A summary of the decisions taken at the 90th session of the Maritime Safety Committee (MSC 90)
held from 16th ~ 25th May 2012 is presented hereunder for your information.
1. Adopted Mandatory Requirements
The main mandatory requirements adopted at the session are as follows:

9 Carriage of Dangerous goods – Amendments to the International
Maritime Dangerous Goods Code (IMDG Code) and supplements
(amendment 36-12) were adopted, in which 11 new items are
added based on the United Nation’s recommendations on the
Transport of Dangerous Goods (17th revised edition) and specific
dangerous goods are clarified to which relaxation provisions
regarding transport documents are applicable.

10 High speed craft – Amendments to Regulation 14 of the
International Code of Safety for High-Speed Craft, 2000 (2000
HSC Code) were adopted, in which the requirements for the
annual survey for EPIRB installed on passenger ships are
clarified.

2. Passenger Ship Safety
In the wake of Costa Concordia incident, which occurred in January 2012 in Italy, the subject item
was hastily added to the agenda for this session for the purpose of reviewing the standard
regarding the safety of passenger ships.
The preliminary investigation report on the accident by the Government of Italy and Cruise Lines
International Association (CLIA) introduced the emergency safety plans voluntarily implemented by
the industry.
Based on the above, discussions were held on the future course of action regarding the safety of
passenger ships. Consequently, it was agreed to classify the countermeasures into two categories:
1) Operational safety measures to be implemented immediately (short-term measures); and
2) Safety measures to be implemented after examination based on the results of the
investigation into the accident (long-term measures).
In accordance with the above, an MSC Resolution was adopted and an MSC Circular regarding
the tentative recommendations for the securing of safety of passenger ships was approved. The
recommended interim operational measures include:

• carrying additional lifejackets, to be readily accessible in public spaces, at the
muster/assembly stations, on deck or in lifeboats, so that in the event of an emergency
passengers need not return to their cabins to retrieve the lifejacket stored there;
• reviewing the adequacy of the dissemination and communication of the emergency
instructions on board ships;
• carrying out the muster for embarking passengers prior to departure from every port of
embarkation, if the duration is 24 hours or more;
• limiting access to the bridge to those with operational or operationally related functions, during
any period of restricted manoeuvring, or while manoeuvring in conditions that the master or
company bridge procedures/policy deems to require increased vigilance (e.g. arrival/departure
from port, heavy traffic, poor visibility); and
• ensuring that the ship's voyage plan has taken into account IMO’s Guidelines for voyage
planning, and, if appropriate, Guidelines on voyage planning for passenger ships operating in
remote areas. 3. Goal-based Standards Implementation
There are two aspects of IMO current work on Goal-Based Standard (GBS)
1) Application of GBS to new construction of the hull structures of bulk carriers and oil tankers,
in accordance with the new SOLAS regulation II-1/3-10 adopted by Res. MSC.290(87).
2) How to develop the framework to apply GBS to a wider range of regulations and in particular
how to use the safety level approach.
MSC 90 considered both and had established a Correspondence Group on Goal-Based Standards
to develop draft guidelines for the approval of equivalents and alternatives as provided for in
various IMO instruments, and endorsed a work plan for the development of interim guidelines for
the safety level approach. A working group on goal-based standards will be established at MSC 91
to further consider matters related to the safety level approach and the draft guidelines to be
developed by the correspondence group.

