• What is a 28 Day Schedule?• A work cycle extending over 28 days instead of 7 days

• Exception to Fair Labor and Standards Act (FLSA) for fire and lawenforcement personnel

• 29 C.F.R. § 553.211(f) – “security personnel in correctional institutions” 

• may be paid overtime on a “work period” basis. A “work period” may be

from 7 consecutive days to 28 consecutive days in length.• overtime pay is required when the number of hours worked exceeds 171

Incident Definition:

• Serious Staff Assault : Any assault on a staff member that results in personalinjury to the staff member or another staff member, resulting in the need forimmediate medical attention or an assault involving the use of a weapon orobject.

Inmate Disciplinary Definitions: 

• Assault (ASL), Assault on Staff (AOS) (Class A): Any intentional injury upon the

person of another. (Applies to Staff, Inmates or Visitors)

Staff/Inmate Provocation (SIP): 

• To intentionally or knowingly cause physical contact with staff or anotherinmate that a reasonable person would regard as offensive, but which resultsin no injury.

Policy 103.02 Incident Reporting

Draft report is reviewed and approved by the on-duty Shift Commander prior to entry

in TOMIS

Within 24 hours (excluding weekends & holidays), each Warden reviews incidents

from the previous day to ensure accuracy and compliance with standards.

Wardens submit all deletion and modification requests as outlined in policy 103.02.

Deputy Commissioner’s office approves or denies request

If approved, the request is forwarded to a Correctional Program Manager for

appropriate disposition

• TDOC incident reporting is a thorough reporting process

• Classifying incidents can be subjective in nature and it is

imperative to have a good local incident review process

• TDOC’s goal is to ensure incident reports are accuratelyreported and documented in an effort to promote

transparency and provide data that reflects the activitywithin our prisons
