On January 14, 2013, the South Dakota Truck-ing Association's Board of Directors met for their Winter Board Meeting, in Pierre, SD. If you have any questions about what was dis-cussed at the Board Meeting, please feel free to contact a Board Member or call the SDTA office at (605) 334-8871.

Following the Winter Board Meeting each year, the SDTA membership host Pierre’s Largest Sundae Bar where we meet with the South Da-kota Legislators to discuss the legislation af-fecting the trucking industry. The meeting was a great success! Take a look at the pictures on page 25 of this publication.

It's not just teddy bears and ice cream sundaes...

For those that were able to attend the Winter Board Meeting, we recently had another good opportunity to work on some relationship building with our state legislators in Pierre. The teddy bears and ice cream certainly help attract our legislative guests, which we all enjoy, but the real work starts once we get them in the door. The forum allows us to discuss the is-sues important to our members. We are fortunate that we do not have any major issues on the table (at least not yet - and lets hope it stays that way) but we were able to position our stance on the "88" plate

and the "super single" issue with many of our guests.

We had a good Executive Committee meeting and regular board meeting, along with a joint Executive Committee meeting with SDADA. As reported at the board meeting, it was a pleasure to see our regular membership growing to 356 members, along with our 171 associate members. In 2008, we saw the most significant decline in our membership as many businesses experienced the economic downturn. We have not quite restored our membership to pre-2008 levels, but we are getting there. We are a healthy, growing association and that should be good news to everyone.

By now you probably have received in your mail the information on the five $1,000 scholarships that SDTA is sponsoring this year. I think it speaks very well of our as-sociation to be able to provide those opportunities to help further the education of children within the SDTA membership.

We also set the dates for the "Call on Washington" which will be in May. I appreciate our Board and members continual support of this effort as we have seen first hand the benefits of staying close to our national legislators. In addition, Myron did a nice job going through the South Dakota House and Senate bills that have any impact on our industry. Myron will stay close to these issues and anything new that surfaces to make sure our best interests are protected.

2013 is here and rolling and most of us have been able to avoid most of the bad weather. Let's hope we make it safely into spring when we can get past the snow and ice and firmly onto dry roads. I am looking forward to what the new year brings and hope to see continual improvements for our industry and SDTA.

Well, here I am again, living at my “Winter Camp” in the capitol city. The 88th Session of the South Dakota Legislature started on January 8th. The days are long and the nights are short but, in my opinion, this is the most important part of my job. The SDTA Membership definitely needs a full time representative in the halls of the state capitol building every day the legislature meets. It has only been a week and there are already a bunch of bills that will require out attention, some are good and some are bad for the SDTA Member-ship. As the session progresses, I will be sending up-dates to all members in my email group.

At this time in the legislative session, everyone is still smiling and shaking hands. There is a large number of first time legislators that are trying to learn the rules and protocols. It will not take too much time and legislators and lobbyists will dig in and fight for their causes. When that happens, and it always does, the mood will change. I guess by now you are thinking, “Why would you like this process?” Well, it may be that I am wired differently or a bit crazy but I do truly enjoy representing your interests to the state legislature.

The SDTA Board of Directors held their winter meeting on January 14th in Pierre. Dur-ing that meeting, we had a lengthy discussion regarding our position on the legislation that was in the hopper at that time. To find our position on these Bills, please review the Bill Log that appears in this edition of the Trucking News. I also realize there will be additional decisions to make regarding other Bills that are filed. If possible, those decisions are made during a call with the SDTA Chairperson of the Board, Mr. Rick Hoogendoorn. If additional opinions are necessary, we have a conference call with the entire SDTA Executive Committee. In other words, stay tuned, this session of the state legislature is shaping up to be very interesting.

As in past years, I will be walking the halls of the state capitol attempting to represent your interests every day that the legislature meets. If you need to contact me, please call your SDTA office and the staff will make sure I get a message to call you. Also, please attentively watch your email during the legislative session because that is the way I will keep you informed about what is going on. I will also be using email to ask for any necessary grassroots lobbying help from individual members.

In closing, I would like you to watch your mailbox because the 2013-2014 SDTA Foun-dation Scholarship Applications should have arrived by now. Your SDTA Board of Directors decided to offer 5 scholarships at the level of $1,000 each. The application guidelines and restrictions are attached to the applications. As always, copies can be made and the application is also available on the SDTA Website.

President, Black Hills Log Haulers Association

The 2013 SDTA Winter Board meeting was held on January 14th. One of the main purposes of this board meeting is to discuss the bills coming up

in the current legislative session. We discussed which bills the association is in favor of, opposed to or to stay neutral on. Again this year, Governor Daugaard's State of State Address included the pine beetle epidemic and a two million dollar funding bill for suppression has been introduced. Also again this year, Myron will lobby in favor of and testify in favor of that bill. The board meeting lasted all day then we took a short break before the evening dinner. The remainder of the evening was spent visiting with leg-islators at an ice cream social. l took this opportunity to visit with many leg-islators about the pine beetle bill and other bills that have a positive effect on the trucking industry. It was very important that we showed a presence at this social, for it is impossible to express our importance and expect support if we are not present.

Craig Bobzien, U.S. Forest Service supervisor recently released a report to the media in which he indicated that in the next five to seven years the forest service will be taking a more

proactive approach to the pine beetle epidemic on over 248,000 acres. This is a positive thing for the logging industry but even more important it is a big step in getting control of the pine beetle which is good for all of South Dakota.

