Leslie, a former executive at a subsidiary of American Express Company, violated Section 13(b)(5) of the Securities Exchange Act of 1934 and Rule 13b2-1 promulgated thereunder, and seeking a permanent injunction and civil penalty. Simultaneous with the commencement of the action, Leslie consented to the entry of a Final Judgment permanently enjoining him from violating Section 13(b)(5) of the Exchange Act and Rule 13b2-1 thereunder and ordering him to pay $10,000 in civil penalties. The Commission's complaint alleges that from about September 1990 through June 1991, Leslie knowingly circumvented and failed to implement American Express's policies governing the accounting and write- off of delinquent Optima credit card accounts receivable. The complaint also alleges that, by his actions, Leslie delayed the write-off of uncollectible accounts, and 1 caused the falsification of American Express's books, records, and accounts, and overstated American Express's pretax income by $36.3 million for three quarterly periods.
