MINUTES OF THE 251st MEETING OF THE STATE LEVEL EXPERT APPRAISAL COMMITTEE HELD ON 04/08/2015 AT COMMITTEE ROOM, GUJARAT POLLUTION CONTROL BOARD, GANDHINAGAR.
The 251st meeting of the State Level Expert Appraisal Committee (SEAC) was held on 4th August 2015 at Committee Room, Gujarat Pollution Control Board, Gandhinagar. Following members attended the meeting:

All 152 proposals of minor minerals which have been received by the Committee through the Office of the Commissioner, Geology and Mining, Gandhinagar were taken up in the meeting. Considering the scale of individual project, all the proposals were categorized as B2 and appraised individually based on the information furnished in the Form-1 and performa endorsed by the district Geologist / Asst. Geologists.

Shri R K Modi, Assistant Geologist, Dist:Amreli informed the committee that method of basalt removal involves drilling, blasting, sizing of mineral, etc. Top soil will be stacked separately for green belt development whereas overburden will be removed, stacked and refilled in mined out pits. None of the proposal involves intersection of ground water table. No wastewater generation is envisaged from mining activities. Domestic wastewater will be disposed off through septic tank – soak pit. Arrangement will be made to prevent contamination of surface runoff. Proposed air pollution control measures include use of only controlled blasting, water sprinkling on haul roads, tree plantation in periphery and road sides, etc. It is proposed to convert mined out pits into water reservoirs. After deliberations on various aspects, considering the proposed mitigation measures, the committee unanimously decided to recommend the above proposals for grant of environmental clearance to SEIAA with stipulation of standard conditions for non sand mining as approved in 232nd SEAC meeting held on 15th April 2015. SAND MINING PROJECTS – DISTRICT DAHOD
Shri Mehul Dave,Asst. Geologist, Dist: Dahod represented that river Ujjal is seasonal river and sand excavation will be done only from dry river bed. It was represented that no any bridge piers / water intake wells / irrigation structures exist within 500 m distance from boundary of the above lease area. He explained that sand excavation will be done up to maximum 3 m depth or water level, whichever is less. The committee observed that the lease holder has proposed to leave adequate setback distance from the river bank so as to avoid chances of river bank erosion. After deliberations on various aspects, considering the proposed mitigation measures, the committee unanimously decided to recommend the above proposal for grant of environmental clearance to SEIAA with stipulation of standard conditions for sand mining as approved in 232nd SEAC meeting held on 15thApril 2015. Shri A.B.Premlani, Geological Assistant, Dist: Jamnagar represented that river Aaji is seasonal river and sand excavation will be done only from dry river bed.He explained that sand excavation will be done up to maximum 3 m depth or water level, whichever is less. The committee observed that the lease holders have proposed to leave adequate setback distance from the river bank so as to avoid chances of river bank erosion. After deliberations on various aspects, Committee asked Geological Assistant to submit details of distance of check dam/water bodies/irrigation structures/bridge piers etc. from outer periphery of the above leases. Upon submission of the aforesaid details, committee decided to take up the above proposals in one of the upcoming SEAC meeting for further decision. It was also noticed that none of the above projects involve intersection of ground water table. It was presented that arrangement of water sprinkling will be done during cutting for control of fugitive emission.Asst. Geologist mentioned that the human habitation is existing beyond 500 meters from all the above proposals. During meeting, considering the proposed mitigation measures, the committee decided to recommend all the above proposals for grant environmental clearance to SEIAA with stipulation of standard conditions for Non Sand mining as approved in 232nd SEAC meeting held on 15th April 2015. SEIAA with stipulation of standard conditions for Non Sand mining as approved in 232nd SEAC meeting held on 15th April 2015. Shri M.R. Vala, Asst. Geologist, Dist: Surendranagar informed the committee that proposals at Sr No: 1,2,4,6,10,14,15,16,19,21,22 are existing in Bhogavo river bed. After detailed deliberation, it was decided by the Committee that since prooopsals Sr No: 1,2,4,6,10,14,15,16,19,21,22 are existing in Bhogavo river bed, proposals cannot be appraised properly unless a detailed study is conducted by recognized institution to assess impact of mining in river bed on physical characteristics like river stability, flood risk, environmental degradation, loss of habitat, decline in bio diversity, change/ alteration in river morphology and other associated environmental aspects. It was decided by the committee to close the proposals at Sr No: 1,2,4,6,10,14,15,16,19,21,22 and decided that after submission of aforesaid detailed study report to the committee, proposals shall be considered for appraisal. During presentation, Shri M.R. Vala, Asst. Geologist, Dist: Surendranagar mentioned that proposal of Shri Gambhirsinh Agarsinh Rathod (at Sr No: 12) is located at 310 meter distance from Nava Jashapar village. After deliberation, since the proposal is existing at a distance less than 500 meter from the human habitation, Committee decided to recommend for rejection of the proposals at Sr NO: 12 to SEIAA. Shri M R. Vala, .Asst. Geologist, Dist:Surendranagar represented the above proposal at sr NO:1 and 3. He mentioned that above lease is located more than 500 meters away from the human habitation. It is an open cast mining with manual and semi mechanized method. Water sprinkling will be made to curb the fugitive emission due to vehicle movement, material handling, and unloading of stacks. Top soil will be stacked separately for green belt development whereas overburden will be removed, stacked and refilled in mined out pits. Above proposals do not involve intersection of ground water table. No wastewater generation is envisaged from mining activities. Domestic wastewater will be disposed off through septic tank – soak pit. Arrangement will be done to prevent contamination of surface runoff.

During meeting of SEAC held on 30-09-2014,The committee observed that all the above proposals were for in-stream mining of sand. The committee was of the view that these projects cannot be appraised properly unless and until a study has been conducted by recognized institution to examine sand replenishment rate as well as impact of mining on plankton, benthic flora and fauna, turbidity downstream and other related environmental parameters. It was informed to the committee that Commissionerate of Geology and Mining (CGM) is going to undertake siltation study of rivers in Gujarat through a credible institute. After deliberations, considering that these projects could not be appraised in absence of a study to examine sand replenishment rate as well as impact of mining on plankton, benthic flora and fauna, turbidity downstream and other related environmental parameters; it was decided to close files of above projects. It was also decided to reopen

file of these projects upon submission of a detailed study reports of Tapi and Purna rivers by the CGM to the committee.
Vide letter NO: NGT/CGM/EC/2015/1838 dated 03-07-2015 addressed to Geologist( Lease), Head Office, Geology and Mining by Asst Geologist, DIst: Tapi stating " CGM is going to undertake siltation study of rivers in Gujarat through a credible institute and detailed study reports of Tapi and Purna rivers will be submitted to Committee".
During meeting, it was decided to close all the files of the above proposals since detailed study report is awaited. According to OM of MOEF, New Delhi dated 24 December 2013, in stream mining is not allowed, it was decided by the committee to delist all the above proposals from the list of pending applications of SEAC.

During meeting of SEAC held on 30-09-2014, above proposals were appraised and committee observed that the nearest human habitation for the above proposals were less than 500 meter from the nearest villages. It was decided by the committee then to submit resolution passed by concerned Gram Sabha revealing no objection of villagers for the above projects.
District Geologist, Dist: Tapi submitted reply on 17-07-2015 mentioning details of the nearest village from the lease areas of the aforementioned proposals along with NOC letters of Juth gram panchayat.
After detailed deliberation, Committee noticed that above proposals are located within 500 Meter from the nearest villages and therefore decided to recommend for rejection of the above proposals to SEIAA.

The committee noticed that none of the above projects has proposed to undertake blasting and mineral will be removed only with help of cutter machine. It was also noticed that none of the above projects involves intersection of ground water table. It was presented that arrangement of water sprinkling will be done during cutting for control of fugitive emission. Committee deliberated on applicability of CRZ Notification 2011 for all the above proposals as all the proposals seemed near the Sea Coast. Additional information was sought from Shri Devendra Baraiya, Geological Assistant regarding applicability of CRZ Notification 2011. Committee asked Shri Devendrasinh Baraiya, Geological Assistant to submit details regarding bifurcation of all the above proposals whether falling under CRZ area or not and decided to take up the proposals in one of the upcoming SEAC meeting after submission of the aforesaid details.

During meeting of SEAC held on 30-9-2014,Shri P.J.Bhavsar, Geologist, District Vadodara presented the above proposlals before the committee. He informed that some of the lease areas are in dry riverbed whereas some are underwater. He represented that no any bridge piers / intake wells exist within 500 m distance from boundary of lease areas in dry riverbed, at least 10 m setback distance is left for excavation and sand removal will be done up to maximum 3 m depth or water level, whichever is less. The committee asked Shri Bhavsar to submit written confirmation on which of the above lease areas are in dry river bed and which are under the water.
Shri P J Bhavasar, Geologist, Vadodara submitted the information through e Mail dated 20.05.2015 that proposals at Sr No: 1,2 and 4 are at off stream, proposal at sr No: 3 is instream and proposals at Sr No: 5 is partially instream. He further confirmed that CRZ Notification 2011 is not applicable to the above proposals.
Considering the reply and after detailed deliberation, Committee decided to recommend the proposals at Sr No: 1,2 and 4 for grant of environmental clearance to SEIAA with stipulation of standard conditions for Sand mining as approved in 232nd SEAC meeting held on 15th April 2015.
It was deliberated that according to the OM of MOEF dated 24 Dec 2013, instream mining is not permitted and since proposals at Sr No: 3 and 5 are for instream and partially instream mining, Committee decided to recommend for rejection of the proposals at Sr No: 3 and 5 to SEIAA.

After submission of the said details, committee decided to take up the above proposals in upcoming SEAC meeting for further decision. Geologist, Dist: Gir Somnath vide letter dated 22-07-2015 submitted that lease area does not fall in the radius of 10 Km from Gir Sanctuary and also submitted opnion of Dy. conservator of Forest, Gir(East) Forest Division, Dhari Considering the reply and after detailed deliberation, Committee decided to recommend the above proposal for grant of environmental clearance to SEIAA with stipulation of standard conditions for Non Sand mining as approved in 232nd SEAC meeting held on 15th April 2015.
