TAKE CARE WITH COMPRESSED AIR

Compressed air tools are commonly used in many workplaces. Many workers take them for granted, ignoring the hazards involved in their

use. Compressed air is not "just air." Its a focused stream of air driven at a high velocity, which can cause serious injury or death to its

operator or persons in the immediate area.

Fooling around with compressed air can be lethal. In one case, a blast of air playfully directed behind a worker startled him and caused him

to fall against a moving piece of machinery. A misdirected blast of compressed air can "pop" an eyeball from its socket, rupture an eardrum

or cause a brain hemorrhage. Directed at the mouth, it can rupture the lungs and intestines. If used to blow dust or dirt off clothing or body

parts, it can cause bubbles of air to enter the blood stream, even through a layer of clothing, and inflate and rupture body organs.

To prevent accidental injury when working with compressed air, here are several precautions to follow:

A compressed-air tool operator must wear eye protection and other appropriate personal protective equipment.

Before operating an air hose, examine all connections to make sure they are tight and will not come loose under pressure. A loose

air hose can make a dangerous bullwhip.

Check the air hose carefully to make sure it is in good condition before opening the valve to let air into the hose; when the job if

finished, turn off the valves on both the tool and the air line.

Hold the nozzle when turning the air on or off.

Before turning on the air pressure, make sure that dirt from machinery will not be blown onto other workers.

Dont kink the hose to stop the airflow; always turn off the air and the control valve.

Continuously check the condition of a compressed air tool and the air hose for damage or signs of failure.

Never point a compressed air hose nozzle at any part of your body or another person.

Never use compressed air for a practical joke.

Never look into the "business end" of a compressed air tool.

Never use compressed air for cleaning work clothes or machinery.

Keep air hoses out of aisle ways where they can be damaged by traffic or be a tripping hazard.

Compressed air tools are safe and reliable when properly and sensibly used.

Las herramientas de aire comprimido se utilizan comunmente en muchos lugares de trabajo. Muchos trabajadores no les prestan suficiente

atención y hacen caso omiso de los riesgos que conlleva su uso. El aire comprimido no es "solamente aire". Es una corriente concentrada

de aire impulsada a alta velocidad, la cual puede causar serias lesiones o la muerte a su operador o a las personas que se encuentran en

las inmediaciones.

Jugar con el aire comprimido puede resultar mortal. En una ocasión, un chorro de aire dirigido en broma a espaldas de un trabajador, lo

Like the timber wolf that has been in the news looking for new territory across the borders of Oregon and California, contractors across the west are also looking for opportunity in new places. For contractors with longer reach, knowing the variations in license law can make the difference between success and failure. We share some of the problems and some of the ‘profit’ in working across state lines…

Q: Capitol Services helped us years ago with obtaining our GC contractor’s license in Nevada and California and I have a question for you. The Responsible Managing Officer (RMO) on the license (who also happens to be my Uncle) is planning to retire at some point in the near future and we were wondering if there is a way to add me as a second Qualifier on the licenses so it doesn’t lapse. We were also thinking this would be beneficial in case anything unexpect-ed were to happen to him. A: Thanks for thinking of us. Since California only allows one Qualifier per classification, you cannot both be Qualifiers on the CA license si-multaneously. You can either replace your Un-cle on the license now as a pre-emptive step, or

you could obtain your own Sole Owner license as a “back-up” so the process of replacing him will be easier down the road. Keep in mind that even if you do nothing now, you will have 90 days to replace him if he were to retire or some-thing unexpected occur.With regards to Nevada, you certainly can be added to the license as a second Qualifier. In fact, Nevada actually allows up to TEN qualifiers on each license! Please contact us if you’d like assistance with this process.

