and belief against JOHN ERNEST MANCINI, charging that in Maricopa County, Arizona:

JOHN ERNEST MANCINI, on or about the Sth day of October, 200S, intentionally, knowingly, or

recklessly caused a serious physical injury to J JENNINGS # 2088, a peace officer engaged in official

duties. in violation of ARS. §§ 13-1203, 13-1204, 13-701, 13-702, 13-702.01, and 13-801.

The State of Arizona further alleges that the offense charged in this count is a dangerous felony

because the offense involved the discharge, use, or threatening exhibition of a handgun, a deadly

weapon or dangerous instrument and\or the intentional or knowing infliction of serious physical injury

upon Officer Jennings. in violation of ARS. § 13-S04(P).

COUNT 2:

JOHN ERNEST MANCINI, on or about the 6th day of October, 2006, recklessly endangered

JOSEPH M SPECTOR #2075 with a SUbstantial risk of imminent death, in violation of A.RS. §§ 13-

1201,13-701,13-702,13-801, and 13-812.

COUNT 3:

JOHN ERNEST MANCINI, on or about the 6th day of October, 200S, intentionally or knowingly

disturbed the peace or quiet of a neighborhood, family, or person, by recklessly handling, displaying, or

discharging a han'dgun. in violation of A.RS. §§ 13-2904,13-701,13-702,13-702.01, and 13-801.

The State of Arizona further alleges that the offense charged in this count is a dangerous felony

because the offense involved the discharge, use, or threatening exhibition of a handgun, a deadly

weapon or dangerous instrument and\or the intentional or knowing infliction of serious physical injury in

violation of ARS. § 13-S04(P).

COUNT 4:

recklessly inflicted unnecessary physical injury to an dog, an animal, in violation of A.R.S. §§ 13-2910,

B. PROBABLE CAUSE STATEMENT 1. Please summarize and include the facts which establish

probable cause for the arrest ON 10/06/06 OFFICERS RESPONDED TO THE SUSPECTS HOUSE REFERENCE A WELFARE CHECK. WHEN OFFICERS ARRIVED THEY ATTEMPTED TO CONTACT THE SUBJECT AND GET HIM OUT OF HIS HOUSE. SHORTLY THEREAFTER GUNSHOTS WERE FIRED AT THE OFFICERS FROM THE SOSPECTS RESIDENCE. AT THAT TIME OFFICERS BACKED OFF AND ESTABLISHED A PERIMETER AROUND THE AREA. THE SURPR1SE POLICE DE­PARTMENT AND GLE~DALE POLICE DEPARTMENT'S SAU TRAMS WERE CALLED TO THE SCENE. THE SUSPECT THEN BARRI­CADED HIMSELF IN THE HOUSE AND FIRED SEVERAL MORE ROUNDS INTO THE NEIGHBORHOOD. THE SURROUNDING NEIGH­BORS WERE EVACUATED AND TAKEN TO A NEAR-BY SCHOOL. THE SOSPECT CONTINUED TO FIRE MULTIPLE ROUNDS FROM ASSOALT RIFLES AND HANDGUNS PROM INSIDE OF THE HOUSE. THE SUSPECT THEN SHOT AND KILLED HIS DOG. APTER HOURS OF NEGOTIATIONS THE SUSPECT SURRENDERED WITHOUT FURTHER INCIDENT. THE SUSPECT SHOT APPROXIM­ATELY 50 ROUNDS FROM HIS RESIDENCE, SOME OF WHICH STRUCK NEARBY HOMES. INCI.lJDING SIGH POWERED RIFLE ROUNDS. THE SUBJECT APPEARS TO BE MENTALLY UNSTABLE. AT THE BBGINING OF THE INCIDENT THE SUBJECT STATBD HE WAS GOING TO KILL THE POLICE.
