FUEL SURCHARGE

The fuel surcharge is in effect to offset the impact of the increase in fuel prices. The surcharge will apply to net freight charges. The surcharge will be calculated utilizing the Department of Energy average diesel fuel price West Coast Average. RULES ITEM

DEFINITIONS

(1) “Delivery” means the service of the carrier in delivering freight to dock, platform or unloading area directly accessible to trucks at consignee’s designated point of delivery.

(2) “Joint Line / Interline Shipments” are defined as:

a) inbound collect shipments originated by other than, but delivered by, the Carrier party to a particular agreement and/or

b) outbound prepaid shipments originated by the Carrier party to a particular agreement, and delivered by the Carrier's partner carrier.

(3) “Pickup” means the service of carrier in calling for and collecting freight at dock, platform or doorway directly accessible to trucks at consignor’s residence, warehouse, factory, store or similar place of business, and receipting therefor.

(4) “Place” means a particular street address or other designation of a factory, storage site, place of business or residence, construction camp or the like, at a point.

(5) “Point” means a particular city, town or village which is treated as a unit for the application of rates.

(6) “Regular Working Day” shall mean any eight hour working period broken by not less than ½ hour, nor more than 1 hour, and NOT requiring overtime or holiday pay.

(7) “Shipment” means a lot of freight received from one shipper, on one Bill of Lading, at one place, at one time, for delivery to one consignee at one destination.

(8) “Ton” means a ton of 2,000 pounds, except where otherwise specifically provided.

(9) “Legal Holiday” is defined as:

New Year’s Day – Jan. 1 Thanksgiving Day – The 4th Thurs. in Nov.

Presidents’ Day – The 3rd Mon. in Feb. Day after Thanksgiving Day

Memorial Day – The last Mon. in May Christmas Eve – Dec. 24

Independence Day – July 4 Christmas Day – Dec. 25

Labor Day – The 1st Mon. in Sept.

When a holiday referring hereto falls on a Sunday, the following Monday will be treated as the holiday.

Accessorial services performed on holidays are at 150% of the charges named herein. Also see Item 754 of

this Tariff for provisions governing pickups on Saturdays, Sundays or Holidays.

AMAZON DELIVERY ADMINISTRATIVE FEE

All Amazon shipments tendered to Carrier for delivery will incur a $35.00 administrative fee in addition to all other applicable rates and charges.

APPLICATION of TARIFF

The rates and provisions referencing this Tariff, or as amended, are limited in their application on Interstate or Foreign Commerce and Intrastate Commerce to the extent of the Carrier’s operating authority.

APPLICATION of RATES, GENERAL

Except as otherwise specifically provided, rates referencing this Tariff:

1: Are named in cents per unit specified;

2: Include one pickup and/or delivery for each shipment;

3: Do NOT include loading into NOR unloading from carrier’s equipment;

4: Are for truck and driver ONLY;

5: Are named and payable in lawful money of the United States;

6: Do NOT include the return of pallets or dunnage;

7: Apply within a fifteen (15) air mile radius of cities, towns, and other locations named;

8: Do NOT include traveling over unpaved roads;

9: Do NOT include pickup, delivery or accessorial services on Saturdays, Sundays or Holidays. (See Definition of Holidays and provisions for service on same in Item 110 and Item 754.)

ABSORPTION of PORT, RAIL HEAD and OTHER CHARGES and ADVANCING CHARGES

The carrier will not absorb Port or Rail Head or Yard charges of any sort or other accessorial charges or labor costs. When not addressed elsewhere in this publication, 110% of any such charges incurred will be assessed the payer of

the freight charges, provided the requested or required services or extra labor is available. Such charges include but are not limited to:

1: Port or rail head charges;

2: Bridge, ferry, road, tunnel and turnpike tolls or charges

3: Transceiver “Fax” fees or electronic mail access fees.

SECTION 1

RULES ITEM

BILL of LADING, GENERAL

This Rules Tariff is an integral part of the Bill of Lading Contract and of all contractual relationships of the carrier. This Rules Tariff contains the Terms and Conditions specifically governing the Bill of Lading, Loss and Damage Claims, Overcharges, Undercharges and related matters. Refer exclusively to this Rules Tariff to determine the process and time limitations in effect. If there is a conflict between the carrier’s Tariffs and Contracts and any governing publication, or any bill of lading or other shipping document prepared in connection with a shipment, the carrier’s Tariffs and Contracts will control and govern the movement of goods.

Unless otherwise agreed to in writing, Contract Terms and Conditions shall be those as indicated in the carrier’s bill of lading as governed by the carrier’s Rules Tariff and Contracts in effect on the date the shipment was tendered to the carrier. ONLY carrier personnel with titles of CEO, President or Vice President are authorized to agree to alternate contract terms and conditions and the use of an alternate bill of lading referencing such terms and conditions. NO other person(s) are authorized. Where a bill of lading other than the carrier’s bill of lading, issued by the shipper, is signed for by the carrier’s driver or other person(s), that signature ONLY acknowledges receipt of the freight and identifies the entity to deliver. It is NOT a contract for the carriage of freight. Continued use of an unauthorized bill of lading by the shipper will NOT constitute an implied acceptance by the carrier.

All references made to Rates or “Rates on File” mean rates contained in the carrier’s files. Such rates shall be available to shippers on request to the extent that they apply to the shipper.

Any alteration, addition or erasure in the carrier’s bill of lading which is made without the special notation thereon of the agent of the carrier issuing this bill of lading, shall be without effect, and the bill of lading shall be enforceable according to its original tenor.

BILL of LADING DESCRIPTION CORRECITON

1. The Carrier or Carrier's agent shall have the right to take any action necessary to determine if the information provided on the bill of lading is correct including, but not limited to:

A. Inspection of packages,

B. Verification of gross shipment weights (a shipping carrier, container or package, or pallet, platform, or skid constitutes part of the gross weight),

C. Verification of actual or declared density,

D. Collection of other sufficient evidence necessary to verify whether or not the shipment is correctly described.

2. When the information is found to be incorrect, the carrier freight bill will be corrected and freight charges assessed according to the proper descriptions and weights.

3. Density will be determined by the cube utilized as defined by the methods contained in this Rules Tariff (Item 110) and the weight shown on the Shipper's bill of lading, unless the Carrier determined the weight on the bill of lading to be in error, or the Shipper provides documentation that the weight was in error.

4. When the inspection of a shipment results in a change to the freight charges of at least $16.70, an additional charge of $29.10 will apply.

