SINDH ORDINANCE NO.VI OF 1972 THE SIND BOARDS OF INTERMEDIATE AND SECONDARY EDUCATION ORDINANCE, 1972 [20 th April, 1972] An Ordinance to reconstitute and establish Boards of Intermediate and secondary Education in Sind and to amend the consolidate the law relating thereto. ORDINANCE, 1972[20th April, 1972]

An Ordinance to reconstitute and establish Boards ofIntermediate and secondary Education in Sind and to amend theconsolidate the law relating thereto.

WHEREAS it is expedient to reconstitute and establish Boardsof Intermediate and Secondary Education in Sind and to amendand consolidate the law relating thereto.

Preamble.

NOW, THEREFORE, in pursuance of the Martial LawProclamation of 25th March, 1969, read with the ProvisionalConstitution Order, and in exercise of all powers enabling him inthat behalf, the Governor of Sind and Martial Law Administrator,Zone ‘D’ is pleased to make and promulgate the followingOrdinance :-

1. (1) This Ordinance may be called the Sind Boards ofIntermediate and Secondary Education Ordinance,1972.

(2) It shall come into force on such date as may benotified by Government in the official Gazette.

2. In this Ordinance, unless the context otherwise requires, thefollowing expressions shall have the meanings hereby respectivelyassigned to them, that is to say—

(a)“Audit Officer” means the Audit Officer of a Board;(b)“Board” means a Board of Intermediate and Secondary

Education constituted under section 3;(c)“Chairman” means the Chairman of a Board;(d)“College” means an institution within the jurisdiction of a

ORDINANCE, 1972(j) “Head of an Institution” means the Principal of a College

or the Head Master or Head Mistress of a School;(k) “Institution” means a School or a College and any other

institution recognized as such by the Board;(l) “Intermediate College” means an institution recognized

for imparting instructions to class XI and class XII andincludes an institution having classes for Intermediateand Secondary education;

(m) “Intermediate education” means educationpertaining to class XI and class XII;

(n) “prescribed” means prescribed by Regulations or Rules.(o)“Principal” means the head of a college;(p)“Recognized” means recognized by a Board;(q)“Regulations” and “Rules” means respectively the

Regulations and Rules made under this Ordinance andfor the time being in force;

(r) “School” means an institution recognized only for theSecondary Education;

(s) “Secondary Education” means education pertaining toclass X and such other classes as may be declared byGovernment to be classes of Secondary Education;

(t) “Secretary” means the Secretary of a Board;(u) “University” when used with reference to Boards in

Karachi means University of Karachi and when used withreference to Boards at Hyderabad and Khairpur meansUniversity of Sind;

3. (1) As from the date of commencement of this Ordinance,the Board of Intermediate and Secondary Education, Hyderabadand the Board of Intermediate and Secondary Education, Karachiestablished and reconstituted respectively under the Board ofIntermediate and Secondary Education, Hyderabad Ordinance,1961 (West Pakistan Ordinance XVII of 1961) and the Board ofIntermediate and Secondary Education, Karachi Ordinance, 1962(West Pakistan Ordinance III of 1962), shall cease to exercise anypowers and perform any functions;

and as from the said date shall be reconstituted andestablished—

(i) at Khairpur a Board called the Board of Intermediateand Secondary Education, Khairpur.

(ii) at Hyderabad a Board called the Board ofIntermediate and Secondary Education, Hyderabad;and

(iii) in Karachi two Boards one called Board of

Ceasure ofjurisdiction.

ORDINANCE, 1972Intermediate and Secondary Education, Saddar,Karachi and other called Board of Intermediate andSecondary Education Nazimabad, Karachi.

(2) A Board shall be a body corporate and shall haveperpetual succession and a common seal with power to acquireand hold property and to transfer the same, and may sue or besued by the corporate name.

4. (1) A Board shall consist of the following members, namely:-

(i) the Chairman;(ii) the voice-Chancellor of the University or a University

Professor nominated by him;(iii) the Director of Education, Sind, for the Boards at

Hyderabad and Khairpur and the Director ofEducation, Karachi for Boards in Karachi.

