Members of the Spring Valley Lake Association:

Over the years, the Rules & Regulations of Spring Valley Lake Association have had many revisions, amendments and clarifications. This latest edition, approved by the Board of Directors in January, 2007, incorporates all of those changes, plus adds or deletes other components that address our community in today’s legal environment.

For most of 2006, various committees have spent considerable time to revise the sections governing their respective areas of concern. The changes implemented in this iteration are the result of that volunteer work. Committee members are to be commended for their contribution.

It should be understood that the Rules & Regulations are a dynamic, ever-changing document. Therefore, as the next several years proceed, you can expect to see individual clauses, paragraphs, or even entire sections subject to additional change. Most often these changes will come about as a result of modified state law and the need for SVLA to comply with those changes. We hope you will understand thenecessity of such revision.

A sincere thank you is extended to all of our members for their cooperation with our governing documents. The primary purpose of this set of rules is to maintain and enhance the appearance, living standard, and economic value of our property and to strive to retain our community in a beautiful condition.

Such a lofty goal can only be accomplished with your cooperation.

1. GENERAL

1.1. The Board of Directors, Spring Valley LakeAssociation,hasestablishedrulesfortheuseofAssociationfacilitiestobefollowedbyallmembers,associatemembers,andtheirguests.

1.2. Itistheresponsibilityofallmemberstoensurethattheirfamilymembers,tenantsandguestsarefamiliarwithandabidebyallAssociationrules.

1.3. All applicable federal, state and county laws andordinanceswillbeenforcedbytheresponsibleauthority.

1.4. Any reference to fees, fines or financial costsassociated with the various sections of these Rules &Regulations refer to the Spring Valley Lake AssociationFee Schedule which shall be updated annually by theBoardofDirectors.

1.5. Community Patrol (Security) personnel andcertain other properly identified Association personnelarechargedwith theresponsibilityofchecking IDcardsand other personal identification, enforcing establishedrules, and requesting services of appropriate civil andlawenforcementagencieswhenviolationsoccurand/orapprehension is required. Violators of these rules mayexpecttobecitedand/oraskedtoleavetheAssociationowned property. Refusal to leave when requested mayresult inaSanBernardinoCountySheriff’s citation fortrespassing.

1.6. ViolationsoftheSVLAgoverningdocumentsmayresult in citation of members. Citations may result infines and/or loss of membership privileges. The BoardofDirectors,afterdueprocessincludingahearingbytheCitationCommittee,makesfinaldecisionsregardinglossofmembershipprivilegesand/orrecoveryofadministrativecharges (fines) for offenses. The complete hearingproceduresaresetforthinaseparatepublication.

1.7. Community Patrol (Security) Officers/BeachPatrol/Lifeguardsondutyarevestedwiththesupervisoryauthority over all beach, fishing, marina and allAssociationamenitiesand,accordingly,arechargedwiththeresponsibilityofmaintainingorderandinsuringthesafety of people utilizing all the amenities. Lifeguards,beach patrol, and Community Patrol (Security) Officersareauthorizedtoban/ejectfromallAssociationamenitiesanyperson(s)whointheirjudgment,is/arecontributingtothediscomfortofothers,orinanywayinterfereswithmaintenance,safetyandsanitation.

1.8. The closing time for all Association amenitiesshallbe10:00P.M. to coincidewith the county curfew.Noonewillbeallowedonthebeach,fishingareasorthe

Associationparksbeyondthe10:00P.M.curfew.

1.9. FoullanguageorabusedirectedtoanySpringValleyLakeAssociationemployee,BoardofDirectors’member,orCommitteemember,willnotbetoleratedandissubjecttoacitation.

1.10. NoindividualispermittedtoborroworremoveanypieceofAssociationequipmentexceptdesignatedrentalequipment.

1.11. Noperson shalldischargeordeposit food scraps,garbage, fish scraps, oil, gas or other waste materials inthe lake, along its shorelines,orontootherAssociationpropertyorintoAssociationownedtrashdumpsters.

1.12. Trash from homes, construction sites, and otherdomestic sources, will not be placed in any Associationtrashcontainer.

1.13. There will be no burning of tumbleweeds or dryvegetationunless youhave a validpermit issuedbySanBernardinoCounty,orbytheTownofAppleValleyforpropertyintheEquestrianEstates,inyournameandinyourpossession.Shouldyouanticipateaburning,pleasefurnishtheAssociationofficeacopyofyourpermitalongwithdateandtimeofanticipatedburning.

1.14. Associationfacilitiesmaynotbeusedforcommercialpurposes(boattesting,guidedfishing,foodsales,etcetera).Similarly, therewillbenosolicitationordistributionofliteratureonSpringValleyLakeAssociationproperty.

1.15. Outside groups may not use Association facilitieswithoutwrittenpermissionoftheBoardofDirectorsortheGeneralManager.

1.16. No refuse shallbedeposited, thrown into, leakedinto,orotherwiseallowedonthebanksorinthelake.

1.17. All SVLA identification cards and guest passesremain the property of the Association. Misuse of thecardsmayresultintheirinvalidationand/orseizure.

1.18. PropertyownersareresponsibleforcompliancewithSVLA’sRulesandRegulationsbyanyoneusingtheirguestpassesunlesstheyhavereportedtotheAssociationoffice,inwriting,thattheguestpasshasbeenlostorstolen.

1.19. Lostorstolenmembershipcardsandguestpassesmust be reported immediately to Community Patrol(Security)andconfirmedinwritingwithin7days.

1.20. Areplacementfeewillbechargedforthefirstlostor stolen guest pass or membership card and for eachsubsequentcard.

2. ELIGIBILITY/AUTHORIZEDUSERS

2.1. Facilities are for theuseof allSpringValleyLake

members,AssociateMembersandbonafideguests.

2.2. Definitions:For thepurposesof applicability andenforcementoftheserulesandregulationsthefollowingdefinitionsapply:

2.2.1. Identification cards - a plastic or paperform, wallet sized card, provided by the Association,which identifies various categories of authorized usersof Association facilities. These cards are to be used inconjunctionwithanotherformofidentification(i.e.

driverslicense,studentID.

2.2.2. Guestpasses-aplasticorpaperform,walletsizedcard,issuedtoAssociationmembersforusebytheirbonafideguests.

2.2.3. Members - owners of lots, improved orunimprovedandcondominiumunitsintheSpringValleyLakeAssociation(i.e.husbandandwife,ortworelatedorunrelatedindividuals).Onlytwoownerstoalotareallowedunder this definition. Corporate and trustee owners oflotsmaydesignateup to twoownersof thecorporationasmembers.Otherownersontitleareconsideredtobeco-owners.

2.2.4. Co-owners are those persons with anownership interest in an SVL lot, as recorded withSanBernardinoCounty,beyondthetwoownersasdescribedin2.2.3above.

2.2.5. Associate members include the followingcategories.

2.2.5.1. Spouse and/or children of amemberwhoalsohavethesameresidenceasthememberbutarenotontitletotheproperty.

2.2.5.2. Co-owners of any lot who havepaidAssociateMembershipfeesforthecurrentyear.

2.2.5.3. Persons who have the sameresidenceastheownerandwhohavepaidadministrativefees for thecurrent yearas establishedby theBoard. (Ifonlyonepersonisontitle,thatpersoncandesignateanysecondpersonofthehouseholdtoreceiveamembershipcardatnocharge).

2.2.5.4. Tenantsofasingle-familyresidenceandtheirfamilymembersasdefinedin2.2.5.7belowwhohavepaidAssociatemembershipfeesforthecurrentyear.

2.2.5.5. Bona fide guests - include thosepersonsvisitingamemberattheirSpringValleyLakeplaceof residence. Tenants and/or lessees are not consideredbonafideguests.

2.2.5.6. Familymembers-Father,mother,brother,sister,sonordaughterofamemberwhohavethesameresidenceasthepropertyowner.

2.2.5.7. Tenants - A person or personsactually living in a Spring Valley Lake house orcondominiumunderleasefromamember.

2.3. Membership identification cards are normallyissuedtopropertyownersandtheirdesignates(seeSection2.2.3 above)during the assessment collectionprocess atthebeginningofeachfiscalyear(November1st).

2.4. Associate member identification cards are issuedtothoseindividualsdefinedinSection2.2.5)abovewhohavepaidthefeesestablishedbytheBoardandagreedtotermsandconditionspublishedseparately.

2.5. PersonsfoundonAssociationpropertywhodonothave an identification card showing their eligibility foruseoftheamenitieswillbeaskedtoleaveimmediately.Iftheyrefusetodoso,theymaybecitedand/ortheSheriff’sDepartmentwillbeaskedtochargethemwithtrespassing.

2.6. Guest passes are required for persons 12 years ofageorolder.Theowner(s)ofeachlotreceive(s)fourguestpasses.OwnersmayallowanyonetousethepassesexceptfortenantsrentingorleasinghomesinSpringValleyLake.Ownerswhoallowtenantstousetheirguestpassesareinviolationoftheserulesandmaybecited.

2.7. Guest restrictions may be waived by the Boardof Directors for special events at the beach or parks.Application for such waivers may be made at theAssociation office. If swimming is involved, a chargefor extra lifeguards will be imposed. Beach parties withplanned attendance in excessof 50 individualsmustbeapprovedbytheBoardofDirectors,orattheirdelegation,the General Manager. The Board of Directors reservetherightto limitbeachpartiestonomorethantwo(2)partiesperdaywithamaximumcombinedattendanceof150 individuals. Requested special events or parties onweekendsandholidaysfromMemorialDaythroughLaborDayontheeastandwestbeachareamustbeapprovedbytheBoardofDirectorsortheGeneralManager.

3. DOGS,PETS,ANIMALS

3.1. Alldogsmustbeonaleashorconfinedwithinanowner’sproperty (SanBernardinoCounty andTownofAppleValleyOrdinances).DogsnotsocontrolledmaybepickedupbyAnimalControlOfficers.DogtagsmaybeobtainedattheAssociationOfficeswhichwillaidAnimalControl Officers in contacting owners. Dog tags maybe obtained for a fee, payable at the Association office.LoosedogswithSVLdogtagsshouldbereportedtotheCommunityPatrol(Security)whowillcontacttheowneroftheanimal.

3.2. Thenumberofdomestic animals, (dogs andcats)permitted will conform to the respective ordinance foreither San Bernardino County or the Town of AppleValley.

3.3. Animals and other pets are prohibited from thelake and all other Association-owned property exceptequestriantrailsandtheEquestrianCenter.NodomesticanimalshallbeallowedtoenterthelakeordischargewastealongitsshorelineoronanyotherAssociationproperty.Properlycontrolleddogsmayaccompanytheirownersinboatsonthelake.

