Overview

Credit Report $45.00 – Per adult (over 18 years of age)

Rent $355.00 for 2 Adults $50.00 for each additional adult Children Under 18 years of age – no charge Due 1st of Month – Late after 5th of Month ( $38.00 late fee after the 5th at 5:00) Includes: Public Water, Sewer Water, Irrigation Water and Trash Keys are $50.00 each. (to get into Shiloh Village).

Security Deposit $710.00 the security deposit is not an advance payment of rent.

Cable TV/Internet Service Satellite or Wireless TV or Internet Service is permitted. CABLE lines are not

permitted. Cars

2 cars are allowed. A $35.00 charge will be charged for each additional car(s). One-time Move-in Costs

The one-time costs incurred to move the mobile into SVE due to the specific needs of the mobile are the full responsibility of the Resident. For example, if electrical lines, gas lines, water lines, electrical boxes, water risers, trees, sprinklers, etc. need to be moved or 100 or 200 amp replacements or breakers in the electrical box are required to accommodate the mobile, the Resident is responsible for the arrangements to have the work done. The arrangements and cost are the full responsibility of the Resident.

Pets A total of 2 pets are permitted – indoor cat and/or dog equal to or less than 15

pounds full grown. Black rod- iron portable fence is required for a dog. Dogs NOT Allowed in Shiloh Village Estates Park: Doberman Pincher, Rottweiler, Chow, Pit-bull, German Shepard, Akita, Husky, Malamute, Shar pei, and Wolf -Hybrid or any mix of these breeds.

Welcome to Shiloh Village Estates! Shiloh Village Estates (SVE) was established in 1976 in Billings, Montana, and is well-known throughout the city for its reputation as an outstanding mobile home park. We appreciate our Residents for their hard-working contribution to uphold the standards of this Rules and Regulations booklet; it is these collective efforts of the Residents that allow SVE to continue looking beautiful and in top-class condition. Shiloh Village Estates Management will strive to work with Residents to achieve the following objectives:

Shiloh Village Estates Office Hours: The SVE Office Hours are posted on the bulletin boards located at the front door of the main office and at the central mailbox. Please be advised that these hours are subject to change at the discretion of SVEM. Residents may make an appointment with SVEM. Please call the SVE Office to schedule appointments; voicemail and E-mail are frequently monitored. Shiloh Village Estates Management is available during normal business hours and, if necessary, may be contacted after hours for emergencies only. Please allow 14 days for non-emergency work requests such as approval for sheds and garages, inspections, completing reports, etc.

Shiloh Village Estates Maintenance: Shiloh Village Estates staff performs routine maintenance and emergency maintenance procedures throughout the community. Depending upon the nature of the work, SVE staff or its agents may require access to water, gas, electrical or telephone lines, etc. Shiloh Village Estates Management may use equipment, such as the Gator, to cross lawns; this will not cause damage to the grass. If larger equipment is needed, SVEM will take necessary precautions to minimize disturbance to the Residents.

Complaints of Residents: 1. Complaints from Residents to SVEM must be in writing and must be both signed

and dated. No action will be taken by SVEM if the complaint is not signed by the Resident. The written complaint may be left in the mail drop slot or mailed to the SVE Office. Once the written complaint is received by SVEM, management will contact the Resident, if necessary, to resolve the complaint.

A. The Resident must provide a written complaint to SVEM before requesting

an appointment to resolve a complaint with SVEM. B. Shiloh Village Estates Management will not respond to complaints left on the

SVE answering machine unless said complaint is an emergency.

2. Residents are encouraged to resolve disputes amongst neighbors. Contact SVEM only if Resident neighbors are unable to agree on specific issues, such as sprinkler heads, trimming of trees, etc.

Utilities/Hookup If SVEM is notified by a vendor that a utility bill is unpaid and/or delinquent, the expense to reconnect the utility is the Resident’s responsibility.

Cable TV and Internet Service: Residents may have satellite television service and/or wireless internet service through his or her provider of choice; however, cable TV and high-speed cable internet connections are NOT permitted in SVE due to easement rights.

