INTRODUCTION TO FAMILY LAWHOW CAN WE DEFINE FAMILY LAW:

• Before introducing about the family law, we will explain the legal definition of family. What does exactly family mean in terms of law.

• In legal terms family is described as the group of individuals who are related to each other and share the ties of blood, marriage or adoption. Family consists parents, children and other relatives who live together and are related to each other.

• FAMILY LAW: An area of law that deals with matters arise in family. Examples of these matters are: Divorce, child custody, adoption, support paternity etc. Besides married couple, unmarried couple and their legal matters come under family law.

• Divorce: Termination of a marriage by a court in a legal proceeding is called Divorce. It is a legal separation of  husband and wife. There are two types of Divorce.

• Fault:  Fault divorce is when one party blames the other party for any misconduct. In this type of divorce we need to present enough and accurate proof in a court and need to require sufficient ground for divorce.

• No Fault: In No- Fault divorce neither party is required to show any proof, it is just the breakdown of marriage or due to the irreconcilable differences between the couple.

• But many of the courts  do not offer no fault divorce.

Stepwise Process of Divorce• File petition: The very first step in divorce process is to file a petition. Whether a couple is filing for

fault divorce or no fault divorce, In both the cases he/she needs to file a petition

• Temporary orders:  In order to get the child custody or financial support, spouse who is dependent for these needs on other require to file their request in court. This request for temporary orders should be file as soon as possible and they will get the order in a few days.

• Services of process:  This is a document that proves a copy of divorce petition was given by you to your spouse and was received by him/her. Most of the time your divorce attorney handles this process and negotiate with your spouse.

• Response: Spouse who receive the service of process needs to file a response to a  petition. In  Divorce cases these works are handle by the attorneys of both the sides.  

• Negotiation: During negotiation spouses get an opportunity to negotiate their differences if there are any. This is when collaborative divorce process works. If still they do not agree, they go to trial.

Stepwise Process of Divorce:• Of the order of dissolution: Order of dissolution is the last step of divorce process that

legally end the marriage and give decision on the basic aspects related to the couple that includes- property, child custody etc.

• Child custody : Child custody is also called as legal guardianship. It is a decision took by the court that who will be responsible for the custody of child after divorce. It is the legal rights and responsibilities of parents towards their children. Court takes decision after checking it on many grounds.