3.4. Responsiblepetownershiprequiresthatownersofpets do not allow their animals to annoy others and tocomplywithallanimal rulesandregulations. It shallbeaviolationof theserulesandregulations foranypersonowningorhavingcontrolofoneormoreofanyanimalorfowl,eitherwillfullyorthroughfailuretoexercisepropercontrol, to allow any such animal or fowl to habituallybark,howl,crowormakeanyother loudnoises insucha manner as to cause general annoyance or discomfortto the inhabitants of a neighborhood and to interferewith the reasonable and comfortable enjoyment of lifeorproperty. Eachreportedincidentshallbeconsidereda separate violation. Any infraction of this rule, SanBernardinoCountyand/orTownofAppleValleyanimalnoiseordinanceswillbecauseforissuingaSpringValleyLake Association citation. Continued violations of thissection will be cause for referral to the proper animalcontrolagencyforpossibleprosecution.

4. TRAFFICANDPARKING

4.1. Alloff-streetparkingforwardofthefrontbuildingline(physicalstructure)shallbeofshortduration,seventy-two(72)hoursorless,andbeonpreparedsurfacessuchasbrickorconcrete. In theEquestrianEstates,parkingmayalsobepermittedongraveladjacenttoroadstructure.ViolatorsmaybecitedorfinedandvehiclesmaybetowedpursuanttoCVC22658.2.

4.2. The California Vehicle Codes apply throughoutSpring Valley Lake. San Bernardino County Codes alsoapply in the Lake Side; Apple Valley Town Ordinancesapply in theEquestrianEstates. Speed limits arepostedandprudentspeedmustbeobserved.Childrenareatplayon many of our streets and residential density dictatescautionbeobserved.

4.3. Street or driveway parking of vehicles and of anytypetrailer,camperormotorhomeislimitedto72hours.Inoperableordisabledvehiclesofanykindmustbemovedfrom roadways. The California Highway Patrol and San

Bernardino County Sheriff’s Department cooperatein enforcement of these ordinances. Vehicle parkingregulations are enforced in accordance with CountyCodesandAppleValleyTownOrdinances.ViolatorsmaybecitedorfinedandvehiclesmaybetowedpursuanttoCVC22658.2.

4.4. Street parking on the days scheduled for streetsweepingisprohibited.Vehiclesremainingonthestreet,therebyblockingaccesstothesweeper,willbecited.ThestreetsweepingschedulewillbepostedintheBreezeeachmonth.

4.5. Contractor’s equipment may not be parked onstreetsbetweensunsetandsunrise.Violatorsmaybecitedor fined and vehicles may be towed pursuant to CVC22658.2.

4.6. Nosoil,gravelorconstructiondebriswillbeallowedonroadways.

4.7. Noboattrailers,RVsorothervehiclesorequipmentmaybestoredonvacantlotsovernight.ViolatorsmaybecitedorfinedandvehiclesmaybetowedpursuanttoCVC22658.2.

4.8. Vehicles will not trespass upon private property,improvedorunimproved.ViolatorsmaybecitedorfinedandvehiclesmaybetowedpursuanttoCVC22658.2.

4.9. At theCommunityPatrol Supervisor’sdiscretion,eitheroneorbothofthebeachareaparkinglotsmaybeclosedtoprovidebettercommunitypatrolofthearea.

4.10. Parking is authorized on beach parking lots onlybetween6a.m.and10P.M.ViolatorsmaybecitedorfinedandvehiclesmaybetowedpursuanttoCVC22658.2.

4.11. AllvehiclesparkedonAssociationownedfacilities,exceptMarinaandEquestrianCenterparkinglots,mustpossessanddisplayaSpringValleyLakeparkingpermit.ViolatorsmaybecitedorfinedandvehiclesmaybetowedpursuanttoCVC22658.2.

4.12. FromMemorialDayweekendthroughLaborDay,parking permits will not be required on either beachparking lot for those members and guests with properpassesandI.D.

4.13. Overnight parking is not allowed on Association-owned property or vacant property except for on-dutyAssociationandfiredepartmentpersonnel.ViolatorsmaybecitedorfinedandvehiclesmaybetowedpursuanttoCVC22658.2.

4.14. Trailers of any sort, except for designated horsetrailers in theEquestrianCenter,willnotbeparkedonAssociationparkinglots.ViolatorsmaybecitedorfinedandvehiclesmaybetowedpursuanttoCVC22658.2.

5. BOATING

5.1. General

5.1.1. For the purpose of these rules andregulations,unlessthecontextclearlyrequiresadifferentmeaning,thefollowingdefinitionsapply:

5.1.1.1. “Alcohol” means any form orderivativeofethylalcohol(ethanol).

5.1.1.2. “Alcohol concentration” meanseither grams of alcohol per 100 milliliters of blood orgramsofalcoholper210litersofbreath.

5.1.1.3. “Boat”meansthesameasvessel.

5.1.1.4. “Chemical test” means a testthatanalyzesan individual’sbreath,blood,orurine, forevidenceofdrugoralcoholuse.

5.1.1.5. “Controlled substance” meanscontrolled substanceasdefined inSection11007of theHealthandSafetyCodeoftheStateofCalifornia.

5.1.1.6. “Drug” means any substance orcombinationofsubstancesotherthanalcoholthatcouldsoaffectthenervoussystem,brain,ormusclesofapersonastoimpairtoanappreciabledegreehisorherabilitytooperateavesselinthemannerthatanordinaryprudentperson, in full possession of his or her faculties, usingreasonable care, would use to operate a similar vesselunderlikeconditions.

5.1.1.7. “Intoxicant” means any form ofalcohol,drug,orcombinationthereof.

5.1.1.8. “Length” shall be determined bythemanufacturer’sspecifications,whereavailable.Inthecaseofcustomboatsorwheresuchspecificationcannotbeascertained,thenthelengthoftheboatshallbephysicallymeasuredfromtheoutsideofthebowtotheoutsideofthe sternalong thecenterlineof thevessel. In thecaseofpontoonboats,thebowshallbeconsideredtobetheextremeforwardendofthepontoonordeck,whicheverisgreater.Thesternshallbeconsideredtobetheextremeafter end of the pontoon or deck, whichever is greater.Motors or other appurtenances that extend beyond thehullorpontoonofthevesselshallnotbeconsideredindetermininglength.

5.1.1.9. “Mainlakebody”meansthatareaoftheSpringValleyLakethatlieslakewardofthelineofred/orangebuoysinwhichspeedsinexcessof5mpharepermitted.

5.1.1.10. “Motor boat” means any vesselpropelledbymachinerywhetherornotthemachineryistheprincipalsourceofpropulsion.

5.1.1.11. “Observer”meansapersonotherthanoperator,atleast12yearsofageorolderwhoactsasalookoutandflagbearerwhenengagedinwatertowingactivity.

5.1.1.12. “Operator”means thepersononboardwhoissteeringthevesselwhileunderway.

5.1.1.13.“Owner”meansthepersonhavingalltheincidentsofownership,includingthelegaltitle,ofavesselwhetherornotthatpersonlends,rents,orpledgesthe vessel; the person entitled to the possession of avesselasthepurchaserunderaconditionalsalecontract,themortgageeofavessel,ortherenterorlesseeofavesselunderalease,lease-sale,orrentalpurchaseagreementthatgrantspossessionofthevesseltothelesseeforaperiodof30consecutivedaysormore.“Owner”meansthesameas“LegalOwner”.

5.1.1.14. “Passenger” means any personaboardavesselwhileunderwayotherthantheoperatorofthevessel.

5.1.1.15.“Personal watercraft (PWC)” is avesseldescribedbythemanufacturerasaPWC,propelledbymachinery,thatisdesignedtobeoperatedbyapersonsitting,standing,orkneelingonthevessel,ratherthanintheconventionalmannerofsittingorstandinginsidethevessel.

5.1.1.16. “Special-use area” means all or aportionofawaterwaythat is setaside forspecifiedusesoractivitiestotheexclusionofotherincompatibleusesoractivities.

5.1.1.17. “Sunset or sunrise” is the timespecifiedintheFarmer’sAlmanacorDailyPressweathersectionforthisgeographiclocation.

5.1.1.18. “Vessel”includeseverydescriptionofwatercraftusedorcapableofbeingusedasameansoftransportationonwater,exceptseaplanes.

5.1.1.19. “Water skis, an aquaplane, orsimilardevice”includesallformsofwaterskiing,barefootskiing,skiingonskimboards,skiingonwakeboards,kneeboards,inflatabletubes,orothercontrivancesoractivitywhereapersonistowedbehindoralongsideaboat.Thisdefinitiondoesnotincludeparasailing,skikitingoranyothersimilaractivitythatisspecificallyprohibitedbytheseRules.

5.1.2. The Association member/owner of avessel is responsibleatall time for the safeoperationoftheir vessel and the conduct of the passengers thereon.Recklessoperationanddisregardforthesafetyofpersons

andpropertymayresult intheforfeitureof lakeboatingprivilegesinadditiontootherpenalties.

5.1.3. California Boating laws apply to boatingoperations on Spring Valley Lake. The CommunityPatrol(Security)Departmenthastheauthoritytoenforceprovisions of California Boating Law and Spring ValleyLakeAssociationrules.Areportofviolationoftheserulesand/ortheCaliforniaBoatingLawswillbesubmittedtotheGeneralManager forany requiredaction to includesuspensionofboatingprivilegesonthelake.

5.1.4. A vessel operator’s permit issued by theAssociationmustbe ineachvesseloperator’spossessionwhenoperatingavesselanywhereonthelake, includingthose areas deemed to be within the lake easement ormarina. Operators licenses are issued subject to thefollowingconditions:

5.1.4.1. Alloperatorsofvesselsmustpassa written test administered by the Community Patrol(Security)Departmenttoobtainanoperatorspermit.Thewritten test will be based on information contained inSection5oftheRulesandRegulationsandthecontentofaboatingsafetyvideotape.Operator’spermittestingshallbeconductedona regularbasis, the schedule forwhichshallbecontainedintheBreeze.

5.1.5.Alloperatorspermitsshallbeendorsedfor:

5.1.5.1. Powervesselsover15HP, includingPWC’s

5.1.5.2. Powervesselsunder15HP,or

5.1.5.3. Non-poweredvessels

5.1.5.4. Endorsement(1)shallinclude endorsement(2)and(3)

5.1.5.5. Endorsement(2)shallinclude endorsement(3)

5.1.5.6. Endorsement(3)shallnotincludeanyotherendorsement.

5.1.6. GuestsofMembersorAssociateMembersmust be accompanied by the sponsoring Member whenapplyingfor,orrenewinganoperator’spermit.

5.1.7. Allvesseloperator’spermitsaresubjecttorevocationbytheBoardofDirectorsforviolationoftheserulesafterdueprocess.

5.1.8. Powervesseloperatorsmustbeat least16yearsofageandmusthaveavaliddriver’slicense.Powervessels operator’s permits shall expire on the same dateas the operator’s state driver’s license; however, shall beautomatically renewed without re-examination uponproduction of a current driver’s license. Non-poweredvesselsoperator’spermitsshallnotexpire.