Electricity: The electric pedestal must be two (2) feet away from the mobile. Do not contact SVEM when there is a power failure; management does not receive any information regarding the nature of electrical problems or when they will be repaired. Gas: Natural gas is provided by Montana-Dakota Utilities. Residents must purchase a gas permit from the City of Billings. The gas line hookup must be two (2) feet away from the mobile. The gas line cannot be located under a window and must be no less than five (5) feet from any surrounding windows. Newly connected gas lines must be pressurized and inspected by the City. Please note that the electricity to a home must be connected before Montana-Dakota Utilities can turn the gas meter on and light the gas appliances. Please direct all inquiries, comments, or complaints to MDU at 1-800-638-3278. Mail payments to:

Informal/Emergency Communication with all SVE Residents: Current events are posted on the Bulletin Boards at the front door of the Main Office and on the Message Board near the central location of mailboxes on South 38th Street West. Planned Outages are posted in advance on the Bulletin and Message Boards. Urgent, informative messages may be heard on the answering machine of the Main Office at 656-8444. These messages will also be placed on the Bulletin and Message Boards, as time permits.

All mail is delivered to the central location of mailboxes on South 38th Street West (by the SVE Main Office). Please do not block the mailboxes or the mail will not be delivered. New Residents must contact USPS to receive a mailbox key. If a Resident needs a replacement key, he or she must contact USPS. The mailboxes are the property of the USPS and therefore SVEM is not permitted access to any of the Residents’ mailboxes.If, for any reason, a Resident is unable to retrieve and/or receive mail from the central location, the Resident must contact USPS. Shiloh Village Estates provides a keyed mailbox for each Resident at the central location on South 38th Street West. If a Resident wishes to install a mailbox at his or her mobile, he or she must first request approval from SVEM. All requests must be accompanied by a signed and dated doctor’s request. Once approved, the Resident will then need to submit this doctor’s request to USPS. The Resident is responsible for all costs incurred during the purchase and the placement of individual mailboxes located at the Resident’s address.

Telephone: CenturyLink (previously Qwest) provides telephone service to SVE. Contact customer service at 1-800-366-8201.

Utility Markings: The utility companies must be given a minimum 3-day notice for utility markings. Requests for utility markings must be submitted prior to a Resident changing, installing or constructing a structure on their space. If a Resident has received SVEM approval to change a structure, please submit a utility marking request to SVEM as well. Shiloh Village Estates Management will contact the utility companies to mark the gas, electrical, water and telephone lines.

Water/Sewer: Billings City water, irrigation water, and sewer services are included in the rent price at SVE.

City Water/City Water Riser: The water lines at SVE will not be shut off during minor repairs; however, SVEM recommends that each Resident keep two 5-gallon containers of water in the event that the entire water system must be shut off. During such an unforeseen event, SVEM will record a message onto the Main Office answering service so that the Resident will know it is not a specific problem with the individual mobile.

City Sewer:

It is the Resident’s responsibility to connect his or her mobile to the sewer system; he or she is also responsible for the sewer connection between the mobile and the main line. Shiloh Village Estates is responsible for the main sewer lines. Please contact Roto-Rooter with any sewer-related problems and inform SVEM of all maintenance performed by Roto-Rooter. Call emergency line 406-647-2815.

Irrigation Water/Irrigation Water Riser: Shiloh Village Estates Field Workers can turn on irrigation water only when the ditch rider releases water from the Big Ditch. The irrigation water system is accessible by connecting the Resident water hoses to the water riser; only then can the sprinkler system clocks be turned on. Typically, the irrigation water begins in late May and is discontinued at the end on September 28th. The irrigation water is NOT suitable for consumption!!!

