NYS ACCEPTANCE NOTICE

NAC P.O. Box 1599 Carthage, NC 28327 Re: Duncan Family Farms, LLC- NY1296049 Dear Employer: Your ETA Form 790 for an H-2A job order was received and reviewed by this office. It was determined the job order was filed timely, meets the regulatory requirements and will be placed on New York State’s active file to initiate intrastate recruitment of U.S. workers. Here is information regarding next steps:
1. Housing Inspection: A compliant housing inspection report must be received by the Chicago National Processing Center (CNPC) at least 32 days prior to your date of need. Please see the attached flyer for additional details about the approval process.
• If your total housing capacity is 4 or less workers, to schedule an inspection, please contact the NYS Department of Labor’s Agriculture Labor Specialist in your area. The contact information can be found here: https://labor.ny.gov/immigrants/agriculture-labor-program/agriculture-labor-specialists.shtm. Employers must provide evidence of compliant drinking water to the NYS Department of Labor as part of the housing inspection process. Well-water must be tested through a NYS certified lab, at least once before the workers arrive and once during the operational season. A list of certified labs can be found here: https://www.wadsworth.org/regulatory/elap/certified-labs.
• If your total housing capacity is 5 or more workers, to schedule a housing inspection, please contact the Department of Health (DOH) in the county where the housing is located. Use this link to locate the contact information for the correct DOH location: https://www.health.ny.gov/environmental/water/drinking/doh_pub_contacts_map.htm.
2. Submit ETA-9142A: You must submit a completed ETA-9142A, a copy of the enclosed accepted ETA 790 including all attachments and any other required documentation to the CNPC no less than 45 calendar days before the start date of need. The NYS Department of Labor recommends you create an account to submit the documents electronically through US DOL’s iCERT portal. Please visit http://icert.doleta.gov/ to create an account. Or, you may submit the documents to the following address:
