    I n re: W i l l County Foreclosures

    Dear

    M r .

    Kuzma:

    Pnor to the 1964 JudicialArticle,

    sheriff sales

were conducted by Masters in Chancery.

    ^Vhen

that system was abohshed and a

    unified

    court system

    estabhshed,

the Mortga ge Foreclosure A ct

    aUoAved

    asaleby thesheriff or anyjudge. In 1965 the W i l l County Court system experienced a backlog i n

    processing the numiber ofsheriff

    sales

    and the supen'ising CircuitJudgefor

    W i l l

    Count}',the Sheriff and

    the Chief

    Judge

created a procedurewhichwas then adopted by the W i l l Coun ty Board pursuant to the

    County

    Board resolution enclosed.

In 1987 a new mortgage foreclosure act took effect in Hhnoiswhichprovided that realestate

    shall

    be sold at a

    sale

on such term.s and conditions as shall be specified by the Court in the

    judgm-ent

    o f

    the foreclosure.

    Subsequently, the

    Twelfth

    Judicial

    Circuit

    enacted rules for

    judicial

    and foreclosures

    sales

    in

    Section 11

    which

    provides that

    .unless

othe rwise ordered by the Court,

    al l

    judicial

    and foreclosure

    sales
