If this is a hearing to consider an appeal from an automatic fine, the Filing Officer has imposed a fine on you for your failure to file a campaign treasurer's report on the designated due date and, by filing an appeal, you have asked the Commission to consider either (1) that the report was in fact timely filed; or (2) that there were unusual circumstances that excused the failure to file the report timely. You are required to prove your case If the Commission finds that the report was filed timely or that there were unusual circumstances that excused the failure, it may waive the fine, in whole or in part. The Commission may reduce a fine after considering the factors in Section 106265, Florida Statutes .. If the Commission finds that the report was not timely filed and there were no unusual circumstances, the fine will be upheld

If this is a heaiing to consider a consent order before a determination of probable cause has been made, the Commission will decide whether to accept or reject the consent order.. SUMMARY: Solar Power PAC was a committee of continuous existence (CCE) registered with the State of Florida The CCE's chair was Chris Maingot and its treasurer was Dillon Daniels The Division acknowledged receipt of the CCE's disbandment letter as of 9/11/13

The CCE is appealing the fine claiming that management responsibilities for this CCE switched on 1/1/13 which resulted in errors accounting records. According to Wendy Parker Barsell, Deputy Treasurer, "Contributions to the Solar Power Pac are included on the dues invoice to each member. Dues invoices were prepared and input into the FLASEIA accounting system by the former management company in October of 2012 for the 2013 Calendar year Upon investigation, it was found that most of the invoices to members for 2013 did not properly allocate the total amount of the invoice correctly between F LASEIA dues and contributions to the Solar Power PAC Our accountant reviewed the accounting records and corrected the errors so that a proper and accurate 2013 QI report could be filed but it resulted in the report being filed three days past the April 10, 2013 due date.. Our goal was to file the report as soon as we folt the contribution figures were accurate which is why the report was filed on the first Saturday after the due date which was not a normal work day"

I have attached your notice dated April 15, 2013 regarding a fine in the amount of $150 00 for the late filing of the 2013 QI campaign treasurer's report for the Solar Power PAC which was filed on April 13, 2013. The proper address and telephone number for the Solar Power PAC is as follows:

I am appealing this fine pursuant to Rule 2B-l .. 005 under the Florida Administrative Code .. There was an unusual circumstance which caused a delay in filing a proper and correct report by the due date .. Management responsibilities for the Florida Solar Energy Industries Association, Inc .. (FLASEIA) and its related Committee of Continuous Existence, the Solar Power PAC were assumed by the Florida Swimming Pool Association (FSPA) on January I, 2013.. The FSPA received FLASEIA's accounting and other records in January, 2013 There was no reason to believe the accounting records contained any errors and the FSPA certainly was not alerted to any errors by the previous management company. During the process of completing the 2013 Q 1 report, our accountant discovered an error which resulted in the late filing of the report The nature of the error is explained below

Contributions to the Solar Power Pac are included on the dues invoice to each member ofFLASEIA. Dues invoices were prepared and input into the F LASEIA accounting system by the former management company in October of2012 for the 2013 Calendar year .. Dues and contributions to the Solar Power Pac were recognized by all F LASEIA members who had paid their invoice by March 31, 2013 When our accountant ran the first quarter reports in order to complete the 2013 QI report, he noticed that the amount of contributions to the Solar Power PAC were much lower than the 2012 amount which seemed to indicate an error as the number of members did not change significantly from year to year Upon investigation, it was found that most of the invoices to members for 2013 did not properly allocate the total amount of the invoice correctly between FLASEIA dues and contributions to the Solar Power PAC. Our accountant reviewed the accounting records and corrected the errors so that a proper and accurate 2013 QI report could be filed but it resulted in the report being filed three days past the April 10, 2013 due date. Our goal was to file the report as soon as we felt the contribution figures were accurate which is why the report was filed on the first Saturday after the due date which was not a normal work day

Effective August 1, 2013, yow committee of continuous existence may no longer accept any contiibution as defined in section 106 011, Florida Statutes Any failure by yow committee to comply with this prohibition on accepting contributions constitutes a violation of chapter 106 However, please note the law further provides that notwithstanding any other provision of law, yow committee now may make unlimited contributions to a political committee

Also, the new law automatically revokes the certification of your committee of continuous existence on September 30, 2013 At that time your committee's account must have a zero balance. Following the revocation of the committee's certification, the committee must file any outstanding report as required by law

Chapter 201.3-37, Laws of Florida (extract of first 2 of37 sections)

Section I Section 106.04, Florida Statutes, is repealed.

Section 2 (1) Effective August 1, 2013, a committee of continuous existence may not accept a contribution as defined ins. 106 011, Florida Statutes By July 15, 2013, the Division of Elections of the Department of State shall notify each committee of continuous existence of the prohibition on accepting such a contribution as provided under this subsection

(2) Effective September 30, 2013, the certification of each committee of continuous existence is revoked and all committee accounts must have a zero balance By July 15, 2013, the Division of Elections of the Department of State shall notify each committee of continuous existence of the revocation of its certification pursuant to this subsection. Following the revocation of certification, each committee of continuous existence shall file any outstanding report as required bylaw

(3)(a) A violation of this section or any other provis10n of chapter 106, Florida Statutes, constitutes a violation of chapter 106, Florida Statutes, regardless of whether the committee of continuous existence is legally dissolved

(b) A political committee or electioneering communications organization that has received funds from a committee of continuous existence whose certification has been revoked and that is directly or indirectly established, maintained, or controlled by the same individual or group as the former committee of continuous existence, is responsible for any unpaid fine or penalty incurred by the former committee of continuous existence If no such political committee or electioneering communications organization exists, the principal officers of the former committee of continuous existence shall be jointly and severally liable for any fine or penalty

(4) Notwithstanding any other provision of law, a committee of continuous existence may make unlimited contributions to a political committee

(5) This section shall be effective upon this act becoming a law.
