A charge sheet No. 13/188-2015 HRME (3) dated 29.06.2016

under rule-8 of Haryana Civil Services (Punishment & Appeal) Rules, 1987

was served upon Sh. Satyadev, Assistant, 0/o DEO, Rohtak on the

following charges:-

Sh. Satyadev, Assistant has failed to send the pension

case of Sh. Ramphool, Clerk (Retd) GSSS Kakrana in the office of

Accountant General, Haryana for approval in time. Sh. Ramphool

has filed the CWP No. 19580 of 2015 in the Hon'ble Purliab and

Haryana High Court for release of retiral benefit which was

forwarded to DEO Rohtak vide this office letter dated 13/185-2015

dated 30.10.2015. Even after receipt of CWP, the DEO Rohtak sent

the pension case to this office vide their letter No. E-2-16/1248-49

dated 26.02.2016 through Sh. Satyadev, Assistant for onward

forwarding to A.G. office, Accountant General Haryana. The same

was returned on the same day with the advice to take up the matter

with A.G office at their own level. But till now no response has been

received. Without approval of pension case from A.G. Haryana, this

office is unable to file the reply to CWP in Hon'ble Punjab and

Haryana High Court.

Sh. Satyadev submitted his reply to chargesheet vide his letter dated

26.08.2016 which was considered and he was given opportunity of

personal hearing on 29.12.2016 by the competent authority. During the

course of personal hearing, he failed to explain why no service book was

received from Govt. College Hodal for 31 years. He failed to convince on

any point why it is pending for years together.

After careful consideration of reply to the charge sheet and

submissions made by the official during personal hearing, on 29.12.2016,

1. Sh. Shripal [094148], Clerk, GMS, ChaharKhurd, Bhiwani is hereby informed

that it is proposed by the Governor of Haryana to take action against him under rule 7

of the Haryana Civil Services (Punishment and Appeal) Rules, 2016, on the grounds set

out in the enclosed statement of charges. The charges are based on the statement of

allegations appended thereto.

2. Sh. Shripal [094148] is hereby required to state in writing within a period of 15

days from the receipt of this memorandum by him whether he admits the truth of all,

or any, of the charges, what explanation or defence, if any, he has to offer and whether

he desires to be heard in person.

3. Sh. Shripal [094148] is hereby further informed that if for the purpose of

preparing his written statement, he wishes to have access to the relevant official records,

he should inspect the same in the office of the Director General, School Education, i Haryana, Panchkula, on any working day after making prior appointment with him. It

is, however, pointed out that only such documents will be shown to him as are in the

possession of the Director General, School Education, Haryana, Panchkula and as are

strictly relevant to the case. If in the opinion of the Government, it is not desirable in

the public interest, to allow him access to any document, such access shall be refused.

If, Sh. Shripal [094148] wishes to consult any other relevant record, which is not in the

custody of the Director General, School Education, Haryana, Panchkula, it is for him to

undertake its inspection. It is, however, made clear to Sh. Shripal [094148] that his

failure to inspect the documents shall not constitute a valid ground for delay in the

submission f his written statement and if the written statement is not received by the

undersign within the specified period, it shall be presumed that he has none to

e‘a

submit. \

4. The written statement should be submitted direct to the undersigned.

5. The receipt of this memorandum with enclosure may be acknowledged.

any information to the higher authority. The Headmaster, GMS, ChaharKhurd,

Bhiwani sent letter: to his house address regarding joining of duty. Instead of joining

duty, Sh. Shirpal visited the school on 26.08.2016 and submitted his resignation

w.e.f. 12.05.2016 by enclosing an affidavit to this effect.

Thus, Sh. Shripal, Clerk is willful absent from duty since 13.05.2016

and has violated the Haryana Civil Services (Employees Conduct) rules-2016,

Note :-

1. The official will be relieved immediately and in any case with in 3 days failing which he/she will be liable for disciplinary action, However if any official is working in Census duty, he/she shall not be relieved till the Census duty is accomplished.

2. No TA/DA and joining time will be admissible to the official if he/she has been shifted on his/her request after exercising option.

3. No male official below the age of 50 years be allowed to join in the girls schools. 4. If there is no vacancy in the destination school for any reason the incumbent transferred shall re-join his/her

previous place of posting and also inform to concerned branch/computer cell at HQ. If any discrepancy is noticed in this order or there is a violation of transfer policy, It should be brought to the notice of Computer Cell/Concerned branch within three days and the order be not implemented.

5. In case of mutual transfer, it is directed that before relieving/joining the officials concerned, it may be ensured that the distance between both the schools is not less than 8 km.

6. The mutual transfer would be effective only when both the employees seeking mutual transfer submit a consent document to their respectivePrincipals.

7. Consent/affidavit of the official be taken that he is willing to loose his seniority in case of requested transfer orders.

8. With condition that the official does not joined in his previous place of posting.

9. The official will be update their profile in MIS Portal when he/she join/relieve from his/her present working station and also supply the information to the Directorate within three days positively.

10. Concerned DDO is also directed to update and approved MIS data of the official at your own level within three days positively.
