Spill Prevention Control and Countermeasures (SPCC) Plan How will it affect your business? The Spill Prevention Control and Countermeasures (SPCC) Plan is a comprehensive, facility-specific description of the documented containment and countermeasures in place to prevent an oil spill from occurring, and the procedures to respond and clean up if it does. Driven by the EPA’s Federal Water Pollution Control Act (as amended by the Clean Water Act), this ruling is designed to prevent discharge of oil and oil-related materials from reaching navigable waters and adjoining shorelines. The SPCC Plan consists of three parts: O Operating procedures that prevent oil spills O Control measures to prevent a spill from reaching the environment O Countermeasures to contain, clean up and mitigate the effects of an oil spill that reaches the environment Who needs to have a plan? Before a facility is subject to the SPCC Plan rule, it must meet three criteria: O Be non-transportation related O Have an aggregate above-ground storage capacity greater than 1,320 gallons or a completely buried storage capacity greater than 42,000 gallons O Have a reasonable expectation of a discharge into or upon waters of the United States or adjoining shorelines What are the consequences for non-compliance? Financial penalties for non-compliance can be as high as $25,000 per day per violation. Specific violations include: O Untrained personnel O Failure to report a spill which releases to waterways O Lack of a facility-specific SPCC Plan Who prepares the SPCC Plan? Preparation of the SPCC Plan is the responsibility of the facility owner or operator. It can be prepared by an engineer or consultant, but it must be certified by a registered Professional Engineer (PE). By certifying the SPCC Plan, the PE, having examined the facility, attests that: O He/she is familiar with the requirements of Part 112 O The engineer or their agent has visited and examined the facility O The plan has been prepared in accordance with good engineering practices, including consideration of applicable industry standards, and with the requirements of Part 112 O Procedures for required inspections and testing have been established and the plan is adequate for the facility Regulations The following OSHA and EPA regulations protect your employees and the environment: 29 CFR 1910.22(a)(2) Clean, dry workplace floors. 40 CFR 112.7(c)(1)(vii) Absorbent materials are one option for preventing oil spills from reaching waterways. 29 CFR 1910.120(j)(1)(vii) DOT-specified containers and suitable quantities of absorbents shall be kept available for response to spills.