CANCELING ORIGINAL and REVISED PAGES, METHOD of

When this Tariff or Tariffs governed by this Tariff are amended by revised pages, the cancellation of prior pages will be affected by means of this rule. A revised page will not show a cancellation notice, (See Exception).

Except where a specific cancellation is shown on a new revised page, a revised page cancels any and all uncancelled revised or original pages, or uncancelled portions thereof, which bear the same page number.

Examples: “First Revised Page 1” will have the effect of canceling Original Page 1; “4th Revised Page 2” will have the effect of canceling 3rd Revised Page 2 and also 2nd Revised Page 2 as well as any earlier version of Page 2.

EXCEPTION: This Tariff’s Index will be updated as a single unit. No distinction will be made between different Pages of the Index. The Revision Number of any Page of the Index will indicate the Revision Number of the Entire Index.

CAPACITY LOADS – OVERFLOW as a SEPARATE SHIPMENT

The minimum weight specified applies in connection with each vehicle used to transport the shipment.

That portion of the shipment which can be loaded into a vehicle will be charged for at the actual weight loaded, or the applicable minimum weight. The remaining portion of the shipment which cannot be loaded into said vehicle will be charged for as a separate shipment.

RULES ITEM

CLAIMS for DAMAGE and OVERCHARGES

As a condition precedent to recovery, claims and suits must be accompanied by the original paid bill for transportation, (or a copy of same notarized as identical) and must be filed in writing with the carrier as follows:

1: Overcharge claims must be filed within nine months after the delivery of the property (or, in the case of export

traffic, within nine months after delivery at the port or export), except that claims for failure to make delivery must be filed within nine months after a reasonable time for delivery has elapsed.

2: Suits for overcharges shall be instituted against any carrier no later than 3 months from the date when written

notice is sent by the carrier to the claimant that the carrier has disallowed the claim or any part or parts of the claim specified in the notice. Where claims are not filed or suits are not instituted thereon in accordance with the foregoing provisions, the carrier shall NOT be liable, and such claims will NOT be paid.

3: Suits for undercharges shall be instituted against the shipper, consignee, or payer of the freight charges no later than 3 months from the post mark date when written notice is sent to the carrier by the party responsible for

freight charges that such party has disallowed the claim or any part or parts of the claim specified in the notice. Where claims are not filed or suits are not instituted thereon in accordance with the foregoing provisions, the party responsible for freight charges shall NOT be liable, and such claims need Not be paid.

Claims specific to Loss and/or Damage

1. All claims for loss or damage must be filed in accordance with the requirements set forth In the NMF 100 series tariff Item 300100 through 300155 and filed within not more than nine (9) months from the date of delivery in the event of a damage claim, and not more than nine (9) months from the date of the bill of lading in the event of loss. A civil action must be filed not more than two (2) years from the date on which the carrier provided written or electronic notice disallowing all or part of the claim. Claims must be filed in writing and state the amount of the claim, the date of the occurrence, the location of the loss being claimed, and the bill of lading number.

2. Carrier shall not be liable for any claims for loss or damage unless claims are filed in accordance with paragraph 1 of this item.

3. Customer shall not deduct or offset any cargo claim or other alleged claim or debt of Carrier from the charges owed to Carrier unless authorized in writing by the Carrier.

4. The filing of a claim in accordance with this Item Is a prerequisite to the filing of a lawsuit against the Carrier. The failure to file a claim in accordance with this Item shall constitute an estoppel of any right to the filing of the lawsuit and said right shall be deemed waived and subject to a dismissal with prejudice.

5. Claims for damaged goods or hidden damage require that all damaged goods and packing materials be kept in received condition for inspection by the carrier. Packaging which is insufficient to protect goods from the normal rigors of transportation will invalidate damage claims.

Duplicate billing issues shall be resolved in accordance with State Laws in effect in the state containing the carrier’s principle place of business.

All disputes shall be initiated and settled with respect to venue within the County containing the carrier’s principle place of business.

This Tariff is an integral part of the Bill of Lading Contract and of all contractual relationships of the carrier. Also Refer to Section 2 of this Tariff for additional Terms and Conditions specifically governing the Bill of Lading.

Maximum carrier liability is limited as provided in “Limitation of Liability’ and in the Bill of Lading Terms and Conditions Appendix of this Rules Tariff.

Shipments governed by this publication are to be transported with normal and reasonable dispatch in time for no particular market.

C. O. D. SHIPMENTS

1: Collect on Delivery “COD” shipments will be accepted subject to a charge of 1.5% of the COD amount collected, subject to a minimum charge of $15.00 per freight bill. Charges for collecting and remitting COD

amounts will be assessed the party paying the freight charges.

2: The letters “C.O.D.” must be stamped, typed or written on all bills of lading and shipping orders in RED letters at least 1 inch in height and ¼ inch thickness of stroke. Carrier shall NOT be required to collect C.O.D.

charges should such markings be omitted. Omission of markings prescribed herein or in the above paragraph release the carrier from any and all obligations regarding C.O.D. collection.

3: Unless the phrase “CASH ONLY” appears in RED letters at least 1 inch in height and ¼ inch thickness of stroke on all bills of lading and shipping orders, the carrier will accept checks or drafts from the consignee to

the order of the shipper in payment of C.O.D.’s. Carrier will accept NO responsibility for the validity of such checks or drafts and they shall be accepted at the risk of the shipper. Such checks and drafts will be transmitted to the shipper together with the carrier’s own check for amounts collected in cash.

COLLECTION & PAYMENT of CHARGES

1: Except as otherwise provided, the carrier requires payment for all rates and charges to be received by the carrier within 15 days from the date on the carrier’s invoice. An account will be considered delinquent if payment has not been received within 30 days from the date on the carrier’s invoice.

2: All checks written to the carrier that are not honored by the carrier’s bank will be subject to an additional charge of $20.00 per check so rejected.

3: The carrier will invoice the shipper’s broker, bank or other agent for freight charges. However, the carrier reserves the right to bill and collect freight charges from the shipper on prepaid shipments or the consignee on collect shipments in the event full payment of freight charges is not received pursuant to third party billing.

4: If no payment or disputed payment is made short of the billed amount and the carrier is required to incur costs to collect past due charges, the carrier shall be entitled to recover its collection costs, including its attorney fees and administrative costs, in addition to the charges owing and regardless of whether legal proceedings are instituted. If legal proceedings are instituted to collect past due charges, the carrier shall be entitled to recover,

in addition to the past due charges, its collection costs, including but not limited to, its attorney fees, court costs and administrative fees.

