Outline Siting Issues to Discuss:
5 foot separation to groundwater
Soil permeability requirement
Pad requirements
Compost Maturity
500 feet of horizontal separation6
5’ separation to the groundwater7035.2555 subp. 3: An owner or operator may
not establish or construct a source-separated waste composting facility in the following areas:
(B) within five feet of a water table The water table is defined in Minn. R. 7035.0300Generally top of saturated zonePerched groundwater tables will be considered on a
site by site basis
7
Soil Permeability Requirement7035.2836 subp. 8(G): at a minimum, the site
should have a net of five feet of native soil with a maximum permeability of 1.4 x 10-4 cm/sec
The permeability throughout the entire 5 feet of soil must be less than 1.4 x 10-4 cm/sec
If there is more than 5 feet of soil, the net permeability of the soil must be less than 1.4 x 10-4 cm/sec
8
Pad RequirementsIs there more than 5’ of native soil to the groundwater??
Does that 5’ of soil have a net permeability less than 1.4x10-4 cm/sec??

No pad required
NOPad required
Option #1: Soil PadPlace at least 1’ of soil with a permeability of less than 1x10-5cm/sec (must have at least 5’ to groundwater)
Option #2: GeomembraneInstall liner system defined in 7035.2836 subp. 4
Possible Option #3: Hard SurfaceConcrete or asphalt pad
Pad RequirementsIf a pad is required,
Must be at least 1’ of soil with a permeability less than 1 x 10-5 cm/sec
There must be at least 5’ of soil between the final grade and groundwater
Tipping area, active composting and screening must be done on a pad
Storage of mature compost does not require a pad
10
Compost MaturityMaturity is defined in Minn. R. 7035.263660% decomposition as determined by an
ignition-loss analysis and one method approved by the commissioner including, but not limited to: Solvita (7-8) C/N ratio (10:1 to 20:1) Other MPCA approved methods

500’ separation to neighbors7035.2555 subp. 3: An owner or operator may not
establish or construct a source-separated waste composting facility in the following areas:
(C) A minimum of 500 feet horizontal separation distance from the facility to the nearest…
Requires 500 feet between all permitted waste activity areas and the nearest neighbor. Tipping Area • Screening Area Compost Pad • Finish Compost Storage Contact Water Treatment

Variance Process
Minn. R. 7000.7000Applicant may apply for variances for:
Grounds of economic burdenGrounds that compliance is not
technically feasible