Enforcement of Rules and Regulations The primary goal of SVE’s Rules and Regulations booklet is to provide a clean and safe living environment for its 500+ Residents. These rules and regulations are intended to provide fair, uniform, and equitable treatment to all Residents; some are necessary to comply with Montana law. The principle purpose of interviewing prospective Residents and providing the Rules and Regulations booklet to Residents is to ensure that each Resident understands the rules of SVE. Residents are advised to be thoroughly informed of all rules and regulations. LACK OF KNOWLEDGE OF THE RULES DOES NOT EXEMPT A

RESIDENT FROM A VIOLATION. Please remember, this Rules and Regulations booklet is carefully compiled by SVEM with the following objectives in mind:

To provide a pleasant and friendly mobile park where our Residents respect the rights and privacy of others

Violations: Rather than Residents reporting violations immediately to SVEM, Residents generally appreciate neighbors first bringing to their attention any violations of the rules. Shiloh Village Estates Management therefore encourages Residents to assist one another in complying with the rules of SVE and report violations to SVEM only as a last resort.

Letters of Violation and Written Notices: Letters of Violations and Written Notices are sent to the Resident via Certificate of Mailing or Certified Mail.

All notices of violations are governed by Montana Law Sec 70-33-433MCA. If the Resident is in violation of the Rental Agreement by non-payment of rent or of any other provision(s) of the Rental Agreement and/or rules contained herein, SVEM sends the Resident the appropriate notice as per Montana Law. Upon receipt of a violation notice, SVEM requires the Resident to correct the violation within an allotted amount of time or the Rental Agreement is terminated. It is the responsibility of the Resident to notify SVEM when a violation is corrected. If a violation remains uncorrected, SVEM reserves the right to proceed with an eviction. Shiloh Village Estates Management reserves the right to terminate the Rental Agreement upon giving the appropriate notices as provided by law and proceed with an eviction if repeated violations are sent. Certain violations allow SVEM to terminate the Rental Agreement without the opportunity for correction. If such a violation occurs, SVEM reserves the right to provide the appropriate notice to terminate the Rental Agreement and proceed with an eviction.

Changes to Rules and Regulations: These Rules & Regulations, dated June1, 2014, supersede all prior Rules & Regulations released by SVEM. These Rules and Regulations are subject to change. Residents are notified of the changes in writing and are put into effect thirty (30) days after the written notice is provided. When the Rules and Regulations are amended, a copy of the amendment is provided to the Residents; Shiloh Village Estates Management encourages Residents to insert these amendment pages into his or her current Rules and Regulations booklet.

A. GENERAL RULES A.1. All exceptions to the rules must be in writing. An exception to the current

regulations is granted only when the current Resident has a written agreement with SVEM that supersedes the current Rules and Regulations. Shiloh Village Estates Management acknowledges that such agreements are then “grandfathered in,” but only while the Resident for whom the exception was granted remains in SVE. The grandfather clause is terminated when the Rental Agreement with the current Resident is terminated. A Resident must consult with SVEM if he or she believes they are exempt from a requirement due to the grandfather clause.

A.2. Harassment of SVEM employees, agents of SVEM (workers hired by SVEM to perform services), or Residents is not tolerated. Harassment is defined as, but not limited to, any conduct, act, or omission of repeated incidents of intrusive or unwanted behaviors, words, or gestures that have a substantial adverse effect or are intended to have a substantial adverse effect on the

safety, security or privacy of the Residents, employees, management or their agents of SVE. Examples of harassment include repeated interruption or requests of employees as they are working, threatening employees, calling or sending anonymous letters of complaints that cause or is intend to threaten, intimidate, or disturb the privacy, comfort, peace or enjoyment of employees or Residents of SVE.

A.3. Mobiles are subject to the following SVE standards:

A. Mobiles older than twenty (20) years that do not meet the requirements of

the codes and regulations: SVEM does not allow such mobiles to remain in SVE after the mobile is sold and/or the Rental Agreement is terminated. In order for Resident’s to keep the value of their mobiles appreciating, SVEM has the discretion of regulating which mobiles must be updated to meet current standards (depending on practicality/costs) in order to keep SVE as an outstanding mobile home court. This standard is not only for SVE to follow, but is a standard that all SVE Residents must follow. Working as a team will accomplish the goal of keeping SVE as an outstanding mobile home court, which will insure the appreciating value of your mobile.

B. Outdated mobiles will be required to be updated or removed from SVE. All

mobiles moved into SVE must first be approved by management. C. Each year, SVE lots are modified to accommodate double-wide mobiles.