(iv) one expert on technical education to be nominatedby the Controlling Authority;

(v) one representative of the Syndicate of the University;(vi) one Principal of a College nominated by the

Controlling Authority;(vii) one representative of Heads of Intermediate Colleges

elected by and from among themselves;(viii) one Headmaster or Headmistress of Schools elected

by and from among the Headmaster andHeadmistress of Schools; and

(ix) two persons nominated by the Controlling Authority.

(2) The names of the nominated and elected membersshall be notified in the official Gazette.

(3) The term of office of members other than ex-officiomembers shall be two years.

(4) No member appointed by virtue of his office shallcontinue to be a member if he ceases to hold that office.

(5) When a person ceases to be a member of a Boardhe shall cease to be a member of any of the Committees ofwhich he may be a member.

5. A member of a Board may resign his membership by a letteraddressed to the Chairman; provided that the resignation shallnot have effect until it is accepted by the Controlling Authority.

ORDINANCE, 19726. A member of a Board shall be liable to be removed by theControlling Authority, if—

(i) he becomes of unsound mind;(ii) he is declared insolvent by a competent court;(iii) he is convicted by a Criminal Court of an offence

involving moral turpitude.

The decision of the Controlling Authority in this behalf shallbe final.

7. (1) Whenever there occurs a vacancy in themembership of a Board due to death, resignation or removal, itshall be filled in accordance with the provision of this Ordinance.

(2) The person who fills the vacancy shall be a memberof the Board for the remaining term only.

8. (1) The Chairman may, whenever he considers necessaryand shall, on a requisition from at least five members of the Board,call a meeting of the Board.

(2) The quorum for meetings of a Board shall be six.

9. (1) A Board shall exercise the powers conferred on it byor under this Ordinance in respect of the institutions within theterritorial limits that may be notified by Government in the officialGazette.

(2) Government may, by general or special order, modifythe jurisdiction of a Board with regard to such territorial limits orinstitutions.

10. The Intermediate Examination in Agriculture shall continueto be conducted by the University.

11. (1) Subject to the provisions of this Ordinance, a Boardshall have power to organize, regulate, develop and controlIntermediate and Secondary Education.

(2) In particular and without prejudice to the generalityof the power conferred by the preceding sub-section, a Boardshall have the power—

(i) to hold and conduct all examinations pertaining toIntermediate Education and Secondary Education

ORDINANCE, 1972and such other examinations as may be determinedby Government;

(ii) to prescribe courses of study for its examinations;(iii) to lay down conditions for recognition of institutions;(iv) to accord, refuse or withdraw recognition wholly or

partly, after considering inspection reports—(a)in the case of School, received from the Education

Department, Government of Sind; and(b)in the case of Intermediate Colleges, received

from an Inspection Committee appointed by theBoard in this behalf;

(v) to inspect and arrange for inspection of recognizedinstitutions and call for inspection reports;

(vi) to lay down conditions for admission to itsexaminations, to determine the eligibility ofcandidates and to admit them to the examinations;

(vii) to grant certificates and diplomas to persons whohave passed its examinations and to withdraw suchcertificates and diplomas;

(viii) to fix, demand and receive such fees as may beprescribed;

(ix) to supervise the residence, health and discipline ofthe students of recognized institutions and classeswith a view to promoting their general welfare;

(x) to institute and award scholarships, medals and prizesin accordance with the Regulations and Rules;

(xi) to organize and promote extra-mural activities in andfor recognized institutions;

(xii) to hold, control and administer its property and funds;(xiii) to enter into and carry out contracts in exercise of its

powers and performance of its duties under thisOrdinance and the Regulations;

(xiv) to pass the annual budget;(xv) to transfer any movable and immovable property;(xvi) to hold and manage endowments;(xvii) to regulate and decide all administrative matters,

including the creation and abolition of posts;provided that it shall be lawful for the Chairman tocreate temporary posts for a period not exceeding sixmonths;

(xviii) to appoint the staff and define their duties andconditions of service in accordance with theGovernment rules;

(xix) to make provision for building, premises, furniture,apparatus, books and other means required forcarrying out the purposes of this Ordinance;

ORDINANCE, 1972(xx) to sanction such expenditure and to appoint such

officers and staff as may be necessary to carry outthe purposes of this Ordinance, and

(xxi) to do all other acts necessary for carrying out thepurposes of this Ordinance.

