This document is North Sydney Council’s response to actions arising from Precinct Committee Minutes. On receipt of the minutes, actions are numbered and
allocated to relevant Council Officers for response. To effectively manage and provide clarity, all actions are allocated a status when reporting to Precinct Committees
in response to their minutes. There are three categories:
Awaiting Response - action allotted to Council Officer - response awaited.
Open/Ongoing - action allocated to Council Officer, initial response provided. Matter ongoing and further response/update to be provided at later date.
Closed for Council - Council either completed related works/tasks or has taken all reasonable steps within its power to resolve issue (for example when matter
is beyond its jurisdiction). If the Precinct Committee feels Council can take further steps, they can request Council reopen action.

The Two Western Harbour & Beaches Link Tunnels and
the CPS & APPS Campaigns – Impact Report by Council
Necessary like other Councils are doing.
Action - After the RMS briefing at APPS, Precinct
continue to lobby NSC to conduct an Impact Report on the
NSC LGA for community asap.

3 State Significant Infrastructure
Private Schools putting SSI Applications direct to State
Government without community getting any input
opportunity and lack of info flow back to Community
directly affected e.g. Milsons Pt.
Action - Precinct recommends that Council take direct
action in so far as possible to address this situation given
immediate local impact and given that the Hearings fail to
take into account the impact on the local area and only
examine issues within the development not the impact
Council’s Manager Development Services has advised that
the management of public consultation for these
applications rests with the Department of Planning. The
Departments consultation regime does not generally
feature Public Meetings as seen in past processes at North
Sydney Council when applications were determined by the
elected Council.
The community has the opportunity to make both written,
and verbal submission when the matter is heard before the
Regional Planning Panel or Planning Assessment

outside it. NSC needs to try to restrain multiple
developments impacting one small area at the same time.
Precinct supports the GM’s idea to create a Working Paper
and invite a State Planning Rep.
determinations and are thus generally across the issues
raised by the Community and the Council. Council staff
also try to engage with the department but this is also not
without difficulty. We will keep raising this issue with the
Department. I believe their intent is not to cut the
Community out totally but to streamline a somewhat
convoluted process as much as possible.

Briefing re latest developments. (ii) RMS Consultation
Sessions 30/8 & 1/9 @ Crows Nest Community Centre
Action - Precinct continues its opposition to the Lack for
filtration of the new Monster Stack proposed for Ernest St.
opposite the Anzac Park School. Members to attend the
RMS briefing sessions sat Crows Nest Centre this Thurs
30 and Sat 1 Sept.

6 NSC’ Special Rate Variation
Action - Precinct continues to reject any Rate Variation
higher than 5%.

7 CPC Feedback
Action - Precinct acknowledged the information from the
GMs Talk on Resourcing issue & the overdevelopment
developments in Crows Nest; and
supports the argument that Private Schools should be
rated in return for Services provided by NSC; and
a levy should be meted out against them for Stanton
Library Upgrades and upgrades to sporting facilities in
the NSC LGA; and
Noted by Council’s Manager Financial Services for
comment.

Urge Council to amend the iniquitous 60/40 Residents
vs Business breakup of the Rate Collection Pie so that
Business is at least equal 50/50; and
Urge Council to address the situation where new high
rises in CBD fail to generate rates revenue to the
residential rates section of the Rates Pie.
Urge Council to lift the Cap on the total amount of
revenue that it can receive from educational institutions,
as we are an established educational precinct.
9 Housing Development Pause proposed by NSC
Action - MW raised this. Precinct query the status of this
initiative and support it.
Council at its meeting of 30 July 2018 resolved (relating to
report CIS02: Crows Nest Integrated Station Development,
Min. No. 242):
1. THAT, consistent with the recent Ryde City Council resolution
on 26 June 2018, Council resolves as the planning proposal
authority for the North Sydney LGA not to accept any new
planning proposals involving a residential use as per the
Minister’s initiative, until the earlier of 1 July 2020 or the
completion of any gazetted amendments to the North Sydney LEP
in respect of any Land Use and Infrastructure Plan produced by
the Department of Planning’s Priority Precinct planning process
and with the exception of any Planning Proposal submitted
consistent with and in relation to a Precinct Planning Study
already adopted by Council. 2. THAT Council writes to the Minister for Planning, the Hon.
Anthony Roberts, seeking an amendment to the state policy for
rezoning reviews to exclude its operation for the North Sydney
LGA in respect of new residential planning proposals until 1 July
2020 or the completion of any gazetted amendments to the North
Sydney LEP in respect of any Land Use and Infrastructure Plan
produced by the Department of Planning’s Priority Precinct