Placement of a mobile on a lot at SVE is at management’s discretion.

A.4. Owners of a mobile need to reside in the mobile as Residents in SVE. Subleasing a mobile is not permitted and is cause for immediate termination of the rental agreement.

A.5. Daycare service businesses are not allowed in SVE. Babysitting is strictly limited to those children whose residence is in SVE. Babysitting children who live outside SVE is not permitted.

A.6. Resident shall not use the mobile for business or commercial purposes without prior approval by SVEM. Business or commercial purposes includes, but is not limited to, all at-home occupations, both part-time and full-time. Exceptions by SVEM will be based on the nature of said purpose, its impact on traffic, and its possible interference with other Residents’ use and enjoyment of their property. No business or commercial signs are allowed in SVE, either outside or on the mobile.

A.7. Shiloh Village Estates Management requires all Residents to register at the main office when moving in or out of SVE.

A.8. Changes to the rental agreement must be updated as soon any Resident information changes, such as telephone numbers, number of occupants, pets, etc. Changes in phone numbers will impact the Resident’s ability to access the SVE entrance gates. Please contact SVEM immediately with the new telephone number.

A.9. Address numbers for each mobile must be in black letters and must be a minimum of three (3) inches high with placement on either the left side of the mobile or above the carport/garage.

A.10. Drapes, shades, blinds and shutters are the only acceptable window treatments for mobile windows. Window films and wind-breaker shades are also acceptable. Any other treatments must be approved by SVE. DO NOT place objects such as poster board, foil, cardboard, tarps, plastic, etc. in mobile windows or decks FOR ANY REASON.

A.11. It is the Resident’s responsibility to contact and file a report with the Billings Police Department if his or her mobile/deck/garage/carport/car/shed is damaged by vandalism; Shiloh Village Estates will not become involved. Adequate insurance coverage is the responsibility of the Resident.

A.12. DO NOT APPROACH SVE FIELD WORKERS AT ANY TIME Due to safety concerns, Residents must not give instructions or make requests of SVE maintenance personnel while they are working in SVE. Direct all questions and concerns to the SVE office. All requests for work must be in writing, and must be both signed and dated before being submitted to SVEM.

A.13. Residents are accountable for the actions of their children and for their guests; Residents are therefore responsible for any damages caused by their children or guests.

A.14. Residents are responsible for any damages to his or her rented mobile lot and to SVE property. This includes, but is not limited to: light fixtures, light poles, yards, driveway, SVE streets/parking lots/buildings, vegetation, gas/sewer/water lines, etc. Additionally, the Resident is responsible for the cost of repairs of property damage caused by vegetation planted by said Resident. Residents will be responsible for all trees and bushes in which they plant without prior consent of SVEM as well as the cost of maintaining and removing should they be required by SVEM to do so upon moving.

A.15. Signs or advertising materials cannot be posted without prior approval from SVEM.

A.16. Soliciting, delivering of handbills or peddling is not allowed in SVE. Residents are requested to inform SVEM of such activities as soon as possible.

A.17. Drunkenness or boisterous conduct is not tolerated.

A.18. Excessive noise is not tolerated from parties, motorbikes, cycles, automobiles, radios, televisions, stereos, or musical instruments. All cars and motorbikes must be muffled.

A.19. Lawn furniture may be placed in the front, side, or back yards, or on the deck.

A.20. Seasonal furniture must be stored in a shed or garage behind a closed door, or covered on the deck when not in use. A barbeque can be stored on the deck during the winter but must be covered.

A.21. Stolen articles are the responsibility of the Resident, not of SVE. Mobiles, cars and sheds should be locked at all times and properly insured, if possible.

A.22. Bicycles must be stored at all times when not in use. Bicycles may be kept in the shed, behind the front deck, or in a closed garage. Shiloh Village Estates Management highly recommends that the bicycles be chained and/or locked at all times when not in use.