Q: My company has had a General Building (“B”) license since 1985. In 2009 we obtained an “A” license by having one of our employees take the necessary exams. He is now leaving the company and I was wondering if there is any way for me to qualify the “A” portion of our license without having to take the tests? I am currently the RMO/President for the General Building license. Our company has been doing “A” projects for over 12 years. A: Unfortunately, you will have to take the trade exam to replace your employee for the General Engineering or “A” classification. The only way to qualify for a waiver is if your company had held

that classification (and the license has been in good standing) for 5 of the prior 7 years. The “A” work you reference was actually done with-out benefit of a license “in good standing” and would not be counted as experience. Q: I currently have a “C-61”/”D-06” (Concrete re-lated services) license in CA. My company does concrete pumping. We have some potential work in Nevada and I have reviewed Nevada’s classification list and it doesn’t appear that they have anything that is equivalent. Do I even need a license to perform this work in Nevada? A: Thank you for contacting us. If all you are doing is delivering and pumping from the truck then no, a contractor’s license is not required in Nevada. We hope this advice helps ‘pump’ up your profit line!

for disciplinary action if a contractor fails to no-tify workers’ compensation insurance providers within 20 days of hiring additional employees.

AB 2219 would amend Business and Professions Code section 7125 to indefinitely extend the requirement that all C-39 Roofing contractors obtain workers’ compensation coverage, even if they certify that they have no employees. That requirement currently is set to expire at the be-ginning of 2013. The bill also would extend, in-definitely, the requirement that insurers conduct annual audits, and would add that these audits be conducted in person to verify the accuracy of the reported number of employees.

AB 2449 would make changes to laws regarding the definitions of independent contractors and workers’ compensation.

Senate Bill (SB) 691 would add the Contractors State License Board to the list of agencies ap-proved to receive workers’ compensation in-formation from the Employment Development Department.

Employer vs. Independent Contractor/Wages AB 2288 would authorize a city or county pros-ecutor to take civil action against a build-ing

contractor for failure to pay wages, benefits, and workers’ compensation to employees.

AB 2373 would amend the definition of an inde-pendent contractor. SB 1333 would direct the Division of Labor Stan-dards Enforcement to establish consultation ser-vices for businesses with fewer than 100 employ-ees to help them clarify wage and hour laws, and would charge fees for these consulting services.

Underground Economy SB 1185 would create the Central Intelligence Partnership among multiple state agencies to combat underground economic activity.

Regulations/Permits AB 1537 would make changes to the rule-mak-ing process for regulations that would have a $50 million or more impact on California busi-nesses.

AB 2114 would enact new construction permit requirements for swimming pools, spas, or pub-lic wading pools.

AB 2398 would impact permits for construction projects related to recycled water.

AB 2595 calls for streamlining the permitting process for the design and construction of de-salination plants.

SB 1099 would change the effective date of regulations to four times annually, versus the current 30 days following Office of Administra-tive Law (OAL) approval, and would require OAL to provide a link on its website to all regulations filed with the Secretary of State.

SB 1306 would make changes to the process of permitting and denial of permits for construc-tion granted by the State Water Resources Con-trol Board or its regional offices.

SB 1520 seeks to streamline the state’s regula-tory and permitting processes.

Public Works Contracting AB 2353 would address substitutions in public works contracting.

AB 2440 would make changes impacting those contracting for public works projects with the Los Angeles County Metropolitan Transporta-tion Authority.

SB 1370 would require the Department of Industrial Relations to post on its website prevailing wage requirements on public works proj-ects.

SB 1549 would change public works contract bidding in the San Diego region. Boards and Licensees AB 1588 would waive fees or continuing education requirements for a licensee whose license expires while on active duty in the military reserve or California National Guard.

AB 1904 would allow for the issuance of temporary professional li-censes (including those issued by CSLB) to spouses of those serving in the military.

AB 1920, which would have addressed payments for work done out-side a contractor’s licensing classification or without a license, failed passage in the Assembly Business, Professions and Consumer Protec-tion Committee.

AB 2027 would change provisions for courts in determining whether individuals had substantially complied with state licensing require-ments during the time work was performed.

AB 2482 would create the California Registered Interior Designers Board within the Department of Consumer Affairs, and includes provi-sions related to construction contractors licensed by CSLB.

AB 2570 would prohibit a licensee from including provisions in settle-ments of a civil dispute that prohibit the consumer from contacting, filing a complaint, or withdrawing a complaint with CSLB (or any other consumer protection board overseen by the Department of Consumer Affairs).

