RESOLVED toimplementthisEuropeanUnion onthebasis,firstly,oftheCommunitiesoperatinginaccordancewiththeirownrulesand,secondly,ofEuropeanCooperationamongtheSignatoryStatesinthesphereofforeignpolicyandtoinvestthisunionwiththenecessarymeansofaction,
DETERMINEDtoworktogethertopromotedemocracyonthebasisofthefundamentalrightsrecognizedintheconstitutionsandlawsoftheMemberStates,intheConventionfortheProtectionofHumanRightsandFundamentalFreedomsandtheEuropeanSocialCharter,notablyfreedom,equalityandsocialjustice,
CONVINCEDthattheEuropeanidea,theresultsachievedinthefieldsofeconomicintegrationandpoliticalcooperation,andtheneedfornewdevelopmentscorrespondtothewishesofthedemocracticpeoplesofEurope,forwhom theEuropeanParliament,electedbyuniversalsuffrage,isanindispensablemeans ofexpression,
AWAREoftheresponsibilityincumbentuponEuropetoaimatspeakingeverincreasinglywithonevoiceandtoactwith consistencyandsolidarityinordermore effectivelytoprotectitscommoninterestsandindependence,inparticulartodisplaytheprinciplesofdemocracyandcompliancewiththelawandwithhumanrightstowhich theyareattached,sothattogethertheymay make theirowncontributiontothepreservationofinternationalpeaceandsecurityinaccordancewiththeundertakingenteredintobythemwithintheframeworkoftheUnitedNationsCharter,
DETERMINEDtoimprovetheeconomicandsocialsituationbyextendingcommonpoliciesandpursuingnewobjectives,andtoensureasmootherfunctioningoftheCommunitiesbyenablingtheInstitutionstoexercisetheirpowersunderconditionsmostinkeepingwithCommunityinterests,
WHEREAS attheirConferenceinParisfrom19to21October1972theHeadsofStateorofGovernment
approvedtheobjectiveoftheprogressiverealizationofEconomicandMonetary Union,
HAVINGREGARDtotheAnnextotheconclusionsofthePresidencyoftheEuropeanCouncilinBremenon6and7July1978andtheresolutionoftheEuropeanCouncil inBrusselson5December 1978ontheintroductionoftheEuropeanMonetary System(EMS)andrelatedquestions,andnotingthatinaccordance

withthatResolution,theCommunityandtheCentralBanksoftheMember Stateshavetakenanumberofmeasuresintendedtoimplementmonetarycooperation,

TITLEI
COMMONPROVISIONS
President of the Commission of the EuropeanCommunities.TheyshallbeassistedbytheMinisters forForeignAffairsandbyaMemberoftheCommission.
TheEuropeanCouncilshallmeetatleasttwiceayear.
Article 1
The European Communities and European PoliticalCo-operationshallhaveastheirobjectivetocontributetogethertomaking concreteprogresstowardsEuropeanunity.
The European Communities shallbefoundedontheTreaties establishing theEuropean Coal und SteelCommunity,theEuropean Economic Community,theEuropean Atomic Energy Community and on thesubsequentTreatiesandActsmodifyingorsupplementingthem.
PoliticalCo-operationshallbegovernedbyTitleIII. TheprovisionsofthatTitleshallconfirmandsupplementtheproceduresagreedinthereportsofLuxembourg(1970),Copenhagen (1973), London (1981), the SolemnDeclarationonEuropeanUnion (1983)andthepracticesgraduallyestablishedamongtheMemberStates.
Article 2
TheEuropeanCouncilshallbringtogethertheHeadsofStateorofGovernmentoftheMember Statesandthe

1. The institutionsof theEuropean Communities,henceforth designated as referredtohereafter, shallexercisetheirpowersandjurisdictionundertheconditionsand forthepurposesprovided forby theTreatiesestablishingtheCommunities andby thesubsequentTreatiesandActsmodifyingorsupplementingthemandbytheprovisionsofTitleII.
2. TheinstitutionsandbodiesresponsibleforEuropeanPolitical Co-operation shallexercisetheirpowersandjurisdictionundertheconditionsandforthepurposeslaiddowninTitleIIIandinthedocumentsreferredtointhe
thirdparagraphofArticle1.
TITLEII

