The Board of Public Utilities (the "Board") is vested with the authority to oversee theimplementation of N11 Dialing codes, as delegated by the Federal CommunicationsCommission ("FCC") Order FCC 05-59. The FCC has designated 8-1-1 as a nationalabbreviated dialing code to be dedicated exclusively to access state One Call Centers asmandated by the Pipeline Safety Improvement Act of 2002, (Pub. L. No.1 07-355, § 17, 116Stat. 2985, 3008 (2002» and the FCC Order I/M/O The Use of N11 Codes and OtherAbbreviated DialinQ ArranQements, CC Docket No. 92-105, 20 FCC Rcd 5539, FCC ReleaseNo. 05-59 (March 14, 2005) ("N11 Order").
In the above referenced Docket the FCC found that the state commissions are in the bestposition to address issues associated with implementing 8-1-1 because many of the One CallCenters were developed by or under the auspices of the state commissions. Pursuant to theUnderground Facility Protection Act ("UFPA") , N.J.S.A. 48:2-73, §~, the Board is theauthority vested with the jurisdiction to oversee the establishment and operation of the statewideNew Jersey One-Call Damage and Prevention System ("One-Call"). In New Jersey the 8-1-1dialing code will coexist with the current toll free phone number for the New Jersey One CallSystem -800-272-1000. Both numbers shall route calls to the operator of the One Call Systemas described in the UFPA, which requires anyone who intends to engage in excavation ordemolitiqn tq give advance notice to facility operators to allow facility operators to markunderground facilities prior to excavation to prevent facility damage and service outages.
Under the Order, the FCC set an implementation deadline of Spring, 2007 for alltelecommunications carriers throughout the United States, including wireline, wireless andpayphone service providers, to provide access to state One Call Centers via 8-1-1. N11 Order,at 11 32. Furthermore.. as to implementation, the FCC delegated authority to state commissions-in this case, the Board --to address the technical and operational issues associated with theimplementation. !Q,., at 11 35. Accordingly, and in light of these requirements and in compliancewith the FCC's Order, the Board HEREBY ORDERS that each New Jersey TelecommunicationsCarrier shall:
1. Implement the 8-1-1 dialing code in addition to the current 800-272-1000 phonenumber as described in the N11 Order by March 15, 2007; and
2.
Issue a letter to the Board by March 15, 2007, certifying that the technicalimplementation is completed, has been tested, and is ready for public use; and
3, Not advertise or make public the availability of the 8-1-1 dialing code until April30, 2007, or any other date set by the Board; and
4.
Advise Board Staff of any non-technical issues between parties that arise andcannot be resolved as to this implementation. These issues shall not delay theimplementation of the 8-1-1 Dialing Code but shall take a separate path toresolution with Board Staff assistance.
In the event that Staff's assistance with any non-technical issues does not produce a resolution,Staff shall so advise the Board, and the Board will take such further action as it deemsappropriate within one hundred fifty (150) days of receipt.