Everyone should have received their revised 2011 survey forms by now. Please get them filled out and returned by February 1st. We will be holding a Black Hills Log Haul-ers meeting on February 24th at the Deadwood Mountain Grand in Dead-wood at 1:00 pm to discuss many oth-er issues and survey results. Bruce Votroubek, Joe Couch and myself will meet before the meeting in order to have some tentative cost per hour scenarios for membership approval and then presented to mill officials.

2013 membership dues are due; please get them sent in! We also need to work hard on getting non-members signed up and start working on associate members.

This year the SDTA Board approved five one thousand dollar scholarships. I suggest that everyone eligible ap-ply. This is a good selling point to use when silicating associate members as they too are eligible for scholarship dollars.

Your New Year’s Resolution: The Road to Better HealthBy Dan Heinemann, MD, Sanford Health

Every new year many of us restart our engines, determined to change aspects of our lives for the better. We make resolutions to lose a few pounds. Eat better. Exercise more.

For most of us, however, after a few days or weeks of hitting the gym and swapping fast food with home-cooked food, we lose ambition and our healthy hopes fall by the wayside.

Much like office workers who sit at a desk 40 hours a week, your career as a truck driver provides you with a few extra challenges when it comes to weight loss in particular. Fortunately, life behind the wheel of a truck (or behind the keyboard of a computer) doesn’t have to be unhealthy.

Removing the roadblocks

There are factors that act as roadblocks and get in the way of making permanent changes in our lifestyles. Getting rid of these roadblocks will make our resolutions reachable. Some common challenges include:

• Unrealistic expectations. Fad diets or exercise plans that promise results in days set us up for failure.

• Attitude. When we set our mind on seeing immediate results, we aren’t in the mindset necessary for sustain-able, long-term changes.

• Lack of support. Trying to make major change without letting people around us know our plans makes it even harder to make our resolutions a reality.

Making a change

Once we’ve gotten rid of the roadblocks it’s time to take those first steps toward lasting change. To reach your resolution, you should:

• Make realistic exercise and weight loss goals. Have a clear idea of what you’re trying to achieve.

• Create long-term lifestyle changes. Make plans for changes you can live with each and every day instead of reaching out to the quickest fix.

• Don’t get stressed out by failure. On those days when you don’t see immediate results or you fall off the wagon, don’t give up. Move past those steps backward to keep making progress.

• Work for steady change in both mind and body. Lasting lifestyle changes require gradual shifts in both our thoughts and habits.

Dan Norgaard, MCT Transportation LLC, Sioux Falls, SD, has been selected as the January 2013 Driver of the Month by the South Dakota Safety Management Council.

Mr. Norgaard has logged over 3.6 million miles in a professional driving career that spans 35 years. One accident in 2011 mars his otherwise accident-free record.

Dan has been a past Driver of the Month recipient three times. He has participated in the SD and National Truck Driving Champion-ships numerous times, finishing with his per-sonal best at the 2010 Nationals with a Third Place in the Straight Truck Class Division.

Dan is a professional from the word “Go!” His attitude is always positive and he shows a true concern for people and the company he represents. Safety is at the top of his list!

Dan and his wife Susan reside in Arlington, SD and are the parents of two adult children, Jenifer, 28 and Katie, 25. They are also the proud grandparents of 3 year old Denver.

FMCSA Gets Tougher On Bad CarriersReprinted from ATA’s Safety Management Council’s Safety Bulletin November 2012 Edition

The Federal Motor Carrier Safety Administration (FMCSA) wants authority to shut down motor carri-ers whose officers have shown “egregious disregard” for safety regulations by, for example, trying to op-erate as a new carrier when its operations under an-

When the train had cleared, the flashing lights cease and the crossing gate (arm) raised, at which time, Driver of V1 proceeded. Before V1’s rear trailer tires crossed the tracks, the arm came down, denting the trailer and cracking the arm.

LESSON LEARNED:

Although this may seem cut and dry when it comes to whether this was a preventable or non-preventable ac-cident, however, the thorough safe-ty director will investigate:

(1) whether there was any signs posted concerning any restrictions on length of time to cross or type of vehicles that are able to cross; (2) whether there were any signs that the arm was potentially defect-ing; (3) whether there was another train following immediately after that the driver could have seen and which would have caused the arm to come down; or (4) whetHer it’s pos-sible the driver started across the tracks before the arm was complete-ly up (although where the damage on the trailer is, indicates otherwise).

Not only is FMCSA after the “reincarnated” carrier, but those who have a controlling influence on the company’s operations, i.e., “engages or has engaged in a pattern or practice of avoiding regulatory compliance or masking non-compliance while acting on behalf of any motor car-rier.” This authority would implement section 4113 of SAFETEA-LU as amended by section 32112 of MAP-21. Comments were due January 14.

Preliminarily, ATA supports getting what may be a small number of “bad” carriers off the road but some of the rulemaking is peppered with language vague and imprecise which may create escapable loop-holes. For example, is a president, CFO or driver su-pervisor considered an officer, are all of them? ATA said FMCSA needs to elaborate and clarify.

North Central Farmers Elevator hosted a CDL driver training courseNorth Central Farmers Eleva-tor (NCFE) hosted a CDL driver training course on January 4, 2013. The training was conduct-ed by Trooper John Berndt from the South Dakota Highway Pa-trol. The 68 farmers and employ-ees that attended learned about the new MAP - 21 law (Mov-ing Ahead for Progress in the 21st Century) and the changes and requirements for companies and farmers. Trooper Berndt also covered a variety of other topics including pre and post trip inspec-tions, seasonal CDL requirements and rules covering logging miles.

North Central Farmers Elevator will host Trooper Berndt at NCFE locations throughout their trade terri-tory, for customer based trainings. Future dates will be determined.