CHAPTERI
PROVISIONSAMENDING THE TREATY ESTABLISHING
THEEUROPEANCOALANDSTEELCOMMUNITY
notbecompetenttohearanddetermineactionsbrought by Member States or by CommunityInstitutionsorquestionsreferredforapreliminaryrulingunderArticle41.
Article 4
The ECSC Treaty issupplementedby thefollowingprovisions:
'Article32d
1. AttherequestoftheCourtofJusticeandafterconsulting the Commission and the EuropeanParliament,theCouncil may, actingunanimously,attachtotheCourtofJusticeacourtwithjurisdictiontohearanddetermineatfirstinstance,subjecttoarightofappealtotheCourtofJusticeonpointsoflawonlyandinaccordancewiththeconditionslaiddownbytheStatute,certainclassesofactionorproceedingbroughtbynaturalorlegalpersons.Thatcourtshall
2. TheCouncil,followingtheprocedurelaiddowninparagraph1,shalldeterminethecompositionofthatcourt and adopt thenecessary adjustments andadditionalprovisionstotheStatuteoftheCourtofJustice. Unless theCouncil decidesotherwise,theprovisionsofthisTreatyrelatingtotheCourt ofJustice,inparticulartheprovisionsoftheProtocolontheStatuteoftheCourtofJustice,shallapplytothatcourt.
3. Themembersofthatcourtshallbechosenfrom
personswhoseindependenceisbeyonddoubtandwhopossesstheabilityrequiredforappointmenttojudicialoffice;theyshallbeappointedbycommonaccordoftheGovernmentsoftheMemberStatesforatermofsix
years.Themembershipshallbepartiallyrenewedevery

threeyears. Retiring members shallbeeligibleforreappointment.
4. ThatcourtshallestablishitsrulesofprocedureinagreementwiththeCourtofJustice.ThoserulesshallrequiretheunanimousapprovaloftheCouncil.'.
Article 5
'Aftertheendofthesecondstage,however,theCouncilshall,actingbyaqualifiedmajorityonaproposalfromtheCommissionandinco-operationwiththeEuropeanParliament,issuedirectivesfortheco-ordinationofsuchprovisionsas,ineachMemberState,areamatterforregulationoradministrativeaction.'.
6. InArticle57(1)oftheEECTreatytheterms'andafterconsultingtheAssembly'shallbereplacedby'andinco-operationwiththeEuropeanParliament'.
7. InArticle57(2)oftheEECTreaty,thethirdsentenceshallbereplacedbythefollowing:
'InothercasestheCouncilshallactbyaqualifiedmajority, in co-operation with the EuropeanParliament.'.
Article 45oftheECSCTreatyissupplementedbythefollowingparagraph:
TheCouncilmay,actingunanimouslyattherequestofthe Court of Justice and after consulting theCommissionandtheEuropeanParliament,amendtheprovisionsofTitleIIIoftheStatute.'.
CHAPTERII
PROVISIONSAMENDING THE TREATY ESTABLISHING
THEEUROPEANECONOMICCOMMUNITY
Article 7
Article 149oftheEECTreatyshallbereplacedbythefollowingprovisions:
'Article149
1. Where,inpursuanceofthisTreaty,theCouncilactsonaproposalfromtheCommission,unanimityshallberequiredforanactconstitutinganamendmenttothatproposal.
2. Where,inpursuanceofthisTreaty,theCouncilactsinco-operationwiththeEuropeanParliament,thefollowingprocedureshallapply:
(a)TheCouncil,actingbyaqualifiedmajorityundertheconditionsofparagraph1,onaproposalfromtheCommissionandafterobtainingtheOpinionoftheEuropeanParliament,shalladoptacommonposition.
(b)The Council's common position shall becommunicatedtotheEuropeanParliament. TheCouncil andtheCommission shallinformthe
EuropeanParliamentfullyofthereasonswhichledtheCounciltoadoptitscommonpositionandalsooftheCommission'sposition.
If,withinthreemonthsofsuchcommunication,theEuropean Parliament approves this commonpositionorhasnottakenadecisionwithinthatperiod,theCouncilshalldefinitivelyadopttheactinquestioninaccordancewiththecommonposition.
(c)TheEuropeanParliamentmaywithintheperiodofthreemonthsreferredtoinpoint(b),byanabsolutemajority of itscomponent members, proposeamendmentstotheCouncil'scommonposition.TheEuropeanParliamentmay also,bythesamemajority,rejecttheCouncil'scommonposition.TheresultoftheproceedingsshallbetransmittedtotheCouncilandtheCommission.
SectionI
InstitutionalProvisions
Article 6
1. A co-operationprocedureshallbeintroducedwhichshallapplytoactsbasedonArticles7,49,54(2),56(2),secondsentence,57with theexceptionofthesecondsentenceofparagraph2thereof,100a,100b,118a,130eand130q(2)oftheEECTreaty.
2. InArticle7,secondparagraphoftheEECTreatytheterms'afterconsultingtheAssembly'shallbereplacedby'inco-operationwiththeEuropeanParliament'.
3. InArticle49oftheEECTreatytheterms'theCouncilshall,actingonaproposalfromtheCommissionandafterconsultingtheEconomicandSocialCommittee',shallbereplacedby'theCouncil shall, actingby aqualifiedmajority on a proposal fromtheCommission, inco-operationwith theEuropean ParliamentandafterconsultingtheEconomicandSocialCommittee'.
4. InArticle 54(2)oftheEECTreatytheterms'theCouncilshall,onaproposalfromtheCommissionandafterconsultingtheEconomicandSocialCommitteeandtheAssembly',shallbereplacedby'theCouncil shall,actingonaproposalfromtheCommission,incooperationwith theEuropeanParliamentandafterconsultingtheEconomicandSocialCommittee'.
5. InArticle56(2)oftheEECTreatythesecondsentenceisreplacedbythefollowing:

Article 10
Article145oftheEECTreatyshallbesupplementedbythefollowingprovision:
'— conferontheCommission,intheactswhichtheCounciladopts,powersfortheimplementationoftheruleswhich theCouncil laysdown. TheCouncil may imposecertain requirementsinrespectoftheexerciseofthesepowers. TheCouncil may alsoreservetheright,inspecificcases,toexercisedirectlyimplementingpowersitself.Theproceduresreferredtoabovemustbeconsonantwith principlesandrulestobelaiddown in advance by the Council, actingunanimouslyonaproposalfromtheCommissionandafterobtainingtheOpinionoftheEuropeanParliament.'.
IftheEuropean Parliament has rejectedtheCouncil'scommonposition,unanimityshallberequiredfortheCouncil toacton a secondreading.
(d)TheCommission shall,within aperiodofonemonth,re-examinetheproposalonthebasisofwhichtheCounciladopteditscommonposition,bytakingintoaccounttheamendmentsproposedbytheEuropeanParliament.
TheCommissionshallforwardtotheCouncil,atthesametimeasitsre-examinedproposal,theamendmentsoftheEuropeanParliamentwhichithasnotaccepted,andshallexpressitsopiniononthem.TheCouncilmay adopttheseamendmentsunanimously.
(e)TheCouncil,actingbyaqualifiedmajority,shalladopt the proposal as re-examined by theCommission.
Unanimity shallberequiredfortheCouncil toamend theproposal as re-examined by theCommission.
(f) Inthecasesreferredtoinpoints(c),(d)and(e),theCouncilshallberequiredtoactwithinaperiodofthreemonths.Ifnodecisionistakenwithinthis
period,theCommissionproposalshallbedeemednottohavebeenadopted.
(g)Theperiodsreferredtoinpoints(b)and(f)maybeextendedbyamaximumofonemonthbycommonaccordbetweentheCouncil andtheEuropeanParliament.
AslongastheCouncilhasnotacted,theCommissionmayalteritsproposalatanytimeduringtheproceduresmentionedinparagraphs1and2.'.
Article 11
TheEECTreatyshallbesupplementedbythefollowingprovisions:
'Article168a
1. AttherequestoftheCourtofJusticeandafterconsulting the Commission and the EuropeanParliament,theCouncil may, actingunanimously,attachtotheCourtofJusticeacourtwithjurisdictiontohearanddetermineatfirstinstance,subjecttoarightofappealtotheCourtofJusticeonpointsoflawonlyandinaccordancewiththeconditionslaiddownbytheStatute,certainclassesofactionorproceedingbroughtbynaturalorlegalpersons.Thatcourtshallnotbe competenttohearanddetermineactionsbrought by Member States or by CommunityInstitutionsorquestionsreferredforapreliminaryrulingunderArticle177.
2. TheCouncil,followingtheprocedurelaiddowninparagraph1,shalldeterminethecompositionofthatcourt and adopt thenecessary adjustments andadditionalprovisionstotheStatuteoftheCourtofJustice. Unless theCouncil decidesotherwise,theprovisionsofthisTreatyrelatingtotheCourt ofJustice,inparticulartheprovisionsoftheProtocolontheStatuteoftheCourtofJustice,shallapplytothatcourt.
3. Themembersofthatcourtshallbechosenfrom
personswhoseindependenceisbeyonddoubtandwhopossesstheabilityrequiredforappointmenttojudicialoffice;theyshallbeappointedbycommonaccordoftheGovernmentsoftheMemberStatesforatermofsix
years.Themembershipshallbepartiallyrenewedeverythreeyears. Retiring members shallbeeligibleforreappointment.
4. ThatcourtshallestablishitsrulesofprocedureinagreementwiththeCourtofJustice.ThoserulesshallrequiretheunanimousapprovaloftheCouncil.'.
Article 8
ThefirstparagraphofArticle237oftheEECTreatyshallbereplacedbythefollowingprovision:
'AnyEuropeanStatemayapplytobecomeamemberoftheCommunity.ItshalladdressitsapplicationtotheCouncil,whichshallactunanimouslyafterconsultingtheCommissionandafterreceivingtheassentoftheEuropeanParliamentwhich shallactbyanabsolutemajorityofitscomponentmembers.'.
Article 9
ThesecondparagraphofArticle238oftheEECTreatyshallbereplacedbythefollowingprovision:
'TheseagreementsshallbeconcludedbytheCouncil,actingunanimouslyandafterreceivingtheassentoftheEuropeanParliamentwhich shallactbyanabsolutemajorityofitscomponentmembers.'.