A.23. The following are not permitted anywhere in SVE:

A. Driving of snowmobiles on SVE property B. Semi-trucks, boats, travel trailers, snow or skimobiles, trailers, boat trailers,

campers (mounted or non-mounted), recreational mobile homes, fifth-wheelers, fourth-wheelers, three-wheelers or horse and utility trailers;

C. Rock throwing D. Fences E. Decorative bark or woodchips F. Outdoor clotheslines G. Basketball hoops H. Possession of knives, firearms, arrows, slingshots or similar weapons I. Fireworks are prohibited at all times in SVE.

A.24. Residents MUST receive prior approval from SVEM before engaging in digging of any kind. Call for markings on your lot by phoning 811.

A.25. All trash, debris, brooms, building materials, flower pots that are not in use and personal items must be kept in sheds or in the garage.

A.26. If SVEM has reason to believe that a Resident has abandoned his or her mobile home, the disposition of the abandoned mobile home will be according to Montana law, 70-33-432.

A.27. Yard sales are permitted at SVE; however, items must remain on the Resident lot (driveway and lawn) and NOT in the street.

B. APPLICATION FOR OCCUPANCY B.1. Credit Report:

A. First and foremost, all adults (18 years and older) who apply for residency in

SVE must complete an Authorization for Credit Report. The Authorization for Credit Report is used by SVEM to request a credit report. A nonrefundable fee for credit report must be paid at the time of application for occupancy.

B. If the household members change after the Rental Agreement is signed, the

new household members must complete a Rental Application and get a credit report prior to occupancy. This includes replacing current members for any situation that differs from what is stated on the original Application/Rental Agreement.

B.2. Rental Application Form:

A. SVEM has the right to approve or disapprove a Rental Application based on the credit reports.

B. If the credit reports are approved by SVEM, each potential adult Resident must

complete and sign a Rental Application. C. If the Rental Application is approved by SVEM, each potential adult Resident

must sign the Rental Agreement. D. The mobile title must be in the name of the Owner(s) occupying the

mobile in SVE unless otherwise approved by SVEM. A copy of the mobile title must be submitted to SVEM within eight (8) weeks. Failure to do so will result in a written violation.

C. RENTAL AGREEMENT – APPROVED APPLICATION FOR OCCUPANCY If both the Credit Report and Rental Application are approved by SVEM, each adult must sign the Rental Agreement, which entails the following:

C.1. Security Deposit:

A. After approval for occupancy, the Resident must pay a security deposit at the time of signing the Rental Agreement. Please note that the security deposit is not an advance payment of rent. Upon vacating SVE, the security deposit, less any charges, will be returned to the Owners or to the estate of the Owner. Residents who move from SVE have three (3) months to cash their security deposit refund check. If the previous Resident has lost or failed to cash the check or within the allotted time, SVE will not reissue another refund check.

B. Upon termination of the Rental Agreement, the Resident must provide a forwarding address to SVEM. If a forwarding address is not on file with SVEM, then all correspondence is mailed to the last residency address in SVE.

Upon termination of the Rental Agreement, the security deposit is returned pursuant to provision of Montana law. As per Montana law, SVEM will provide proper notice of any delinquent rent charges or damages to SVE property, or if the lot is not cleaned to SVEM standards.

SVEM does not hold the Resident responsible for ordinary wear and tear or for damage due to extreme weather or other unusual causes beyond the control of the Resident.

C.2. Rent:

A. What is Included in Rent? Rent is defined as and/or includes, but is not limited to, the following: 1. The lot space, which includes the mobile space, driveway, sidewalk, city

sewer and water, irrigation water for the yard, garbage collection once per week, a USPS locked-mailbox, as well as city fire and police protection. Shiloh Village Estates has paved streets with three gated entrances.

