COMMISSION CHAMBERSJULY 9, 2015 – 6 P.M.

1. CALL TO ORDER Chairman Madalena called meeting to order at 6:03 p.m. Present were Chairman Madalena, Vice Chairman Dominguez, Commissioner Scherzinger, Commissioner Chapman and Commissioner Walters.

2. PLEDGE OF ALLEGIANCE Pledge of allegiance was led by Jamie Grindatto.

3. INTRODUCTIONS & ANNOUNCEMENTS Chairman Madalena announced 15-16 students from the Pueblo of Jemez are attending the Tribal White House Summit.

4. PRESENTATIONSA. Girl Scouts of New Mexico Trails – Rancho del Chaparral

(Nancy Wood, Director of Development) Casey Hoyt, Ambassador for the Girl Scouts of New Mexico Trails spoke about her experiences with the program and how much it has impacted her life. Nancy Wood the Director of Development also spoke about her time with the program and asked the Commission for financial support. The Commissioners thanked them for their presentation and will consider their request.

B. 2008 Airport Feasibility Study Update – Phase I Summary(Dianne Maes, County Business Development Director)

County Business Development Director Dianne Maes gave an update on the 2008 Airport Feasibility Study. She went over the pieces that would need to be in place in order to move forward with an airport in Sandoval County. Steve Summers the Aviation Director for the State of NM and Mike Rice former Aviation Director and Director of the Sunport also commented on the airport study. Commissioners made their comments on the airport study.

C. Sandoval Economic Alliance Contract Year End Update(Dianne Maes, County Business Development Director)Director Maes gave an overview of the Sandoval Economic Alliance as the contract year ends. CEO and President, Jamie Grindatto was also present and briefed the Commission on the many accomplishments as well as the ongoing projects for the SEA. The Commission congratulated them as well as the County Manager on all of their accomplishments.

5. APPROVAL OF AGENDA Commissioner Walters motion to move item 13 before item 12, second by Commissioner Scherzinger. Motion passed. Vote was unanimous. Commissioner Walters motion to approve as amended, second by Vice Chairman Dominguez. Motion passed. Vote was unanimous.

Vice Chairman Dominguez, second by Commissioner Scherzinger. Motion passed. Vote was unanimous.

E. Request for a Motion to Approve an Economic Development Lease between SandovalCounty and Commissioner of Public Lands for 529 Acres of Land for the Purpose ofEconomic Development and Authorize the County Manager to Enter into the Lease andAll Subsequent Amendments

Director Springfield introduced Deputy Commissioner for the State Land Office Laura Riley and the Commercial Resources Division Director for the State Land Office Craig Johnson. Deputy Commissioner Riley spoke on behalf of Commissioner Dunn and stated that they are looking forward to working with Sandoval County on Economic Development. County Attorney Trujillo noted that this is a request to authorize the County Manager to execute this agreement. Attorney Trujillo has not done his final review and some minor changes such as formatting may be made.Commissioner Scherzinger motion to approve, second by Vice Chairman Dominguez. Motion passed. Vote was unanimous.

10. FIRE DEPARTMENT(James Maxon, Fire Chief)Request for Motion to Adopt Resolution No. 7915.10 Declaring Sandoval County anEmergency Disaster AreaChief Maxon read the resolution and briefed the Commission on various areas within Sandoval County that have experienced recent flooding. Comments made by Commission on flooding in the County.Vice Chairman Dominguez motion to approve, second by Commissioner Scherzinger. Motion passed. Vote was unanimous.

12. CLOSED SESSION: Pending Litigation Update (Fleming v. Gutierrez, et al., Case No.13CV 222 WJ/RHS) in Accordance with the Open Meetings Act, NMSA 1978, Section10151(H)Commissioner Scherzinger motion to enter into closed session pursuant to NMSA Section 10-15-1(H) at 8:24 p.m., second by Vice Chairman Dominguez. Motion passed. Vote was unanimous.Commissioner Scherzinger motion to come back into regular session at 8:40 p.m., second by Vice Chairman Dominguez. Motion passed. Vote was unanimous.Chairman Madalena stated that only those matters referred to in the amended agenda were discussed in closed session and no action was taken.

13. COMMENTS FROM THE COMMISSIONERSCommissioner Walters reminded everyone that the County Fair is coming up, July 27th- Aug.1st. Commissioner Walters and Vice Chairman Dominguez will be meeting with officials in Cuba during the fair. Also Vice Chairman Dominguez and Commissioner Walters will be in North Carolina. Vice Chairman Dominguez requested that Director Mora notify residents that they are aware of the situation and will be working on County Road 11 as soon as the rain stops. Vice Chairman Dominguez thanked Director Mora and staff for their hard work. Chairman Madalena agreed that is important to keep residents in rural areas informed that the County is aware of the flooding and will be working on those areas as soon as the rain stops. Chairman Madalena announced a fundraiser for Eugene McNeil and family on Friday July 10th in the Administration Building atrium. Chairman Madalena recommended the Commission look at passing a resolution to preserve the Chaco cultural site. Also the Jemez Pueblo Fire Station #64 Dedication Ceremony will be on July 17th at 10a.m.

Commissioners thanked Manager Rios, Finance Director Cassandra Herrera, and staff for doing a great job on the final budget. Commissioner Chapman motion to approve, second by Vice Chairman Dominguez. Motion passed. Vote was unanimous.

AttachmentsResolution - BLM Buffalo Tract

WHEREAS, the Bureau of Land Management owns a tract of land commonly referred to as

the “Buffalo Tract” located in eastern Sandoval County adjoining the communities of Placitas and

Algodones; and

WHEREAS, those areas of Sandoval County that are contiguous to the Buffalo Tract are

currently zoned RRA (Rural Residential Agricultural); and

WHEREAS, on April 16, 2009, the Sandoval County Commission adopted the Placitas Area

Plan, which states that one of the county’s goals for this area is to, “[e]ncourage the BLM to

maximize open space opportunities on the roughly 3,500 acre tract to the north of the Plan Area as

open space, and to set aside any part of this tract identified as a wildlife corridor for use by wildlife”,

page 66; and

WHEREAS, the Sandoval County Commission is concerned by the possibilities of the adverse

effects of additional sand and gravel mining in the Placitas and Algodones areas.

NOW THEREFORE BE IS RESOLVED, that the Board hereby states, it would not

support any new sand and gravel mining on the BLM Land known as the Buffalo Tract that

adversely affects the citizens of Sandoval County on the BLM Land known as the Buffalo Tract.

BE IT FURTHER RESOLVED that the Board hereby encourages the BLM to maximize

open space opportunities on the Buffalo Tract to include setting aside a part of this tract as a wildlife

corridor.

BE IT FURTHER RESOLVED that the Board hereby requests that the BLM provide the

County Manager notice of any planned development of the Buffalo Tract or any hearing involving

the development of the Buffalo Tract, utilizing the following contact information:

Why Action Is Necessary (Summary):This funding will construct a new senior center in Bernalillo at Rotary Park in the Town ofBernalillo. The current center is over 70 years old and does not have the neededcapacity to meet the needs of the growing senior population. The Bernalillo SeniorCenter cooks for Bernalillo, Placitas, Jemez, and Pena Blanca. The new Center willhave a large commercial kitchen designed to meet the increase in Congregate andHomebound meals for these Centers.