Article 12
AsecondparagraphwordedasfollowsshallbeinsertedinArticle188oftheEECTreaty:
'TheCouncilmay,actingunanimouslyattherequestoftheCourt of Justice and after consulting theCommissionandtheEuropeanParliament,amendtheprovisionsofTitleIIIoftheStatute.'.
'Article8c
When drawing up itsproposalswith aview toachievingtheobjectivessetoutinArticle 8a,theCommissionshalltakeintoaccounttheextentofthe
effortthatcertaineconomiesshowingdifferencesindevelopmentwillhavetosustainduringtheperiodofestablishmentoftheinternalmarketanditmayproposeappropriateprovisions.
Iftheseprovisionstaketheformofderogations,theymustbeofatemporarynatureandmustcausetheleastpossibledisturbancetothefunctioningofthecommonmarket.'.
SectionII
ProvisionsrelatingtothefoundationsandthepolicyoftheCommunity
Sub-sectionI— Internalmarket
Article 13
TheEECTreatyshallbesupplementedbythefollowingprovisions:
'Article8a
TheCommunityshalladoptmeasureswiththeaimofprogressivelyestablishingtheinternalmarket overaperiodexpiringon31December1992,inaccordancewiththeprovisionsofthisArticleandofArticles8b,8c,28,57(2),59,70(1),84,99,100aand100band
without prejudicetotheotherprovisionsofthisTreaty.
Theinternalmarket shallcompriseanareawithoutinternalfrontiersinwhichthefreemovementofgoods,persons,servicesandcapitalisensuredinaccordancewiththeprovisionsofthisTreaty.'.
Article 16
1. Article28oftheEECTreatyshallbereplacedbythefollowingprovisions:
'Article28
AnyautonomousalterationorsuspensionofdutiesinthecommoncustomstariffshallbedecidedbytheCouncilactingbyaqualifiedmajorityonaproposalfromtheCommission.'.
2. InArticle 57(2) oftheEEC Treaty,thesecondsentenceshallbereplacedbythefollowing:
'Unanimity shall be required for directives theimplementationofwhich involvesinatleastoneMemberStateamendmentoftheexistingprincipleslaiddownbylawgoverningtheprofessionswithrespecttotrainingandconditionsofaccessfornaturalpersons.'.
3. InthesecondparagraphofArticle 59oftheEECTreaty,'unanimously'shallbereplacedby'byaqualifiedmajority'.
4. InArticle 70(1) oftheEECTreaty,thelasttwosentencesshallbereplacedbythefollowing:
'ForthispurposetheCouncil shallissuedirectives,actingbyaqualifiedmajority.Itshallendeavourtoattainthehighestpossibledegreeofliberalization.Unanimity shall be requiredformeasures whichconstituteastepbackasregardstheliberalizationofcapitalmovements.'.
5. InArticle 84(2) oftheEEC Treaty, theterm'unanimously'shall be replacedby 'by a qualifiedmajority'.
6. Article84(2)oftheEECTreatyshallbesupplementedbythefollowingparagraph:
'TheproceduralprovisionsofArticle 75(1)and(3)shallapply.'.
Article 14
TheEECTreatyshallbesupplementedbythefollowingprovisions:
'Article8b
TheCommissionshallreporttotheCouncilbefore31December1988andagainbefore31December1990ontheprogressmade towardsachievingtheinternalmarketwithinthetimelimitfixedinArticle8a.
The Council,actingbyaqualifiedmajority onaproposalfromtheCommission,shalldeterminetheguidelinesandconditionsnecessarytoensurebalancedprogressinallthesectorsconcerned.'.
Article 15
TheEECTreatyshallbesupplementedbythefollowingprovisions:

Article 99oftheEECTreatyshallbereplacedbythefollowingprovisions:

5. The harmonizationmeasures referredtoabove
shall,inappropriatecases,includeasafeguardclauseauthorizingtheMemberStatestotake,foroneormoreofthenon-economicreasonsreferredtoinArticle36,
provisionalmeasuressubjecttoaCommunitycontrolprocedure.'.
'Article99
TheCouncilshall,actingunanimouslyonaproposalfrom theCommission and after consulting theEuropean Parliament, adopt provisions for theharmonizationoflegislationconcerningturnovertaxes,excisedutiesandotherformsofindirecttaxationtothe
extentthatsuchharmonizationisnecessarytoensuretheestablishmentandthefunctioningoftheinternalmarketwithinthetimelimitlaiddowninArticle8a.'.
Article 19
TheEECTreatyshallbesupplementedbythefollowingprovisions:
'Article100b
1. During1992,theCommissionshall,togetherwitheachMember State,drawupaninventoryofnationallaws,regulationsandadministrativeprovisionswhichfallunderArticle 100aandwhich havenotbeen
harmonizedpursuanttothatArticle.
TheCouncil,actinginaccordancewiththeprovisionsofArticle100a,maydecidethattheprovisionsinforceinaMember State must be recognizedasbeingequivalenttothoseappliedbyanotherMemberState.
2. TheprovisionsofArticle100a(4)shallapplybyanalogy.
3. The Commission shalldrawuptheinventoryreferredtointhefirstsubparagraphofparagraph1andshallsubmitappropriateproposalsingoodtimetoallowtheCounciltoactbeforetheendof1992.'.
Article 18
TheEECTreatyshallbesupplementedbythefollowingprovisions:
'Article100a
1. BywayofderogationfromArticle100andsavewhereotherwiseprovidedinthisTreaty,thefollowingprovisionsshallapplyfortheachievementoftheobjectivessetoutinArticle 8a. TheCouncil shall,actingbyaqualifiedmajorityonaproposalfromtheCommission in co-operation with the EuropeanParliamentandafterconsultingtheEconomic andSocial Committee, adopt the measures for theapproximationoftheprovisionslaiddownbylaw,regulationoradministrativeactioninMember Stateswhich haveastheirobjecttheestablishmentandfunctioningoftheinternalmarket.
2. Paragraph1shallnotapplytofiscalprovisions,tothoserelatingtothefreemovementofpersonsnortothoserelatingtotherightsandinterestsofemployedpersons.
3. TheCommission,initsproposalsenvisagedinparagraph1 concerninghealth,safety,environmentalprotectionandconsumerprotection,willtakeasabaseahighlevelofprotection.
4. If,aftertheadoptionofaharmonizationmeasurebytheCouncil actingby aqualifiedmajority, aMember StatedeemsitnecessarytoapplynationalprovisionsongroundsofmajorneedsreferredtoinArticle36,orrelatingtoprotectionoftheenvironmentor theworking environment, itshall notify theCommissionoftheseprovisions.
TheCommissionshallconfirmtheprovisionsinvolvedafterhavingverifiedthattheyarenotameans ofarbitrarydiscriminationoradisguisedrestrictionontradebetweenMemberStates.