B. Rent Space and Due Dates:

1. The monthly rent at SVE is analyzed on a yearly basis according to inflation

and operating costs. Monthly rent checks must be submitted via the mail slot located on the left side of the door at the front entrance to the SVE Office in accordance with the following regulations:

a. Rent is due on the 1st of each month. Details of the current monthly

rent are posted on the bulletin board above the check slot.

b. Rent received after 5:00pm on the 5th of the month is LATE. Late

rent includes the monthly rent fee plus the late fee charge of $35.

c. Do not use an envelope to submit rent checks, money order, cashier’s check; please submit ONLY the check, and nothing else!

d. A Non-Sufficient Funds (NSF) fee is assessed for any check returned

by the bank as a result of insufficient funds. This fee is $38.00. After two (2) checks have been returned as a result of NSF, all future rent payments must be paid with a money order or cashier’s check. Shiloh Village Estates Management does not accept cash payments for rent. If a check is returned as a result of NSF, the rent is considered late and the Late Fee applies in addition to the NSF Fee.

e. The base rental rate is inclusive for up to two (2) adult Residents. Other

Residents 18 years of age or older cannot reside in any mobile without the written approval of SVEM. Upon approval, the Additional Resident Fee must be added to the monthly rent. No more than four (4) permanent adult Residents are permitted in any mobile home. There is no additional rent fee for children under 18 years of age. After the first two adults there is a $50 fee for each additional adult 18 years of age and older.

f. Residents are informed of changes in rent by mail. Rent increases are

at the discretion of SVEM and are therefore determined by management. Please do not call or visit the Main Office to inquire about changes in rent.

g. The base rental rate does not include the rent for storage or extra

vehicles.

h. Rent is the same for all singles and double wide mobiles.

2. Shiloh Village Estates Management gives the Resident a 30-day written notice prior to any changes in the Rules and Regulations of SVE. This includes, but is not limited to, changes in lot rent, additional parking, and storage. Shiloh Village Estates Management does not give advance notice for changes in fees that are not under its control (e.g. electric, gas, water, etc.).

C. Resident One-Time Costs:

a.) Replacement of breakers (one home breaker and one street breaker) b.) Gas line & electrical lines: all charges for hookup/re-hookup c.) Waterline: all charges for hookup/re-hookup d.) Sewer line: all charges for hookup/re-hookup e.) Street light on your lot space: all repair & rewiring is at your cost

D. Rent Term: When the Rental Agreement is terminated with the Registered

Owner of the mobile, the Rental Agreement is terminated with all Residents of the mobile. The rules of the Rental Agreement are enforced until the mobile is either:

a.) Sold and/or removed from property and the lot is cleaned, or b.) In order to keep the mobile in Shiloh Village Estates Park, a new

rental agreement is required and needs to be signed by the new Resident(s) to live in Shiloh Village Estates Park.

E. Method of Rent Payment:

1. Checks must be made payable to Shiloh Village Estates, or abbreviated to SVE.

2. Shiloh Village Estates Management does not accept cash payments for

rent. Personal checks, money orders, or cashier’s checks are the only accepted forms of payment.

3. Each Resident’s lot space has a designated alphanumeric character, for

example B-17, N-7 or L-9. If you do not know what this please call the office. This must be included on the “Memo line” of the check or the check address must match the Resident’s SVE mailing address. The maps for this information is on Page 53 and 54 to find the lot space.

4. Please put the rent check directly in the mail slot located on the left side of

the front door of the office. Please do not put rent checks in an envelope. Messages, return agreements, etc. may be put in the mail slot.

5. Residents who are unable to submit his or her rent check in the mail slot at

the SVE Office may mail the check to: Shiloh Village Estates 3808 Towhee Lane Billings, MT 59102-7723

F. Partial Month Rent: Shiloh Village Estates does NOT prorate rent for mobiles moving onto or moving off of a lot. The month’s rent for the sale of a mobile will be adjusted at the mobile’s closing for the month.

G. Advance Rent Payments:

1. Rent may be paid in advance.

2. Please postdate all advanced checks for the 1st of the month that the check is intended to cover. All advanced checks are held until the postdated month and will be deposited on the 6th of each month.

3. It is the Resident’s responsibility to ensure that his or her advance rent has

been paid; Shiloh Village Estates does not notify the Resident when the last advance rent check has been deposited.

H. Roommates, Guests and Visitors:

Roommates: 1. Only Residents included in the Rental Agreement may reside in any mobile

without written permission of SVEM. Additional Residents (related family members only) must first be approved by SVEM before occupying the mobile.