5.1.9. Marina slips are leased subject to thefollowing:

5.1.9.1. CurrentSVLboatregistration.

5.1.9.2. Paymentofsliprentalfees.

5.1.9.3. A signed agreement regardingcompliancewithtermsoftherental.

5.1.10. Slips cannot be transferred or sub-leased,butmustbepromptlyreleasedbacktotheAssociationifnolongerneededoreligibilityisterminated.

5.1.11. Vesselskeptinslipsmustbemaintainedinanattractiveandoperablecondition.

5.1.12. Overnightsleepingaboardvesselsafloat isprohibited.

5.1.13. SVLAregisteredvesselsmaybelaunchedatthe marina ramp. Sailboards, kayaks, canoes and othersimilarsmallandlightweightnon-poweredvesselsmaybelaunchedfrommarinaramp,fishingareasorbeach.Vesselsregistered to owners of lakefront lots or condominiumunitsmaybelaunchedattheirownlaunchingramp.BoattrailersmaynotbeparkedintheMarinaparkingareaorinbeachparkinglots.

5.1.14. Subject to Community Patrol (Security)Department determination of acceptable weatherconditions,thelakeisnormallyopenforboatingactivitiesfrom6:00a.m.to10:00p.m.daily.SeeSection5.4.2.3forearlymorningandeveningspeedregulationsandSection5.8.2forspecialpersonalwatercraftrestrictions.

5.1.15. Vessels beached in designated ski beachareasmustbesecurelymooredtotheshoreinsuchawaythattheywillnotdriftaway.

5.1.16. Vesselsshallnotbetiedtobuoys.

5.1.17. Illegallybeached,docked,ordriftingvesselsmay be towed to the marina and the owner assessed aservicefee.

5.1.18. Use of a parachute or any other airbornedevice on the lake is prohibited. This includes, but isnot limited to, parasailing, kite boarding, and similaractivities.

5.1.19. Onlymushroom-typeanchorsand/orsandbagsmaybeused.

5.2. BoatandVesselLiftRegistration.

5.2.1. Allboatsorvesselsplaced inorupon thewaters of Spring Valley Lake must be registered withSpringValleyLakeAssociation.Allnewlyinstalledvessellifts must have a completed Architectural ImprovementandLicenseAgreement–Vessel Lift on file at theAssociationoffice.

5.2.2. All vessels must have current State andSpringValleyLakeregistrationdecalsbeforebeingplacedonthelake.(Vesselspropelledsolelybyoarsorpaddlesand vessels eight feet or less, propelled solely by a sail,maybeexemptfromStateregistration,however,mustberegisteredwithSVLA).

5.2.3. All vessels are subject to inspection inconjunction with the annual registration and may besubjecttofurtherinspectionatanytimeasrequestedbyaLakePatrolofficer.Inspectionmayincludeverificationoflengthandenginenoiselevels.

5.2.4. MembersorAssociateMembersregisteringvesselsmustbeproperlyidentifiedandmustshow:

5.2.4.1. Proof of vessel ownership byMemberorAssociateMemberregisteringthevessel.

5.2.4.2. Valid state vessel registration(unless vessel is exempt fromstate registration) innameof Member or Associate Member that reflects mailingaddressthatagreeswithAssociationmembershiprecords.

5.2.4.3. ProofofinsuranceasevidencedbyaCertificateofInsurance.

5.2.4.3.1. Showinganexpirationdate of the policy later than the expiration date of theSVLAregistration.

5.2.4.3.2. $300,000minimumliabilitycoverage.

5.2.4.3.3. Naming Spring ValleyLakeAssociation,13325SpringValleyParkway,7001SVLBox, Victorville, CA 92395-5107; its directors, officers,employeesandagentsasapartyofinterest.

5.2.4.3.4. Having a name andaddressfortheinsuredpartythatcorrespondstothenameandaddressoftheMemberorAssociateMemberinthemembershiprecordsoftheAssociation.

5.2.4.3.5. Fullandproperidenti-ficationoftheinsuredvessel,and

5.2.4.3.6. A statement that atleastten(10)dayswrittennoticeshallbegiventoSVLApriortocancellationofthepolicy.

5.2.4.4. Payment of the annual Boat andVesselLiftRegistrationFee.

5.2.4.5. Signedconditionsforissuanceof

boat registration / permit liability form by Member orAssociatemember.

5.2.4.6. Thememberorassociatememberwill be issued a copy of the most current Section 5 –

Boating,oftheSpringValleyLakeAssociationRulesandRegulations and agrees to become familiar and complywiththeinformationcontainedtherein.

5.2.4.7. Driver’s license or I.D. with anaddresswhichcorrespondswiththemembershiprecordsoftheAssociation.

5.2.5. Boat registrations are valid from January1sttoDecember31stofeachyear.Aftertheregistrationfeeiscollected,theregistrantwillnormallybegivencopiesof “ABC’s of the California Boating Law,” the SpringValleyLake“RulesandRegulations”andanSVLAboatregistrationdecal.Thedecalshallbeplacedontheport(left) sideof thevesselnear thebow(front)area, just totherightoftheStatedecalifapplicable.Stateregistrationnumbers,ifapplicablemustbepaintedonorpermanentlyattached to each side of the forward half of the vessel.Windsurferdecalsshallbeplacedon the mast or boom.Decalsforothervesselsnototherwiselistedmustbeplacedontheforwardhalfofthevessel,ontheleftside,wherebestseen.

5.2.6. Vessel registrations may be transferred byapropertyowner toanewlypurchasedvessel subject inaccordance with the rules of the Association and uponpaymentofapplicablefees.AnychangeofownershipofvesselsregisteredwithSVLAmustbereportedinwritingtotheAssociationofficewithinten(10)daysfollowingsuchchangeofownership.Registrationfeesarenotrefundable

5.2.7. SizeLimitations:

5.2.7.1. Power boats and sail boats maynotexceed22feetmaximumlength.

5.2.7.2. Pontoonboatsmaynotexceed24feetmaximumlength.

5.2.8. Prohibitedvesselsinclude:

5.2.8.1. Fixed keel sailboats with deeperthan24”draft.

5.2.8.2. Vesselswithtoiletfacilitiesand/orcapableofdischargingwastewaterunlesssuchfacilitiesaredisabled.

5.2.9. No person (for each lot owned) shall beallowedtoregistermorethantwovesselsexceedingfifteen(15)horsepower.ThisalsoappliestoassociatemembersasdefinedintheBylaws.

5.3. VesselOperations

5.3.1. All vessels will observe the InlandNavigation Rules, however, Lake Harvesting machinesshallbeconsideredtobethe“burdened”vesselatalltimeswhenoperatingonSpringValleyLake.

5.3.2. No vessels shall be moored to any dockbelongingtotheAssociationexceptatthegasdockwhilepurchasing gas, at the guest dock while loading andunloadingpassengersandmaterials,andinMarinaslipsinaccordancewithrentalagreements.

5.3.3. Vesselsareprohibitedfrombeingbeachedorrunagroundonanylakeshorelotexcepttheskibeachandon approved launch ramps.Thisdoesnot apply tosmaller, non-powered vessels authorized pursuant toSection5.1.6.

5.3.4. Allvesselswhenoperatingoutsidethe“No-Wake”areaswillfollowacounter-clockwisepatternaroundthelakekeepingthenearestshorelinetotheright.

5.3.5. Vesselstowingandthedevicebeingtowedmusteachstaywellclearofsolidorange/redbuoys.Thevesseltowingandthedevicebeingtowedmusteachpassonthesamesideofthebuoy.

5.3.6. Towingofpersonsbehindaboatislimitedto kneeboards, water skis, devices shaped like innertubes,torpedoes,wakeboards,etcetera,whichhavebeencommerciallydesignedandsoldforthispurpose.

5.3.7. Vesselsandallskiersmuststaywellclearofweedharvestersatworkonthelake.Adangerousconditionexistsintheeventaskiershouldfall,miscalculatespeedordirection,orcollidewiththemachine.

5.3.8. Paddle and row boats, kayaks and canoesshallremainwithinthe“NoWake”areas.

5.4. SpeedRegulations

5.4.1. Themaximumspeedforallvesselsisthirty-five (35)milesperhour. Radarmaybeusedtoenforcespeedregulations.

5.4.2. Themaximumspeedshallbefive(5)milesperhour(“No-Wake”)asfollows:

5.4.2.1. During all periods of restrictedvisibility,includinghoursofdarkness.

5.4.2.2. From sunset to 10:00 p.m.daily except during the period beginning at sunrise onthe Saturday of Memorial Day weekend and ending atmidnightonLaborDaywhentheperiodshallbeextendedtomidnight.

5.4.2.3. Dailyfrom6:00a.m.til7:00a.m.

5.4.2.4. Withinonehundredfeet(100’)ofanyboatbeing towed, anyboat that is capsized,or theAssociation’sharvestervessels.

5.4.2.5. Atalltimeswhenlandwardofthered/orangebuoysestablishedatafixeddistancefromtheshoreline.

5.4.2.6. It is unlawful to use a vesselor permit a vessel to be used at a speed in excess of 5mph within 100 feet of a beach frequented by bathers,aswimmingfloat,divingplatform,orlifeline,andawayor landing float to which boats are made fast or whichisbeingusedforembarkationordischargeofpassengers.(SanBernardinoCountyCodeSection52.032).

5.5. Safety

5.5.1. Allboatsoperatingonthelakeshallmeetthe Coast Guard and State of California equipmentrequirements as stipulated in “ABC’s of the CaliforniaBoating Law,” current edition, for safety equipment toincludethefollowingdefinitions:

5.5.1.1. At least one personal flotationdevice (PFD) of proper size for each person on boardwhileunderway. This requirementapplies toall vesselsincluding windsurfing boards, sailboards and similardevices.Childrenundertheageoftwelve(12)mustwearaPFDatalltimeswhileonboardavessel.

5.5.1.2. Allpowervesselsmusthaveafireextinguisher.

5.5.1.3. Eachvesselmustbeabletoprovideameansofmakinganefficientsoundsignal.Ahornisrecommended.

5.5.1.4. Navigationlightsmustbekeptinserviceable condition and displayed in accordance withthe“RulesoftheRoad”betweensunsetandsunriseandatothertimesofrestrictedvisibility.

5.5.1.5. Recommended additional equip-ment: paddle or oar, red/orange flag, bailing device(pump,bucket,etcetera),firstaidkit,towingline.

5.5.2. Vessels will not be loaded beyondmanufacturer’srecommendedcapacityandalloccupantsaretobeseatedinside(notonthegunwales(sides)orbow(front))whenevertheboatisunderway(moving)exceptintheordinaryhandlingofsailingcraftandpersonsproperlyseatedinbow-riderboats.