1. Member Statesshallpayparticularattentiontoencouragingimprovements,especiallyintheworkingenvironment, asregardsthehealth andsafetyofworkers, and shall set as their objective theharmonization of condition in thisarea, whilemaintainingtheimprovementsmade.
2. Inordertohelpachievetheobjectivelaiddowninthefirstparagraph,theCouncil,actingbyaqualifiedmajority onaproposalfromtheCommission, inco-operationwiththeEuropeanParliamentandafterconsultingtheEconomicandSocialCommittee,shalladopt,bymeansofdirectives,minimumrequirementsforgradualimplementation, havingregardtotheconditionsandtechnicalrulesobtainingineachoftheMemberStates.

Member Statesshallconducttheireconomicpolicies,andshallcoordinatethem,insuchaway as,inaddition,toattaintheobjectivessetoutinArticle130a.TheimplementationofthecommonpoliciesandoftheinternalmarketshalltakeintoaccounttheobjectivessetoutinArticle130aandinArticle130candshall

TheEuropeanRegionalDevelopmentFundisintendedtohelpredresstheprincipalregionalimbalancesintheCommunitythroughparticipatinginthedevelopmentand structural adjustment of regions whosedevelopmentislaggingbehindandintheconversionofdecliningindustrialregions.

TheEECTreatyshallbesupplementedbythefollowingprovision:

InpursuingtheseobjectivestheCommunityshallcarryout the following activities, complementing theactivitiescarriedoutintheMemberStates:
(a)implementation of research, technologicaldevelopmentanddemonstrationprogrammes,bypromotingco-operationwithundertakings,researchcentresanduniversities;
(b)promotion of co-operation in the field ofCommunity research,technologicaldevelopment,and demonstration with thirdcountries and
internationalorganizations;
(c)disseminationandoptimizationoftheresultsofactivitiesinCommunity research,technologicaldevelopment,anddemonstration;
(d)stimulation of thetrainingand mobility ofresearchersintheCommunity.
Article130e
After adoption of the decision referred to inArticle 130d,implementingdecisionsrelatingtotheEuropeanRegionalDevelopmentFundshallbetakenbytheCouncil,actingbyaqualifiedmajority onaproposalfromtheCommissionandinco-operationwiththeEuropeanParliament.
With regardtotheEuropeanAgricultural Guidanceand Guarantee Fund, Guidance Section and theEuropeanSocialFund,Articles43,126and127remainapplicablerespectively.'.

2. Action by the Community relating to theenvironmentshallbebasedontheprinciplesthatpreventiveactionshouldbetaken,thatenvironmentaldamageshouldasapriorityberectifiedatsource,andthatthepollutershouldpay.EnvironmentalprotectionrequirementsshallbeacomponentoftheCommunity'sotherpolicies.
3. Inpreparingitsactionrelatingtotheenvironment,theCommunityshalltakeaccountof:

1. At therequestoftheCourtofJusticeandafterconsulting the Commission and the EuropeanParliament,theCouncil may, actingunanimously,attachtotheCourtofJusticeacourtwithjurisdictiontohearanddetermineatfirstinstance,subjecttoarightofappealtotheCourtofJusticeonpointsoflawonlyandinaccordancewiththeconditionslaiddownbytheStatute,certainclassesofactionorproceedingbroughtbynaturalorlegalpersons.Thatcourtshallnotbe competenttohearanddetermineactionsbrought by Member States or by CommunityInstitutionsorquestionsreferredforapreliminaryrulingunderArticle150.