4. Piracy Issues
Against the backdrop of the recent escalation of piracy incidents off the coast of Somalia and the
Gulf of Aden, the deployment of Privately Contracted Armed Security Personnel (PCASP) and the
carriage of arms onboard vessels sailing in the above areas are increasing. Discussions of policy
matters related to the arms on board ships in the piracy high risk area and to develop international
guidelines regarding contracted PCASP and Private Maritime Security Companies (PMSC) which
supply such personnel/security personnel as well as guidance for shipowners, ship operators and
shipmasters; flag States; and port and coastal States on the use and acceptances of PCASP so as
to comply with the legal regulations of each flag state, port state, and coastal country.
As a result, guidance for PMSC supplying armed security service was adopted and notified to
member states. The guidance covers:
• PMSC Professional Certification; including the recommendation that PMSC should seek
certification with relevant national and international private maritime security service standards
when these are established;
• PMSC Company requirements; including the recommendation that PMSC should establish
procedures to provide maritime security services to ship owners and ship operators and
comply with all relevant legal requirements;
• Management, including recommendations on selection, vetting and training of personnel for a
PCASP team;
• Deployment considerations, addressing the specific aspects of PCASP deployment and the
role of the PMSC in ensuring efficient and successful deployments, including communications
with the ship owner or operator, and including recommendations relating to management of
firearms and ammunition from embarkation to disembarkation and use of force. (The PMSC
should recognize that laws governing the use of force may differ over time and according to
location. The applicable national law, including any criminal laws, for an incident on a ship
from which PCASP will be operating will be principally that of the flag State. It may also include
the laws and regulations of coastal, port and other States.)

5. Other Issues
Safety of Navigation:
• Adopted revised performance standards for voyage data recorders (VDRs) to update the
current performance standards (Res. A.861(20), as amended by resolution MSC.214(81)) and
provide for VDRs to continuously maintain sequential records of preselected data items
relating to the status and output of the ship's equipment, and command and control of the ship
in a fixed recording medium; a float-free recording medium; and a long-term recording
medium. (MSC. 333(90)) – 01 July 2014
• Approved unified Interpretations of the Convention on the International Regulations for
Preventing Collisions at Sea, 1972, as amended (COLREG), relating to navigation-light
arrangements to provide interpretation on Horizontal and Vertical sector regulated in Annex
I/9(a)(i) and 10(a)(i) of COLREG. (MSC. 1/Circ.1427 – 01 July 2013
• MSC resolution on amendments to performance standards for speed and distance measuring
equipment, to add a new paragraph referring to the need for two separate devices, if ships are
required to carry speed logs measuring speed through the water and speed over the ground.
Also, approved a related draft MSC circular on the interpretation of SOLAS regulation
V/19.2.9.2, to clarify the requirement for two separate devices. (MSC. 334(90)) – 01 July 2014

• Approved MSC circular on Pilot transfer arrangements, which includes a revised graphic
depiction of required boarding arrangements for pilots, reflecting amendments adopted to
SOLAS regulation V/23 by MSC 88 in 2010 and Assembly resolution A.1045(27) on Pilot
transfer arrangements. (MSC. 1/Circ.1428)
• Adopted several new and amended ships' routeing measures.
Life-Saving Appliances
• Approved, for adoption at MSC 91, new draft SOLAS requirements (new regulation III/17-1) to
require ships to have plans and procedures to recover persons from the water, as well as
related Guidelines for development of plans and procedures for recovery of persons from the
water. Also, approved a draft MSC resolution on Implementation of SOLAS regulation III/17-1
to ships other than those engaged in international voyages.

• Approved MSC circulars on
o Revised Guidelines for the design and approval of fixed water-based fire-fighting
systems for ro-ro spaces and special category spaces (MSC. 1/Circ. 1430);
o Guidelines for the approval of helicopter facility foam fire-fighting appliances (MSC.
1/Circ. 1431); and
o Revised Guidelines for the maintenance and inspection of fire-protection systems and
appliances. (MSC. 1/Circ. 1432) – all ships including existing from May 2013
• Approved, for future adoption,
o draft amendments to SOLAS regulation II-2/10 on fire fighting to require a minimum of
duplicate two-way portable radiotelephone apparatus for fire fighters’ communication to
be carried (01 July 2014); and
o draft amendments to regulation II-2/15 Instructions, on-board training and drills, to
require an onboard means of recharging breathing apparatus cylinders used during
drills, or a suitable number of spare cylinders (01 July 2014).
• Approved unified interpretations regarding SOLAS II-2/3.2.3, which requests the "A" class
insulation on board should be provided by the same way as that of approval test, and
regarding Chapter 3 of the FTP Code, which requests the details of approval test condition
should be mentioned in the test report. (MSC1./Circ. 1345)
Hazardous Materials
• Approved unified interpretations clarifying the process to verify that materials which contain
asbestos, prohibited under SOLAS regulation II-1/3-5, are not installed on ships by reviewing
asbestos-free declarations and supporting documentation for the structure, machinery,
electrical installations and equipment covered by the SOLAS Convention, which should be
provided to the Administration or recognized organization by shipyards, repair yards, and
equipment manufacturers. (MSC. 1/Circ 1426)