(3) A Board may delegate any of its powers to itsChairman or nay officer of the Board or to a Sub-Committeeappointed by it as it may deem fit.

12. The Governor of Sind or his nominee shall be the ControllingAuthority of a Board.

13. The Controlling Authority shall have the power to cause aninspection to be made by such person or persons as he maydirect, of the offices, activities and funds of, and examinationconducted by, a Board, and to cause an inquiry to be made inlike manner in respect of any matter concerning a Board.

(2) The Controlling Authority shall communicate to beBoard the result of such inspection or enquiry and may advise theBoard to take such action within such period as may be specified.

(3) The Board shall report to the Controlling Authority theaction it proposes to take or has taken on such communication.

(4) Where the Board does not, within a reasonable time,take action to the satisfaction of the Controlling Authority, theControlling Authority, may, after considering any explanationmade by the Board issue such directions as it thinks fit, and theChairman shall comply with such directions.

(5) If the Controlling Authority is satisfied that anyproceeding of a Board or a Committee is not in conformity withthis Ordinance, the Controlling Authority, may, without prejudiceto the foregoing provisions of this section, by order in writing,annual such proceeding:

Provided that before making any such order the ControllingAuthority shall, through the Chairman, call upon the Board or theCommittee, as the case may be, to show cause why such anorder should not be made.

ORDINANCE, 197214. (1) The following shall be the officers of a Board—

(i) the Chairman;(ii) the Secretary;(iii) the Controller of Examination(iv) the Audit Officer; and(v) such other officers as may be appointed by the

Board.

(2) The Chairman, the Secretary, the Controller ofExaminations and the Audit Officer shall be whole-time officersand shall be appointed by the Controlling Authority on such termsand conditions as may be determined by it.

15. (1) The Chairman shall hold office for a term of threeyears from the date of notification of his appointment and on theexpiry of the term of office shall be eligible for re-appointment forsuch further period as may be specified in the order ofappointment.

(2) When the office of the Chairman is vacanttemporarily or otherwise, by reason of leave, illness or other cause,for a period not exceeding one year, the Controlling Authorityshall make such arrangements for carrying on the duties of theoffice of the Chairman as it may think fit.

(3) The Chairman shall be the principal executive andacademic officer of the Board and shall, when present, preside atthe meetings of—

(i) the Board(ii) the Committee of a Board constituted under

the Regulations.

(4) It shall be the duty of the Chairman to ensure that theprovision of this Ordinance and the Regulations and Rules arefaithfully observed and carried out, and he shall exercise allpowers necessary for this purpose.

(5) in any emergency arising out of the administrativebusiness of the Board and requiring, in the opinion of theChairman, immediate action, the Chairman may take suchaction as he may deem necessary and shall report the action sotaken to the Board at its next meeting for approval.

(6) The Chairman shall exercise such other powers asmay be prescribed.

16. Subject to the provision of this Ordinance the powers andduties of other officers of the Board shall be such as may bedetermined by the Board.

17. (1) A Board shall have the power to make Regulationsconsistent with this Ordinance on all or any of the followingmatters, namely:--

(a) the constitution, powers and duties ofCommittees.

(b) additional powers and duties of the officers ofthe Board mentioned in section 14;

(c) rules of service including rules regulatingdisciplinary action, grant of leave andretirement of the employees of the Board;

(d) constitution of pension or Provident Fund orboth for the benefit of the officers and otheremployees of the Board;

(e) admission of institution to the privilege ofrecognition and withdrawal of recognition;

(f) general scheme of studies, including the totalnumber of subject to the taught and theduration of courses, and

(g) such other matters as may appear necessaryfor giving effect to the provisions of thisOrdinance.

(2) The Regulation approved by the Board shall besubmitted to Government and shall not take effect until they areapproved by Government. Government may approve or disallowor remit them to the Board with its recommendations for furtherconsideration.

18. A Board may make Rules consistent with this Ordinance andthe Regulations to provide for—

(i) inspection of institutions and the reports, returns andother information to be furnished by them;

(ii) condition of admission of candidates to theexaminations and eligibility for diplomas, certificatesand titles; and

(iii) such other matters as may be required to beprescribed by Rules in the Regulations.