3. Themembersofthatcourtshallbechosenfrom
personswhoseindependenceisbeyonddoubtandwhopossesstheabilityrequiredforappointmenttojudicialoffice;theyshallbeappointedbycommonaccordoftheGovernmentsoftheMemberStatesforatermofsix
years.Themembershipshallbepartiallyrenewedeverythreeyears. Retiring members shallbeeligibleforreappointment.
4. ThatcourtshallestablishitsrulesofprocedureinagreementwiththeCourtofJustice.ThoserulesshallrequiretheunanimousapprovaloftheCouncil.'.

5. Within theirrespectivespheresofcompetence,theCommunityandtheMember Statesshallco-operatewiththirdcountriesandwiththerelevantinternational
organizations. The arrangements for Communityco-operationmaybethesubjectofagreementsbetweentheCommunityandthethirdpartiesconcerned,whichshallbenegotiatedandconcludedinaccordancewithArticle228.
ThepreviousparagraphshallbewithoutprejudicetoMember States' competence to negotiate ininternationalbodies andtoconcludeinternational
agreements.
Article130s
TheCouncil,actingunanimouslyonaproposalfromtheCommission andafterconsultingtheEuropeanParliamentandtheEconomicandSocialCommittee,shalldecide what actionistobe takenby theCommunity.

TREATYPROVISIONSONEUROPEANCO-OPERATIONINTHESPHEREOFFOREIGN

Article 30
EuropeanCo-operationinthesphereofforeignpolicyshallbegovernedbythefollowingprovisions:
1. TheHighContractingParties,beingmembersoftheEuropeanCommunities,shallendeavourjointlytoformulateandimplementaEuropeanforeignpolicy.
2. (a)TheHighContractingPartiesundertaketoinformandconsulteachotheronanyforeignpolicymattersofgeneralinterestsoastoensurethattheircombinedinfluenceisexercisedaseffectivelyaspossiblethroughco-ordination,theconvergenceoftheirpositionsandtheimplementationofjointaction.
3. (a)TheMinistersforForeignAffairsandamemberoftheCommissionshallmeetatleastfourtimesa
yearwithintheframeworkofEuropeanPoliticalCo-operation.Theymayalsodiscussforeignpolicymatters within the framework of Political
Co-operationontheoccasionofmeetingsoftheCounciloftheEuropeanCommunities.
(b)TheCommissionshallbefullyassociatedwiththeproceedingsofPoliticalCo-operation.
(c)Inordertoensuretheswiftadoptionofcommonpositionsandtheimplementationofjointaction,theHigh Contracting Parties shall,asfaraspossible,refrainfromimpedingtheformationofaconsensusandthejointactionwhichthiscouldproduce.
4. TheHigh ContractingPartiesshallensurethattheEuropean Parliament is closely associated withEuropeanPoliticalCo-operation. TothatendthePresidency shall regularlyinformtheEuropeanParliamentoftheforeignpolicyissueswhicharebeingexamined within the framework of Political
Co-operationandshallensurethattheviewsoftheEuropean Parliament are duly taken intoconsideration.
(b)Consultations shalltakeplacebeforetheHighContractingPartiesdecideontheirfinalposition.
(c)InadoptingitspositionsandinitsnationalmeasureseachHighContractingPartyshalltakefullaccountofthepositionsoftheotherpartnersandshallgivedueconsiderationtothedesirabilityofadoptingandimplementingcommonEuropeanpositions.
Inordertoincreasetheircapacityforjointactionintheforeignpolicyfield,theHighContractingPartiesshallensurethatcommonprinciplesandobjectivesaregraduallydevelopedanddefined.
The determinationofcommonpositionsshallconstituteapointofreferenceforthepoliciesoftheHighContractingParties.
(d)TheHighContractingPartiesshallendeavourtoavoidanyactionorpositionwhichimpairstheireffectivenessasacohesiveforceininternational
relationsorwithininternationalorganizations.
5. TheexternalpoliciesoftheEuropeanCommunityandthepoliciesagreedinEuropeanPoliticalCo-operationmustbeconsistent.
ThePresidencyandtheCommission,eachwithinitsown sphere of competence, shall have specialresponsibilityforensuringthatsuchconsistencyissoughtandmaintained.
6. (a)TheHighContractingPartiesconsiderthatcloserco-operationonquestionsofEuropeansecuritywould contributeinanessentialway tothedevelopmentofaEuropeanidentityinexternal

