September 25, 2018

A regular meeting of the City of Hopkinsville Code of Ordinance Enforcement Board was held Tuesday,September 25, 2018 at 5:45 p.m. in the Council Conference Room of the Hopkinsville Municipal Center.Chairman Rodney Davis presided at the meeting and asked for roll call. Those present were:

Mr. Green moved to approve the minutes of the September 11, 2018 regular meeting. The motion wasseconded by Ms. Ferguson. All committee members present voted aye. The motion passed.

Mr. Howell requested that the City Attorney go back to City Council and request more lenience on thetines for Unsafe Structures. All board members agreed. Chairman Davis advised that he would bring thatup at the next meeting to the City Attorney.

Pursuant to your request, and a.required by KRS 65.8828 and Chapter 33.189 of the City ofHopkinsville, Kentucky Code of Ordinances, you are hereby formally notified to appear before the Code ofOrdinance Enforcement Board at 715 South Virginia Street, Hopkinsville Municipal Center, CouncilChambers Room (#148), on the 9TH of OCTOBER, 2018, at 5:45 p.m. for a public hearing in reference tothe citation issued to CHARLES R JOHNSON, by Darnell West, Code Enforcement Officer, for a violationat 89 HUNTING CREEK RD of code section(s) 93.03, which is more particularly as follows: Overgrown.

The Board will receive evidence at the public hearing and will make such findings of fact andconclusions of law as are supported by the evidence pertaining to the matters alleged in the citation.During the hearing, you will have the opportunity to testify, to present witnesses, and to cross-examine any witnesses who may testify against you. Although it is not required, you may obtain anattorney, at your own expense, to represent you at the hearing.

If you fail to appear at the time and place of the hearing, you shall be deemed to havewaive the right to a hearing to contest the citation, and the determination a violation wascommitted shall be final. In this event, the Code of Ordinance Enforcement Board shall enter a finalorder determining that the violation was committed and may impose a civil fine up to the maximum setforth in the citation.
