April 2014National Asbestos Awareness Week is an annual event to warn

and educate people about the dangers of exposure to asbestos con-taining building materials, and the prevalence of asbestos related diseases, such as mesothelioma. As we all know, asbestos is still being mined, imported, and used despite being confirmed as a hu-man carcinogen. 55 countries have banned asbestos, but the United States has not. Asbestos fibers can be nearly 700 times smaller than human hair. They are odorless, tasteless, indestructible fibers that can remain suspended in the air. Asbestos fibers can be inhaled easily and are difficult for the lungs to expel.

Abatement is defined as the procedures to control fiber release from asbestos containing materials, typically during removal. Abate-ment includes removal, encapsulation, enclosure, demolition and renovation activities related to asbestos.

The California Health and Safety Code 25915 requires all build-ing owners in the State of California to provide written notification to employees, tenants and contractors of the presence and location of

asbestos containing construction mate-rials within their buildings. Asbestos containing construction materials are defined as any materials with an asbes-tos content of greater than one tenth of one percent (>0.1%).

Under the U.S. EPA National Emission Standard for Hazardous Air Pollutants (NESHAP) regulation, no visible emissions are allowed during building demolition or renovation activities, which involve regulated asbestos containing materials. For this reason all buildings must be surveyed for asbestos containing materials prior to demoli-tion or renovation. The EPA, and or local Air Quality Management District must be notified prior to any building demolition even if no asbestos containing material is present. NESHAP requires removal of all asbestos containing materials which have or will become fri-able prior to any demolition or renovation activities.

California and Nevada Laws require that specially licensed asbestos abatement contractors perform work with asbestos contain-ing materials. Additionally, Federal OSHA, California OSHA and

Nevada OSHA require employers to imple-ment specific work practices which protect workers from airborne asbestos exposure.

Mark your calendar now for the 21st Annual Claims Confer-ence of Northern California: “Hitting A Home Run - covering all the bases”. This Summer Classic will be held August 19-20, 2014. The two-day series will take place on a Tuesday and Wednesday this year, back at the Hyatt Regency Downtown Sacramento.

“Hitting A Home Run - covering all the bases” is an apropos theme, both in honor of the Baseball “Summer Classic”, and in mak-ing the most of a mid-week conference experience, offering a chance to get out of the Sacramento Summer heat for a time.

On deck presently is Exhibitor Registration. First pitch for returning exhibitors is planned for Wednesday, March 19th. CCNC will once again maintain a maximum roster of as many 63 players for the Tradeshow portion of the two-day series. Once returning players get a chance to weigh-in, newcomers will be invited to camp. A huge thanks to all our exhibitors. The overall CCNC experiencing is greatly enhanced because of you all.

CCNC would like to also acknowledge and thank all our spon-sors, who do so much to make this annual event possible. Prime opportunities are being made available for our sponsors this year.

As with the exhibitor roster, returning sponsors will get first rights to renew their spots before opening up the field to all. Spon-sors and Exhibitors from last year, please keep an eye on your email for advanced notice.

CCNC has built a strong reputation as a contender on the pro-fessional field when it comes to industry continuing education, and never has that been more true than now. The Educational Committee scouts have developed a strong line-up of experienced presenters to bring claims professionals the latest in Property and Casualty/Li-ability Claims-related knowledge and information. CE credits will be made available for the various seminar sessions, as has become the norm. A new spark to the team this year comes in the form a special treat for first-night’s relaxation and entertainment, as well. Stay tuned for exciting details to follow on that.

The Sacramento Claims Association enjoyed a needed Re-Certification presen-tation at their March 13, 2014 Luncheon, held at the Lions Gate Hotel & Confer-ence Center at McClellen Park. It was a very entertaining seminar given by Blane Smith, a partner at the law firm of Farmer, Smith and Lane, LLP. Mr. Smith's incredible sense of humor made the day very productive

He passed out an eleven page Summary of Selected Regulations. Mr Smith said "if you've ever testified in a bad faith case you will understand why you need to be familiar with the Regula-tions. You all need to be Certified because Judges are very careful about Jury Instruc-tions and you need to know the laws.

You must be careful that your documents are clear and in detail. They need to be able to reconstruct the Claim. Be specific in claim notes. Take time to put in Mr., Mrs. Ms or Miss. Sometimes names like Chris, Tim, Terry or Stacey could be any gender.

2. Communicate with the In-sured and Claimant.

3. Play Fair. Tell them the time they have to answer. The statute is such and such a date.

Learn about the potential conflicts on a “po-lice” tow as compared to an “insurance” tow. Ad-

ditionally, he will offer-up information on the storage and impound area.

“I’ve been working with the DMV on the lien sale process in CA,” he informs us. “Seems we are becoming the “title washing” state, so we’ve approached them about assisting in cleaning up this issue.”

To the extent there is interest, he may also share details of the technicalities of towing, specifically on correct ways to avoid ad-ditional damage to the vehicle, etc.

Billing is always an issue, too, so Mr. Muzamel may provide a comparison on the CHP billing guidelines, as well.
