BSF rescues abducted man in Meghalaya Shillong, Jan 21, 2015 A 65-year-old abducted man was rescued by BSF from the clutches of kidnappers when they were trying to shift him near Fakirakona in South Garo Hills district along the Indo-Bangla border, a BSF official said today. The incident took place when BSF challenged the abductors on the zero line yesterday. While fleeing they left behind former school teacher Robinson R Marak, he said. As Barack Obama visits, signs that India is pushing back against China New Delhi,Jan 21,2015 When Sri Lanka unexpectedly turfed out President Mahinda Rajapaksa in an election this month, it was the biggest setback in decades for China’s expansion into South Asia – and a remarkable diplomatic victory for India. Despite New Delhi’s protestations, diplomats and politicians in the region say India played a role in organising the opposition against pro-China Rajapaksa. His successor, President Maithripala Sirisena, has said India is the “first, main concern” of his foreign policy and that he will review all projects awarded to Chinese firms, including a sea reclamation development in Colombo that would give Beijing a strategic toehold on India’s doorstep. India has pushed back against China elsewhere in the region since Prime Minister Narendra Modi took office in May, improving ties with Japan and Vietnam, both locked in territorial disputes with Beijing, and contesting a port project in Bangladesh that could otherwise have been a cakewalk for China. The new robust diplomacy, which Modi calls “Act East”, has delighted Washington, which has been nudging India for years to dovetail with the U.S. strategic pivot toward the region. When President Barack Obama makes a landmark visit to India starting Sunday, he will be the chief guest at New Delhi’s showpiece Republic Day military parade, and rarely for a presidential trip, is not scheduled to visit any other country before returning to Washington. “What is appealing to me and my colleagues is the fact that Prime Minister Modi has undertaken to build from what has been a ‘Look East’ policy to an ‘Act East’ policy,” U.S. Assistant Secretary of State for East Asia and the Pacific Daniel Russel said in Washington last month. “He has shown in word and deed his interest in involving India in the thinking and the affairs of the broader region. That’s very much to be welcomed.” Washington made no bones about its distaste for Rajapaksa, who critics accuse of war crimes, corrruption and nepotism. But until last year India was indecisive, perhaps afraid of pushing the hero of the war against Tamil separatists even closer to China. That changed in September, when Rajapaksa allowed a Chinese submarine to dock in Colombo, without informing India, as it was bound to under an existing agreement. “That was the last straw,” a senior Indian diplomat told Reuters. “He told Modi: “the next time I will keep you informed,”” the diplomat said, a promise that was broken when the submarine visited again in November. In the build up to the Jan 8 election, India played a role in uniting Sri Lanka’s usually fractious opposition, for which the station chief of India’s spy agency was expelled, diplomatic and political sources say. IMF growth forecast for India needs to be taken with a pinch of salt New Delhi,Jan 21,2015 Every bull market needs a story. In fact, different phases of the same bull market need different stories. The latest story to hit the Indian stock market is that India will grow faster than China in 2016. This economic forecast has been made by the International Monetary Fund (IMF) in the World Economic Forum Outlook Update which was released yesterday (January 20, 2015). In this update, the IMF expects India to grow by 6.5% against China's 6.3%. This forecast is along the lines of another forecast made by the World Bank on January 14, where it said that India will grow by 7% in 2017-2018. It expects China to grow by 6.9% during the course of that year. The IMF offers reasons as to why it sees growth in China slowing down from 7.8% in 2013 to 6.3% in 2016. “Investment growth in China declined in the third quarter of 2014, and leading indicators point to a further slowdown. The authorities are now expected to put greater weight on reducing vulnerabilities from recent rapid credit and investment growth and hence the forecast assumes less of a policy response to the underlying moderation,” the IMF states. For India, the IMF states that the “weaker external demand” will be “offset by the boost to the terms of trade from lower oil prices and a pickup in industrial and investment activity after policy reforms.” As far as justifications