10 Affordable Housing - Need for an increase in the NSC
LGA
Action - Precinct agrees with the need for an increase in
Affordable Housing in the NSC LGA and urge Council to
take action to implement this.
Council’s Manager Strategic Planning has advised that the
provision and achievement in housing affordability is a
complex matter in Sydney. Local Government has less
tools at its disposal than State and Federal Government to
work towards this outcome. Nonetheless, all Councils,
including North Sydney Council., are required to formulate
"Local Housing Strategies" under the District Plan.
Affordable housing will be one component that is explored
as part of that process.

July Guest Speaker - Council’s Sustainability Project Officer
gave an excellent presentation which everyone found very
useful and informative. His delivery was very good. He
disseminated facts and detail in a clear efficient manner.
He didn’t get bogged down in technical detail but imparted
the key facts that people need to be aware of and
remember. The information was surprising to many in that
people had different misconceptions of some of the issues
re gas v electricity. He enlightened us on Green Power,
Black Power, Heat Pumps and the major benefits of
reverse cycle which is something most people thought was
historically a negative thing.

April TAFE West Street DA - (i) Update (ii) Cycleway
Action - JR gave a brief update for SE. Director NSW
Northern Region has been liaising with the residents after
SE and others have been actively lobbying. Commercial
Use not worthwhile DEC now claims, generates too much
effort but not in writing! Council say that it is not a
Council issue. We await further information.
(ii) Awaiting Clarification from Council on whether
commercial/large vehicles will be diverted to reduce the
risk to cyclists.
UPADATE (24 May 2018) Council’s Senior Assessment Officer (Planning) has
advised that:
(i) the use of hall is conditioned to be school related
community activities only; no third party independent
commercial operations are permitted. The school has
the discretion regarding what these activities are as
long as they are community/school related.
Any independent third party and ongoing use which
would otherwise require a Development application
would not meet this definition.
Council cannot intervene based only on current
speculative community concerns particularly prior to
commencement of operations on site and the precinct
must persist in directing their concerns to the DEC and
School itself.
Once the operation commences and there are uses of
the hall identified which may contravene the
requirements of the condition, these can be reported by
residents and investigated by Council's compliances
officers.
(ii) The school is required to submit a construction traffic
management for the endorsement of the Traffic
Committee as part of their conditions.
Until exact volumes and types of trucks involved are
quantified it is unknown whether there would be any
diversions required. A decision of the Traffic

It is noted however, that if construction traffic is
diverted/ limited then this only prolongs the
interruption to the cycle ways in any case.
Recycling in NSC - What will happen
Action: Precinct asks what NSC’ plans are and seeks

UPADATE (24 May 2018) Council’s Waste Management Officer has advised that
Council is committed to maintaining the current recycling
service through the existing kerbside collection system.
Council is in the process of preparing the tender
documents for the upcoming waste collection service
contract. Council will be seeking the current collection and
processing of recyclables is maintained. Council’s firm
intention is that recyclable material will continue to be
collected for reprocessing into beneficial products and not
landfilled.