2. A person occupying the premises for more than fourteen (14) days within a

sixty (60) day period is considered an unapproved Resident and must be

added to the Rental Agreement. It is a violation of the Rental Agreement if the Registered Owner does not inform SVEM of any unapproved Residents.

3. The Registered Owner must notify SVEM of any increases/decreases in the

number of people living at the residence. If there are more Residents residing in a mobile than is stated on the Rental Agreement, the Resident is issued a violation and subsequently has fourteen (14) days to update his or her Rental Agreement.

4. Approved additional Residents must complete both an Authorization for

Credit Report and Rental Application-Revision for Change of Resident - Add-On Form. At any time the Rental Agreement is terminated with the Registered Owner of the mobile the Rental Agreement is thereby terminated with all Residents in the mobile.

5. Additional Residents must register his or her vehicles and receive a vehicle

permit to park on in parking lots.

Guests and Visitors: 1. Only the persons mentioned on the Rental Application or Rental Agreement

are permitted to live in SVE.

6. A guest is defined as a person who stays overnight for less than fourteen (14) days. A person occupying the premises for more than fourteen (14) days is considered a Resident. At which time they must complete a Rental Application and pay for a credit report. If approved, the adult must sign the Rental Agreement. If said person is under 18 years of age, the adult Resident must sign the minor Resident to the Rental Agreement, which states that the non-adult Resident is living on the premises and abiding by the Rental Agreement and the Rules and Regulations of SVE. All children and adult Residents must be approved by SVEM.

7. Visitors and guests must obey the Rules and Regulations of SVE;

Residents are responsible for the conduct of their guests and visitors. Any violations of these Rules and Regulations by a guest or visitor shall be deemed a violation by the Resident.

8. Visitors may not bring his or her pets to SVE. The pet has to be put into an

animal care facility before coming to SVE.

9. Visitors and guests must park in the driveway or nearby parking lot of the Resident they are visiting.

10. Caretakers of Resident’s mobile cannot live in the mobile while the owners

are away, they must go home each night. Also known as house sitting.

I. Additional Costs: In addition to the monthly rent, the Resident is responsible for the cost of services performed by SVEM or agents of SVEM for repairs necessitated due to the Resident; a concrete pad for a third car, for example.

J. Legal Remedies: If legal remedies are necessary to collect an amount owed

to SVE, the Resident must pay reasonable Attorney and Collection Agency fees.

K. All buyers who desire to purchase a preexisting mobile in SVE must be

approved by SVEM. It is the responsibility of the new Resident to complete and submit all required paperwork to SVEM. Buyers may move into the mobile only when they are approved and the following paperwork is completed and signed:

1. Rental Application and Authorization for Credit Report, which

authorizes SVEM to request a credit report.

a. The credit report is $45.00 per adult and must be paid in advance. This charge is non-refundable. A credit report is valid for only sixty (60) days.

2. The current Resident and new Resident must provide SVEM

with the closing date and move-in date of the new Resident. B. It is a violation of the Rental Agreement if a Resident fails to inform

SVEM of his or her intent to sell a mobile; therefore, SVEM reserves the right to rent the space to another party, who may move a mobile onto the designated space.

D. Moving into SVE 1. Mobile Space

A. Mobile lot spaces remain under direct control of SVEM. B. Please refer to page 51, Map of Appropriate Places for Items. While these diagrams provide a general layout of the mobile spaces in SVE, please be aware that the lots vary in size and the useable space varies due to easements and water, gas, telephone and electrical lines. When moving into SVE, the management team will instruct the driver where to park the mobile based on the uniqueness of the specific space. While it is the goal of SVEM to maintain uniformity on each space, the placement of air conditioners, kennels, sprinkler heads, garages, carports, sheds, etc. will also vary due to the useable space conditions. All plans must therefore be approved by SVEM prior to construction or installation of the above.

A. Shiloh Village Estates Management requires all mobiles, skirting, trim, roofs, sheds, decks, steps, carports and garages to be painted and/or replaced in effort to maintain the original condition and quality housing in SVE. It is the Resident’s responsibility to do this maintenance when necessary. The time for such maintenance may vary, but a maximum of seven to nine years is permitted.