5.5.3. Spring Valley Lake is a Special Use Area.Personalwatercraftandsimilardevicesmustbeoperatedaccordingtomanufacturer’sspecifications,however,maynottowaskierorotherrecreationaldeviceatanytime.

5.5.4. Novesselmaycloselyfollowanothervesselorskier.Vesselswillkeepatleasttwohundredfeet(200’)behindand/ortothesideofskiers.

5.5.5. Ared/orangeflagwillberaisedwhenaskierisinthewaterpreparingtoski,adownedskier,askilineextendedfromthevessel,askiinthewaterinthevicinityofthevessel,towingadisabledvessel,andwhentrolling.

5.5.6. No person shall operate any vessel ormanipulateanywaterskis,orsimilardeviceinarecklessor negligent manner so as to endanger the life, limb,or property of any person. Examples of such operationinclude,butarenotlimitedto:

5.5.6.1. Maneuvering towedskiers,orde-vices,soastopasstowlineoveranothervesseloritsskier.

5.5.6.2. Navigating a vessel, skis or otherdevicesbetweenatowingvesselanditstow.

5.5.6.3. Navigating a vessel, skis or otherdevices in such a manner as to cause a buoy to comebetweenthevesselandthedevicebeingtowed.

5.5.6.4. Operatingundertheinfluenceofintoxicantsornarcotics.

5.5.6.5. Other actions, such as speedingin confined or restricted areas, “buzzing” or “wettingdown”others,orskiingatprohibitedtimesorinrestrictedareas can also be construed to be reckless or negligentoperation.

5.5.6.6. Wakejumpingofanytypeofvesselbyapersonalwatercraft(PWC).

5.5.7. Department of Boating and Waterwaysdetermined that alcohol is a high factor of all fatalmotorboataccidents inCalifornia. Pleasedonotdrinkandoperateavessel!Statelawspecifiesthat:

5.5.7.1. Nopersonshalloperateanyvessel,waterskisorsimilardevicewhileundertheinfluenceofintoxicatingliquorordrugs.

5.5.7.2. Nopersonshalloperateanyvessel,waterskisorsimilardevicewhohas.08percentormore,byweight,ofalcoholintheirblood.

5.5.7.3. If you are convictedof operatinga vessel while intoxicated, the Department of MotorVehicles may suspend or revoke your vehicle driver’slicense.Dependinguponthenumberandtypeofvesselviolations accumulated, this suspension or revocationcouldbeforuptofive(5)years,andcouldalsoresultinfinesofupto$1,000.

5.5.8. AllaccidentsmustbereportedimmediatelytotheSheriffandSpringValleyLakeCommunityPatrol,in addition to necessary reports required by State Law.Accidentsresultingindeathorinjurymustbeimmediatelyreportedvia9-1-1totheSheriff’sDepartment.

5.5.9. In the event of emergencies, hazardousweather,speciallakeactivities,orovercrowdedconditions,allvesselactivitiesmaybelimitedorcurtailedasrequiredbytheSpringValleyLakeCommunityPatrol.

5.5.10. OvercrowdedLakeProcedures:Anytimethe

lakeisunsafeduetoovercrowdingtheGeneralManageror the on duty supervisor of the Spring Valley LakeCommunityPatrolmayactivatetheOdd/Evenflagsystemanddirectthepatrolboattomakeanannouncementovertheloudspeaker.Flagpolesarelocatedatthemarinaandthebeach.

5.5.10.1.ODD – International MarineSignal Flag “O” - Only vessels with a SpringValleyLakedecal endingwithanoddnumbermayusethelake.

5.5.10.2.EVEN – International MarineSignalFlag“E”- OnlyvesselswithaSpringValley

Lake decal ending with an even number may use thelake.

5.5.11. Lake Evacuation Siren: The siren willbe activated by Spring Valley Lake Community Patrolpersonnelduringadverseweatherconditionsoranytimethelakeisconsideredunsafetouse.

5.5.11.1.Wailingsound:Clearthelakeofallrecreationalactivity.

5.5.11.2.Steadysound: AllClear -safetoresumenormalactivity.

5.6. EngineNoise

5.6.1. AllvesselsoperatedonSpringValleyLakeshallbemuffledorotherwiseprevented fromexceedingnoiselevelsof82decibelsestablishedbyCaliforniaboatinglaws.

5.6.2. Anypersonoperatingavesselonthe lakemay be required by a Spring Valley Lake CommunityPatrol officer to submit that vessel for an engine noisemeasurement by Spring Valley Lake Community Patrol,theCountySheriff,or any other authorized person oragencyhavingjurisdictioninthismatter.

5.6.3. Over-the-transom exhaust systems, com-monlyreferredtoaswetanddrystacksareprohibitedonSpringValleyLakeexceptingthoseboatswhichhavebeencontinuallyregisteredtothesameowner.

5.7. WaterSkiing

5.7.1. Waterskiing ispermittedduringhoursofdaylightfrom7:00a.m.tosunset.

5.7.2. Motor boats (other than PWC’s) maytow skiers or other devices and shall observe the speedregulationslistedunderSection5.4,SpeedRegulations.

5.7.3. Waterskiingisprohibitedinallareasotherthanthemainlakebodydefinedaslakewardofthered/orangebuoys.

5.7.4. Motor boats towing skiers will follow acounter-clockwise pattern around the lake, keeping thenearest shoreline on the right. Cutting across the lakewhile towing skiers must be done with extreme cautionwhilegenerallymaintainingthesamecounter-clockwisecourse.

5.7.5. All skiers, persons being towed on anydevice,personsundertheageof12andthosewhodonotknow how to swim or have trouble swimming unaided,must wear a Coast Guard approved personal flotationdeviceatalltimeswhileinoronavessel.Allpersonsareencouragedtowearflotationdevicesfortheirownsafety.

5.7.6. Tow lines for skiers and other toweddevices shall not exceed seventy-five feet (75’) in lengthasmeasuredfromthetowpointaboardthevesseltothetowinghandle.

5.7.7. Ski boats engaged in water skiing mustcarry anobserver at least 12 years of age in addition totheboatoperator.Theobservermustbeinapositiontokeeptheskierinconstantviewandmustsignal,byraisinga red/orange flagof twelve inchesby twelve inches (12”x 12”) minimum size, to indicate any of the followingconditions.

5.7.7.1. Adownedskier.

5.7.7.2. Askierinthewaterpreparingto ski.

5.7.7.3. Askilineextendedfromthe vessel.

5.7.7.4. Askiinthewaterinthevicinity ofthevessel..

5.7.7.5. Theflagmustbeheldhighintheairapproximatelytwohundredfeet(200’)priortoaskierbeingdroppedatthebeachorbeginningskiarea.

5.7.8. Ski Boats shall not tow more than onepersonatatimeonskis.Othertoweddeviceswillbeusedinaccordancewithmanufacturer’sspecifications.

5.7.9. Avesseloperatormustpointtowardafallenskier and vessels approaching a fallen skier should useraisedarmsignaltoacknowledgethatskier’ssituationandtocautionhisownskier.

5.7.10. Boatoperatorsreturningtoretrieveafallenskierwill:

5.7.10.1.Displayred/orangeflag.

5.7.10.2.Checktraffic(alldirections).

5.7.10.3.Slowdown,makeacautiousturn.

5.7.10.4.Expeditebacktofallenskier.

5.7.11. Motor must be stopped and propeller

disengaged(onpropellerdrivenvessels)duringfallenskierpick-uporduringthetransferofanypersonbetweenvesselanddock,beach,water,orothervessel.Skiersshouldbeapproachedfromthedriver’sside.

5.7.12. Skiers arenot to cut close tootherboats,spray on others, or otherwise showdisregard for peopleandpropertyandmustremainwellclearofallbuoys.

5.7.13. Kickingskisoffandleavinginthewaterforlaterpickupisprohibited.

5.7.14. When using ski beach for drop-off, ropeswill be retrieved only at rope pick-up area marked by ayellowbuoyadjacenttoFishingArea15.

5.8. PersonalWatercraft

5.8.1. Personal watercraft must not be loadedbeyondmanufacturer’sspecifications.

5.8.2. Spring Valley Lake is a Special Use Area.Personalwatercraftareprohibitedfromoperatingonthemainlakebodybetweenthehoursof7:00a.m.and10:00a.m. on Saturdays, Sundays, and holidays between andincludingMemorialDayweekendandLaborDayweekendandbetweenthehoursof7:00a.m.and8:00a.m.onallother days. PWC operation is permitted in the 5 mphoperatingareas(“No-Wake”)duringthesehours.

5.8.3. Personalwatercraftshallnotbeoperatedinanymannerthatutilizesthewakeofanyvessel,includinganyotherPWC,waterskier,oranyallowabletowedobject,toturn,jump,ormaneuverthePWC.

5.8.4. Personal watercraft may be turned 360degreesifsuchmaneuvercanbeaccomplishedwithinthelengthofthePWCandthereisnoboattrafficimmediatelybehindthePWC.CircularturnslargerthanthelengthofthePWCareprohibited.

5.8.5. Personal watercraft must obey all “NoWake”restrictions.

5.8.6. PersonalWatercraftoperatorsmustcomplywiththeRulesoftheRoadatalltimes.

5.8.7. PWCshallstayoutsidethewakeofanyboatpullingaskierandshallmaintainadistanceof200feetfromanyskier.ThiswillpermitthePWCtotakeevasiveactionintheeventtheskiershouldfallordropoff.SeeSection5.5.3forotherrestrictions.

5.8.8. Personal watercraft must observe allapplicableboatinglaws.

5.8.9. Personalwatercraftshallnottowanydeviceorskiers.

5.9. Windsurfing/Sailboarding

5.9.1. Windsurfing/Sailboardingisdefinedas“a

formofsailinginwhichaflexiblesail,freetomoveinanydirection,ismountedonasurfboardandthecraftguidedbythestandingrider.AlsocalledSailboarding.”

5.9.2. On weekends and holidays during theperiodthroughandincludingMemorialDayweekendtoLaborDayweekendwindsurfersandsailboardersarenotallowedonthemainlakebody.

5.9.3. Windsurfers, sailboarders and operatorsof other similar devices must wear a Personal FlotationDevice(PFD)ofpropersizewhileoperatingonthelake.

5.9.4. Sailboats at dock areas must have sailslowered.

5.9.5. Sailboats/sailboards must comply withtheRulesoftheRoadatalltimes.Suchvesselsgenerallyhavetheright-of-wayoverpowervesselsbutshouldshowcourtesywhenapproachinganyskiboattowingskiersoranyotherdevice.

5.10. SlalomCourseRules

5.10.1. TheslalomcourseatSpringValleyLakeisaSpecialUseArea.

5.10.2. Spring Valley Lake Association Rules andRegulationsandStateofCaliforniaboatinglawappliestoallvesselsusingtheslalomcourse.

