Henningsen v. Bloomfield Motors(USA, 1960):
Mr. Henningsen had bought a Plymouth, from BloomfieldMotors, Inc.
The purchase order contained a disclaimer of the impliedwarranty of merchantability in virtually illegible fine print.
Mrs. Henningsen suffered a personal injury in a single caraccident when the car's steering mechanism failed.
The Court stated, "We hold that under modern marketing
conditions, when a manufacturer puts a new automobile inthe stream of trade, an implied warranty that it is reasonablysuitable for use as such accompanies it into the hands of thepurchaser."
