Technical ProvisionsThe purpose of the Practice Note is to provide guidance to Practitioners and Building Surveyors with regardinterpretation, administration and enforcement of the relevant provisions of the Building Regulations, the BCAand AS1926-2007 & 2010 in the State of Victoria.

This is essential information for all builder members – but may also be critical advice for thoseinvolved in manufacture, importation, renovation, servicing, etc.

One of the authors of the Standard, Rob Portbury, will also be in attendance to assist with member technicalqueries. It is recommended that those involved in day-to-day interpretation of the BCA obtain a personal copyof the Standard and make themselves familiar with all relevant clauses.

Members may also elect to bring their building surveyor along. A copy of the Practice Note will be circulated toall members as soon as it's published (anticipated within the next 10 days). Australian Consumer Law now appliesOn 1 January 2011 the Trade Practices Act 1974 was renamed the Competition and Consumer Act 2010. TheAustralian Consumer Law comprises Schedule 2 of that Act and also took effect on 1 January.

Sales practices - what you need to knowBusinesses need to ensure that they trade fairly and honestly with consumers to promote genuine competition.The new sales practices laws cover unsolicited supplies, unsolicited consumer agreements, pyramid schemes,multiple pricing, lay-by agreements, referral selling, harassment and coercion, and proof of transaction anditemised bills.

Unsolicited suppliesIt is unlawful to:

request payment for unsolicited goods or services request payment for unauthorised entries or advertisements send unsolicited credit cards or debit cards.

A business or person must not issue an invoice that states an amount to be paid for unsolicited goods orservices, unless:

they reasonably believe they have a right to be paid, or the invoice contains the warning required by law:

This is not a bill. You are not required to pay any money. This warning must be the mostprominent text in the document.

Unsolicited consumer agreementsSalespeople who engage in direct marketing with consumers, for example, door-to-door selling ortelemarketing, in order to sell them goods or services must comply with:

limited hours for contact with consumers disclosure requirements before and when entering into an agreement criteria for the sales agreement requirements, including that it must be in writing restrictions on supply and requesting payment during the cooling-off period.

Consumers have 10 business days to change their mind and cancel the contract (cool off). They can alsocancel the contract within 3 or 6 months if the supplier has not met certain obligations.

The Corporations Act 2001(Cth) prohibits unsolicited hawking of securities, certain financial products andmanaged investment products. More information is available from the Australian Securities and InvestmentsCommission at www.asic.gov.au

Pyramid schemesPyramid schemes make money by recruiting people rather than by selling a legitimate product or providing aservice. Pyramid schemes are illegal.

A business or person must not participate in, or persuade others to participate in, a pyramid scheme.

PricingMultiple pricing - a supplier who displays more than one price for the same goods must either:

sell the goods for the lowest 'displayed price', or withdraw the goods from sale until the price is corrected.

A price published in a catalogue or advertisement is also considered a 'displayed price'. Mistakes incatalogues and advertisements can be fixed by publishing a retraction in a publication with a similar circulationto the original advertisement.

Component pricing - a supplier must not promote or state a price that is only part of the cost of goods orservices, unless also prominently advertising the single (total) price.

Lay-by agreementsLay-by agreements must be in writing, expressed in plain language, legible and clearly presented.A consumer can cancel a lay-by agreement but may have to pay a termination charge.A supplier may only cancel a lay-by agreement under certain circumstances.

Referral sellingPromising future commissions or rebates that depend on other events - for example, subsequent sales - isillegal in certain circumstances.

It is unlawful to persuade a consumer to buy goods or services by promising benefits for assisting the supplyof goods or services to other customers.

Harassment and coercionIt is unlawful to use physical force, coerce or unduly harass someone about the supply of, or payment for,goods or services.

Proof of transaction and itemised billsSuppliers must provide proof of transaction to consumers for goods or services valued at $75 or more. A GSTtax invoice, cash register receipt, credit/debit card statement or a receipt number provided for a telephone orinternet transaction is sufficient proof of transaction. Consumers may request an itemised bill for services thatshows how the price was calculated.

Warranties, refunds, repairs and consumer guaranteesA consumer has rights under the consumer guarantees, regardless of any other warranty.

October 2010 Electrical Safety Approval of Spas I am contacting you and other Spa suppliers in Victoria to inform them of the requirements to supply safe and approved Spas in Australia. Unfortunately some Spa suppliers think that it is only necessary to fit approved Spa components, but as you will see below, complete transportable Spas must also be Approved and marked as such. Prescribing Order According to AS/NZS 4417:2009 ‘Specific requirements for electrical safety regulatory applications’, Section B2.48 Swimming pool or spa equipment, - including transportable Spa Pools (not drained after use) & Spas Baths (drained after use), are listed as prescribed electrical equipment. This means they must be Tested & have Australian Approval. Testing The complete transportable Spa(s) must comply with AS/NZS 60335.2.60 ‘Particular requirements for whirlpool baths and whirlpool spas’ which includes tests for such things as Leakage Current & Temperature Rise, and the Spas shall be constructed so that hair cannot be drawn into apertures due to water suction if this could result in a hazard. (This involves testing by a NATA Registered Laboratory on a complete SPA assembly. The preferred option is to also use electric Blowers, Pumps, Heaters & Controllers which have individual approval. This allows the supplier to sell the separately approved components as spare parts, or alternatively fit another approved model - if it has the same rating.) Approval Once the Spa supplier has compliant Test Report(s) for the Spas they wish to sell in Australia, they must apply for Approval and submit the Test Report(s) to an Approving Authority like Energy Safe Victoria. Once Approval is granted they will be issued with a Certificate of Approval, containing an Approval number or marking, which must be clearly displayed on the Spa. Markings Each piece of prescribed electrical equipment must include the Markings required by Clause 7 of AS/NZS 60335.1 ‘General requirements’ including: Name of Supplier, Tradename, Model Number/Name, Voltage (Vac or 50Hz), Amps and/or Watts, IP Rating & Approval Marking. The markings must be legibly and indelibly printed on a Nameplate Label which is able to withstand exposure to the expected climatic conditions and possible chemical contact, for the life of the product. The Approval marking or Regulatory Compliance Mark (RCM) according to AS/NZS 4417.1 should be placed on the external surface of the product as near as practical to the Model identification. If the Tradename and IP rating are not shown on some other external surface, they should be included on the nameplate label together with the Model and Approval marking. This also allows a prospective purchaser to easily check that the whole Spa is approved, as required. (And possibly the C-tick symbol for EMC approval.) Electricity Safety Act 1998 You are advised that under the Electricity Safety Act 1998, there are penalties for supplying unsafe electrical equipment or prescribed electrical equipment without Approval. To avoid prosecution, please make sure the Certificate of Approval lists all the Trade names and Models you supply, and that the Approval marking is shown on each Spa. (To check for compliance with the Act, Enforcement Officers will be visiting Spa dealers throughout the year and will issue ‘Stop Sales’ letters and possibly ‘Infringement Notices’ to any supplier of Spas without evidence of Approval.)