5.10.3. BoatsandskiersshallonlyusetheSlalom..Course when traffic and water conditions permitconservative,safeoperation.

5.10.4. Theslalomcoursewillgenerallybeavailablebetween October 1st and May 1st during skiing hourspermittedbytheseRules&Regulations.TheAssociationreservestherighttoremovetheslalomcourseatanytimeforlakemaintenanceorlakeover-crowdingconditions.

5.10.5. All vessels using the Slalom Course mustobtainaslalomdecal (affixednext to theSpringValleyLakeregistrationdecal)andpassawrittentestoftheSlalomCourse and Spring Valley Lake Rules & Regulations.Vessels not bearing a slalom decal must keep well clearoftheslalomcourseandshouldpassoutsideofallbuoysmarkingthecourse.

5.10.6. TheSpringValleyLakeCommunityPatrolmayclosetheslalomcourseatanytimeifunsafeoperationisobserved.

5.10.7. Onlyonevesselatatimeisallowedintheslalomcourse.

5.10.8. Any vessel approaching the slalom coursemustturnawayatleast200feetbeforethecourseifanothervesselisobservedintheslalomcourse.

5.10.9. Any vessel using the slalom course mustimmediately reduce power to idle if another vessel is

observed entering or crossing the slalom course fromanydirection.AvesseldoesNOThaveright-of-waysolelybecause it has entered the course prior to other boats,vessels or skiers. If for any reason an emergency turn isrequired,boatsshouldturntotherighttoavoidcollision.

5.10.10. Reducing power to idle is the preferredtacticwhenyourskierfallsinorneartheslalomcourseorwhenothertrafficthreatenssafety.Afteryourboatslowstoidlespeedandtheskiropeisclearofbuoys,thentheboatmayacceleratebacktofallenskier.

5.10.11. When exiting and entering the SlalomCourse boats should do so in a counter clockwisedirection.

5.10.12.Vesselsarelimitedtosix(6)passesthroughtheSlalomCourseoratotalof15minutesifothervesselsarewaiting.

5.10.13.Vesselswaiting touse the coursewillusethearealocatedbehindtheNo-WakebuoybytheMarinaoutlet.

5.10.14.WhenusingtheSlalomCourseandaboatguide or turn ball become disconnected, the ski clubmember is responsible for replacing them immediately.Supplies for re-attaching the buoys are located at theMaintenanceBuildingoryoumaypurchasereplacementpartsandkeeptheminyourvessel.

6. FISHING

6.1. FishinglicensesarenotrequiredonSpringValleyLake.

6.2. Fishing guests must be accompanied by anAssociationMemberorAssociateMemberatalltimesandmustpossessavalidguestpassissuedbytheAssociation.Thisruledoesnotapplytoguestsunder12yearsofage.

6.3. FishingisnotpermittedfromAssociationbeaches,swimming areas or marina slips, or from boats withinfishingareaNo.1.

6.4. Fishing is permitted from boats on the lake, andatdesignatedfishingareas,andfromallprivatelyownedlakefront property by the property owners and theirguests.

6.5. Fishmaybetakenonlybyanglingwithtwocloselyattended rodsandonehand linehavingnotmore thanthreehooks.

6.6. Thedaily combined limit for all sport fishexceptbassisfive(5)perday.Thedailylimitforbassisone(1)perday.Thereisnolimitoncarp.

6.7. SizeandbaglimitsmaybeestablishedbytheBoardofDirectorsfromtimetotimebasedonestimatedbiomassof certain species, known spawning seasons, and the

stockingscheduleoftheAssociation.Suchlimitswillbepostedatthefishingareas,intheBreeze,onthewebsite,andattheAssociationoffice.

6.8. Whenanchoredor still fishingafter sunset,boatsshalldisplayanallaroundwhitelight.Whentrollingaftersunsettheboatshalldisplaynavigationlightsasrequiredbylaw.Whentrollingbetweensunriseandsunsettheboatmust display a red/orange flag of twelve inch by twelveinch(12”x12”)minimumsize.

6.9. Trolling and still fishing shall be limited to the5mph(“nowake”)areasofthelakewhichisdefinedasallareasshorewardofthered/orangebuoysfrom8:00a.m.tosunsetbetweenandincludingMemorialDayweekendandLaborDayweekend,andfromsunrisetosunsetduringallotherperiodsoftheyear.

6.10. Spearfishingorbowfishingisprohibited.

6.11. Chummingisprohibited.

6.12. Fish cleaning is prohibited on the lake or infishing areas. Offal and other discarded material fromfish cleaning must be disposed of properly. Under nocircumstancesmayitbeputintothelake.Fishcleaningfacilities are provided at the Marina. Offal and debrisfromfishcleaningattheMarinamaynotbeplacedintotheAssociationtrashdumpster.

7. SWIMMING

7.1. Swimming is permitted at the Spring Valley Lakebeachlagoonandwithinthe16feetlakeeasementareaofprivatelyownedlakefrontlotsandtheAssociationownedbeach.

7.2. UseoftheSpringValleyLakebeachandparkareaislimitedtoMembers,AssociateMembersandtheirbonafideguests,eachofwhichmusthaveanAssociationissuedguest card in their possession when using the facility.Thisruledoesnotapplytoguestsunder12yearsofage.Childrenunder12yearsofagemustbeaccompaniedbyaresponsibleadult,whoforpurposesofthisrulemustbeatleast16yearsofagewhoisacompetentswimmer.

7.3. Allpersonsusingthebeachareawillobeydirectionsor instructions givenbySpringValleyLakeCommunityPatrol(Security)Officers,lifeguards,orbeachattendants.

7.4. Swimming is discouraged in the 16 feet lakeeasementareaoutsidethedamattheSpringValleyLakeAssociation-ownedbeach.Lifeguardsarenotavailabletopatrolorassistswimmersinthisarea.

7.5. Recreationalfloatationdevicesareallowedupto8feetinlengthinallswimmingareas.

7.6. Useofscubaandsnorkelequipmentisprohibitedinall areasof the lakeother thandesignated swimmingareas.

7.7. Swimmersarecautionedthatvesselsarepermittedon the beach and in the waters of the 16 feet lakeeasement area outside the dam. Even during periodswhenlifeguardsmaybeondutyatthebeachlagoonsuchlifeguardcoveragedoesnotextendtotheeasementarea.Allpersonsenteringthewaterforwhateverpurposeinthe16feetlakeeasementattheSpringValleylakebeachdosoattheirownrisk.

7.8. Membersandtheirguestsswimmingfromprivatelyownedlakefrontlotsmustremainwithinthe16feetlakeeasement.

7.9. Vessels must not proceed at a speed greater than5mphwhenwithin100feetofpersonsinthewater,orwithin200feetof thebeachareaofSpringValleyLake;however,deepwaterandstand-upbeachstartsareallowedprovidedthetowropeisextendedtoitsfulllengthbeforethevesselisallowedtoaccelerate,andthevessel’sdirectionof travel isperpendicular to,anddirectlyaway fromthebeach.

7.10. Vesselsarenotallowedtoenterthebeacharea,orproceedatspeedsgreaterthan5mphexceptasprovidedinSection7.9.Beachdropsarenotpermitted.

8. RECREATIONAL FACILITIES, PLAYGROUNDS,ATHLETICFIELDS,&FISHINGAREAS

8.1. Association members using recreational facilitiesmust confine their activities to within the markedboundariesoftheseareas.Areasbeyondthemarkersareprivateandviolatorsaresubjecttotrespassprosecution.

8.2. PersonsundertheinfluenceofdrugsorintoxicantsareprohibitedfromusingtheAssociationfacilities.

8.3. Childrenundertheageoftwelve(12)yearsoldmustbeaccompaniedbyanadultorqualifiedguardianwhenonthebeachorfishingareas.Minimumageofqualifiedguardianissixteen(16)years.

8.4. Use of playground equipment other than what itisdesignedforwillnotbepermitted. (Includingweightlimitations).

8.5. Motorized vehicles, bicycles and skateboards arenotpermittedonAssociationproperty,otherthanpavedparkinglots.

8.6. Riding equipment is not allowed in playgroundareasexceptthattricycles,bigwheels,andsimilartoysarepermittedonconcreteareasonly.

8.7. Ballplayingispermittedindesignatedareasonly.

8.8. Barbecue facilities and trash cans must not bemoved,misusedordamaged.PicnictablesmaybemovedonlywiththeGeneralManager’swrittenpermission.

8.9. Nobottlesorotherglasscontainersareallowedinparksoronbeaches.

8.10. Rubbish and litter must be placed in receptaclesprovided.Ifspecialeventsrequireadditionalreceptacles,thecostwillbepaidbythepropertyownerwhomadethereservation.

8.11. OpenfiresareprohibitedonAssociationproperty.However, liquid and bottled fuel stoves and charcoalbraziersarepermittedinpicnicareas.Allfireswillbeinaccordancewithlocalfireordinances.

9. SOFTBALL, SOCCER FIELDS, & BASKETBALLCOURTS

9.1. Teampracticeandleagueplaypermittedonlyafterregistering at the Association office. A certificate ofinsurancelistingSVLAasanadditionalinsuredmustbeonfileattheAssociationofficewithminimumcoverageof$300,000.

9.2. Teams using the field must have a significantrepresentation of Spring Valley lake residents. TheGeneralManagermustapproveusagebyteamswithlessthan50%SVLresidents.

9.3. Reservations:

9.3.1. Toensureaccesstoplayingfieldorcourts,reservationsmustbemadeattheAssociationofficebyaSVLAmemberorsponsor.

9.3.2. Without reservations, access to fields andcourtsisonafirstcomebasis.

9.3.3. Maximum time limit for field usage perreservationwillbedeterminedbytheGeneralManager.

9.3.4. All reservationsmustbemade at least72hoursinadvance.

9.4. All teamsand individualusersareresponsible forthesecurityoftheirownequipment.

9.5. All participants, users and young visitors mustbe under adult supervision and abide by all rules andregulations.

9.6. Baseball usage (at the baseball field) is for teamswithparticipantsofLittleLeagueageonly.

9.7. SpringValleyLakeAssociationreservestherighttocancelorrevokepark/fielduseprivileges.

10.EQUESTRIAN BRIDLE TRAILS AND PARKS INSVLAESTATES

10.1. Thebridletrailsconsistofapproximately58acresofimprovedtrailareaforhorsebackridingthatmeandersthroughouttheEquestrianEstatesproperties.Additionally,thereareseveralareaswithinthetrailspacedevelopedassmall,neighborhoodparks.

10.2. The bridle trails in Tract 8032 of Spring ValleyLakearenotopentothegeneralpublicbutareareservedamenityforSpringValleyLakepropertyowners,associatemembers,andtheirguests.

