aa. Keith Dorman: #09-35203-R-2 (Cook – North Chicago) Appellant originally filed with PTAB on 10-13-10. An extension was requested with the original filing. PTAB granted a 90-day extension of time to the Appellant with a notification letter dated 11-21-11 and expiring 2-19-12. On 4-13-12, PTAB dismissed the above docket number for insufficient evidence as no correspondence was received from the Appellant. Per correspondence dated 4-26-12, Appellant, through counsel, is requesting the PTAB reinstate the appeal and have provided evidence to support their claim. Request states that the 11-21-11 extension notification letter from PTAB was never received and supplied a printout from PTAB’s website which does not reflect an extension. PTAB2000, however, does indicate that an extension notification letter was generated on 11-21-11. The PTAB’s letter of 11-21-11 was properly addressed and not returned.

bb. TWG Kedzie: #10-32048-C-1 (Cook – Hyde Park) Appellant originally filed with PTAB on 8-12-11 (postmark). An envelope was included with this filing with a sticker from the U.S. Post Office declaring insufficient postage by .44 cents. An 8-4-11 postmark is on this envelope. The BOR transmitted its final action for Hyde Park Township on 7-5-11. Per hearing officer review, appeal was dismissed for untimely filing on 7-5-12. Per correspondence dated 7-12-12, Appellant, through counsel, is requesting the PTAB reinstate the appeal and has enclosed the returned envelope postmarked 8-4-11 as this would allow the appeal to be timely filed.

cc. Robert Dahl: #09-35013-R-1 (Cook – Lyons) Appellant originally filed with PTAB on 10-13-10. An extension request was submitted with the original filing. An extension notification letter was generated and mailed from PTAB on 11-18-11 with an expiration date of 2-16-12. The appeal was dismissed on 4-13-12 for insufficient evidence as no evidence was submitted by the Appellant. Per correspondence dated 5-23-12, Appellant’s counsel is requesting the appeal be reinstated and states that an oversight in the office occurred. Counsel did not realize that the client had obtained an appraisal for the 2009 tax year. An appraisal dated 1-1-09, is included with reinstatement request.

dd. Lola Shapiro: #09-35573-R-1 (Cook – Evanston) The Cook County Board of Review was notified of the above filing on 2-1-12. A total of 90-days has been granted for the submission of evidence. The BOR was found in default on 6-11-12 with no evidence submitted to the PTAB within the required timeframe. On 6-7-12, The BOR submitted Notes on Appeal and evidence. The BOR is requesting the PTAB rescind the default and accept the Notes on Appeal and evidence that was received over one month from expiration of extension.

ee. Kishor Kamdar: #06-20953-C-1 (Cook – Rogers Park) Decision was drafted using stipulation supplied by the Cook County BOR and the Appellant. The decision was generated and mailed to all parties on 5-30-08 and the file is closed. It has come to the attention of the PTAB that the parcels supplied on the stipulation and used in the decision are incorrect. Hearing Officer

Evidence was not submitted to support Intervenor claim and/or additional extension request. The CBOE has submitted a Motion to Vacate Default dated 7-12-12, on all of the above docket numbers. Evidence and/or an extension request has not been received. The Intervenor has not been defaulted as of yet. The CBOE has submitted a Motion to Vacate Technical Default and requests that Intervenor be allowed to adopt evidence submitted by the City of Chicago. Counsel for Intervenor cites numerous urgent and expedited business and personal matters in an affidavit attached to Motion. ii. Jernberg Industries: #09-31735 Intervenor, Chicago Board of Education (CBOE), was granted a 90-day extension of time to submit evidence, expiring 3-11-12. Evidence and/or extension request has not been received. A default letter has not been generated as of yet by PTAB. Intervenor has submitted a Motion to Vacate Technical Defaults and request an additional extension of time to submit evidence or, alternatively, adopt evidence submitted by the BOR. Counsel for Intervenor cites numerous urgent and expedited business and personal matters in an affidavit attached to Motion. Counsel also states that she is the only attorney currently handling PTAB cases and the only one with knowledge of current cases. Emergencies cited include illnesses within counsel’s family and one attorney on leave from March to June of 2012.

jj. Scott AFB Properties, LLC: #09-05452-C-3 (St. Clair) (PIN #09-15.4-200-005) The St. Clair County Board of Review was notified of the above filing on 10-26-11. A 90-day extension granted with this notification to submit evidence. On 1-12-12, The BOR requested a second extension due to a small staff and heavy workload. This request went before PTAB’s Board at the 2-13-12 meeting. It was decided at this meeting to grant the BOR a final 90-day extension. This letter was generated and mailed on 2-27-12 with an expiration date of 5-27-12. A review after this due date indicated no evidence or extension request had been received by PTAB. The BOR was defaulted on 7-6-12. Per request dated 7-10-12, the BOR is requesting the PTAB rescind the default. Request states that the county file was thoroughly reviewed and an extension letter from PTAB could not

The affidavit also includes information regarding 09-05453 which includes a second parcel of the leasehold interest held by Scott AFB Properties, LLC. This docket number received a final extension from PTAB with an expiration date of 7-10-12. The BOR believed this expiration date to be the same for both docket numbers. In docket #09-05453, the BOR timely submitted a narrative appraisal that included PIN #09-15.4-200-005, the subject matter of this appeal.