are concerned, you cannot get more general than this. Having said that, this bit of news drove the BSE Sensex to rally by 1.84% to close at 28,784.67 points on January 20. The foreign institutional investors who have been at the forefront of driving the Indian stock over the last few years, bought stocks worth Rs 1275.59 crore. The domestic institutional investors, who on most days do the opposite of what the FIIs are doing sold stocks worth Rs 761.7 crore. With India likely to grow faster than China in the years to come, it is but natural that FIIs want to bet their money on India. Nevertheless, the question is, should the IMF forecast on India (or even their forecasts in general) be taken so seriously? IMF forecasts in general have a certain amount of optimism bias built into them. As Chris Giles wrote in the Financial Times in October 2014: “Between 2011 and 2014, these forecasts have averaged 0.6 percentage points higher than the outturn...In the very laudable exercise to examine what went wrong, the fund discovered about half of its errors came from predicting greater strength in Brics countries – Brazil, Russia, India and China – than occurred.” French Premier Announces ‘Exceptional’ Measures Against Terrorism PARIS Jan 21,2015 Two weeks after one of the deadliest attacks ever to hit France, Prime Minister Manuel Valls announced “exceptional” measures on Wednesday to fight terrorism and reinforce a package of existing laws that are already considered to be among the strictest in Europe. Mr. Valls made his announcements at a news conference after France formally charged and detained four men accused of providing logistical support to Amedy Coulibaly, one of the three gunmen involved in the three-day onslaught. Bedi will contest from BJP stronghold of Krishna Nagar while Kejriwal will seek re-election from the prestigious New Delhi constituency where he had defeated three-time chief minister Sheila Dikshit by over 22,000 votes last time. "Around 916 candidates, including Independents, have filed their nomination papers for the upcoming Assembly elections. However, we are now compiling the data to ascertain the exact number of candidates," said a senior official at the Delhi Chief Electoral Officer's office. Of the total, around 532 candidates today filed their nomination papers, the official said, adding as many as 384 candidates had filed their nominations yesterday. Meanwhile, the official said a total of 117 FIRs has been lodged against different political parties till January 20 for violation of the Model Code of Conduct, which came into force on January 12. "Out of the 117 FIRs, 52 have been registered against AAP while 22 have been lodged against BJP. Twenty-six and 10 FIRs were lodged against Congress and BSP, respectively," the official said. Till yesterday, a total 10569 persons have been booked under various sections of CrPC/Delhi Police Act, and as preventive measures 110 licensed arms were deposited, 11 unlicensed arm and 1039 cartridges were seized. Bedi, who filed her nomination for the Assembly election from Krishna Nagar constituency, said the RSS is a very nationalist organisation that has kept India united. The statement is quite significant because it comes at a time when the RSS is learnt to be unhappy with the projection of Bedi as the BJP's CM nominee. Talking about her decision to join the BJP, Bedi said she did so to defeat the "confrontational politics" of Aam Aadmi Party's Arvind Kejriwal. At one point in time, Bedi was Kejriwal's colleague in Team Anna and had launched agitation along with him. She broke away with him on the issue of forming AAP, saying that like their leader Anna Hazare she too was against party politics and electoral politics. However, after she made a U-turn to join the BJP, she said she got inspired by Prime Minister Narendra Modi's policies. Meanwhile, commenting on Bedi joining the BJP, Hazare said, "Politics is dirty. I don't want to talk about it. I don't want to comment on Kiran Bedi." Ever since she joined the BJP, Bedi had been trying to contact Hazare but has failed to do so. She has repeatedly called him up but has never been able to talk to him. On Wednesday, Hazare has made his displeasure by maintaining that he did not approve of party politics. In December 2013, shivering under a tarpaulintent at a relief camp in Loi, Muzaffarnagar, Rahisalost her five-year-old son, three months after she hadfled her village following the September riots. InDecember 2014, four months after she bought landin a new colony for people displaced from her village,just opposite the original camp, she lost another sondays after his birth.