10.3. Boardersofahorseat theEquestrianCenterandthoseresidingintheEquestrianEstates(Tract8032),andtheirbonafideguests,mayrideontheprivatetrails.

10.4. Horses are to be confined to permissible ridingareasonly;horsesmaynotcrossorotherwisetrespassontheprivatepropertyofothersunlesswrittenpermissionfromtheownerofsaidpropertyisobtained.

10.5. All riders using bridle trails or parks in SVLAEquestrianEstatesshallwearprotectiveheadgearapprovedby American Society for Testing and Materials/SafetyEquipmentInstitute(A.S.T.M./S.E.I).

10.6. On advice of legal counsel, all resident riders arerequiredtowearhelmets.

10.7. Noabuseofanykinduponanimalswillbetolerated.Ifaviolationoccurs,acitationwillbeissuedand/orthematterwillbereferredtoSanBernardinoCountyAnimalControl(1-800-472-5609).

10.8. No one under the age of eighteen (18) will beallowedtorideontheSpringValleyLakebridletrailsystemunlessaparentorguardianhassignedareleaseformandforwardsthereleaseformtotheSVLAAssociationoffice.

10.9. AllunleasheddogsonthebridletrailsaresubjecttoAppleValleyAnimalControlordinances;theirownersmay be cited and/or the matter will be turned over toAnimalControlauthorities.

10.10.Nodebrisor storageofanyarticlesorequipmentshallbeallowedonbridletrailorparkareas.

10.11.Allprivate corrals, sheltersorbarnareasmustbekept in a reasonably clean and orderly condition at alltimes.Manure-freestalls,sheltersandcorralsareessentialtopreventhorsesfrombecominginfectedwiththeinfectivestagesofstrongylesandsoconsequentlypreventparasiticinfestation.

10.12.Manurefrompropertyowners’corralsandsheltersmaynotbedispensedontotrails.Manuremustberemovedfrompropertyowners’corralsaminimumofonceaweek

(twice a week from shelters and stables during summermonths) and hauled away weekly. Property owners mayobtainadditionalcontainersfromthelocaltrashservice.

10.13.OtherthanofficialAssociationvehicles,nomotorvehiclesarepermittedonthebridletrailsexceptthoseusedincleaning,gradingormaintainingthetrailsandvehiclesneeded for equestrian-related activities such as mobileveterinarianvans,farriers,haydelivery,manureremoval,etcetera.

10.14.Nojoyridingofanymotorvehicleswillbeallowed,includingcars,trucks,motorbikes,cycles,ATVs,etcetera.Violatorswillbe reported toSpringValleyLakeofficerswhichmay result inaSVLAcitationand/or thematterbeingturnedovertotheSheriff’sDepartment.

10.15.No walking, jogging, or bicycles permitted onequestriantrails.

10.16.EquestrianEstatesresidentsmaintaininghorse(s)ontheirpropertiesorboardedattheEquestrianCentermustfile documentation with the Association by April 30thofeachyeartoshowtheirhorse(s)havebeenimmunizedagainst disease per SVLA and current veterinarianrecommendations for this area. Owner(s) agree to keepallimmunizationscurrentandtohavethehorse(s)paste-wormedeverythreemonths,andits/theirteethcheckedannually.Immunizationsareasfollows:

11.EQUESTRIANCENTERRULES

11.1. The Equestrian Center consists of a clubhousewithloungeandpatio,officeandon-site,live-inquartersfortheEQCentercaretaker;showarenaswithspectatorseatingandjudgingpavilion;boardingbarnswithattachedoutside corral areas, additional outside corrals; exercise

rings,hotwalker;washrackareawithhotandcoldwater;tack rooms, changing rooms and restrooms, a meetingroomwithkitchenfacilities;andampleparking.

11.2. Hours of Operation - The Equestrian Center isopen24hourswith theexceptionof theLoungeRoomin themainbuilding. Special events,with theapprovalof the Equestrian Estates Committee, may require theclosingoftheCentertogeneraluse.Exteriorlightsaretobeturnedoffby11:00PMunlessotherwiseposted.Showsand/ortraileventsmayvaryfromthesehours.AlleventsplannedfortheEquestrianCentermustbepresentedtotheEquestrianEstatesCommitteeatleast15dayspriortotheevent.

11.3. “Nosmoking”isallowedanywhereontheEquestrianfacility.

11.4. Tack rooms will be locked during non-businesshours.NeithertheSpringValleyLakeAssociationnortheEquestrianCentermanagerisresponsibleforanytheftorlosses. Locking saddle, to saddle rack, and locking tackbox,istheresponsibilityoftheowner.

11.5. VeterinaryCall -AllboardedhorsesaresubjecttoveterinarycallatanytimeSpringValleyLakeEquestrianCenterstaffdeemitnecessaryinaccordancewithboardingcontract. The horse’s owner will be notified as soon aspossible.Anychargeswillbebilleddirectlytotheowner.

11.6. Clubroom Rental - The clubroom may be rentedto property owners and Associate members who havecompletedand filedouta facility rentalagreement.Theclubroomandpatioareamustbeleftinaclean,orderlycondition.Trashmustbeproperlydisposedofinbinsthatwillbeprovided.

11.7. Attire - It is mandatory for anyone riding horsesat the Equestrian Center to be dressed in proper attireforthetypeofridingbeingdone.Allresidentridersarerequiredtowearhelmets.AllheadgearshallbeapprovedbytheAmericanSocietyforTestingandMaterials/SafetyEquipmentInstitute(A.S.T.M./S.E.I.).

11.8. Stallions-NostallionswillbepermittedtoboardattheEquestrianCenter,however,coltsupto2yearsofagearepermitted.

11.9. Kicking Horse - Any horse that is known to kickmusthavearedribbontiedtothetailatalltimeswhilebeing riddenon theEquestrianCenterpremises or anyotherAssociationproperty.

11.10.PermissiontoRide-NohorseonEquestrianCenterpropertymayberiddenbyanyoneotherthantheowner(s)unlessawrittenreleaseisfiledintheAssociationofficebytheowner(s),inperson.Allresponsibilityrestsuponthe

owner/softhehorsefortheanimal,riderandAssociationproperty. All handling and riding of horses is done atowner(s)and/orriders’risk.

11.11.GuestPasses&Damages–Aguest at the facilitymaynotridealoneandmustbeaccompaniedbyamemberoftheAssociation.Ifdamagesbeyondnormalwearandtearareincurredbecauseoftheconductofaboarderorguestofboarder,orresultingfromtheboardedanimal,allcostsforrepairwillbetheresponsibilityoftheownerofthehorse.

11.12.Rules-Allpostedarenarulesmustbeobeyedatalltimes.i.e.NOSMOKING,NOENTRYBEYONDTHISPOINT,etcetera.

11.13.Noridingisallowedinsidethebarns.

11.14.Nohorseswillbeleftonhotwalkerunattended.

11.15.Nohorseswillbeleftunattendedinwashrack,ontierails,orincrossties.Maximumtimeforeachhorseinwashrackis45minutes.

11.16.Nobicycles,motorcyclesorATCsareallowedinthestablearea.

11.17.Alldogsaretoremainonaleash,atalltimes,onEquestrianCenterpremises.

12.EQUESTRIANCENTERARENARULES

12.1. Ridersmustenterandexitarenaatawalk.

12.2. Usecommonsenseandcourtesyatalltimes.

12.3. Nooneundertheageofeighteen(18)willbeallowedtorideattheSpringValleyLakeEquestrianCenterunlessaparentorguardianhassignedareleaseformanditisonfileinAssociationoffice.

12.4. Riders shall call “heads up” when jumping overobstaclesonlywhenneeded,i.e.warningisneededduetocrowdedconditionsetc.,toensuresafejump.

12.5. Slowerhorses shall ride toward themiddle, fasterhorsesclosetorail.

12.6. Whenmorethanoneriderisinarena,riderswillpasslefttoright(counterclockwise).

12.7. Longeing may be done in main arena if there isroomandinexercisearenas.

12.8. Nohorsesshallbeturnedlooseinanyarenaifridersarepresent.

12.9. AnyhorsesturnedloosetofreeexerciseinanyarenaattheEquestrianCentermaynotbeleftunattendedformorethan20minutes.

12.10.Nostandingorsittingonarenawalls.

12.11.HorseShows-Mainarenaclosedpriortoshowsforareasonableperiodoftimeforpreparations.

12.12.Minorsundertheageofeighteen(18)maynotusetheEquestrianCenterwithoutadultsupervisionunlessaparentorguardianhassignedareleaseformanditisonfileintheAssociationoffice.

12.13.Rulesmaybechangedoradditionsmadeperiodically.Alwayscheckpostedrulesasallrulesareforridersafety.

12.14.TurnOutArena-Maximumtimeuseforthearenais 30 minutes unless otherwise posted. If another partywishestheuseofthearena,youmustremoveyourhorsewithin10minutesofsucharequest,providingyouhavealready had the use of the arena for approximately 20minutes.Otherwise, youwillhave20minutes inwhichto removeyourhorse fromtimeof request.Ridershaveprioritytousethemainarena.

13.EQUESTRIANCENTERBOARDING

13.1. Only property owner(s) and/or paid tenants arepermittedtoenterintoacontracttoboardhorse(s)attheSVLAEquestrianCenterfacility.

13.2. RighttoRefuseService-SpringValleyLakeGeneralManager reserves the right to refuse service or cancel aboardingcontractatanytime.

13.3. Eviction -Aboardedhorsewhichhasbeenaskedto vacate must be removed from the premises withinforty-eight (48)hours.Thirty (30)daysafternotificationtoowner(s),failuretocomplywithevictionrequirementsmayresultinboardingfineofonehundreddollars($100)perdayand/orhorse(s)beingsoldtopayfees.

13.4. Monthly Boarding fees – Boarding fees shall beestablishedannuallyinaccordancewiththeSpringValleyLake Association Fee Schedule. The SVLA Board ofDirectors, with recommendations from the EquestrianEstatesCommittee,mayrevisethemonthly(30daycycle)boardingfeesattheEquestrianCenter.

13.5. Daily Boarding Fees - The daily fee for boardingtransitory horses will be set at 150% of the pro-ratedmonthlyfee inaccordancewiththecurrentmonthlyfeeschedule. Failure to pay boarding fees to SVLA or itsdesignated agent will result in notification to owner(s).Horse(s) will be sold after sixty (60) days to satisfy backboardingfeesandanyadditionalencumberedcharges.

13.6. Reservations – Reservations for stall rental maybe made no more than two weeks in advance. A non-refundable25%depositmustbesubmittedatthetimeofthereservation.

13.7. TemporaryBoardingRequirements.

13.7.1. Nostallwillbemadeavailableorheldatalesseramountduetoahorsevacatingfortraining. Thefullmonthlyrentalwillapplyifthestallistoberetained.

13.7.2. Notwithstanding an emergency situation,nohorsemayoccupyastallwithoutacurrentvaccinationrecordonfileattheAssociationoffice.