5: This shall be applied ONLY to the non-payment of original, separate, or independent freight bills and shall NOT apply to aggregate “Balance-Due” claims sought for collection on past shipments by a Bankruptcy Trustee, or any other person or agent.

Throughout the carrier’s Tariffs, a COLON (:) is used in place of the terms "Viz." and "Namely". The Colon has the same effect as if such phrases were used.

CONSTRUCTION SITE DELIVERIES

Shipments delivered to construction sites will be subject to an additional charge of $8.50 per 100 lbs., subject to a Minimum Charge of $85.00 per shipment and Maximum Charge of $250.00 per shipment. This charge will be in addition to all other applicable charges and is not subject to any discount provisions.

The term construction site shall be defined as the site of any construction of buildings, roads, bridges or other structures, including the entire property upon which the construction is taking place and delivery to any facility located on such property.

Charges and payment for this service will follow the terms of the bill of lading. If charges are to be paid by a party other than debtor as prescribed on the bill of lading, acceptance for payment of services performed must be in writing or other acceptable form of communication.

CORRECTIONS TO BILL OF LADING / RECEIPT OF GOODS

Prior to delivery of shipment

A request to change the payment terms (prepaid or collect) will be permitted upon receipt of a corrected bill of lading or other written instructions from shipper.

After delivery of shipment

A change in payment terms or payor will be permitted when the party accepting responsibility For payment submit written authorization of their intent to pay the carrier.

After payment of invoice

Once carrier has received payment for the charges no change in the terms of the freight bill will be accepted.

Correction will not be presented or accepted to:

a) Change released or declared value of products. (Actual value will be accepted, with proof of the actual value.)

b) Change weight, commodity description, cubic feet, or density after freight has been delivered, unless carrier is provided with sufficient proof of the actual characteristics being changed. The following documents may be used to establish the change: Invoice, packing slip, purchase order, pre-printed spec sheets, and catalog page (must provide commodity description, weight, shipping dimensions, or other Information to support the change). There must be a clear audit trail that allows a connection between the documents and goods being shipped.

Charge for correction

A charge of $8.50 will be assessed for a correction made under the provisions of this Item.

CUSTOMS BOND SHIPMENTS

1: When shipments moving under rates governed by this Tariff are under United States Customs Bond, a charge of $80.00 per shipment will be assessed.

2: When the carrier is required to make delivery of a shipment to a U.S. Customs Office or a U.S. Customs Broker, such delivery shall fully discharge the carrier’s liability for delivery.

DELIVERY at DESTINATION WITHOUT RECEIPT

When the bill of lading provides for delivery at field locations, the bill of lading shall be so endorsed. If there is no one present to sign the delivery receipt, the carrier shall complete delivery at designated location and carrier’s responsibility ceases upon delivery being made.

DETENTION of VEHICLE WITH POWER (and DEMURRAGE, DELAYS, UNPAVED ROADS and SUBSISTENCE CHARGES)

A vehicle as defined In this Item consists of the power unit (tractor) and the trailer(s) being pulled and presented for pickup or delivery.

1: LOADING and UNLOADING

When a carrier's vehicle is delayed beyond the free time listed below for loading or unloading on or near the premises of consignee / consignor, the detention charges in this Item will apply. The free time begins when the driver contacts the consignee or consignor that the vehicle Is available for loading or unloading. The detention time begins when the free time ends. The free time and detention time ends when the vehicles are loaded or unloaded and all bills of lading or delivery receipts are signed, and the vehicle is available for movement. Free time does not begin if carrier arrives before 8:00 a.m., unless loading or unloading has started, or there is an agreed upon arrival time prior to 8:00 a.m.

Where there are multiple shipments loaded or unloaded on the same vehicle, the free time will be computed on the total actual weight of the shipments.

Free time shall be determined as follows:

Consignor or consignee maintained arrival and departure logs will be used for verification of time for the application of this Item. If the consignor or consignee does not maintain logs of this time, the carrier's driver is required to mark the original bill of fading or the delivery receipt with the time arrived and the end time.

Once loading or unloading is started it is to be completed.

If after the carrier has arrived and the loading or unloading cannot be started, the free time will be considered ended. If the carrier is required to return for loading or unloading, a redelivery charge will be applied to the Invoice, and the detention time begins when the carrier arrives for the loading or unloading. This applies if the carrier arrives no later than one hour prior to 3:30 p.m. for shipments weighing under 5000 pounds, and two hours prior to 3:30 for shipments weighing 5,001 and greater.

If upon arrival the consignee immediately advises the carrier there Is not enough time to unload the shipment(s), the carrier will return the next day, and there will be no charge for redelivery and full free time allowances will apply.

The provisions of this Item will not apply if the loading or unloading cannot be started and completed due to acts of God, Instructions from public or law agencies, or unforeseen illegal or terrorist acts which affect the consignee or consignor premise directly or immediate transportation infrastructure.

The charge for detention is $50.00 per vehicle for each 15 minutes or fraction thereof.

Unless agreed to in writing, the carrier will collect the charges applied under this Item for detention of loading from the consignor and unloading from the consignee, notwithstanding the bill of lading terms of prepaid, collect or 3rd party.

DETENTION of VEHICLE WITH POWER (and DEMURRAGE, DELAYS, UNPAVED ROADS and SUBSISTENCE CHARGES)

2: FERRY and GENERAL DELAY in TRANSIT

Transit on ferries and demurrage/delay caused by necessity through no fault of the carrier will be charged for at this same rate for all time in excess of one (1) hour free time per incident or ferry. Time will begin upon arrival at the Ferry Terminal and will continue until departure from the Ferry. Also see Item 300.

3: UNPAVED ROADS

This same charge will apply on all time in which the carrier’s equipment must travel over unpaved roads.

4: OVERNIGHT DRIVER SUBSISTENCE CHARGE

When, for their sole convenience, the shipper or consignee requests that the carrier hold a driver and truck unit overnight for loading or unloading the following day at a location that precludes the driver’s return to his terminal that evening, the party requesting said service will pay a driver subsistence charge in the amount of $545.00.

DETENTION WITHOUT POWER UNITS

1: All charges incurred due to the detention of chassis containers will be billed against the shipment.

2: When trailers are dropped or spotted for the convenience of the shipper or consignee, the first 24 hours following the placement of the trailer at the shipper’s or consignee’s facilities will be at no charge. Time beyond the initial day allowed will be billed against the shipment at $120.00 per each day of 24 hours or fraction

thereof.