policymatters.Theyarereadytoco-ordinatetheirpositions more closely on thepolitical andeconomicaspectsofsecurity.
(b)TheHighContractingPartiesaredeterminedtomaintain the technological and industrialconditionsnecessaryfortheirsecurity.Theyshallworktothatendbothatnationalleveland,whereappropriate, within the framework of thecompetentinstitutionsandbodies.
(c)Nothing in this Title shall impede closerco-operationinthefieldofsecuritybetweencertainof theHigh Contracting Parties within theframeworkoftheWesternEuropeanUnionortheAtlanticAlliance.
(b)ThePresidencyshallberesponsibleforinitiatingactionandcoordinatingandrepresentingthepositionsoftheMember StatesinrelationswiththirdcountriesinrespectofEuropeanPoliticalCo-operationactivities.ItshallalsoberesponsibleforthemanagementofPoliticalCo-operationandinparticularfordrawingupthetimetableofmeetings and forconvening and organizingmeetings.
(c)ThePoliticalDirectorsshallmeetregularlyinthePoliticalCommitteeinordertogivethenecessaryimpetus,maintain thecontinuityofEuropeanPolitical Co-operation andprepare Ministers'discussions.
(d)The Political Committee or, ifnecessary, aministerialmeetingshallconvenewithin48hours
.attherequestofatleastthreeMemberStates.
(e)TheEuropeanCorrespondents'Group shallberesponsible,underthedirectionofthePoliticalCommittee,formonitoringtheimplementationofEuropeanPoliticalCo-operationandforstudyinggeneralorganizationalproblems.
(f) Working groupsshallmeet asdirectedbythePoliticalCommittee.
7. (a)Ininternationalinstitutionsandatinternationalconferences which they attend, the HighContracting Parties shallendeavourtoadoptcommonpositionsonthesubjectscoveredbythisTitle.
(b)IninternationalinstitutionsandatinternationalconferencesinwhichnotalltheHighContractingPartiesparticipate,thosewhodoparticipateshalltakefullaccountofpositionsagreedinEuropeanPoliticalCo-operation.
8. TheHighContractingPartiesshallorganizeapoliticaldialoguewiththirdcountriesandregionalgroupingswhenevertheydeemitnecessary.
(g)A SecretariatbasedinBrussels shallassistthePresidency inpreparingandimplementingtheactivitiesofEuropeanPoliticalCo-operationandinadministrativematters.ItshallcarryoutitsdutiesundertheauthorityofthePresidency.
9. TheHighContractingPartiesandtheCommission,throughmutual assistanceandinformation, shallintensifyco-operationbetweentheirrepresentationsaccreditedtothirdcountriesandtointernational
organizations.
11. Asregardsprivilegesandimmunities,themembersoftheEuropeanPoliticalCooperationSecretariatshallbetreatedinthesameway asmembers ofthediplomaticmissionsoftheHighContractingPartiesbasedinthesameplaceastheSecretariat.
12. FiveyearsaftertheentryintoforceofthisActtheHighContractingPartiesshallexaminewhetheranyrevisionofTitleIIIisrequired.
10. (a)ThePresidencyofEuropeanPoliticalCo-operationshallbeheldbytheHighContractingPartywhichholds thePresidency of theCouncil oftheEuropeanCommunities.
