1. SUMMARY OF REPORT:

This report incorporates the VCAT appeals update and decisions made by Council officers under delegation. This report also details some performance indicators.

1.1 Performance

Included within this report are bar charts illustrating the following key performance indicators:

• Planning applications received and determined in the previous month

• Outstanding applications

• Average gross days in dealing with planning applications and

• Percentage of applications issued in 60 days or less.

The number of permit applications received in February was the second highest level over the past 12 months. The amount of permits issued fell slightly as did the number of permit applications outstanding.

The number of gross days to determine planning applications showed a slight decrease and is significantly below metropolitan and other growth Council averages. The percentage of applications issued within 60 days or less increased to above 55%.

1.2 VCAT status update

The table in section three of this report lists all files related to VCAT matters.

1.3 Delegated matters

The table within Section 4 of this report further details applications that have been determined under delegated authority and planning applications that receive 2 objections or less, applications to amend planning permits or plans, applications to extend planning permits, applications to certify plans of subdivision, and the issuing of Statements of Compliance under the Subdivision Act and Section 173 Agreements signed under delegation.

3. APPEAL DECISIONS RECEIVED OVER FEBRUARY 2014

The following table lists and details the current status of all planning files which are subject to VCAT proceedings.

3.1 The hearing against Council’s decision to issue a Notice of Decision to Grant a Permit for a Place of Assembly at 60-66 Kyabram Street, Coolaroo is set to resume on 1 April 2014.

3.2 In regard to all appeals lodged for 370 Riddell Road, Sunbury, an Administrative Mention hearing has been scheduled for 15 April 2014. By this date Council and the appellant must advise the Tribunal of the following:

• What issues, if any, remain in dispute;

• Whether the full hearing should proceed; and

• Whether the time scheduled for a full hearing remains adequate.

3.3 Council previously resolved to issue a Notice of Refusal for a proposed double storey 14 unit motel and signage at 121-123 Mickleham Road, Tullamarine. In its decision on 6 February 2014, VCAT directed that Council’s decision be set aside and that a permit issue.

The decision was based on the Tribunal considering the site suited to the business tourism objective in the Planning Scheme of providing accommodation close to the airport and providing local employment.

The Tribunal also considered the design acceptable in regard to neighbourhood character
