MOTION TO CONTINUE SENTENCING DATE FROM DECEMBER 18, 2014 (FIRST

NOW COMES THE DEFENDANT, VERNON R. KLINEFELTER, BY HIS ATTORNEY,
THOMAS O. FINKS, AND FOR HIS MOTION TO CONTINUE THE SENTENCING
HEARING IN THIS CAUSE NOW SET FOR DECEMBER 18, 2014 STATES AS FOLLOWS:
1) That this cause is set for sentencing as to Vernon R. Klinefelter and as to Geraldine
Klinefelter on December 18, 2014.
2) That a critical witness for Vernon Klinefelter, Dr. Jonathan Hess, is out of state from
December 15, 2014 until January 20, 2015.
3) That with the multiple delays in the sentencing hearing necessitated by an ongoing trial
which has lasted approximately 2 months, Dr. Hess is now unable to be present to testify.
4) That, in addition, counsel for Vernon Klinefelter has a personal and family commitment
from December 17 through December 21 which is impossible to change.
5) That counsel for the Government, Mr. Hansen, has been advised of this conflict and has
indicated that the Government would not object to this continuance and would cooperate
with the rescheduling.
6) That Peter Wise, counsel for co-defendant Geraldine Klinefelter has been advised of this
request and has indicated no objection to same.
7) That this is the first extension or continuance of any kind for any purpose sought by
Vernon Klinefelter since the trial of this cause in April 2014.
8) That this continuance is sought for the purposes recited herein and not for the purposes of
prejudice or delay.
Wherefore, Vernon R. Klinefelter, hereby requests that this honorable court grant this unopposed
request for a continuance of this cause to a time and date certain as soon as is practicable for the

schedule of this honorable court and, further, requests that sufficient time be allotted to allow
Vernon Klinefelter to present up to five live witnesses to assist in presenting mitigation
testimony and evidence, which counsel for defendant suggests would be approximately 90
minutes.