ORDINANCE, 197219. A Board shall have a fund to which shall be credited all itsincome including income from fees, endowments, grant andcontributions.

20. (1) The accounts of a Board shall be maintained in suchmanner as may be prescribed by Rules.

(2) The statement of accounts of a Board shall besubmitted to Government once a year.

(3) The account of the Board shall be audited in suchmanner as may be prescribed by the Regulations.

21. (1) A Board shall establish for the benefit of its employeessuch pension or Provident Fund or both as it may deem fit in suchmanner and subject to such conditions as may be prescribed.

(2) Government may, by notification, declare that theprovisions of the Provident Fund Act, 1925, shall apply to suchfund, and on the making of such declaration that Act shall applyaccordingly as if such Board were Government and the said fundwere the Government Provident Fund.

22. No member of a Board shall draw any fee or otherremuneration in any capacity whatever from the funds of theBoard or enter into any contract with the Board directly or throughany other person in connection with the affairs of the Board:

Provided that the emoluments of the Chairman shall inaccordance with the terms and conditions of his appointment, bepaid from the funds of the Board:

Provided further that a member of a Committee mayreceive from the Board remuneration in lump-sum for writing,compiling or editing a book intended to be prescribed for anexamination of the Board.

23. No person who has any financial interest in any bookprescribed by a Board as a course of study for any examinationconducted by such Board or has a financial interest as a partneror otherwise in any firm which publishes, procures, or supplies anysuch book, shall be eligible to become a member of such Boardor a Committee thereof or continue as such after having acquiredany such interest.

ORDINANCE, 197224. No act or proceedings of a Board or any Committee shallbe invalidated merely by reason of the existence of a vacancy onthe Board or the Committee, as the case may be, or by reason ofany irregularity in the appointment of any member of the Board orthe Committee.

25. No act done, orders passed or proceedings taken by aBoard shall be called in question in any court by a suit orotherwise.

26. Members of the Board and the Committee constitutedunder this Ordinance, the employees of the Board and otherpersons appointed for carrying out the purposes of this Ordinance,shall be deemed to be public servants within the meaning ofsection 21 of the Pakistan Penal Code.

27. No suit for damages or other legal proceedings shall beinstituted against Government, the Controlling Authority, theBoard, any Committee, any member of the Board or Committee,or officer or employee of the Board in respect of anything done orpurported to have been done in good faith in pursuance of thisOrdinance and the Regulations and Rules made thereunder.

28. (1) Notwithstanding anything to the contrary containedin this Ordinance, the Regulation set out in the Schedule shall, onthe commencement of this Ordinance, be deemed to be the FirstRegulations framed by the Board under section 17.

(2) The Regulation laid down by Government within threemonths of the date of commencement of this Ordinance shallbecome part of the Schedule.

29. (1) From the date of commencement of this Ordinanceand till such time as the nominated and elected members areappointed, the Chairman and the ex-officio members shallexercise all the power and perform all the duties of the Board andits Committees.

(2) On the appointment of the nominated and electedmembers, the Board shall exercise all powers and perform allduties of the Committees of the Board till such Committees areconstituted.

(3) If any difficulty arises in giving effect to the provisionsof this Ordinance, the Controlling Authority may take such actionto remove the difficulty as it may deem necessary.

30. (1) Notwithstanding anything to the contrary containedin this Ordinance and the Regulations made thereunder,everything done, action taken, obligation or liability incurred,rights and assets acquired, person appointed or authorized,jurisdiction or power conferred, endowment, bequest or fundcreated, donation and grant made, scholarship or awardinstituted, recognition granted and order issued under any of theprovisions of the Board of Intermediate and Secondary Education,Hyderabad Ordinance, 1961 (West Pakistan Ordinance XVII of1961) and the Board of Intermediate and Secondary Education,Karachi Ordinance, 1962 (West Pakistan Ordinance III of 1962) andthe regulations and rules made thereunder, shall be continuedand so far as may be, be deemed to have been respectivelydone, taken, incurred, acquired, appointed or authorised,conferred, created, made, instituted, granted and issued underthis Ordinance or the Regulations made thereunder.