SB 975 would prohibit local governments from imposing licensing re-quirements on any professions that are licensed by DCA boards, bu-reaus, and commissions (such as CSLB).

SB 1576 would enable CSLB to take administrative action to address the filing of a false complaint against a licensee.

Other Proposals Related to Construction AB 1750 would affect those contracting for rainwater capture proj-ects.

AB 2339 would require state regulators and those involved in the heat pump and geothermal heating and cooling industries to evalu-ate policies and develop infrastructure for wider-spread use of these technologies.

AB 2644 would direct the Building Standards Commission to adopt standards for the construction, installation, and alteration of charging stations for electric vehicles in single family residential properties.

SB 1092 would address surety bonds for construction trucking ser-vices.

SB 1447 would address construction of artificial reefs.

The Board of Equalization is considering regulations that will im-•pact use tax collection that might apply to some contractors in California. The proposal is on page 456 of 2012 Register No. 14-Z http://www.oal.ca.gov/res/docs/pdf/ notice/14z-2012.pdf. State Allocation Board regulations that became effective March •26, 2012, will impact future school construction contracts with re-spect to Department of Industrial Relations requirements for pay-ment of prevailing wage. Details are on page 469 of 2012 Register No. 14-Z. Regulations proposed by the Secretary of State will impact fees •required by some corporations regarding its Victims of Corpo-rate Fraud Compensation Fund. The proposal is on page 477 of 2012 Register No. 15-Z http://www.oal.ca.gov/res/ docs/pdf/notice/15z-2012.pdf. Regulations proposed by Cal Recycle for the recycling of archi-•tectural paint called for in AB 1343 of 2010 were disapproved by the Office of Administrative Law, as detailed on page 528 of 2012 Register No. 16-Z http://www.oal.ca.gov/res/docs/ pdf/notice/16z-2012.pdf. State Water Resources Control Board regulations related to the •construction of underground storage tanks became effective on May 10, 2012, and are detailed on page 534 of 2012 Register No. 16-Z.Department of Insurance proposed regulations regarding work-•ers’ compensation premium rates to take effect on July 1, 2012, are detailed on page 546 of 2012 Register No. 17-Z http://www.oal.ca.gov/res/docs/pdf/ notice/17z-2012.pdf. Regulations proposed by the Department of Fish and Game •could impact construction in areas impacting some endangered species beginning on page 524 of 2012 Register No. 16-Z, and be-ginning on page 595 of 2012 Register No. 18-Z http://www.oal.ca.gov/res/docs/pdf/ notice/18z-2012.pdf. The Occupational Safety and Health Standards Board has pro-•posed changes to regulations regarding safety issues for high and low voltage electrical workers and cranes and derricks. Sealed proposals for Bid No. 3675 for the Taxiways H, J and C Pavement Rehabilitation Project will be received in the Purchasing Office, 310 E. Unlicensed Operators

Like legitimate contractors, unlicensed operators sometimes use advertising to find new clients. Ads without license numbers or with numbers that are not issued by the CSLB are frequently used by the Board to identify sting targets.

The CSLB and other enforcement agencies use two sections of the law—B&P Sections 7027.1 and 7099.10—to take legal action against unlicensed contractors and, on occasion, against licensed contractors who advertise illegally.

If an unlicensed operator advertises as a contractor in a telephone directory, and if an investigation determines the entity doing the advertising is unlicensed, under B&P Section 7099.10 (a), the Registrar can issue a citation for a fine or other civil penalty assessment. The citation will also include an order of correction that requires:

any phone number in the unlawful ad and to not refer subsequent calls to any new number obtained by that person. If the order of correction isn’t made, the Registrar can have the Public Utilities Commission disconnect the phone service.

If you believe that an unlicensed contractor is actively working on a construction project, contact the CSLB at 1-800-321-CSLB (2752) or fill out a “SWIFT Lead Referral” form, which is available on the CSLB Web site, www.cslb.ca.gov.
