TIGER Drylac® Powder Coatings

All powder coatings in this pricegrouplist are available from stock in 20 kg cartons or as a 2,5 kg minipack

(not available in Series 68 and Series 40).

Prior to processing the appropriate Product Data Sheets and Technical Information Sheets and in case of

metallic effect powder coatings also the Data Sheet no. 36 of the Austrian Chemicals and Technoloy

Research Institute each in their latest version as well as any and all notes given in this pricegrouplist

must be consulted.

Please observe pigment related color differences of bright colors between architectural applications

(TIGER Drylac® Series 29 and Series 17) and other exterior applications (TIGER Drylac® Series 59 and Series

47) - use the same product line throughout the entire coating job.

Two-coat-systems: for the first coat use just the half of the curing time of the corresponding Product

Data Sheet (provided that no other information is given there). The following top-coating is to cure as

stated on the corresponding Product Data Sheet (full curing time).

Please observe also the Technical Information Sheet no. 1090 (latest version) for the cleaning of powder

coated surface.

As part of our product information program each of our Product Data Sheets and Technical Information

Sheets are periodically updated in accordance with present technological standards, so that the latest

version shall always prevail. Therefore, please contact our sales department to make sure that you have

the most current version of the respectiv Product Data Sheet and Technical Information Sheet as well as

pricegrouplist and pricelist.

Terms of Delivery and Payment

11.. GGeenneerraall:Unless otherwise agreed upon in writing, the making of offers, the conclusion of sales contracts, as well as the delivery of products by TIGERWERK shall be made exclusively according to the present Terms of Delivery and Payment, any gene-ral terms of business or other variant terms of the CUSTOMER notwithstanding.

22.. OOffffeerrss,, OOrrddeerrss::Offers made by TIGERWERK are not binding, especially with regard to the quoted prices, amounts, delivery times and thegeneral availability of the products. Orders of the CUSTOMER will be binding on TIGERWERK only after issuance of a written order confirmation or upon actual delivery.

33.. DDeelliivveerryy,, SShhiipp DDaattee:: With orders amounting to Euro 109,-- (excl. VAT) deliveries within Austria are made on a freight prepaid basis, smaller orders are subject to a freight charge of Euro 5,45 (excl. VAT). lf requested by the CUSTOMER, delivery may also be madeby train or mail at the risk and expense of the CUSTOMER. Notice of discrepancy concerning the amount and weight ofthe products shall be made by the CUSTOMER immediately upon receipt of the products, otherwise they will not beaccepted. Ship date information we indicate is based on extensive experience, but not binding. No liability will be accepted for non-compliance with given delivery dates.

44.. RReettuurrnnaabbllee PPaacckkaaggiinngg::Only packaging material that is explicitly marked as returnable will be taken back by TIGERWERK. Such packaging shall be returned at no cost to TIGERWERK by the CUSTOMER within three months. In case of return after the expiration of suchterm, no credit will be given.

55.. RReetteennttiioonn ooff TTiittllee,, AAssssiiggnnmmeenntt::TIGERWERK retains title to all products delivered until full settlement of the sales price and any and all connected claims.By processing the delivered products the CUSTOMER will not acquire property rights in the goods produced partly or entirely by such processing. In case of the continued use of - processed or unprocessed - products that are subject to suchretention of title, the CUSTOMER shall assign any and all claims it may have against the transferee (e.g. against the buyeror any other customer) to TIGERWERK in advance. The CUSTOMER has to notify his contractual partner about the assign-ment without delay. In case the right to retain title lapses for whatever reason, TIGERWERK and CUSTOMER hereby agreethat, by means of the processing, title to the products shall pass over to TIGERWERK, which accepts the transfer. The CUSTOMER remains bailee of the products for no consideration.

66.. CCoonnddiittiioonnss ooff PPaayymmeenntt,, DDeeffaauulltt::Payment shall be madea) either within 8 days as of invoice, less a 2 percent discount; orb) within 30 days as of the invoice date, net cash;In the event TIGERWERK bottles products at the request of third parties, payment shall be made net cash upon receipt ofthe invoice.In case of payment by way of bills of exchange, bank discount charges and collection fees shall be borne by the CUSTO-MERS and shall be payable immediately in cash.

