SPECIFICATION CLAUSES FOR SUPPLY AND DELIVERY OF SIX NEW SIDE TIPPING TRAILERS AND FOUR NEW DOLLIES

Diamantina Shire Council and Barcoo Shire Council invites tenders for the supply and delivery of six new side tippers and four dollies. Tenders close in Bedourie at 4pm on Thursday, March 1, 2012 and should be submitted by post to: Tender No. 2012/05 Diamantina Shire Council Herbert St BEDOURIE QLD 4829

DELIVERY Delivery is to be made as soon as possible from receipt of order to each of the following:

Two side tippers and one dolly Workshop Manager (for pre-delivery inspection between 8.30am & 4.00pm Mon.-Fri.)

Registration and delivery not to be included with tender price.

All prices are to be inclusive of GST.

The units shall be supplied for each council with manuals / parts lists / CDs to suit.

CONDITIONS OF TENDERS FOR SIDE TIPPERS AND DOLLIES 1.1 Tender Documents

A. The tenderer shall complete all details on the Tender Form which shall be recognised as the tender.

B. The tenderer shall sign the tender or, if the tenderer is a corporation, affix the common seal or otherwise formally sign the tender.

C. Selection shall be made from the signed tender and not from any literature or letter accompanying the tender, unless such attachments are specifically referred to in the signed tender schedules.

1.2 Variations from Specification

A. If because of the basic design or other factors it is impracticable for the tenderer to fully comply with the specification of vehicle required, he/she shall clearly list these variations and attach to the General Tender Schedule.

B. Unless these exclusions are stated, it shall be expected that the unit offered complies with the specification in all respects.

1.3 Time for Delivery The tenderer shall state on the tender the time for delivery of the vehicle. A monetary penalty shall be incurred by the tenderer on failure to comply with the stated delivery time, and at Council’s discretion. The penalty shall be calculated at the rate of 0.1% of the tender price per ordinary working day, i.e. Monday to Friday, exclusive of public holidays, that the actual delivery time exceeds the stated delivery time. Council also reserves the power to subtract this calculated penalty amount from the tender price and to make payment accordingly. Delivery shall be to the Council Depots at Eyre Street, Bedourie and Perkins Street, Jundah, and all tenderers should nominate the price involved in delivering the items to this point in their tender price. If the successful tenderer fails to supply the vehicle or equipment tendered for within the time set out in their tender documents, Council reserves the right to cancel the order and either place an order with another tenderer or recall tenders. 1.4 Lodgement of Tender

A. The tender – in its original form -must be received by the addressee by the time and date stated in the specification. Any tender not conforming with this condition will not be considered unless there is evidence satisfactory to Council that such tender:

o Was delivered to the specified place for lodging the tender before the closing time; or o Was posted to reach the specified place for lodging the tender under normal

circumstances before the closing time, and was in the course of postal delivery at that time.

B. Tenders will be accepted by post only. C. Each Tender shall be enclosed in a plain sealed envelope and distinctly endorsed with the

name of Council and “Tender 2012/05”. D. Notwithstanding the provisions of clauses A, B and C above, Council can accept or reject any

non-conforming Tender in its sole subjective discretion when such Tender is shown to best meet the procurement principles provided for in section 177 of the Local Government (Finance,

Plans and Reporting) Regulation 2010 (Qld). 1.5 Notice of Tender Every notice to be given to a tenderer may, if Council thinks fit, be posted to the tenderer's address given in the tender, and such posting will be deemed good service of such notice, and the time mentioned for doing any act after notice shall be reckoned from the time of posting same.



1.6 Acceptance of Tender

A. Any tender which does not comply with the requirements of the conditions of quoting in all respects may be rejected.

B. The lowest or any tender not necessarily accepted. C. The tenderer whose tender has been approved and accepted shall be advised by the

placement of an official order form from Council. D. If the successful tenderer fails to supply the vehicle tendered within the time as set out in their

tender documents, Council reserves the right to cancel the order and either place an order with another tenderer or recall tenders.

1.7 Trade-in Allowances

A. By inspection on site of any trade-in unit the tenderer shall satisfy him/herself as to the actual condition of the trade-in unit/s.

B. Council reserves the right to refuse any and all trade-in offers, and dispose of the trade-in vehicle by other means, at its sole discretion.

C. The trade-in unit shall be available ex Bedourie or Jundah and all costs associated with its relocation are to be borne by the tenderer.

D. Council reserves the right to continue to utilise the trade-in unit at its discretion until the delivery of the replacement unit is affected.

E. No claim on account of alleged mis-description or of the incorrectness or insufficiency of information supplied shall be allowed.

DISCHARGE Nil internal obstructions which may cause product build-up of binding.

SKIDPLATE Height set at 1,300mm with 12mm plate with bolt in key block for ball race.

HYDRAULICS Air switches only needed in prime mover for trailer operation. As body tips door activates automatically and opens first. Trailer has manual valve also in case of truck hydraulics failure, another prime mover can power hydraulics and be operated manually for discharge without necessary controls inside of cab. All hydraulic fittings are quick release to front and rear. All trailers set up for quad operation. Festo quick release 6mm airlines for hydraulic valve operation.

MAIN TIP RAMS Two (2) single stage 20 Tonne (40 Tonne capacity), double acting hydraulic cylinders externally mounted to each end of body. Cylinders fully chromed, skived and roller burnished. Remote grease lines fitted to top and bottom cylinder pivot.

DOOR OPENING Two (2) 16. Tonne double acting, single stage 4” x 36” cylinders fitted to each end of body. Cylinders fully chromed, skived and roller burnished.

SUSPENSION 90mm wide springs / 10 leaf