Machinery
• Approved unified interpretations clarifying that the "bilge injection system" stipulated in SOLAS
II-1/48.3 requirements for protection against flooding does not include emergency bilge
system. (MSC.1/Circ 1424)
• Approved unified interpretations accepting for vessels to conduct sea trials not at the deepest
seagoing draught, on the condition that the estimation of load and torque on steering under the
full load condition is derived, to the satisfaction of the Administration or RO. (MSC.1/Circ.
1425)
• Approved, for adoption at MSC 91, the draft revised Code on noise levels on board ships,
which sets out mandatory noise level limits for machinery spaces, control rooms, workshops,
accommodation and other spaces on board ships, updates and revises the previous version
published in 1973 (resolution A.468(XII)) which recommends limiting the noise from machinery
spaces and noise exposure of crews to a certain level. Also approved, for adoption at MSC 91,
a related draft new SOLAS regulation II-1/3 12 to require new ships to be constructed to
reduce onboard noise and to protect personnel from noise, in accordance with the Code. If
they are adopted at the MSC91, ships constructed on or after 1 July 2014 are scheduled to be
complied with the Code on Noise Levels onboard Ships. Vessels of 1,600 GT or over are
subject to the Code and limitations on noise levels will be tightened for those of over 10,000GT
• Approved unified interpretations regarding SOLAS II-2/5.2.1.1, which clarifies the ventilation
system of battery rooms may be omitted in the special cases.
Stability and Load Lines
• Adopted amendments to the Guidelines for the design and construction of offshore supply
vessels, 2006 (resolution MSC.235(82)), concerning damage stability standards. (MSC.
335(90) – November 2013
• Approved unified interpretations regarding the access to controls for closing of ventilation of
Ro-Ro spaces.

Radio Communications and Search & Rescue
• Approved amendments to the International Aeronautical and Maritime Search and Rescue
(IAMSAR) Manual for inclusion in the 2013 edition of the IAMSAR Manual and decided that
the amendments should become applicable on 1 June 2013. The amendments include revised
paragraphs relating to common language (English serves as the default SAR operational
language in all cross-boundary operations where there is no other common language) and
references to 406 MHz Distress Beacons. (MSC. 1/Circ 1415)
• Approved an MSC circular on Revised Guidelines on annual testing of 406 MHz satellite
EPIRBs. (MSC.1/Circ 1040/Rev. 1)
• Approved an MSC circular on Guidance to prospective GMDSS satellite service providers.
• Agreed that the Global Maritime Distress and Safety System (GMDSS) should be reviewed
and included an item on Review and modernization of the Global Maritime Distress and Safety
System (GMDSS), with a target completion year of 2017, on the agenda of the Sub-
Committees on Radiocommunications, Search and Rescue (COMSAR), Safety of Navigation
(NAV) and Standards of Training and Watchkeeping (STW), assigning the COMSAR Sub
Committee as the coordinating organ.
Carriage of Dangerous goods
• In recognition of recent incidents associated with the liquefaction of cargoes, approved an
MSC circular on Interim measures for early implementation of the draft amendments to the
International Maritime Solid Bulk Cargoes (IMSBC) Code, recommending the early voluntary
implementation of proposed draft amendments to the IMSBC Code, set to be adopted in 2013,
relating to the carriage of a concentrate or other cargo which may liquefy.
• Approved unified interpretations clarifying that with regard to vessels carrying cargoes which
require continuous ventilation under the IMSBC Code, the installation of a closing device is not
prohibited in view of fire extinguishing, while a closing device is not required for the opening of
ventilation. A summary of the outcomes of MSC 90 is also available on the IMO web-site (http://www.imo.org).