(2) The Board shall have the power to decide whetherany regulation or rule framed under the Board of Intermediateand Secondary Education, Hyderabad Ordinance, 1961 (WestPakistan Ordinance XVII of 1961), and the Board of Intermediateand secondary Education, Karachi Ordinance, 1962 (WestPakistan Ordinance III of 1962), is or is not consistent with theprovisions of this Ordinance and the Regulations and Rules madethereunder.

1. The Chairman shall exercise control over the office of theBoard as its principal executive and academic officer and shalldo all acts to ensure that the officers and the staff properlyperform the duties entrusted to them. In particular he shall—

(i) write confidential reports on the work of officerswhose grades carry an initial salary of three hundredrupees or more per mensem;

(ii) recommend to the Board any disciplinary action thathe considers necessary against officers mentioned inclause (i);

(iii) take disciplinary action against members of theestablishment whose grades carry an initial salary ofless than three hundred rupees per mensem; and

(iv) appoint Superintendents of Examination.

2. (1) The Secretary shall, subject to the control of theChairman, be incharge of the academic and administrativesector of the Board’s office and shall cause the orders anddecisions of the Board and the Chairman to be carried out.

(2) The Secretary shall take all possible steps, to ensurethat the funds of the Board are spent on the purpose for whichthey are provided.

(3) The Secretary shall cause to be prepared and submitto the Board for approval the annual statement of accounts andbudget estimates.

(4) All meetings of the Board and the Committees shallbe convened by the Secretary under the directions of theChairman. While preparing the agenda for a meeting of theBoard or a Committee, the Secretary shall carry out the directionsof the Chairman given in this respect and no item shall be placedon agenda or be considered in the meeting without previouspermission of the Chairman.

(5) The Secretary shall record the minutes and maintainthe records of the proceedings of the Board and the Committees.

ORDINANCE, 1972(6) The Secretary shall conduct the official

correspondence of the Board under the authority of theChairman except the correspondence relating to the conduct ofexamination.

(7) All fees and dues payable to the Board, and all sumsreceived by the Secretary, shall be credited without delay to theaccount of the Board in a Bank or treasury approved by theBoard.

(8) The Secretary shall issue to successful candidates onbehalf of the Board, in the prescribed form, certificates of havingpassed the examinations held by the Board.

(9) The Secretary shall perform such other duties as maybe assigned to him by the Chairman.

(10) Notwithstanding anything to the contrary in theseRegulations the Board may assign to any other officer or officerssuch duties of the Secretary as it may deem necessary.

(11) The post of the Secretary shall be a tenure post. Theterm of his appointment shall be three years and may berenewed.

3. The Controller of Examinations shall, subject to the control ofthe Chairman, be incharge of the Examination sector of the Boardand shall—

(i) make arrangements for the conduct of allexaminations of the Board;

(ii) conduct official correspondence of the Boardrelating to the examinations, and

(iii) perform such other duties as may from time to timebe assigned to him by the Chairman.

4. The Academic Committee shall consist of—

(i) the Chairman of the Board;(ii) a University Professor nominated by the Vice-

Chancellor of the University.(iii) The Director of Education concerned;(iv) one expert in technical education, to be nominated

by the Controlling Authority;(v) one representative each of the following groups of

Teaching Departments of the University nominated by

(4) (a) The Academic Committee shall have the generalsuperintendence and control of and the responsibility for themaintenance of the standards of teaching and examination.

(b) Without prejudice to the generality of theforegoing provisions and subject to such conditions as mayprescribed, the Academic Committee shall exercise the followingpowers and perform the following duties, namely:---

(i) to determine the subject or subjects which shallbe assigned to each Committee of Courses;

(ii) to advise the Board on the qualifications of theteachers and examiners, their duties andconditions of appointment;

(iii) to advise the Board on all academic mattersincluding the general schemes of studies for anexamination, the number of subject to beincluded in an examination, the value of eachof subject in respect of marks to be assigned toit, and the conditions to be fulfilled for passingan examination and for being placed in aparticular division; and

(iv) to exercise such other powers and performsuch other duties as may be prescribed;

5. (1) The Appointments Committee shall consists of—(i) The Chairman of the Board;(ii) The Vice-Chancellor of the University;(iii) The Director of Education concerned;(iv) two nominees of the Controlling Authority.

