    Part 1: Introduction

    Passport applications can be an excellent source of genealogical information especially about foreign-born individuals.The National Archives and Records Administration (NARA) has passport applications from Oct. 1795-Mar. 1925; the U.S.Department of State has passport applications from Apr. 1925 to the present

    As stated in our phone call, I do have access and have done research over the years with my family history and theirimmigration. I am amazed that I had no problems in the past obtaining records from the latter 1920's when part of myfamily immigrated to the U.S., but ran into a barrier for the 1950, 60 and 70 era, but have the 80's to present. This makesno logical sense, least to me.

    Of course as I pointed out, blamed the GSA directive given sometime in the 80's, but could not specify.

    I may have to turn my search over to a professional geneologist at some point. For now, I am simply looking for thatdirective to destroy records.

    There are two options for obtaining copies of your passportrecords:1. Passport Records for Issuances 1925 Presenta. Requesting Your Own RecordPassport Services maintains United States passport recordsfor passports issued from 1925 to the present. These recordsnormally consist of applications for United States passportsand supporting evidence of United States citizenship, and are

    protected by the Privacy Act of 1974, (5 USC 552(a)).Passport records do not include evidence of travel such asentrance/exit stamps, visas, residence permits, etc., since thisinformation is entered into the passport book after it is issued.

    RE: FOIA REQUEST-EXPEDITED PROCESSINGDear FOIA Officer:This is a request under the Freedom of information Act.I request that I be provided with a copy of the documents (or documents that contain thefollowing information) as follows:Passenger andlor Crew lists, BOTH Arrival and Departure information for BOTHvessels and airplanes identified as Record Group 85 at the National Archives, records ofthe Immigration& Naturalization Service, 1787-2004.According to the NARA description these documents are further described as follows:

    This series of ship passenger and crew lists consists of orms provided to theImmigration and Naturalization Sewice (INS) by shipmasters ofvessels.. arriving or departing various sea and airports.. On both shippassenger and crew lists, the typical information includes: name of the vesseland shipmaster, ports of arrival and embarkation, and dates of arrival (andoccasionally of departure). Passenger lists provide the full name, age, sex,marital status, occupation, citizenship (nationality), last place of residence,final destination, and, ifan immigrant were going to oin a relative, thatperson's name, address, and relationship to the passenger. Some manifestsindicate the cabin number and class. Crew lists provide the ull name of eachcrew member, position, length of sewice at sea, citizenship (nationalityl,literacy, age, sex, height and weight, any physically distinguishing marks, thedate andplace of employment, and whether the crew member was to be

    discharged or paid off at the port of arrival. Later lists or both passengersand crew may include passport numbers andor types of visas.Besides vessel passenger and crew lists, this series contains orms for airlinepassenger and crew manifests. These orms were submitted to the INS by thecaptain of each airplane that last departedfiom a US.airport. Both theairline passenger and crew manifests contain the aircra.ft identification,captain's name, and dates and airports of departure and arrival. For eachalien or citizen passenger, the record usually provides the person's name;citizenship; US. address; passport, visa, or other immigration documentnumber; and may note the person's date and place of birth, destination, andbaggage details. For each crew member, the record usually provides theperson's name; position on the airplane; citizenship;passport, visa, or otherimmigration document number; and may note age and gender.

    The records sought herein meet three (3) general classifications:1. Those records outside of the 50 year restriction window and, as such, these recordsshould be available for unrestricted use.

    2. Those records within the 50 year restriction period but that pertain to deceasedindividuals and, as such, these records should be available for unrestricted use.

    3. Those records which fall with the 50 year restriction period and relate to a livingperson. While these records are ordinarily exempt from disclosure, I herein claim apublic interest and compelling need to verify government integrity and that each ofthese concerns out-weighs the aforementioned restrictions.

    Barack Hussein Obama is the living President of the United States and I do not have athird party privacy act release fi-om him.I believe his records should be released because there currently exists an overwhelmingpublic interest in obtaining the infomation requested above and a desire by me and thegeneral public to know who the President is. I believe it is unprecedented in the history ofthe United States that the life, history and background of a sitting president has been sowell hidden, sealed and obfuscated as it has with this President.Further, as Commander-in-Chief of the most powerful military in the world today, and asa President who openly declares that he wants to "fundamentally change the UnitedStates," the public interest far outweighs his personal privacy interest. There is noverifiable evidence in the public record that President Obama was ever vetted to hold the

    office of President. The information requested herein may shed light on the eligibility, orineligibility of Mr. Obarna to be President of the United States. I believe the balancingprocess weighs heavily for release of his records. The information requested could provethat this President is ineligible to hold the office of President and prove that the publictrust has been violated, and continues to be violated, What greater public interest couldpossibly exist than the possibility that a fkaud has usurped the Office of President, whonow has control over the greatest military on earth and has his finger hovering over thebutton that could release the most powerful nuclear holocaust ever known to man andwho now controls the destiny of each and every American citizen?The DOJ Freedom of Information Guide, Exemption 6, states that:

    "One purpose that the FOIA was designed for is to "check against corruptionand to hold the governors accountable to the governed. Indeed,information that would inform the public of violations of the public trust has astrong public interest and is accorded great weight in the balancing process.0 ' 9 . DOJ Guide citations omitted.

