1. SUMMARY OF REPORT:

This report incorporates the VCAT appeals update and decisions made by Council officers under delegation. This report also details some performance indicators. 1.1 Performance

Included within this report are bar charts illustrating the following key performance indicators:

• Planning applications received and determined in the previous month

• Outstanding applications

• Average gross days in dealing with planning applications and

• Percentage of applications issued in 60 days or less. The number of permit applications received in October is the highest amount received in the past 12 months. The number of permits issued increased slightly whilst the number of outstanding applications rose due largely to the high number received.

There was a slight increase in the average number of gross days to determine an application due to the increased workload, however the figure is still significantly below that of growth and metropolitan Councils. The percentage of applications issued in 60 days or less slightly increased to 63% compared to the previous month (61%).

1.2 VCAT status update The table in section three of this report lists all files related to VCAT matters.

1.3 Delegated matters The table within Section 4 of this report further details applications that have been determined under delegated authority and planning applications that receive 2 objections or less, applications to amend planning permits or plans, applications to extend planning permits, applications to certify plans of subdivision, and the issuing of Statements of Compliance under the Subdivision Act and Section 173 Agreements signed under delegation.

3. APPEAL DECISIONS RECEIVED

3.1 An appeal against Council issuing Planning Permits P16764 (Gymnasium, medical centre, office and car parking) and P16715 (Car park) at South–Centre Road, Tullamarine was heard by VCAT on 4 October where VCAT gave the applicant deadlines in which to substantiate their grounds of appeal or the appeal would be struck out. The applicant subsequently sought VCAT’s consent to withdraw the applications, which was granted, and Council is now seeking costs from the applicant.

3.2 Council had no option other than to refuse to extend an out of time request for a permit extension for permit P13432 at 440-490 Craigieburn Road, Craigieburn. VCAT subsequently set aside Council’s decision and directed that an extension be approved.

3.3 In an appeal against conditions related to permit P16722 for a two storey dwelling behind an existing dwelling at 34 Deakin Street, Sunbury, the Tribunal deleted two parts of condition 1 relating to setbacks of walls and amended a further part of condition 1 again relating to wall setbacks. No other conditions were deleted or amended.