Late payments shall be subject to interest on arrears in the amount of 1 percent a month. Any reminder charges, collec-tion charges and lawyer's fees in an adequate amount shall be borne by the CUSTOMER. lf a CUSTOMER defaults in the payment of one or more deliveries, TIGERWERK shall be entitled to suspend any further deliveries until effected paymentor to withdraw from existing contracts with the CUSTOMER.Any notice of defect etc. shall not release the CUSTOMER from its obligation to comply with the terms of payment as setforth above.

77.. WWaarrrraannttyy,, DDaammaaggeess::TIGERWERK warrants that products delivered by it do not have any flaws or defects regarding material or workmanship.

Terms of Delivery and Payment

Before use, the CUSTOMER shall examine the delivered products for their fitness for the intended use. TIGERWERK does not warrant that the products are fit for their intended use, nor does TIGERWERK give a warranty for the quality of the painting, coating, etc. made of products.In general the warranty of TIGERWERK is limited to an adequate price reduction or the exchange or taking back of the deficient product, at the option of TIGERWERK.In case of sales according to samples, minor - in case of sales according to color and effect cards also greater - variationsin quality, color and effect are permissible. Notices of defect referring to the condition of the product shall be made in writing to TIGERWERK before processing or mixing of the product and shall be submitted to TIGERWERK without delay following receipt of the product, otherwise all claims shall be forfeited.

TIGERWERK does not assume liability fora) damage or disadvantages of any kind which are due to the product´s subjection to any process or treatment otherthan such recommended in writing by TIGERWERK;b) products which were subjected to any form of further treatment by the CUSTOMER or products damaged after the risk has passed to the CUSTOMER.

TIGERWERK may be held liable for actions of its legal representatives and agents only in case of reckless negligence or intent. TIGERWERK shall not, except in case of reckless negligence or intent, be liable for a violation of obligations in con-tract negotiations, any violation of actual claims, the violations of obligations secondary to a contract, or for indirect orconsequential damage or damage to persons.Products may only be returned to TIGERWERK upon TIGERWERK´s approval.In case of a notice of defect or any other claim regarding genuinely or allegedly defective products, TIGERWERK is entit-led to suspend further deliveries until the legitimacy of the raised claims is conclusively determined, and in such a case the delivery dates shall be postponed accordingly.

88.. WWiitthhhhoollddiinngg PPaayymmeennttss,, SSeett--ooffff::The CUSTOMER shall not be entitled for any reason whatsoever to withhold payments for products delivered, not to setoff his own payment obligations against any claims he may have vis-à-vis TIGERWERK.

99.. RReepprreesseennttaattiioonnss,, TTeecchhnniiccaall IInnssttrruuccttiioonnss::Any kind of oral representations shall become valid only upon TIGERWERK's written confirmation.Written and oral instructions of TIGERWERK concerning techniques of application are given according to the best know-ledge of TIGERWERK. However, such instructions cannot substitute for the examination of the product by the CUSTOMER,especially for its fitness for a specific use, and are therefore given without obligation and to the exclusion of any liabilityon our part.

1100.. FFoorrccee MMaajjeeuurree::lf TIGERWERK's compliance with its contractual obligations is made wholly or partially impossible or delayed due to governmental restrictions, war, insurrection, labor disputes, fire, natural disasters, etc., TIGERWERK cannot be held liable.In such a case TIGERWERK shall be entitled to withdraw from the contract in full or in part with immediate effect.

1111.. AApppplliiccaabbllee LLaaww,, JJuurriissddiiccttiioonn::Any contract concluded with TIGERWERK shall be subject to Austrian law. The applicability of the United Nations Conventions on Contracts for the international sale of goods is expressly excluded. Any disputes arising hereunder shallbe brought exclusively before the competent court in Wels, Austria. Nevertheless, TIGERWERK is also entitled to turn to the courts of the CUSTOMER's registered principal offices.

1122.. PPaarrttiiaall VVaalliiddiittyy:: Should one or more of the above terms and conditions be or become invalid or unenforceable, the parties shall replace itby such a provision as comes closest to the economic purpose of the invalid term of condition. For customers who are consumers within the meaning of the Austrian Consumer Protection Act, more advantageous provisions of the AustrianConsumer Protection Act shall prevail over the respective provisions of the present terms of delivery and payment.
