Tauranga City Council is notifying its decisions on submissions under the Resource Management Act to the provisions of the Proposed Tauranga City Plan relating to:

• The identification and protection of areas of significant indigenous vegetation and habitats of indigenous fauna (termed Special Ecological Areas);

• The identification and protection of historic heritage (Built Heritage, Significant Maori Areas, Significant Archaeological Sites and Heritage Trees); and

• Associated provisions as contained within:

• Chapter 3 – Definitions; • Chapter 4 – General Rules (relating to earthworks); and • Chapter 12 – Subdivision, Services and Infrastructure of the Proposed Tauranga City Plan.

The provisions of Chapter 5 – Natural Environment put in place a set of Objectives and Policies for the identification, protection (Category 1) and maintenance and enhancement (Category 2) of Special Ecological Areas, whether located on public or private land. The Rule framework supports the set of Objectives and Policies and seeks to mange specific activities located within these Special Ecological Areas to ensure their ongoing protection.

The provisions of Chapter 7 – Heritage put in place a set of Objectives, Policies and Rules to recognise and provide for the protection of individual buildings, objects, places and sites that are significant enough to warrant recognition and protection in the public interest.

The associated provisions contained within Chapter 3 – Definitions, 4 – General Rules (Earthworks) and 12 – Subdivision, Services and Infrastructure support the framework set through Chapters 5 and 7.

Decisions on submissions relating to Chapters 5 and 7 (and associated provisions) to the Proposed Tauranga City Plan are being notifi ed as these provisions had legal effect at the time of notifi cation of the Plan. All other decisions relating to the Proposed City Plan are expected to be notifi ed in early 2011. All submitters to those other decisions will be contacted at that time.

The decision on submissions to the Proposed Tauranga City Plan (Chapter 5 – Natural Environment and Chapter 7 – Heritage) may be inspected or obtained during office hours at the following locations:
