Specifically, TomorrowNow will waive indictment andagree to be charged in an Information with eleven counts of Unauthorized Access to a ProtectedComputer, with Intent to Defraud and Obtaining Something of Value, in violation of 18 U.S.C. 1030(a)(4), and one count of Criminal Infringement of a Copyright, in violation of 17 U.S.C. 506(a)(1)(A) and 18 U.S.C. 2319(b)(1). The United States previously filed the Informationwith the Court. See Attachment A (Information).STIPULATION

    TomorrowNow will enter guilty pleas to all twelve counts of the lnfonnation pursuant toa Rule 11 (c)(1 )(C) plea agreement. The United States will lodge an under-seal copy of theproposed plea agreement with the Court separately.

    The United States and TomorrowNow will agree that the appropriate sentence is that setforth in paragraphs IO.a through 1O.d of the proposed plea agreement.

    The parties respectfully request that a change of plea and sentencing take place onSeptember 14, 20 II. The parties have agreed to waive a presentence investigation report, and donot anticipate filing additional pleadings unless requested to do so by the Court. The UnitedStates has notified Oracle about the proposed resolution and expects that a representative fromthat company will be present at the hearing on September 14, 2011. The Oracle representative
