SETTING THE CONTEXTStandardiza�on: The Indian perspec�ve

What is BIS?The Bureau of Indian Standards (BIS), previously known as the Indian Standards Ins�tute (ISI), is India’s statutory na�onal standards body, established under the Bureau of Indian Standards Act, 1986.

Which Act covers standardiza�on?

Under the framework of the Bureau of Indian Standards Act, 2016 (BIS Act), the government is empowered to no�fy goods or ar�cles which are required to have minimum standards prescribed by the BIS and have an ‘ISI’ cer�ficate mark.

What are the types of standards covered by BIS?

The following types of Standards are developed by BIS:Terminologies| Product Specifica�on| Methods of Tests| Codes of Prac�ce| Guides |Symbols or Dimensional| Special Publica�ons (NBC, NEC, etc.) | Others

What are the consequences for non-compliance?

Any contraven�on in the said context may a�ract consequences ranging from monetary penal�es (minimum INR 1 Lakh which may extend up to 5 �mes the value of goods involved) to even imprisonment in excep�onal cases.

How o�en are standards reviewed?

All established standards are reviewed periodically, at least once in five years, to determine the need for revision or withdrawal.

Which stakeholders can determine the need for a new standard?

Stakeholders include Ministry of the Central Government, State Govern-ment, Union territory administra�on, consumer organiza�on, industrial unit, industry-associa�on, professional body, member of the Governing Council, member of a technical commi�ee or any individual who propos-es for establishment of an Indian Standard or for amending or for revising or withdrawing an established Indian Standard.

Which products require mandatory cer�fica�on?

Presently, mandatory cer�fica�on is prescribed in respect of 136 products wherein issues like public interest, public health and safety, security, infrastructure requirements, mass consump�on are involved. Compliance with BIS standards is mandatory not only for Indian businesses but also for foreign manufacturers supplying the prescribed products into India.

Compulsory registra�on for manufacture, storage, import, sale or distribu�on in India for specified productsProducts to be properly tested and registered under BIS to ensure public health and safetyProducts no�fied by the Ministry of Electronics & Informa�on Technology (GoI) in rela�on to Electronics & IT GoodsProducts no�fied by the Ministry of New and Renewal Energy-products such as - Solar Photovoltaic, Systems, Devices and Components Goods

Compulsory Registra�on Scheme (CRS)

Applicable on domes�c manufacturers and provides third party assurance of the quality, safety, condi�on and reliability of the productProvides third party guarantee of quality, safety and reliability of products and adds to its value and goodwill

Product Cer�fica�on Scheme (PCS)

Provides cer�fica�on to foreign manufacturers having a factory loca�on outside India in rela�on to the products imported into IndiaApplicable for grant of license for all the products except Electronic & IT Goods no�fied by the Ministry of Electronics & Informa�on Technology

TIMELINEThe applica�on for obtaining the cer�fica�on is a long-drawn process entailing submission of numerous documents with great detailing ranging from documents substan�a�ng the kind, nature and quality of raw material to the machinery involved in its manufacturing. Further, the procedure also extends even to the qualifica�on of the personnel involved in overall quality control and management of its produc�on. Experts from the BIS also visit the manufacturing facility to undertake recce of the produc�on process and quality control procedures so adopted. Random checks and surveillance are carried out regularly for ensuring adher-ence to the standards. The process is given below:

Prepara�on before visit

QC Personnel have to undertake relevant tests in the presence of BIS nominated Scien�st Feasibility of taking two suitable samples for carrying out prescribed tests before the OfficersOne sample should be kept in the factory �ll the grant of License

During the visit

Suitable sample should be sent to India for carrying out tests at BIS Lab / authorized lab This may delay the overall period of obtaining license, thus requires effec�ve planning

Post the visit

Certain jurisdic�ons bar manufacturers from expor�ng goods directly. This may give rise to exploring the possibility of ensuring joint responsibility obliga�on of manufacturer and exporter vis-a-vis the BIS, in order to safeguard the financial interest of the manufacturer in wake of any contraven�on by the exporter

Submission of Indemnity Bond, BIS Agreement and the Performance Bank Guarantee

Actual marking fee needs to be calculated at the end of financial year basis actual produc�on on which BIS mark is used against which the advance fee would be adjusted

Payment of minimum marking fee in advance

Technical tests as prescribed in the scheme of inspec�on and tes�ng are to be conducted and documented for each consignment leaving for IndiaCertain prescrip�ons to be captured in the tests reports to be accompanied with export documenta�on

WHERE ELP STEPS IN

ADVISORY

Represen�ng the domes�c producers before the BIS Commi�ee and ancillary bodies with regard to issuance of product standards under the BIS. Coordina�ng on this behalf with the Parent Ministry / Ministry of Finance for the purposes of implementa�on.

Represen�ng the stakeholders before the Commi�ee Mee�ngs prior to the issuance of the standards and the filings to be made thereto.

Evalua�ng op�ons and assistance before various forums such as the concerned Ministry / BIS / Domes�c Courts / World Trade Organisa�on.

Due diligence of whether the underlying goods are subjected to BIS cer�fica�on.

Filing an Applica�on for revision of standards as per the applicable procedure on behalf of the stakeholder

Conduc�ng BIS compliance as well as an wri�en opinion as requested

COORDINATION & FOLLOW UP

Regular follow-up with the BIS Authori�es (including nominated Scien�sts)

Filing any le�ers / cer�ficates / undertakings that the BIS Authori�es may require post the facility visit

A�ending day-to-day mee�ng with the BIS Officials to procure the BIS License

Colla�on of relevant documenta�on for prepara�on of Applica�on

Prepara�on and filing of Applica�on and any informa�on required thereto during the course of the applica�on.

Visi�ng the Company’s manufacturing facility with the BIS Officials for inspec�on