DRY RUN ( Driver Dispatched – No Freight Tendered)

1 In the event that a pickup request has been communicated to Carrier, Carrier dispatches a driver for pickup, and, through no fault of Carrier, the shipment is not tendered to Carrier, a $115.40 charge will apply. This charge will not apply to check stops or equipment drops enroute.

2. This charge will be assessed against the party requesting the pickup.

HAZARDOUS MATERIALS

1. Carrier may accept shipments of hazardous materials for transportation in accordance with the transportation Requirements of the US Department of Transportation, subject to the following provisions:

A. Hazardous Materials (HM) shipments must be tendered on Uniform Straight Bill of Lading forms as shown in NMF 100 series.

B. Fines and/or penalties will be billed to the Shipper, who will reimburse Carrier for all losses incurred when such are imposed on the Carrier as a result of the Shipper's failure to comply with 49 CFR and/or provide:

1. Proper packaging and labeling

2. 24-hour emergency phone number

3. Proper shipping name

4. Hazard Class

5. Identification number

6. Packing group-where required

7. Total quantity

8. Shipper's Certification or any other certification requirements as specified in 49 CFR series

C. Hazardous Materials in the categories listed below are embargoed from transportation:

1. Explosives (Division 1.1, 1.2, 1.3)

2. All Radioactive Materials (Class 7)

3. Hazardous waste

4. Poison / Toxic Inhalation Hazard Zone A

5. Etiologic Agents/Infectious Substances (Division 6.2)

D. As used herein, Hazardous Materials means articles described in 49 CFR. When service is provided by

Carrier to transport materials defined under 49 CFR, an additional charge of $22.80 per shipment plus the actual costs of required permits will be assessed to each shipment.

E. Carrier reserves the right to deal in any way It deems proper without prior notice to Consignor/Consignee or Shipper, with any Hazardous Material that it reasonably suspects may become a danger to any other goods stored by Carrier, or freight in transit or to be moved in transit, or may become a danger to Carrier's property, its employees, its servants or agents, or to third parties.

F. Except for Carrier's negligent acts or omissions resulting in loss, damage, or injury, Carrier shall have no liability for loss, damages, delay, or injury, including attorneys' fees and costs, caused by or arising out of the transportation or storage of any Hazardous Material, whether declared or undeclared. Shipper shall indemnify and hold harmless Carrier against all loss, damages, delay or injury, including attorneys' fees and costs, caused by or arising out of the transit or storage of any Hazardous Material, whether declared or undeclared.

G. Except for Carrier's negligent acts or omissions resulting in loss, damage, or injury, Carrier reserves the right to collect from the Shipper, Consignee or Debtor the costs of cleanup, and payments of claims for property damage or loss and personal injury, or death including attorney's fees and costs, caused by or arising out of the transportation or storage of any cargo.

2. A surcharge of 30% will be applied to the shipment of Hazardous Materials in the Republic of Mexico, subject to a charge of US $14.83 minimum and a US $300.00 maximum.

IMPRACTICABLE OPERATIONS

Nothing in this Tariff shall be construed as making it binding on a carrier to pick up and/or deliver freight at locations from and/or to which it is impracticable to operate equipment on account of the condition of highways, roads, streets, or alleys, or because of riots.

In no case shall it be obligatory for a carrier to make deliveries to points over roads which are unsafe or impassable. In such cases, at the consignee’s request, delivery to the nearest point which can be safely reached will constitute proper execution of the contract.

Carrier is NOT bound to transport property by any particular schedule or in time for any particular market or otherwise than with reasonable dispatch.

INACTIVITY

Carrier reserves the right to cancel negotiated pricing programs due to the lack of shipment activity over a ninety (90) consecutive day period.

INSIDE DELIVERY

Carrier will assess an Inside Delivery Fee of $ 2.00 per cwt., subject to a $ 60.00 minimum charge and a $ 325.00 maximum charge per shipment. This applies when Carrier delivers a shipment or portions of a shipment to positions that are located 30 feet or more from the delivery door or to any floor above or below the receiving area.

LICENSES – TEMPORARY HIGHWAY

When carrier is required to obtain a license for movement of an unlicensed chassis over highways, a charge of $25.00 for each license obtained will apply, in addition to the cost of the license and all other applicable charges.

LIFTGATE

For use of liftgate, Carrier will charge $ 3.00 per cwt., subject to a $ 55.00 Minimum Charge and $ 450.00 Maximum Charge.

LIMITATION of LIABILITY

1. Liability Standard.

Carrier's liability for loss, damage or destruction to cargo transported shall be that of a motor carrier as set forth in the Carmack Amendrnent currently codified at 49 U.S.0 § 14706 (Carmack), as amended from time to time, regardless of whether transport is interstate or intrastate, or involves foreign commerce. The period of Carrier's liability shall commence upon coupling of a power unit operated by Carrier to a loaded trailer. The period of Carrier's liability shall terminate once Carrier has made the trailer available for unloading at the consignee's location. Carrier's sole liability with respect to delay in pick-up or transportation shall be if Carrier fails to deliver with reasonable dispatch and such failure results in loss, damage or destruction to cargo being transported Carrier's liability under this paragraph shall be limited in accordance with this Item.

2. Definitions.

A. Exception Class. Carrier and Shipper may agree in writing that various classes under the National Motor Freight Classification ("NMFC") will be rated by Carrier pursuant to a single class (which class shall be referred to as the FAK or Exception Class (collectively, the "Exception Class")). For example, Carrier and Shipper may agree that product falling into NMFC Classes 77.5, 85, 92.5 and 100 will be rated as NMFC Class 70. Such an agreement may be evidenced by a "Pricing Agreement" provided by Carrier or Shipper or otherwise in an agreement that is signed by a representative of Shipper and an officer of Carrier. In the event of a claim involving cargo rated in a class that is included in an Exception Class, if class rating is relevant to determining Carrier's liability/Shipper’s recovery with respect to such claim, the cargo shall be rated at the Exception Class for purposes of determining Carrier's liability and Shipper's recovery.

LIMITATION of LIABILITY

D. Shipments of Prohibited or Restricted Articles regardless of origin or destination points. Regardless of the origin or destination, Carrier's liability, if any, with respect to items listed in Item 780 of this Tariff as not being accepted by Carrier ("Prohibited Articles"), if such items are nevertheless tendered for transportation and inadvertently accepted by Carrier, shall be limited to the lesser of the following amounts:

A. If the NMFC includes a limitation on the specific Item (for instance, Item 100200 for household goods), the amount of such limitation.

