Overview of Section 504 and Related Legislation Introduction This Section 504 Resource Guide focuses on the provision of educational programming and services to students qualified under Section 504. Section 504Overview Section 504 of the Rehabilitation Act of 1973 (Section 504) is federal legislation designed to protect the civil rights of qualified individuals with disabilities and provide a free appropriate public education (FAPE) for qualified eligible students in the least restrictive environment (LRE). Section 504 mandates that no qualified individual with a disability shall, on the basis of disability, be excluded from participation in, be denied the benefits of, or otherwise be subjected to discrimination under any program or activity of any entity that is a recipient of Federal financial assistance. (34 CFR 104.4(a)) 504 FAPE Requirement. Section 504 also requires that public school districts receiving federal funding provide a free appropriate public education (FAPE) to each qualified person with a disability who is in the school districts jurisdiction, regardless of the nature or severity of the persons disability. (34 CFR 104.33(a)-(b)) 504 Least Restrictive Environment Requirement. Section 504 requires that students be educated in the least restrictive environment (LRE) appropriate for the student. A school district must:

[P]rovide for the education of each [student with a disability] in its jurisdiction with [non-disabled] persons . . . to the maximum extent appropriate to the needs of the [person with a disability]. A school district shall place a [student with a disability] in the regular educational environment . . . unless it is demonstrated by the school district that the education of the [student with a disability] in the regular environment with the use of supplementary aids and services cannot be achieved satisfactorily . . .