(2) The Appointment Committee shall recommend theappointment, confirmation and scale of pay of officers oremployees of the Board whose scales of pay carry an initial salaryof three hundred rupees or more per mensem.

(3) The member of the Appointments Committee otherthan ex-officio members, shall hold office for two years.

(4) The quorum for a meeting of the AppointmentsCommittee shall be three.

6. (1) The Finance Committee shall consist of—(i) The Chairman of the Board;(ii) the Director of Education concerned;

Government of Sind; and(iv) two nominees of the Controlling Authority;

(2) The functions of the Finance Committee shall be—

(i) to examine the annual budget and advise theBoard thereon; and

(ii) to review the financial position of the Boardperiodically and make recommendations tothe Board for improving its finances.

(3) The members of the Finance Committee, other thanex-officio members, shall hold office for two years.

(4) The quorum for the meetings of the FinanceCommittee shall be three.

7. (1) There shall be a Committee for appointment of PaperSetters and Head Examiners and shall consist of—

(i) the Chairman of the Board;(ii) the Vice-Chancellor of the University; and(iii) the Director of Education concerned;

(2) The function of the Committee for appointment ofPaper Setters and Head Examiners shall be to appoint PaperSetters and Head Examiners for all examinations conducted bythe Board, after considering the recommendations of theCommittee of Courses in this behalf. Where a Committee ofCourses does not make its recommendations within the timespecified by the Committee for appointment of Paper Setters andHead Examiners, the Committee will make these appointmentswithout the recommendations of the Committee of Courses.

8. (1) There shall be a Committee of Courses for eachsubject or a group of allied subjects included in the courses ofstudies organized by the Board. Each such Committee shallconsist of the following, namely:-

(i) two teachers of the subject from among theteachers of the Intermediate Education,nominated by the Academic Committee;

(ii) two teachers of the subject from among theteachers of the Secondary Education,

(iii) two persons having experience of IntermediateEducation or Secondary Education, nominatedby the Board; and

(iv) one expert in the subject, nominated by theChairman:

Provided that if in a subject the required number ofteachers is not available, the Chairman may decide that thenumber of the members of the Committee of Courses for thesubject concerned may be less than seven or may permit thenomination of suitable persons who are not teachers, as membersof a particular Committee of Courses.

(2) The term of office of the members of the Committeeof Courses shall be two years:

Provided that if a vacancy occurs during the courseof two years, the member appointed to fill the vacancy shall holdoffice for the remaining term only.

(3) Each Committee of Courses shall consider academicmatters relating to the subject or subjects with which it isconcerned and shall recommend to the Academic Committeethe courses of study and text books to be prescribed as well as theconditions to be fulfilled for passing the relevant examination inthe subject or subjects.

(4) Each Committee of Courses shall have a Convenerwho shall be nominated by the Board.

(5) The quorum for meetings of the Committee ofCourses shall be four.

9. Notwithstanding anything contained in these Regulations,when a person ceases to be member of a Committee, he shallcease to be a member of any Sub-Committee of which he maybe a member by virtue of his membership of that Committee.

10. (1) The Board shall accord recognition, for the SecondarySchool Examination, to such schools as are within the jurisdiction ofthe Board in Sind if it is satisfied, on the basis of the inspectionreport received from the Divisional Inspector of Schools of theDivision concerned, through the Education Department,Government of Sind, that the conditions prescribed forrecognition have been satisfactorily fulfilled.

(2) If the Board, on the basis of a report received fromthe Divisional Inspector of Schools, through the EducationDepartment, Government of Sind, is satisfied that the conditions ofrecognition have ceased to be fulfilled by any school, the Boardmay cancel the recognition.

(3) The Board may, if it considers necessary, arrange aspecial inspection of any school by an Inspection Committeeappointed by it.

11. (1) No expenditure shall be made from the funds ofBoard, unless the bill for its payment has been audited by theAudit Officer in conformity with the Regulations and Rules.

(2) The statement of accounts of the Board, signed bythe Secretary and the Audit Officer, shall be submitted toGovernment within six months of the closing of the financial year.

(3) The accounts of the Board shall be audited one ayear, in conformity with the Regulations and Rules, by Auditorsappointed by Government for this purpose.
