPMENT

Exct;pt as provided by Rule 19-C, as used herein the tenu "'sh~pmeIlt" meMS propelty tendered by one shipper and accepted by the carrier, at one place of origin, at one time, for one consignee, at one destination, and covered on on~ bill oflading.

CaJ.UeJ' will not accept or transport articles which create hitz!p:dous circumstances or threaten life or property, such as but not limited to, articles requiring iefi'igeration (except as provided by Rule 7), explosive, fla:m:riJ.able, and articles which' cannot be taken from the premises without damaging the articles or the premises. When canier 1'1asonably believes article or contents ofpaokagesm'tist be inspected fOl' complianCe to this rule, he shall make or cause such inspection, and may BUbseqUen-tly relJ.uire sufficient evidence to determine actual oharaoter of property. Carrier shall be reimbursed by shipper all actual costs incurred according to labor rates published within tariff.

RULE 7

PERISfIABLE ARTICLES

Subject to Rule 6, carrier will not accept perishable articl"s 01' thoso requiring refrigeration, except FROZEN FOODS, ~nd only then under the tollowing conditions:

2, If a shipper orders a longer route than as may be computed hereunder, the longer route mileage shall apply and applicable charges computed there fr~,

HOURLY TRANSPORTATION RATES

A. . Bxcept as provided by paragraph "D" below, tra1:1hportation rates.in this section apply to Household Goods as defined in paragraphs (1) and (2), "Co:rmiwdity Description", Page 4 in this tariff; between all points and places within any mtmicipality, and a 30 mile radius thereof, when transportation therein is regulated by the State of New Mexico.

C. RATES IN THIS SECTrON APPLY ON SHIPMENTS RELEASED TO A VALUE NOT EXCEEDING 60 CENTS PER POUND PER ARTICLE. WHEN A SHIPMENT IS RELEASED AT A VALUE IN EXCESS OF 60 CENTS PFJUOUND PER ARTICLE, THESE RATES SHALL BE lNCREASED BY THE APPLICABLE AMOUNT IN RULE 3.

These rates do not apply to the pickup or delivery ofStorage-in:I'ransit shipments regardless of distance municipality involved, nor may they Illtel11ate with other transportation rates in this tmiff or elsewhere. The manner ofreoording time upon which rates herelll are to ·be computed shan be from the start of loading, continuous tin'Ough tmloading, plus 30 minutes added thereto as compensation for driving time to and from carriers terminal. If shipment is loading Ot lJnloading outside of city Ihnits tilere will be 1 hour drive tilne added. ..

EXAMPLE: A catTier begins physically loading a shipment at 8: 15 A.M., drives to destination, and completes o:ff-loading at 12:15 P.M., :for a t~tal of 4 hours working time (including driving from Oligin to destination). 30 rn.inutes is then added and charges computed on the basis of 4.5 hom's, in furil1el' accordance with Rule 25. .

1. When Full Value Protealion is ordered in writing by the customer, carrier will guarEmtee either replacement ofal'ticles lost or.damaged while in earlier's custody, reimbursement fol' full replacement cost (as determined 'by current market value), oTl'epairs, oJ'the oost ofrepairs to damaged ltem(s) to the extent necessary to restore the item to 1he same cOl)dition ·as when received by carrier fi'om the shipper. Actual replacement articles, if any, shall consist of articles of like kind and quality with deduction fOl' depreciation.

2. Carrier's maximum liability shall not exceed the released or declared value' on the shipment or the full cost of repair to the damaged property, whiohever is less. Carrier shall hav:e the option ofrepair or replacement of damaged articles.

3. All items which are replaced or for which the fuIr current m:;rlcet value has been paid become the prope:tty of the carrier.

4. Provisions oftbis section :;re contraotuallimits ofliabillty as provided for in the Seotion 14706 of the ICC Termination Aot of 1995, and are not to be construed as «Insurance".
