– Feminism and restorative justice
What do you think Feminism will believe is the solutions to crime? Which ones will they feel a focus is need on?
THE DIFFERING BRANCHES OF FEMINISM DIFFER GREATLY ON SUCH AREAS.....
However the over view is as follows:
Policies aimed at protecting women from male violence and routine harassment are favoured by Feminists.
The police need to prioritize the victimization of
women in the form of domestic violence, sexual attack and harassment and to deal with these issues in a more sensitive manner.
Feminists believe that the law needs to do more
to protect women
FEMINISTS: MAIN CONCERN RAPE AND SEXUAL ATTACK
Feminist solutions to this: Safer streets by ensuring adequate street
lighting. Encourage women to carry rape alarms Encourage women to take self- defense classes.
They DO NOT AGREE with the following advice to women to solve rape:
Do not go out alone. Do not travel on public transport at night. Do not use alleyways
FEMINISTS ACTIVELY CAMPAIGN FOR:
The police to be better trained to deal with victims. That there should be more specialist centers to help
women give their accounts. There should be better recording of the forensic
evidence. Women should not be put on trial when she enters
the court. The preservation of the victims anonymity where
possible. More rape crisis centers More domestic abuse centres. Legislation on sexual harassment at work Legislation on equal pay at work.
HOW FEMINISM HAS HAD AN IMPACT ON GOVERNMENT POLICY:
There ARE now more rape examination suites and case are now more personally dealt with by female officers.
However Newburn argues that there has been a decline in the number of rape crisis centres whilst there has been an increase in the number of reported rapes.
EVALUATION
RESTORATIVE JUSTICE Solutions to crime:
In contrast to incarceration and retribution a new model of justice is developing. Christie puts forward the concept of RESTORATIVE JUSTICE which puts the victim and the community at the heart of the solution s to crime.
The 3 elements of restorative justice are:
It seeks to put right the harm that has been done.
It seeks to balance the need of the victim with the need for accountability fo the offender
It seeks to ensure that the victim is involved in the decision making process.
According to the Home Office the process of restorative justice is based on tth 3 R;s:
Restoration – offenders should apologies and make amends for the harm done.
Reintegration – offenders should be brought back into the community after they have paid their dept.
Responsibility – offenders take responsibility for the consequences of their actions.
LINK TO GOVERNMENT POLICY:
Restorative justice has influenced many government policy initiatives such as:
Victim- Offender mediation. Citizens panels and community boards. Sentencing circles Conferencing and court-based schemes.