March TAFE West Street DA - Cycleway Action: SE was unable to locate a copy of the latest Sec96
at Stanton Library and noted that changes to parking have
already been made on Rodborough Ave. Awaiting
Clarification from Council on whether commercial/large
vehicles will be diverted to reduce the risk to cyclists.
UPDATE (14 September 2018)
Council’s Senior Assessment Officer (Planning) has
advised that there are no conditions that specifically detail
that traffic to be diverted to provide safety to the bike lane
in Rodborough Avenue. Being a Crown DA the applicant
was within their rights to not agree to the imposition of
such conditions. The applicant is required however, to
have their construction traffic management plan endorsed
by the North Sydney Council Traffic Committee. The
concerns can be put to the committee and it is possible that
specific requirements may be able to be negotiated in this
regard but it is a matter for the committee and applicant to
resolve. It is noted however that there is insufficient space
within the site for articulated trucks to enter, reverse/turn
around and exit all from West Street and the applicant
(Crown authority) require the trucks to use Rodborough
Avenue to make the construction traffic management
work. It is also noted that the construction activities will be
temporary.
UPDATE (7 August 2018)
Council’s Manager Traffic and Transport Operations has
advised that changes to parking in Rodborough Avenue
were related to a previous resident parking survey.

Council is not in possession of any specific information to
advise the Precinct Committee of the “intended” uses but
can advise they must be for bona fide related to the school
and community associated uses. The Precinct Committee
is advised to contact the existing Cammeraygal School for
information regarding the potential types of uses which
may be entertained on the site at the discretion of the
School Principal.
Third party fully private uses would need DA approval to
go ahead. Any such proposals would require a full DA and
notification to residents.
TAFE West Street DA - Cycleway
Action: Clarification sought from Council on whether
commercial/large vehicles will be diverted to reduce the
risk to people using cycleway.
UPDATE (7 August 2018)
Council’s Manager Traffic and Transport Operations has
advised that the design improvement to cycling facilities
along West Street has only recently commenced and is still
at concept stage. It is not possible to anticipate the impacts
on vehicle movement as yet, however the interactions
between different road users and safety will be key
considerations in the design development.

TAFE West Street DA - Concern about proposed height,
width and usage of new hall as a Sports Centre after hrs.
Post JRPP Hearing decision, Amended Plans to now go
before Council as a S.96.
Council’s Senior Assessment Officer (Planning) has
advised that the Section 96 proposal intends to reduce the
overall height of the building and has increased the setback
to the sites eastern boundary. The primary usage of the hall
was as an assembly space and multipurpose recreation hall
and there is no proposal in this Section 96 to modify this.
To assist in alleviating potential noise during the late
evening activities in the hall the following condition was
imposed upon the consent:
Louvres to the multipurpose Hall
G12. Prior to the occupation of the multipurpose hall, the louvres on
the northern elevation of the multipurpose hall building are to be
installed with a timer system, which automatically shuts the louvres
from 8:00pm. These shall only be able to re-open after the building is
vacated and after 11:30pm.
(Reason: To protect the amenity of the neighbourhood)
Note: there is no proposal to modify this condition.

UPDATE (6 April 2018)
Council’s Manager Traffic and Transport Operations has
advised that as part of the North Sydney Integrated Traffic
and Parking Strategy, Council has adopted Local Area
Traffic Management (LATM) Action Plans (formerly
known as TAPAS). The LATM implementation procedure
adopts a methodology that takes into consideration an area
wide traffic management scheme and allows the
community’s high priority traffic projects to be ranked
according to a number of criteria, including safety, traffic
volume, speeds, pedestrian and cycling volumes,
surrounding land uses, and alignment with the North
Sydney Community Strategic Plan.
The Action Plans will form the basis of a works program
to be implemented by Council going forward. The Action
Plans will also be updated and reviewed on an ongoing
basis to ensure they are relevant and up-to-date. The
LATM Action Plan for Zone 2 contains a number of
proposals to address similar concerns in Moodie Street and
Lytton Street including - partial closure at either Ernest
Street or Falcon Street (T.29); convert Moodie Street to
one-way (T.35a); create 40km/h local area speed zone
(T.35b).
The 40km/h local speed zone and partial closure proposals
are ranked higher than converting the street to one-way

due to the additional benefits they provide in terms of
pedestrian amenity and speed management, whilst
maintaining access for residents.
Further investigation and consultation with local residents
will be undertaken prior to implementation of the projects
