Wills drafted for free during National Wills WeekAs has become tradition over thepast few years, members of thepublic will be able to have a basicwill drafted by an attorney free ofcharge during National WillsWeek from 7 to 11 October.

Attorneys’ firms throughout thecountry are participating in the Na-tional Wills Week project.

“By ensuring that you have a validwill, you as the testator, can protectthe interests of your loved ones andensure that there is no delay in set-tling your estate after your death. Italso ensures that your executor willact according to your wishes as setout in your will.

A valid will allows you to state whoshould inherit your assets and prop-

erty, to appoint an executor of yourchoice for your estate and also aguardian for your minor children,”said Law Society of South Africa(LSSA) co-chairpersons KathleenMatolo-Dlepu and David Bekker.

During Wills Week attorneys par-ticipating intheNationalWillsWeekinitiative will display posters withtheircontactdetails so thatmembersof the public can make appointmentswith attorneys in their area.

In addition, the contact details ofall participating attorneys can be ac-cessed on the LSSA website atwww.LSSA.org.za or by contactingthe relevant provincial law society. Why should an attorney draft

your will?A practising attorney has the nec-

essary knowledge and expertise toensure that your will is valid by com-plying with all the legal require-ments in the Wills Act and also thatit complies with your wishes. An at-torney can also advise you on anyproblem which may arise with yourwill and assist your executor.

Often a will is not valid because theperson who drafts it does not havethe necessary legal knowledge to en-sure that all the legal requirementsof the Wills Act are met. These in-clude the fact that the will must bein writing, it must be signed by thetestatorinthepresenceofat least twocompetent witnesses, and alsosigned by the witnesses. What could happen to your es-

tate ifyoudiewithoutavalidwill?

If you die without leaving a validwill, your assets will be distributedaccording to the provisions of the In-testate Succession Act.

These provisions are generallyfair and ensure that your posses-sions are transferred to your spouseand children, and where applicable,to siblings, parents, and if required, then to the extended family in termsof degrees of relationships.

But, these are some of the prob-lems that may arise if you die with-out leaving a will:

) Your assets may not be left to theperson of your choice.

) It can take a longer time to havean executor appointed. The executorwho is appointed may be somebodyyou may not have chosen yourself.

) There could be extra and unnec-essary costs.

) There could be unhappiness andconflictamongmembersofyourfam-ily because there are no clear in-structions on how to distribute yourassets.Where to find an attorney to

draft your will? The contact details of attorneys

participating in the National WillsWeek project can be are available onthe LSSA website at www.LS-SA.org.za.
