Item No. 3: To decide on the proposals received for al~proval of fee structure for the courses started durinq BY 2012-13:

(a) To consider and decide on pro~osals where there are no discrepancies.

The Samiti considered the proposals of the following Colleges/ Institutes for finalization of fee structure for the students who joined the courses started during Academic year 2012-13. After deliberations, the Samiti decides to approve the final fee structure of the following Institutes/Colleges for the students who joined the course started during AY 2012-13. The students admitted in the AY 2012-13 and there after continuing their studies will pay an enhanced fee of 5% each successive year as per the norms for 2012-13 till completion of the course. For example if the fee approved is Rs. 1,00,000/- then 2nd year, 3rd year and 4th year's student of the Health Science colleges will be Rs. 1,05,000/-. (assuming course is of 4 years)

1232 of 2012 dated 8th May 2012.

The matter was fixed earlier also, but was required to be adjourned at the

instance of the parentslstudents.

The fee for the MBBS course started in AY 2011-12 was il-~itially approved at

Rs.5,12,760/-. But after hearing the parties, it was reduced to 4,00,000/- by

order dated 23rd August 2011. But the studentslparents filed revision dated

30.th November 2011 and subsequent one raising practically the same points.

We deal with them.

1 The first point raised by the learned Adv. Mr. Kulkarni for the

parentslstudents was salary paid to the staff. I t is submitted that the it should

have been considered only for 59 teachers as these were approved by the

MLIHS. As against this, it is pointed out that in fact Medical teachers are

approved/recognized by Medical Council of India. Though there were teachers

149, admittedly 123 were recognized. I t is submitted, that Medical Council of

India is the authority to recognize or approve the teachers considering the

sanctio~ied strength. Admittedly, the Samiti has deducted nearly 35% of the

salary from what is claimed in the balance sheet.

Hence, there is no substance in this point.

2. The next point raised is regarding electricity expenses. I t is submitted that

for the college it was considered as Rs.34,01,988/- and for the hospital it was Rs.

9,80,572/-. I t was thus 75% for the college and 25% for the hospital. I t is

submitted that it was an error as college is run for some time in a day and for

290 days a year. The hospital is run for the whole year and 24 hours a day.

Therefore, for the college it should have been Rs. 8,50,857/- only. Admittedly,

the area of the college is much larger than hospital and there is one meter.

Some lighting is required in the college for 24 hours and round the year.


Hence, there is no basis for the submission. The division is quite

reasonable.

3. Tlie next is regarding Corporation Taxes of Rs.39,58,343/-, street tax Rs.

20,30, 9291- and Education cess Rs.30,62,365/- (total Rs. 90 ,51, 6391-). It is

submitted that only Rs. 2040,809/- should have been considered. I n fact the

Samiti approved only Rs.70,20,708/-. It is submitted that Rs.20,40,809/- was for

this year while the rest for the earlier years and ought not have been considered.

Admittedly, it was paid during 2010-11. I t was pointed out that this tax was

challenged in the High Court, but later on it was required to be paid.

We find no reason to disturb this.

4. The next point is regarding pre-paid expense for P.G. course. I t is

conceded that the MBBS students have nothing to do with these expenses, which

are to be borne by the P.G. students.

5. The next it is contended that provision for salary ought not have been

considered. It is pointed out by the college that there is no provision made in

the current year. Earlier provision of salary has been paid during the year but is

not reflected in the income & expenditure accounts of this year.

Hence, there is no substance in this point.

6 Then the question is raised regarding the payment of 5th pay commission

arrears and 6th pay corr~mission arrears. I t is conceded that there is no question

of payment of arrears of 5th Pay commission. It is also conceded that 6th Pay

Commission arrears were in fact paid by the college to the teachers. As per our

IVorms it has been divided on all the students studying i.e. 450. This was done


to lessen than the burden on the students for 2011-12. Hence, i t came to Rs.

1,01000/- per student. The fee of Rs. 4,00,000/- included this for the students

admitted in AY 2011-12.

Therefore, there is no error.

7. The next is regarding NRI quota fees. That is in fact reflected in the

balance sheet as fees received. I n addition, fees are approved on the basis of

the expellses incurred by the college.

Hence, there is no substance in it.

Hence we find no merit in any of the submissions. Rejected.

(b) To decide on fee structure of AY 2011-12 of WNM course of Savitribai Phule Colleqe of Nursinq, Kolhapur as decided in the meetinq dated 18th June 2012 (aqenda Item No. 5)

Shri Ranjeet Kadani was present on behalf of the College. Fee already

approved for the Nursing course for 2011-12 required to be reopened and also

the fee for RANM course to be approved. The difficulty has already been

explained to the person present. As the accounts both for nursing course as well

as RANM course submitted are same. I t is prayed that the matter may be taken

in the next meeting. Accordingly it is to be taken in the next meeting.

All the colleges are enquiring about consideration of fee to be charged for the repeater students. We find as follows:-

1. There is no clarification in tlie G.R. dated 20th February 2003 issued by

the Medical Education and Drugs Department. I t is not clear what order

is passed by the High Court in Civil Application No. 740199 in W.P. 31701

97. Further the G.R. issued by the Government dated 26th July 1999 and

5th February 2000 are not annexed. Therefore, concerned department of

Government to be requested to clarify the G.R. dated 20th February 2003

annexed herewith.

2. The concerned colleges to be asked to submit the Government's decision

dated 26th July 1999 and 5th February 2000. They are also to be asked

to submit the order passed by the High Court in Civil Application No.

740199 in W. P. 3170/97. After receiving clarification from the

Government and from the concerned colleges, the decision to be taken by

the Samiti.

Iten1 No.7: Anv other Item with the permission of the Chair.

1) Waiver of fees increase.

Considered the letter dated 7th July 2012 received from parents and

students of Terna Medical College (4th and final year's students). The fee

approved by the Sarr~iti is not challenged. IVo revision was also filed. The prayer

made is for grant of installment in fee. Parentslstudents are required to

approach the management/college for this purpose and it is not for the Samiti to

grant it.

2) Extension of date for submitting Proposals for AY 2012-13.

The last date for subrnitting the proposals was 30th June 2012. Further it

was extended up to 31st July 2012 subject to penalty of Rs.l0,000/- per


proposal for delay. Further it is extended for second time for a period of one

month i.e, till 31st August 2012 subject to penalty of Rs.30,000/- per proposal.

The next meeting of the Shikshan Shulka Samiti (Medical Education)

would be held on Tuesday the 7th August 2012 at 11.30 a.m. in the Meeting

Hall, Office of the Samiti at 305, Government Polytechnic Building, 49, Kherwadi,

Ali Yawar lung Marg, Bandra (E) Mumbai 400 051.