B. The applicable NMFC Exception Amount

C. $0.50 (U.S. Cents) per pound per package with a maximum liability of $1,000 (U.S. Dollars) per shipment.

4. Requesting Excess Liability. If Shipper wishes for Carrier to accept additional liability in excess of the otherwise applicable limitation as calculated in accordance with the foregoing, the following will apply:

A. Declaring Excess Liability on the Bill of Lading. Subject to applicable caps as set forth below, Shipper may request that Carrier accept liability in excess of the otherwise applicable limitation by inserting the amount of liability being requested on the face of the bill of lading in the space indicated, notating "Excess Value liability" on the original bill of lading, and by paying additional fees calculated in accordance with this Tariff.

A. Cost of Excess Liability. The cost of requesting that Carrier accept additional liability shall be $4.00 per each $100.00 in excess of the otherwise applicable limitation of liability, subject to a minimum charge of $53.00 per shipment A maximum of $10,000.00 in excess liability coverage is available for articles moving pursuant to a Spot Quote and used or reconditioned articles as defined in Item 780. With the exception of Exhibit Materials, all used goods move subject a released value not to exceed $0.50 per pound, unless excess liability coverage is purchased. If Excess Liability coverage is purchased the maximum liability for used goods is $5.00 per pound not to exceed $10,000.00 per shipment. For all other shipments, a maximum of $100,000.00 in excess liability coverage is available unless Shipper obtains an exception as provided in subparagraph (b) below.

B Procedure for Requesting Additional Liability. To request that Carrier accept excess liability in an amount

exceeding the maximum liability set forth in subparagraphs (a)(i) and (a)(ii) above, Carrier must be notified at the time it agrees to transport cargo of any such request, and the otherwise applicable limitation of liability shall apply as if no declaration of excess value had been made unless Carrier has agreed in writing signed by an authorized representative to accept such excess liability. In order request such additional liability, the Shipper must contact Carrier and make such request. Carrier reserves the right, in its sole discretion, to provide excess liability coverage exceeding the maximum liability set for in subparagraphs (a)(i) above.

C Actual value as cap. Carrier's total liability, regardless of the amount of excess value requested or agreed upon, shall be capped at the lesser of the cost to repair or replace the cargo in question regardless of whether Shipper requests, or whether Carrier agrees to accept, excess liability in excess of such amount. If Shipper requests and Carrier agrees to accept excess liability in excess of the cost to repair or replace the cargo in question, Carrier shall be entitled to retain any and all such fees associated with excess liability in excess of the cost to repair or replace the cargo.

D. Excess Liability is not Insurance. Carrier's acceptance of excess value liability is not, and shall not be construed as, insurance of any kind. Carrier's liability for shipments with respect to which Shipper has requested excess liability is governed by the standard of liability in section 1 of this Item. If Shipper wishes to obtain insurance insuring its interest in any goods tendered for transportation, it must do so through third parties.

E. Corrected Bills of Lading. A corrected bill of lading or other documentation will not be accepted after a shipment is accepted for transport and the period of Carrier's liability has commenced.

LIMITATION OF LIABILITY

5. Packaging and Refurbished Articles.

A. Articles must be packaged by Shipper in a box, crate, or other protective material that effectively provides protection from damage to the articles contained therein caused by conditions normally and customarily expected during transport by motor carrier. Where there are commonly accepted industry standards for the packaging of articles or where the NMFC requires certain types of packaging, articles must be packaged in accordance with those standards or requirements.

B. For articles refurbished / remanufactured / rebuilt to a °like new condition" with full warranty documentation comparable to the warranty provided for a new item, moving from the point of origin, or refurbishment, such articles shall be treated for purposes of this Item as new articles and not as used or reconditioned articles.

6. Liability of Shipper for Claims. Except to the extent caused by Carrier's negligent acts or omissions, where Shipper's product causes loss, damage, or injury to other lading or Carrier's property, or where a Shipper's product causes damage or loss to property or personal injury or death to persons or entities, Carrier reserves the right to collect from the Shipper any and all amounts, costs, claims for damage or loss to property or claims paid for personal injury or death including amounts paid for judgments entered in favor of said persons or entities, including attorneys' fees and costs incurred by Carrier in the handling of such claims. Shipper shall defend, indemnify, pay, reimburse and hold harmless Carrier from and for such costs, claims or judgments, including attorneys' fees and costs.

7. Individual Capacity. All claims shall be brought solely in a Shipper's individual capacity. Shipper agrees it will not bring an action against carrier as a class plaintiff or class representative, join a class as a member, or participate in any way as an adverse party in a class action lawsuit against Carrier. Claims may not be joined or consolidated unless agreed to in writing by all parties.

MAXIMUM CHARGE

MIXED SHIPMENTS

Except as otherwise provided, when rates referencing this Tariff apply on two or more articles, such rates will apply on straight or mixed shipments of the articles named.

NON COMMERCIAL / LIMITED ACCESS PICKUP OR DELIVERY

1. When Carrier makes a pickup or delivery at a non-commercial or limited access location, the following charges will apply:

A. $35.00 flat charge per shipment.

B. Other applicable charges described in this Tariff, including inside pickup or delivery Exception: In the case of delivery, charges will include an initial notification to make delivery arrangements only if Carrier is provided the correct telephone number of the Consignee.

2 The term "Non-Commercial" means:

A. Apartment complexes, schools (other than the general receiving docks at colleges and universities), churches, camps, dormitories, and other locations that differ from locations such as businesses, warehouses, and other commercial locations.

B. Businesses located at a private residence, farm, or ranch that is not open to the walk-in public during normal Business Hours.

3. The term "Limited Access Location" includes, but is not limited to, the following: individual (mini) storage units, fairs or carnivals, prisons, military base/installations, mine sites.

4. Pickup and delivery service to non-commercial or limited access locations will be made to ground-level door or garage opening closest to the location accessible to the Carrier's vehicle.

5. Carrier's pickup or delivery service does not include packing, unpacking, dismantling, assembling, set up, and/or removal and disposal of packaging materials.

NOTIFICATION PRIOR TO DELIVERY / APPOINTMENT

When a shipper’s bill of lading requests/requires Carrier to notify or make an appointment with consignee prior to delivery, or when a consignee requests/requires notification or an appointment prior to delivery, an additional charge of $ 10.00 per shipment will apply and be billed to the party responsible for the line haul charges on the bill.