14.COMMUNITY BUILDING & EQUESTRIANCENTERMEETINGROOMS

14.1. Meeting room facilities at the CommunityBuilding and the Equestrian Center are available foruse by Association members and their guests under theconditionscontainedherein

14.2. NosmokingispermittedinanySVLAfacility.

14.3. Categoriesofusersaredefinedasfollows.

14.3.1. Official Use: Those functions sponsoreddirectly or indirectly by the Board of Directors. Suchuses include Board meetings, committee meetings,membership meetings, Association elections, local issueforums, and similar activities authorized by the Board.Local government elections are also considered officialuse.

14.3.2. Member Groups: These are organizedgroupswhich exist primarily toprovide social and civic-typeactivitiesexclusively for SVL residents. Theyfunctionforthebenefit,enjoymentand/oreducationofSVLAmembers.Thesegroupsmustberegisteredasnon-profitfortaxpurposesandcomposedexclusivelyofSVLresidents. These groups must present an application to,andreceiveapprovalfrom,theSVLABoardofDirectorstobeconsideredamembergroup.

14.3.3. YouthGroups:YouthactivitieswhichhaveSVLmembersasprincipaladvisors;BoyandGirlScoutorganizations,SVLLittleLeagueandcommunityserviceactivities programmed primarily for the benefit of SVLmembers,includingbutnotlimitedtoAARPsponsoredfunctions, health fair, Victor Valley College programs,shall be permitted without fee in accordance with allotherprovisionsofSection14.4.TheBoardofDirectorswillapprovetheserequestsonayearlybasisaspartoftheconsentcalendar.

14.3.4. Member Sponsored Functions. These aremeetings or activities sponsored by one or more SVLpropertyownersingoodstanding.Analphabeticallistofnon-residentguestsisdueattheAssociationofficeatleastten(10)dayspriortothecommencementoftheevent.

14.4. Priorities.Boardsponsoredactivities,asdescribedin14.3abovehavepriorityoverallothereventsifscheduledatleastthirty(30)daysinadvance.Allotheractivitiesarescheduledonafirstcome,firstservebasis.

14.5. Scheduling

14.5.1. Scheduling of facilities is done at theAssociation’s Administrative office. SVLA memberswishing to schedule a meeting must sign a contractassumingcertainresponsibilities.

14.5.2. ApplicationforuseoftheSpringValleyLakeCommunityBuildingandEquestrianClubroommustberequestedforandsignedbySVLApropertyowner(s),agetwenty-oneorover,atleastthirty(30)daysinadvanceoftheevent.

14.5.3. Schedulingmaybedoneuptooneyearinadvancewiththeunderstandingthattheprioritysystemin14.3aboveexists.Inallcases,schedulingmustbedoneatleastthirty(30)dayspriortothebeginningofthedesireduse.

14.5.4. Arequestedroomdiagrammustbeprovidedat least thirty (30) days before the event, describing thenumber and arrangement of tables and chairs required.SetupwillbeconductedbytheAssociation.

14.5.5. Anon-refundablebookingfeeischargedatthetimearoomisscheduled.

14.5.6. Acertificateofinsuranceintheamountof$300,000mustbeprovided,andmustbeintheAssociationofficeatleastthirty(30)dayspriortothebeginningofuse,otherwiseusagewillberevoked.

14.5.7. Acancellationfeeof10percentofthefullfeewillbechargedonthoseeventscanceled, inwriting,less than thirty (30) days prior to the beginning of thedesireduse.

14.5.8. SpringValleyLakeAssociationCommunityPatrol(Security)OfficerfeesaresetinaccordancewiththeSVLA Fee Schedule. Those using the facility must haveSVLA Community Patrol. Property owners cannot hireprivatecommunitypatrol.

14.6. If the requested meeting rooms and/or EQClubroomarenotcleaned,acleanupperhourfeewillbedeductedfromthedepositedamount.Thebalancewillberefundedtothepropertyowneronly.

14.7. AchecklistwillbecompletedatthebeginningandendofthefunctionbySVLACommunityPatrol(Security)Officer,andsignedbythesponsoringmember.Lesseeisresponsibleforthecleanupandremovalofallitemsatthesiteonthedayoftheevent.SeeSVLAstaff forcleanupandresponsibilitieschecklistatthetimeofreservation.If

allconditionsaremet,thedepositwillberefundedwithintwoweeks.

14.8. Deposits andFees.There isno chargeordepositforofficialfunctions.DepositsandfeesforuseofroomswillbechargedaccordingtoaBoardapprovedschedule,identifiedastheSpringValleyLakeFeeSchedule,whichwillberevisedannually.AcopyoftheFeeSchedulemaybeobtainedbycontactingtheAssociationOfficestaff.

14.8.1. FullpaymentofallfeesmustbereceivedintheAssociationofficethirty(30)dayspriortotheevent.

14.8.2. Room Use. All meeting rooms andEquestrianCenterClubroomaresubjecttothefollowinguserrules:.

14.8.2.1.Curfew is 10 P.M. Exceptions tothis curfewwillbe consideredonan individualbasisbytheBoardofDirectors.

14.8.2.2.Lessee accepts full responsibilityforthefacilityandfortheconductofhis/herguests.

14.8.2.3.No alcoholic beverages may besoldwithoutanAlcoholicBeverageControlDepartmentpermit.Thepermitmustbepostedduring the functionandacopymustbeonfileattheAssociationoffice.

14.8.2.4.Noiseisallowedat levelsthatarenon-disturbingtothesurroundingneighbors.

14.8.2.5.The Board of Directors andGeneralManagermaydeny theuseof the facilitywhenthe activity is not considered in the best interest of theAssociation.

14.8.2.6.RoomrentaldoesnotincludetheuseofallAssociationfacilities,onlytheroombeingrented.Guestsarenotpermittedtheuseofanyotherfacilities,i.e.kitchen,soundsystem,etcetera.

14.8.2.7.Thepropertyownerwhosignstherentalagreementwillbeheldaccountableforanydamagetothepremisesduringtherentalperiodandmustensurethat no decorations or other items are attached to thewalls.Damagewillresultinforfeitureofthedepositandpossibleadditionalcharges.

14.8.2.8.Decorations are permitted, butnails,staples,ortacksarenotpermittedinfinishedwoodpiecesorinfixedobjects(doors,cabinets,etc.)Nomajororminorconstructionprojectsareallowed.

14.8.2.9.Decorating time isnotpermittedpriortothestartofthereservationtimeforthefunction.If additional time is required todecorate, an additionalblock of time must be reserved. All decorations mustberemovedbeforeleavingtheeventandtheAssociationcannotstoreitemsforlaterretrieval.

14.8.2.10.Failuretocomplywiththerulesandregulationsmayresultinthelossofprivilegestousethefacility(s).

14.8.2.11.Therentalcontract,signedbythelesseeandSVLAstaff,indicatesfullunderstandingoftherulesandregulations.

15.ELECTIONS

15.1. MediaAccess

15.1.1. No member shall be provided access toAssociationmediawithinthirty(30)daysofanAssociationelection.Forpurposes of this paragraph, “Association media”meanstheAssociation’snewsletters(“TheBreeze”),internet website and/or Association cable channel. Theterm“within thirty (30) days of an Association election”shallmeanthethirty(30)dayspriortothedatethefirstelectionballot material is sent to the membership. The term“Association media” shall not include the official ballotmaterialssenttothemembershipforBoardofDirectorselection,whichmayincludebiographicaldescriptionandphotographs of the nominees that are running for theBoardofDirectors.

15.1.2. TotheextentthattheAssociationpermitsaccesstoAssociationmediabyacandidate(oramemberadvocatingapointofview)forpurposesthatarereasonablyrelated to an election, equal access shall be provided toall other candidates (or members advocating a point ofview)thatarereasonablyrelatedtotheelectionat issue.TheAssociationwillnoteditorredactanycontentfroma candidate or member communication related to anelection,provided,thatthecandidateormemberofferingstatementor commentary is responsible for the contentand any published comment or comments made. TheAssociationmay includeadisclaimer specifying that thecandidate or member, and not the association, is solelyresponsibleforthecontentofthecommunication.

15.2. CandidateForum

15.2.1. IneachelectionfortheBoardofDirectors,theAssociation shall hold a forum at no charge (“Meetthe Candidates”) for the nominees at the Associationclubhouse (or other common area meeting space) priorto the date that the election materials are sent to themembership. The forum will be for the purposes ofallowing the members to meet and ask questions of allnominees and all nominees standing for election shallbe invited to attend the forum. The Association shallensurethateachnomineeisgivenanequalopportunitytoparticipateintheforum.

15.2.2. Ordinarily theforumwillbeheld inearlyApril of each year. The Board shall select a moderatorto conduct the forum.Themoderatorwillprovideeachcandidate with information concerning the format oftheforumandsamplequestionstobeanswered,subjectto reasonable review by the Board. Any current Boardmember who is a candidate for election shall abstainfromparticipatinginanyBoardreviewofthemoderator’sactions.

15.2.3. ForballotmeasuresthatarerequiredtobesubmittedtothemembershipthatareunrelatedtoBoardof Directors election, the Association shall have a townhallmeeting (nota formalmembershipmeeting,butaninformalgatheringofthemembersinwhichthememberscanexpresstheirpointsofview)priortothetimeelectionmaterialsaresenttothemembershiptoamendthebylaws/CC&Rsorsimilarballotmeasuresrequiringmembershipapproval.

15.3. QualificationofDirectors.InordertorunfortheBoard of Directors, a member must meet the eligibility/qualificationsidentifiedbelow:

15.3.1. BeacurrentownerofrecordofrealpropertywithinSpringValleyLake.

15.3.2. BeingoodstandingwiththeAssociation.“Goodstanding”meansthatthemember’sduesarenotdelinquent, and there are no outstanding violations ofthe Association’s governing documents for which thememberhasreceivedarulingfromtheAssociationafterdue process, at the time of the member’s name beingsubmittedforelectiontotheBoardofDirectors;provided,however, that violations which are the subject of anongoingappeal,alternativedisputeresolution,orinternaldisputeresolutionprocessat thetimeof thecandidate’snamebeingplacedinnominationshallnotresultinthememberconsiderednotingoodstanding.

15.4. Nomination of Candidates. The nominationprocesstonominateacandidatetorunfortheBoardofDirectorsshallbeasfollows:

15.4.1. Nominatingprocedure:Inordertobecomea candidate for election to the Board, a member shallsubmitaletterofintenttotheBoardofDirectors.Lettersof intentmust reach theAssociationoffice by the closeofbusinessonthebusinessdaynearesttoFebruary15ofeveryyear.

