Training of staff for emergency situations shall be providedimmediately upon employment and no less than each calendar quarter for all jailpersonnel to include fire, emergency, evacuation drills, and location and use ofequipment.The facility was unable to produce documentation that all jailers receivedtheir life safety training upon employment and quarterly thereafter as requiredby minimum jail standards.

2 263 .42 Fire Prevention Plan. Each facility, after consultation with the local fire departmentor Texas Commission on Fire Protection, shall have and implement a written plan,approved by the Commission, for fire prevention and a fire hazard inspectionchecklist which shall be evaluated no less than each calendar quarter.The facility was unable to produce the documentation for inspection to showthat the quarterly fire prevention inspection was completed for the 3rd and4th quarters of 2012.

3 263 .56 Testing Emergency Power Equipment. Emergency power equipment shall betested at least once each week and the electric load transferred to the circuits atleast monthly.The facility was unable to produce documentation for inspection to show thatthe generator was tested in accordance with minimum jail standards.

4 279 .3 Facility Maintenance. Preventive maintenance, to include necessary repairs, shallbe conducted to ensure a safe, secure, and sanitary facility.During the walk-through, the hot water in cell 230 would not work. Theinmates in the cell will be given access to hot water until the repair is made.The toilet in cell 232 did not work. This cell will remain unoccupied until thetoilet is repaired. The ADA shower button in cell 141 was missing thereforethe shower could not be operated. The inmates housed in the cell will haveaccess to a shower until the repair is made.

observed that the facility was not informing the magistrate as required by the CCI’ 16.22 when the inmate is anexact match or a confirmed possible match through the CCQ system. The administration will now notify themagistrate when this situation occurs. Although the facility failed to notify the magistrate, the inmates inquestion were examined by mental health professionals and their care was not neglected. Issue corrected onsite. Follow-up action wilt take place in 60-90 days to ensure compliance.

259 New Construction Conducted a walk through inspection of the facility. Technical assistance provided. The TCJS Inspector reviewed thenew nonslip flooring sample that the facility would like to use to patch the floor in the kitchen. The material is notone that has been used in a correctional facility before. The TCJS Inspector forwarded the information to theTCJS Construction department for review. The material was not approved for use in the kitchen due to the factthe material was not fire/flame retardant. County will move to another option to repair the floor. The money torepair the floor has been allocated by commissioners court. The issue is being addressed. A follow-up will beconducted to insure movement on the project.

The TCJS Inspector advised the administration to contact the companythat maintains the fire panel to see if the panel could be fixed. Issue was corrected.

While reviewing the classificationdocumentation, the TCJS Inspector observed that 4 classification reassessments were completed past 90 days.The Jail Administrator was out during that period of time with open heart surgery. The Inspector recommended tothe administration to train another person regarding this matter for relief purposes so to make sure that this doesnot happen again. Issue addressed on-site.

provided. While reviewing the grievance documentation, the Inspector observed that a few grievances were notanswered within 15 days as stated by jail standards. The Jail Administrator was out during that period of timewith open heart surgery. The Inspector recommended to the administration to train another person regarding thismatter for relief purposes so to make sure that this does not happen again. Issue corrected on-site.

While reviewing the recreation documentation, the TCJS Inspector observed that the officers onoccasion would neglect to record the time inmate recreation began and when it ended, hence, documenting thatthe inmates received the full 1 hour of recreation as required by minimum jail standards. The Inspectorrecommended reminding the officers to do so in order to show compliance. Issue corrected on-site.

be provided immediately upon employment and no less than eachcalendar quarter for all jail personnel to include fire, emergency,evacuation drills, and location and use of equipment.

The documentation revealed that the staff did not receive lifesafety training upon employment and quarterly thereafter asrequired by minimum jail standards.

2 279 .3 Facility Maintenance. Preventive maintenance, to include necessaryrepairs, shall be conducted to ensure a safe, secure, and sanitaryfacility.

During the walk-through the facility control panel malfunctioned leaving the facility with inoperable electronic doorcontrols and inoperable intercoms throughout the facility.

.4 Staff. Inmates shall be supervised by an adequate number ofcorrections officers to comply with state law and these standards.One corrections officer shall be provided on each floor of the facilitywhere 10 or more inmates are housed, with no less than 1 correctionsofficer per 48 inmates or increment thereof on each floor for directinmate supervision. This officer shall provide visual inmatesupervision not less than hourly. Sufficient staff to includesupervisors, correctional officers and other essential personnel asaccepted by the Commission shall be provided to perform requiredfunctions. A plan, concurred in by both commissioners’ court andsheriffs department, which provides for adequate and reasonablestaffing of a facility, may be submitted to the Commission forapproval. This rule shall not preclude the Texas Commission on JailStandards from requiring staffing in excess of minimumrequirements when deemed necessary to provide a safe, suitable, andsanitary facility nor preclude submission of variance requests asprovided by statute or these rules.

The facility does not meet the 1:48 staff to inmate ratio at alltimes.

.4 The health services plan shall include procedures for themaintenance of a separate health record on each inmate. The recordshall include a health screening procedure administered by healthpersonnel or by a trained booking officer upon the admission of theinmate to the facility and shall cover, but shall not be limited to, thefollowing items:

The facility was not completing the medical screening form orsuicide screening form for the contract inmates in the facilityupon admission.

4 285 .1 Physical Exercise. Each facility shall have and implement a writtenplan, approved by the Commission, for inmate physical exercise andphysical recreation. Documentation of physical exercise and physicalrecreation shall be maintained for Commission review. Each inmateshall be allowed one hour of supervised physical exercise or physicalrecreation at least three days per week.

The facility was not offering the inmates physical recreation atleast three days per week for 1 hour as per jail standards.

State Law requires periodic inspections of county jail facilities (VTCA, Local Government Code,Chapter 351, VTCA, Government Code, Chapter 51 1; Chapter 297.8, Texas Commission on JailStandards).

The facility was inspected on the date indicated below, and it was determined thatdeficiencies exist. You are urged: (1) to give these areas of noncompliance your seriousand immediate consideration; and (2) to promptly initiate and complete appropriatecorrective measures. The Commission is available to discuss or assist you with theappropriate corrective measures required.

Failure to initiate and complete corrective measures following receipt of the Notice ofNoncompliance may result in the issuance of a Remedial Order (Chapter 297.8, et seq.).