PAYMENT of FREIGHT CHARGES

Carrier does not employ property brokers or other intermediaries as its agents for the solicitation of shipments or for the collection of freight charges. Carrier will invoice the shipper’s broker, bank or other agent for freight charges. However, carrier reserves the right to bill and collect freight charges from the shipper on prepaid shipments or the consignee on collect shipments in the event full payment of freight charges is not received pursuant to third party billing.

See Item 435 of this Tariff, Payment and Collection of Charges for additional conditions applicable.

PERMITS, SPECIAL

When a shipment is of such size or weight that a special permit and/or indemnity bond is required under the laws of the states traversed to permit the load to be transported over the highways, the cost thereof imposed by such state or federal agency will be borne by the shipper. If requested by the shipper or consignee, carrier will arrange for such permit and/or indemnity bond and will advance the cost for such service including Transceiver Fees, plus $30.00 for

the account of the shipper or consignee.

PROTECTION from HEAT or COLD

Except as otherwise provided, commodities of perishable nature requiring protection from heat or cold will be accepted and accorded such protection ONLY when the shipper or payer of freight charges and the carrier have negotiated specific rates which clearly indicate that such protection will be provided. The carrier accepts NO LIABILITY for such commodities when they are inadvertently accepted without such agreement.

RECONSIGNMENT / DIVERSION

If outside the original delivery terminal service area, the tariff or contract rate from origin to reconsignment point plus the tariff or contract rate from reconsignment point to ultimate destination will apply. REDELIVERY, RETURN SHIPMENTS, and STORAGE

1: Shipments which cannot be delivered due to causes beyond the carrier’s control, or which are refused for any reason, will be held by the carrier for shipper’s instructions. Shipper shall be promptly notified of non-delivery. After the expiration of free time following arrival of the property at destination the carrier shall be liable solely as a warehouseman for loss, damage or delay.

2: In the event that redelivery is subsequently accomplished, an additional charge of $75.00 will be assessed,

except that shipments moving under mileage rates will also be assessed the mileage rate for the additional distance traveled to complete delivery.

3: 24 hours after attempting to notify the shipper of non-delivery shipments may be placed in a public warehouse

at any location, at the owner’s cost and held there without liability on the part of the carrier and subject to a lien for all freight and other lawful charges, including a reasonable charge for storage.

4: Shipments returned to the shipper will be charged for such return at an additional 75% of the outbound rate.

SHIPPER’S LOAD and COUNT – SL&C

1. In lieu of pickup or delivery service as provided herein and when requested by Shipper or Consignee and agreed upon by Carrier, Shipper may load/Consignee may unload Carrier's Trailers at its sole risk and liability, under the following conditions:

A. SHIPPER LOAD — When requested by Shipper and approved by the Carrier's local operations, the Carrier will spot or drop Equipment at the Shipper's loading facility. The Shipper accepts responsibility for and will be liable for any and all personal injuries to persons or physical damages to any property, including any damage to or loss of Carrier's Equipment while Equipment is in the care, custody and control of the Shipper or Shippers Agent other than damage or loss caused by normal wear and tear, an Act of God, or force majeure. Shipper will promptly reimburse Carrier for the cost of repairing or replacing such equipment within thirty (30) days of notice thereof. Shipper may load the Trailers with one or more LTL shipments at its sole risk and liability. Any discrepancy on those shipments tendered under the Shipper Load and Count arrangement will be handled in the following manner:

1. At pickup, Carrier will include "SL&C" on the bill of lading, indicating that the shipper counted and loaded the shipment without Carrier's driver present. The Shipper assumes all liability and responsibility for properly blocking and bracing the freight. Carrier's failure to note "SL&C" on the bill of lading will not affect the liabilities of the parties, if the Shipper has in fact performed the counting and loading without a representative from Carrier present.

2. Carrier will provide seals for security purposes to the Shipper when requested and such seals will be recorded. Failure to seal a load will not affect the terms and conditions outlined herein or Shipper's liability resulting there from.

SHIPPER’S LOAD and COUNT – SL&C

3. Carrier will notify the Shipper's representative by fax of any exceptions within 24 hours of first unloading. This will not include weekends or holidays. Carrier cannot be liable for uncountable palletized orders, picked up and delivered with wrap intact. The transmit journal from the fax machine listing the time, date, and telephone number of the receiving faxed transmission will be considered as validated proof that the fax was sent to the Shipper.

A. Carrier will not be liable for any loss or damage where exceptions have been reported to Shipper within the time limits specified.

B. Should the shipment or any part thereof be on shrink/stretch-wrapped pallets when unloaded, the Carrier will count and check the pallet as one (1) unit and will not be responsible for individual piece count on the pallet up to the delivery of the pallet, intact, to the Consignee.

4. Overages will be reported as in paragraph 1.A.3 herein. The Shipper will advise Carrier of the disposition of any merchandise that could or should be applied to a valid shortage. Carrier shall only be responsible for handling units or a piece count that can be verified. Individual item numbers or P.O. shortages at delivery shall not be deemed as shortages against Carrier when the handling unit count matches the amount properly reported as received on the SL&C Trailer. Shipper shall indemnify and hold Carrier harmless from any and all liability, actions, costs, and expenses (including attorney fees) arising from its loading or Consignee's unloading of Carrier's trailers including, but not limited to, that liability resulting in damage to property or injury to person (including death).

B. CONSIGNEE UNLOAD — Subject to Carrier's consent and as requested by Shipper or Consignee. Carrier may drop or spot Equipment at the Consignee's facility so the receiver may unload the Trailers. All shipments shall be presumed to have been transported in good and proper order and Carrier shall have no liability or risk of loss or 4amage to shipment or Trailer from the time the Trailer is dropped or spotted until the Carrier picks up the Equipment after the shipment(s) have been unloaded. Any discrepancy on those shipments tendered, as a CONSIGNEE UNLOAD will be handled in the following manner unless a separate signed agreement is already established and signed in place:

1. Carrier shall spot or drop Trailers at Consignee's place of business so that the Consignee can complete the unloading process, without Carrier's driver present subject to the terms as stated herein within normal free time or otherwise agreed to in writing. Free time will be 24 hours, excluding non-Business Days. After the expiration of this free time period, detention charges will be applicable.

2. Consignee will not utilize Carrier's equipment for any use other than the express purpose of unloading or loading cargo for shipment via Carrier.

3. When the Consignee fails to report to. Carrier's local operations that equipment is empty and available to Carrier for removal, it will be subject to detention rules and charges.

4. Consignee will accept liability for any and all injuries to persons or damages occurring to Carrier's equipment or for the loss of Carrier's equipment, or loss or damage to shipments while in its physical possession, other than normal wear and tear or an Act of God. Consignee will promptly reimburse Carrier for the cost of repairing or replacing such equipment within thirty days of notice thereof.