15.4.2. Candidate Educational Seminar: Withinapproximately 7 to 10 days after the filing deadline forreceiptoflettersofintent,theBoardwillsponsoraseminarfor announced candidates which includes information

regardingboardresponsibilities,legalliabilities,conflictsofinterest,amountoftimedemandedbyBoardmembership,etc.Attheseminar,theBoardwillannouncethedeadlineby which any candidate may withdraw their name fromnominationpriortoballotmaterialsbeingprinted.

15.4.3. Candidatesmaywithdrawtheirnamesfromnomination by giving written notice to the Associationoffice at any time, however candidates are encouragedtodosobythedeadlineestablishedbytheBoardunder15.4.2above.

15.4.4. TheAssociation shallnotify themembers(via a document delivery that complies with Civil Code§1350.7, e.g., newsletter, information within billingstatement, mail) of the self-nomination process and thedeadlineforAssociationreceiptoftheletterofintent.

15.4.5. Writtenballots shallprovidea space forawrite-incandidate’snametobeinserted.

15.4.6. Candidatesmaybe requiredby theBoardof Directors to submit proof of their qualifications forserving as a Board member. The Board of Directors’decision as to whether the member’s proof is adequateisbinding.FailureofacandidatetoprovidesatisfactoryproofofqualificationforBoardmembershipshallresultinthecandidatebeingremovedfromnomination.

15.4.7. Anywrite-incandidateelectedtotheBoardshallalsoprovide theBoardofDirectors proofof theirqualificationsforservingasaBoardmember.TheBoardofDirectors’decisionastowhetherthemember’sproofisadequateisbinding.FailureofacandidatetoprovidesatisfactoryproofofqualificationforBoardmembershipshallresultinthecandidate’sseatbeing declared vacantbytheBoardofDirectors.

15.5. Record date. At the March board meeting, theBoard of Directors will specify the record date for thepurpose of determining which persons are qualifiedmembers entitled tonotice of the electionmeeting andthoseentitledtovoteatthemeeting.

15.6. Election Materials. Election materials will bepreparedbytheGeneralManagerorcontractvendorwithBoardapprovalandshallbereviewedbytheAssociation’sgeneralcounselpriortoprinting.

15.7. InspectorsofElection.TheBoardofDirectorsshallselectone (1)or three (3) inspector(s)ofelection. Theinspector(s)ofelectionshallbeanyoneofthefollowing,asdeterminedbytheBoardofDirectorsatanopenBoardmeeting prior to the distribution of the ballot material:TheGeneralManager, aCPAretainedbySVLA,SVLAgeneral counsel,orqualifiedprivatevendorexperienced

inHOAelectionsprocedures.Theinspectorofelectionmay not be a member of the Board, a nominee for theBoard,relatedtoamemberoftheBoard,orrelatedtoanomineerunningfortheBoard.

15.7.1. The inspector of election shall determinethe number of memberships entitled to vote and thevoting power of each membership, shall receive theballots,hearanddetermineall challengesandquestionsinanywayarisingoutoforinconnectionwiththerighttovote,countandtabulatetheballots,determinetheresultsofelectionandshallfurtherperformanyactswhichmaybe proper to conduct the election with fairness to allmembers in accordance with Civil Code §1363.03 andtheAssociation’sgoverningdocuments.Theinspectorofelectionmayalsoappointandoverseeadditionalpersonsto verify signatures and to count and tabulate votes asthe inspector(s) of election deem appropriate, providedthattheadditionalpersonsareindependentthirdparties(e.g. independent third parties may not be a memberof theBoardofDirectors, a candidate for theBoardofDirectors,relatedtoamemberoftheBoardofDirectorsand/orrelatedtoacandidatefortheBoardofDirectors)(hereinafter, “Inspector(s) Designee(s)”). InspectorDesignee(s),pursuanttotheseElectionRules,canincludeanemployee(s)oftheinspector(s)ofelection.

15.8. Election by Secret Ballot Without Meeting.Notwithstanding any other law or provision of theassociation’s governing documents, Board of Directorselections,andotherelectionsrequiredtobesubmittedtothemembershippursuanttoCivil Code§1363.03(b),shallbeconductedbyasecretwrittenballotsubmittedtothememberswithoutameeting.

15.8.1. Ballots and two pre-addressed envelopeswithinstructionsonhowtoreturnballots,mustbemailedbyfirstclassmailordeliveredbytheAssociationtoeverymembernotlessthanthirty(30)dayspriortothedeadlineforvoting.

15.8.2. Inordertopreserveconfidentiality,avotermaynotbe identifiedbyname,addressor lot,parcelorunitnumberontheballotitself.Theballotingmaterialsshallincludeallofthefollowing:.

15.8.2.1.The ballot itself is not signed bythe voter, but is placed into a ballot envelope, which isthen sealed (“Ballot Envelope”). The Ballot Envelopeis then inserted into the second pre-addressed envelope(“AddressEnvelope”)thatisthensealed.IntheupperlefthandcorneroftheAddressEnvelope,thevoterprintsandsignshis/her name, separate interest identifier (such astheaddressoftheseparateinterest,membernumber,lot,

parcelorunitnumberthatentitleshim/hertovote).

15.8.2.2.TheAddressEnvelopeisaddressedtotheinspector(s)ofelection.TheAddressEnvelopecanbemailedbythemembertotheinspector(s)ofelectionordeliveredbyhandtoalocationspecifiedbytheinspector(s)ofelection.Anymembercanrequestareceiptfordeliveryoftheirballot.

15.8.2.3.Thesealedballotsshallbekeptinthecustodyoftheinspector(s)ofelectionoratalocationdesignatedbythe inspector(s) of election until aftertabulationofthevote,atwhichtimecustodycanthenbetransferredtotheAssociation.Thereafter,electionballotsshallbestoredbytheAssociationinasecureplaceforanadditionalone(1)year.

15.8.2.4.Ballots distributed to each andeverymembershallidentifytheproposedaction,providean opportunity to specify approval or disapproval andprovide at least thirty (30) days upon which to returnthe ballot to the inspector(s) of election. The votinginstructions contained within the ballot materials willshowadatebywhichtheballotsmustbedeliveredtothelocationdesignatedbytheinspector(s)ofelectionbyeithertheUnitedStatesPostalService,overnightdeliveryserviceorhanddelivery.

15.8.2.5.Sincetheballotelectionsdescribedabove are to be submitted to the membership withouta meeting, there shall be no proxies permitted in suchballoting process (except to establish a quorum for anyannualmembershipmeeting).ForelectionstotheBoardofDirectors,ballotsmustbereturnedtotheinspectorofelectionat thecloseofbusinesson thedayprior to theannualmeeting,atwhichpointthepollswillcloseandnofurtherballotswillbeaccepted.Sincetheelectionprocesswillbedonebyballotingandnotattheannualmeeting,noballotswillbecastattheannualmeeting.Sincethereisnoelectionconductedat theannualmeeting,proxies(except for purposes of establishing a quorum) will notbepermittedsinceallvotingwillbedonebythewrittenballotprocessitself.

15.8.2.6.All votes shallbe countedby theinspector of election (or Inspector Designee(s)), startingsix (6)hoursprior tocommencementofbusinessat theannualmeeting,inanopensettingallowingmembersandcandidatestowitnessthecountingandtabulationofthevotes.Nopersonmayinterferewith,harassorotherwisecommunicate with the inspector(s) and/or InspectorDesignee(s)whilethecountandtabulationistakingplace(otherthancorporatecounselasdeemednecessarybytheinspector(s)ofelection).Theinspector(s)ofelectioncan

causetheremovalofanyobserverwhocausesinterferencewith or disrupts the counting or tabulation process.Oncetheinspector(s)ofelectionhavefinishedcounting,the inspector(s)of electionwill thereafter announce theresultsof theelection forBoardofDirectorsduring theannualmeeting.Noperson,includinganymemberoftheAssociationor an employeeof amanagement company,shallopenorotherwisereviewanyballotpriortothetimeandplaceatwhichtheballotsarecountedandtabulatedbytheinspector(s)ofelection.

15.8.2.7.Writtenballotsmaynotberevokedoncetheyaresubmittedtotheinspector(s)ofelection.

15.8.2.8.IncumbentDirectorswillbelistedfirstontheNoticeofMeetingandballotitself.Subsequentnon-incumbent candidates’ names will be listed next inalphabeticalorder.

15.9. Theballotingprocessforamendmentstogoverningdocuments shall be submitted to the membership in asimilarmannerastheelectionfortheBoardofDirectors,exceptthat:

15.9.1. Theballotscouldbesenttothemembershipatanytimeandnotinconjunctionwiththetimingofanyannualmeeting.

15.9.2. The addressed envelope should include astatement above the signature line by the owner whichwouldprovide,tocomplywiththegoverningdocuments,thefollowingwords: By signing below, my vote shall act as my written approval or, if applicable, my written disapproval of the pending ballot measure.

15.9.3. Thetabulationandcountingofthevotesbytheinspector(s)ofelectionshallbeconductedsix(6)hoursbeforecommencementofbusinessataproperlynoticedopen meeting of the Board of Directors. No person,includinganymemberoftheAssociationoranemployeeofamanagementcompanyshallopenorotherwisereviewanyballotpriortothetimeandplaceatwhichtheballotsarecountedandtabulatedbytheinspector(s)ofelection.

15.10.LostBallots.Iftheownerloseshis/herballot,theymay request another ballot, along with the appropriateenvelopesfromtheinspector(s)ofelection,buttheymustsignastatement,underpenaltyofperjurythattheoriginalballot was either lost, destroyed or never received. Theinspector(s) of election shall maintain a record of eachsuchrequestand,ifitisdeterminedthattheownervotedtwice,evenbymistake,neitherballotwouldbecounted.

15.11.Electionresults. TheresultsofanyelectionshallbepromptlyreportedtotheBoardofDirectorsandshallberecordedintheminutesofthenextBoardmeetingand

shallbeavailableforreviewbymembersoftheAssociation.Within fifteen (15)daysof theelection, theBoardshallpublicize theresultsof theelectioninacommunicationdirectedtoallmembers(thiscouldbedoneintheformofanewsletterifitismailedtothememberswithinthe15daytimeline).

15.12.Use of Association Funds Relating to Elections. Association funds should not be used for campaignpurposes in connection with any Association election,excepttotheextentnecessarytocomplywiththedutiesoftheAssociationimposedbylaw.Forpurposesofthisparagraph, the Association can use its funds to havecorporatecounsel(orotherBoard-designatedindividuals)prepare and review appropriate ballots as well as thecopying,printingandmailingcostsnecessary toprovidethe ballots to the membership consistent with theAssociation’s governing documents and California law.Association can also add background information andexplanationofballotmaterial.TheAssociationmayusefundstodistribute, forelectionofBoardofDirectors,abiographicaldescriptionandphotographofthenomineeswithin said election materials. The Board shall notadvocatetheelectionordefeatofanycandidatethatisonanAssociationelectionballotfortheBoardofDirectors.