“It will be a month on January 20. My baby wasjust eight or nine days old. There was no time to takehim to hospital,” says Rahisa, who hails from Kheradin Muzaffarnagar. “It is so cold and we are still livingunder tarpaulin structures. We spent all our moneyon the plot and there was nothing left for building ahome.”

Her three surviving children too have recurringfever and cough. “We have started building our homeonly now, for the children. It is the only way to savetheir lives,” she says. She has not taken her childrento a hospital yet; a haqeem from adjoining Budhanais giving them medicine.

These new colonies, one in Loi, one inAhmednagar and a third, named Aman colony, inKandhla, have come up near Muslim-majority areas,in the vicinity of the old camps. People bought theland from Muslim owners from September last year.

But with no water or electricity, drainage systemsor toilets yet, and the bulk of the compensationprovided by the state spent in buying the land, lifehas not changed much for riot victims. Garbage ispiled on the lanes, water stagnates in potholes, andmosquitoes hover around the colony. Pitch dark atnight, the colony stands out from other parts of Loivillage.

Sharafat Ali lost his newborn daughter Ayeshanearly two months ago, a death he attributes to thewinter. A year earlier, he had lost his first child in thecamp in Loi.

“Tell me, what has changed for us?” he says.“Till the relief camp was running, we had at least astructure of organised committees to fight for us. Thechildren would get milk, and rations were suppliedweekly. Now we are on our own, and there is notime to take the children to hospital,” says Ali, whotoo is staying in the new colony in Loi.

Since the camps were declared closed inMuzaffarnagar, their residents say they have had todo without the help they were getting from theadministration or from local political leaders who hadset up relief committees; these were dismantled afterthe Lok Sabha elections.

Mohammad Salim, part of a new four-membercommittee elected by colony residents, said the SDMcame on his first visit on Friday. “There were reportsof deaths, so the SDM came. We told him to firstclean the lanes of garbage,” Salim says. “Yes, we havebought plots, but are we not entitled to basic facilitieslike other citizens? With such conditions here,obviously there will be more disease and death.”Village leaders who had been part of the committeesin Loi don’t visit the colony, residents allege. “Thepradhan is with the SP, and until the Lok Sabha pollshe would come and take our problems to theadministration. We bought land from him and thiscolony has come up. But after the polls, he hasstopped coming,” says Irshad, from Fugana. Peoplesay residents of Loi have become hostile, even onmatters like burying their dead in the villagegraveyard. “They tell us we should get our owngraveyard, but where is the money to buy more land?”Saleem says. Abdul Jabbar, pradhan of Loi, says thecommittee was “automatically” dismantled after thecamp closed. “When district authorities come, theystill meet us, but we are not in touch with themregularly. We have helped them as much as we could.I sold them land cheap, and if someone comes forhelp we never turn him away,” Jabbar says.Muzaffarnagar ADM Indermani Tripathi, who wasput in charge of the camps and supervised their closurelast year, did not respond to calls and messages fromThe Indian Express. SDM (Budhana) J P Gupta, whowent to the colonies last week, says meetings will beheld this week to review the facilities. “We have donea preliminary survey and will share the details withsenior district authorities,” he says. “The camps wereclosed last year, so obviously medicines and rationswere stopped. When people moved and settledelsewhere, how can district authorities keep going tothem?”

Delhi High Court to Centre: Removefreeze on foreign contributionsreceived by Greenpeace India

New Delhi, Jan 21,2015The Delhi High Court

on Tuesday directed thegovernment to remove thefreeze on the IDBI Bankaccount of GreenpeaceIndia, which has foreigncontribution of Rs 1.87crore from GreenpeaceInternational. The courtobserved that thegovernment had notbrought any “evidence onrecord” to support itsaction of freezing theaccount.

“According to me,there is no material onrecord to restrict thepetitioner from accessingthe bank account with theIDBI Bank in Chennai,”said the court of JusticeRajiv Shakdher. It said thatthe “amount in fixeddeposited

in the bank beunblocked and transferredto the NGO’s account”.

The court took noteof the submissions made bythe Ministry of HomeAffairs, which had allegedthat the “foreign funds”had been contributed byGreenpeace International,which was on its watchlist,but observed that theministry’s directions tofreeze the account hadbeen given before anynotice was issued to theNGO.

“How do yourespond to the NGO’sallegation. in the Central ReservePolice Force (CRPF)merely because hecomplained to the PrimeMinister about the poortreatment meted out towater carriers in thedepartment and said theywere denied weekly offs aswell.

Eighteen years later,Gujarat high court orderedCRPF to take Patil back inservice on the ground thathis mistake wasn't graveenough to deprive him ofhis job.

Patil was recruited inthe CRPF as a watercarrier. Fed up with the job,particularly because watercarriers weren't evenallowed to rest on theirweekly offs during his

posting in Gandhinagar, hewrote a letter to the PrimeMinister in 1997 andcomplained about serviceconditions and that watercarriers were made towork without holidays. Healso complained that theywere treated as lowcategory employees in thedepartment.

The departmentsuspended him for writingto the PM directly, withoutgoing through the properchannel. Patil refused toaccept his suspension andwas then dismissed fromservice. His legal battlelasted for 18 years. Hislawyer, Ramnandan Singh,argued before the HC thatthe punishment was tooharsh as compared to hismistake. A bench of JusticeAkil Kureshi and Justice

Sonia Gokani alsoobserved that Patil was noteducated enough tounderstand the proceduralaspects and the properchannel for complaintsregarding serviceconditions.

The court orderreads, "Main misconductalleged against him wasthat he made arepresentation to thePrime Minister withoutrouting it through properchannel. Misconduct itmay be, it certainly wouldnot warrant dismissal of anemployee from service.This is one of the rare case,where the court wouldcertainly come to theconclusion that punishmentawarded was so out ofproportion to shock theconscience of the court..