5. Carrier will note CONSIGNEE UNLOAD on the delivery receipt, indicating that the Consignee unloaded and counted the shipments without Carrier's driver present. Carrier's failure to note CONSIGNEE UNLOAD on the delivery receipts will not affect the liabilities of the parties, if the Consignee has in fact performed the counting and unloading without a representative from Carrier present.

6. Carrier will provide sealed Trailers with the Carrier's seal number documented for security purposes. Failure to seal a load will not affect the terms and conditions outlined in this Item.

A. The Consignee agrees to notify Carrier by fax on a mutually approved form of any exceptions within 24 hours of the Trailer being dropped. This will not include weekends or holidays. Carrier shall not be liable for any loss or damage exceptions reported after 24 hours of Trailer being dropped.

B. Notice of any exception is to be faxed on the mutually approved form to the attention of the local service center's OS&D associate.

C. The transmit journal from the fax machine listing the time, date, and telephone number of the receiving faxed transmission will be considered as validated proof that the fax was sent to the Carrier.

8. Carrier shall not be liable for uncountable palletized orders, picked up and delivered with shrink wrap intact or for Shipper Load and Count orders that have been properly reported to the Shipper at first unloading.

9. Carrier shall only be responsible for handling units as signed for and tendered by Shipper. Individual item numbers and purchase order shortages shall not be deemed shortages against Carrier when the handling unit count matches the amount signed for at time of Pickup, or as applicable, properly reported as received on a Shipper Load and Count Trailer.

10. Shipments tendered to the Consignee to be unloaded at their convenience are to be secured by the Consignee in a manner to prevent theft. Carrier will have no liability for stolen or missing product while in the possession of the Consignee.

11. It is the Consignee’s responsibility to provide a properly reported discrepancy with dated fax confirmation for payment of the claim. The consignee agrees not to file claims when discrepancies have not been properly reported.

SORTING OR SEGREGATING SHIPMENTS

Loading or unloading service does not include assembling, packing, unpacking, dismantling, inspecting, sorting or segregating freight EXCEPT as provided in this item.

A. When a shipment is tendered to the carrier in lots according to size, brand, flavor or other characteristics and is so

identified on the bill of lading or accompanying papers, normal delivery service includes delivery of the shipment

to the consignee in the same manner, including the placement of such sorted or segregated lots on the platform,

dock, conveyor, pallet, dolly, buggy or similar device provided by the consignee for the receipt of freight within or

adjacent to the vehicle without additional charge.

B. When the conditions of paragraph (A) are not met, a charge of $.35 per piece, will be assessed for sorting or

segregating by marks, brands, sizes, flavors, or their distinguishing characteristics EXCEPT as provided in paragraph (C) subject to a Minimum Charge of $10.00. Such charges will be assessed against the party

requesting or requiring this service. This service must be noted on the BOL or D/R including the Name, Company,

and Title of the person requesting the service.

C. No sorting or segregating charge will be made when the only service performed is a count necessary to determine

the extent and identity of shortages or overages.

When shipper or beneficial owner requests equipment but does not utilize said equipment within 24 hours of arrival, carrier shall assess the applicable line-haul charge from point of equipment origin to requested pickup point and from requested pickup point to equipment’s next pickup point or hometown terminal, whichever is nearer, at a rate of $1.50 per mile, subject to a Minimum Charge of $75.00.

WEIGHTS CORRECTION

1. The Carrier or Carrier's agent shall have the right to take any action necessary to determine if the information provided on the bill of lading is correct including, but not limited to:

A. Verification of gross shipment weights (a shipping carrier, container or package, or pallet, platform, or skid constitutes part of the gross weight) and/or

B. Collection of other sufficient evidence necessary to verify whether or not the weight of a shipment is correctly declared.

2. When the information is found to be incorrect, the bill of lading and carrier freight bill will be corrected and freight

charges assessed according to the proper descriptions and weights except, when the Shipper palletizes mixed commodities, the corrected weight will be charged at the highest rated commodity in the shipment.

3. When the weighing of a shipment results in a change to the freight charges of at least $16.70, an additional charge of $29.10 will apply.

DIMENSIONAL WEIGHT, COMPUTATION of

Except as otherwise provided, when carrier’s rates or charges (except minimum charges per shipment) provided are stated to be assessed on the basis of Cubic Dimensional Weight – CDW, the cubic dimensional weight of a

shipment will apply ONLY if the combined cubic dimensional weight of each part of a shipment exceeds the total actual weight of the entire shipment.

A: The cubic displacement of a shipment will be determined by measurement of each part of the shipment. Pieces of a shipment which, if combined, would result in a smaller cubic displacement, will be considered as one part ONLY if firmly fastened together and shipped as one unit. Cubic measurements will be based on the greatest dimensions (height, width, and length) of each part of a shipment.

B: Cubic dimensional weight will be derived from the cubic measurement of shipments or parts thereof on the basis of:

Rates referencing this Tariff are subject to a minimum weight of 800 pounds per lineal foot or fraction thereof of trailer space occupied.

B: If higher charges will result than those provided in Paragraph A from the application of the actual weight of the shipment at the class rate or rates applicable thereto, then such higher charges will apply in lieu of the charges provided for in Paragraph A.

C: The carrier reserved the right to decline acceptance of articles:

1: Weighing in excess of 16,000 pounds; 2: Exceeding 6 feet by 18 feet: 3: Over 29 feet in length.

D: The shipper or the carrier shall make the appropriate notation regarding the lineal feet of equipment utilization on the bill of lading or freight bill. Said notation may be made at any time such utilization is determined.

E: A unit of the carrier’s equipment will be considered loaded to capacity and fully utilized when it cannot accommodate any additional increments of any of the largest article in the form tendered comprising the entire shipment. Loading shall in no case exceed the maximum weight or height or length which may be transported per unit of the carrier’s equipment in accordance with existing highway and safety regulations via the route of movement. Overflow shall be rated as a separate shipment.

F: The provisions of this item may not be used to reduce rates, minimum weights or total charges below the otherwise applicable charges on the shipment.

WEIGHT in the CALCULATION of PALLET RATES

In the absence of a stated maximum weight per pallet in individual contracts of agreements, the maximum weight shall be two thousand (2,000) pounds per pallet. Weight in excess of the aforementioned shall be charged for on the basis of one pallet for each maximum weight unit or fraction thereof.

BILLS of LADING 2100

BILL of LADING CONTRACT TERMS and CONDITIONS:

Sec. 1. (a) The carrier or the party in possession of any of the property described in the carrier’s bill of lading shall be liable as at common

law for any loss or damage thereto, except as hereinafter provided.

(b) No carrier shall be liable for any loss of or damage to a shipment or for any delay caused by an Act of God, the public enemy, the

authority of law or the act or default of the shipper. Except in the case of negligence of the carrier or party in possession, the carrier or the

party in possession shall not be liable for loss, damage or delay which results: when the property is stopped and held in transit upon request

of the shipper, owner or party entitled to make such request; or from faulty or impassable highway, or by lack of capacity of any highway,

bridge or ferry, or from a defect or vice in the property, or from riots or strikes. The burden to prove freedom from negligence is on the

carrier or the party in possession.

Sec. 2. Unless arranged or agreed upon in writing, prior to shipment, the carrier is not bound to transport a shipment by a particular or in

time for any particular market, but is responsible to transport with reasonable dispatch. In the case of physical necessity, the carrier may

forward a shipment via another carrier.

Sec. 3. (a) As a condition precedent to recovery, claims must be filed in writing with the carrier as provided herein.

(b) Claims for loss or damage must be filed within nine months after the delivery of the property (or, in the case of export traffic, within

nine months after delivery at the port of export), except that claims for failure to make delivery must be filed within nine months after a

reasonable time for delivery has elapsed.

(c) Suits for loss, damage, injury or delay shall be instituted against any carrier no later than two years and one day from the day when

written notice is given by the carrier to the claimant that the carrier has disallowed the claim or any part or parts of the claim specified in the

notice. Where claims are not filed or suits are not instituted thereon in accordance with the foregoing provisions, no carrier shall be liable,

and such claims will not be paid.

(d) Any carrier or party liable for loss or damage to any of said property shall have the full benefit of any insurance that may have been

affected, upon or on account of said property, so far as this shall not void the policies or contracts of insurance, PROVIDED, that the carrier

receiving the benefit of such insurance will reimburse the claimant for the premium paid on the insurance policy or contract.

Sec. 4. (a) If the consignee refuses the shipment tendered for delivery by the carrier or if the carrier is unable to deliver the shipment because

of fault or mistake of the shipper or consignee, the carrier’s liability shall then become that of a warehouseman. The carrier shall promptly

attempt to provide notice, by telephonic or electronic communication as provided on the face of the bill of lading, if so indicated, to the

shipper or the party, if any, designated to receive notice on this bill of lading. Storage charges, based on the carrier’s provisions in effect,

shall start no sooner than the next business day following the attempted notification. Storage may be, at the carrier’s option, in any location

that provides reasonable protection against loss or damage. The carrier may place the shipment in public storage at the owner’s expense and

without liability to the carrier.

(b) If the carrier does not receive disposition instructions within 48 hours of the time of the carrier’s attempted first notification, the carrier

will attempt to issue a second and final confirmed notification. Such note shall advise that if the carrier does not receive disposition

instructions within 10 days of that notification, the carrier may offer the shipment for sale at a public auction and the carrier has the right to

offer the shipment for sale. The amount of sale will be applied to the carrier’s invoice for transportation and other lawful charges. The

owner will be responsible for the balance of charges not covered by the sale of goods. If there is a balance remaining after all charges and

expenses are paid, such balance will be paid to the owner of the property sold hereunder, upon claim and proof of ownership.

(c) Where the carrier has attempted to follow the procedures set forth in subsections 4(a) and (b) above and the procedure provided in this

section is not possible, nothing in this section shall be construed to abridge the right of the carrier at its option to sell the property under such

circumstances and in such manner as may be authorized by law. When perishable goods cannot be delivered and disposition is not given

within a reasonable time, the carrier may dispose of property to the best advantage.

(d) Where the carrier is directed by the consignee or shipper to unload or delivery property at a particular location where the shipper,

consignee, or the agent of either, is not regularly located, the risk after unloading or delivery shall not be that of the carrier.

BILL of LADING CONTRACT TERMS and CONDITIONS:– Concluded

Sec 5. (a) In all cases not prohibited by law, where a lower value than the actual value of the said property has been stated in writing by the

shipper or has been agreed upon in writing as the released value of the property on which the rate is based, such lower value plus freight

charges if paid shall be the maximum recoverable amount for loss or damage, whether or not such loss or damage occurs from negligence.

(b) No carrier hereunder will carry or be liable in any way for any documents, coin, money, or for any articles of extraordinary value not

specifically rated unless a special agreement to do so and a stipulated value of the articles are endorsed on the bill of lading.

Sec. 6. Every party, whether principal or agent, who ships explosives or dangerous goods, without previous full written disclosure to the

carrier of their nature, shall be liable for and indemnify the carrier against all loss or damage caused by such goods. Such goods may be

warehoused at the owner’s risk and expense or destroyed without compensation.

Sec. 7. (a) The shipper or the consignee shall be liable for the freight and other lawful charges accruing on the shipment, as billed or

corrected, except that collect shipments may move without recourse to the shipper when the shipper so stipulates by signature or

endorsement in the space provided on the face of the bill of lading. Nevertheless, the shipper shall remain liable for transportation charges

where there has been an erroneous determination of the freight charges assessed, based upon incomplete or incorrect information provided

by the shipper.

(b) Notwithstanding the provisions of subsection (a) above, the consignee’s liability for payment of additional charges that may be found to

be due upon delivery shall be specified by 49 U.S.C. §13706, except that the consignee need not provide the specified written notice to the

delivering carrier if the consignee is a for–hire carrier.

(c) Nothing in this bill of lading shall limit the right of the carrier to require the payment or guarantee of the charges at the time of shipment

prior to delivery. If the description of articles or other information on the carrier’s bill of lading is found to be incorrect or incomplete, the

freight charges must be paid on the articles actually shipped.

Sec. 8. If the carrier’s bill of lading is issued on the order of the shipper or his agent, in exchange or in substitution for another bill of lading,

the shipper’s signature on the prior bill of lading or in connection with the prior bill of lading as to the statement of value or otherwise, or as

to the election of common law or bill of lading liability shall be considered a part of the carrier’s bill of lading as fully as if the same were

written on or made in connection with the carrier’s bill of lading.

Sec. 9. If all or any part of said property is carried by water over any part of said route, such water carrier shall be performed subject to the

terms and provisions and limitations of liability specified by the “Carriage of Goods by Sea Act” and any other pertinent laws applicable to

water carriers.
