Minutes of the meeting of the Shikshan Shulka Samiti (Medical Education) held under the Chairmanship of Justice P.S. The Samiti considered the proposals of the following Colleges/Institutes for finalization of fee structure for the students who joined the course started during Academic Year 2012-13. After deliberations, The Samiti decides to approve the final fee structure of the following Colleges/Institutes for the students who joined the course started during Academic Year 2012-13, subject to final approval/affiliation/perrnissions from respective Authorities. Figures are arrived at after considering the calculations drawn in the worksheet - calculation sheets of the respective colleges/institutes prepared by a Chartered Accountant. The students admitted in Academic Year 2012-13 and there after continuing their studies will pay an enhanced fee of 5% each successive year as per the norms for 2012-13 till completion of the course. For example if the fee approved is Rs. 1,00,000/- then 2" year, 3rd year and 4th year's student of the Health Science Colleges will

Bench) in its order dated 8/2/2013 has observed in the last part as under ."However, as time to pay the tuition fees has been extended, as and when the concerned applicants deposit the amount towards the enhanced tuition fees, we direct respondent nos. 4 and 5 to adjust it towards tuition fees. The liability of the petitioners to pay late feeslfine exists and respondent nos. 4 and 5 free to recover it, in accordance with the law. Subject to this direction, we dispose of this civil application. No costs". We asked the Representative of the Institute to show law or rule on the subject of penalty on the basis of which the penalty can be recovered from the students. He admits that there is nothing in the prospectus about it. He only states that it is covered under the right to establish and administer the Institute and notice is given by the college to the students. Prima Facia this cannot be considered as law or rule giving right to the Institute to impose Penalty. However the Institute is free to approach the High Court to get clarification about this. We make it clear that after getting the clarification from the High court, the college can charge fine or late fee and not till then.

Letter received bv email dated 22/4/2013 from Matoshri School of ANM Nursina, Nashik related to refund of penalty amounts.

Considered the Email dated 22/4/2013 along with the letter of tlie Institute dated 24/4/2013. The Institute is right in asking refund of Rs. 40,000/-. From this office. I t is pointed out that there are a part from these 4 colleges from the total amount paid there are 7 other similarly situated colleges. Though they have not come before the samiti asking for refund office of refund the amount in their case also after deducting Rs. 10,000/-.

Considered the letter dated 25/4/2013 received from the Institute. The students have to pay fee in respect of subjects in which they got ATKT and required to attend the classes. Therefore Institute can charge proportionately the fee in respect of those subjects in which he/she has failed and has claimed ATKT.

Item No. 5: Anv other matter with the permission of the Chair.

I n view of our norm No. 4.2 approved in the meeting held on 1/04/2013 and our earlier resolution passed on 25/8/2010 regarding giving notice of revision to the other party, it is further made clear where there is delay for filing revision application then copy of the said application is also to be made available to the other side for giving its say.