    I request EXPEDITED PROCESSING of this request.In accordance with law, when the subject is of widespread and exceptional media interestand the information sought involves possible questions about the government's integritythat affects public confidence Expedited Processing is permitted. In this instant case theoverwhelming concern of the American public concerning both the eligibility of BarackObama to be President as well as the large number of questions about the government'sintegrity in vetting President Obama.In addition the recent (and apparently well founded) allegations that the US Governmenthas "Spoliated" records from the US State Department passport records of the President'smother, Stanley Ann Dunham has put the public trust and integrity of its government intoquestion.The public had been waiting for over 1?h ears for a response to a FOIA request byChristopher Strunk to the State Department and Homeland Security. The request toHomeland security is similar to the above request, but produced a response fkom CBPthat the travel records and documents prior to 1982 were destroyed and not archived.(Attachment 1 - Pullo Declaration) Additionally the State Department unbelievably statedthat they were unable to locate Stanley Ann Dunham's passport applications prior to1967 and that they were likely destroyed in the 1980's. Incredulously, as the keeper ofthe records, and they don't know if they were destroyed or not?!? This, in and of itself,raises serious questions of trust and integrity in the government.     as 1984 memo referencing "purging" and destroying passport applications prior to 1968.(Attachment 2 - Roblin letter)Ironically the State Department on their website advertises Passport services to "search"their records from 1925 to the present for you for a fee of either $50 for your own recordsor $150 for third party records. (The price was just increased on or about 08/13/10) TheState Department has no notice that records before 1968 "may" have been destroyed in apurge in the 1980's and it seems either they maintain the records they claim (and theNational Archives also claims the State Department has) or they are unfairly advertising aservice for sale that they likely don't have. Who is one to believe? On one hand the StateDepartment makes the claim that passport records before 1968 don't exist and aredestroyed. On the other hand the National Archives, Passport Services of the StateDepartment, the Federal Register claim that passport records prior to 1968 do exist and infact are held by the State Department. My own experience in requesting passport recordsunequivocally support the fact that passport records before 1968 do in fact exist and areheld by the State Department. (Attachment 3 - Jacobsen affidavit)In addition he public trust in FOIA had been diminished by the recent revelation thatthese requests are being monitored and appear to be delayed and in some cases therequestors are vetted before hlfilling the request. (Attachment 4 - AP article)The President of the United States is a public figure and a recent CNN poll taken July20 10 showed that 27% of the Americans polled probably or definitely believe PresidentObama was born in another country. In addition the poll showed 29% of those polledbelieved Obama was probably born in the US and only 42% believed Obama wasdefinitely born in the US, (Attachment 5 - CNN poll)It is apparent that the public has serious questions about the integrity of the USGovernment relating to the eligibility of President Obama and the possible destruction ofthe few documents available that could shed light on the President's eligibility and familyhistory. The documents I have requested herein all concern his family and are believed tocontain information that could help determine his eligibility or ineligibility to the officeof President. In addition, by Expedited Processing of my request, it will quickly helpshow the American public that the above records have not been destroyed, tampered withor compromised and that the integrity of the National Archives is intact and free fromunlawhl political tampering. The records I am requesting were collected by ImmigrationOfficers paid for by taxpayers and the records are in the National Archives which wasfounded and paid for by taxpayers. These records belong to the people of the UnitedStates and not to the government. Additionally, many of these records are alreadyunrestricted and many are fast approaching the 50 year time limit for release fromrestricted to unrestricted. Expedited Processing of this request will of course put therequest to the head of the FOIA list, but it will eliminate what I believe will be a flood ofrequests and scouring of the National Archives in the near w r e n a mob scene

    compared to the storming of the Bastille. The American people have waited for over 1?4years to obtain similar information and should not be expected to wait any longer. Justicedelayed is justice denied.In addition I believe the future savings in time and cost to the government will besubstantial by promptly processing this request and allowing this information toexpeditiously be released to the public.If ever a FOIA request deserves expedited processing this request does or the procedureis meaningless and merely a regulation to be ignored.I am willing to pay up to $100.00 for the requested records, if the estimate should behigher please contact me. I am an individual seeking information for non-commercial useand it is my intent to widely and publicly publish the response(s) I receive.I am requesting a waiver of fees for the following reasons:1. I will release the records publicly upon receipt. They are being requested for non-commercial reasons, but for public consumption.2. The release of these records goes to the core of the integrity of the government tomaintain and keep free from tampering nationally important documents.3. I have expertise and a thorough understanding of these documents and canproperly present them to the public. (see Jacobsen affidavit)4. Disclosure will lead to a better understanding of the government, its variousoperations, including the Immigration and Naturalization Service (CBP) and includingthe function, necessity and importance of the National Archives.