1. The mobile paint or siding must be kept in presentable condition. 2. Since neighbors are impacted by the color of paint, SVEM must approve

any new paint colors if they differ from the current mobile color. 3. Shiloh Village Estates Management may provide a written notice to the

Resident if painting is necessary, and will be given as early as possible to allow the Resident to plan for the required painting. The painting must be completed no later than 6 months after the notice is given to the Resident. For example, if a Resident receives a notice in April, the work must be completed by October 31 of the same year, weather permitting.

4. A violation is issued if the Resident fails to complete painting within 6

months of the notice date. If the violation continues beyond the date specified in the violation notice, each day is considered another violation.

B. Residents are responsible for the operation of the City water and sewer lines to

the main lines. Connections are to be made by the movers. If a mover breaks the City riser or sewer line, the new Resident is responsible for the repairs.

C. All Residents with an electric hot water heater must have a ¾” (inch) check

safety-valve installed to prevent a mobile from being flooded or the heater from burning. This is MANDATORY!

D. All hitches must be removed from the mobile. If a mobile in SVE at this time

has a hitch, the hitch is grandfathered in and may remain where it is located until the mobile is removed from SVE. If hitch cannot be removed then it is the Resident’s responsibility to make cover attractive and match mobile skirting.

E. All driveways, patios and sidewalks need to be cleared of snow throughout the

winter season. Snow is to be put in the yard and not in the street. F. The use of salt to remove snow or ice is not permitted; it damages the

concrete and kills grass. SVE recommends Ice Melt. G. Three-wheelers, four- wheelers, and recreational vehicles must be kept out of

view in closed garages, not in open carports, behind the mobile, or beside the shed.

H. Items other than cars must be stored inside the mobile, shed, or in a closed garage. Items cannot be stored in the yard, in the carport (door-less garage), or on the deck. Each mobile space must be kept tidy. Storage of bottles, cans, boxes, tires, batteries, refrigerators, washers, dryers, indoor furniture, canoes, pontoons, camping equipment, etc. is not permitted on the deck or in the yard.

I. Children’s toys must be picked-up and stored out of view when not in use. A

shed is the best way to keep your lot space clean. J. Mobile additions, i.e. metal awnings, carports, storage sheds, or other structures,

must be approved by SVEM before they are built. K. If the Resident has a fireplace inside their mobile, only one cord of firewood may

be stored in the rear of each mobile. The firewood must be arranged in an orderly fashion.

L. Decorative rocks may be used with prior approval by SVEM; decorative bark

and/or woodchips are prohibited because the wind blows it all over and neighbors become upset by the mess it causes and complains to the office.

M. Rain gutters are mandatory to prevent WATER DAMAGE to the Resident’s

mobile. When WATER DAMAGE is created it will then cause mold and other structural deterioration. SVE will not be responsible for any respiratory infection or disease cause by this nor the lack of resale of a mobile. SVEM will ask the seller to replace and repair such damage before the sale of the mobile.

N. When external Masonite siding is damaged, meaning cracking, swelling, fading,

etc. due to water or other factors, Residents will be required to replace the damaged section with new Masonite siding.

2. Emergency Maintenance Work

SVEM will notify a Resident’s in the case of an emergency such as a water line break, break of a riser or in the case of either a gas or electrical line was damaged. Residents are also required to call SVEM emergency number should any of the above be brought to their attention as well as calling the gas and electrical line companies. Please call MDU 1-800-638-3278.

3. Skirting A. Skirting is first priority of work to be completed when moving

into SVE.

B. Skirting installation must be completed within sixty (60) days from the move-in date of the mobile (weather permitting). There are no exceptions to the skirting requirements.

C. Shiloh Village Estates Management highly recommends factory skirting. Residents must discuss all skirting plans with management before installation of skirting may begin. Any unapproved skirting will be subject to approval by SVEM, and may require removal at the Residents’ cost if not compliant with SVE’s Rules and Regulations. Once plans are approved, Residents must contact SVEM to request utility markings (7) days prior to construction. Utility markings are mandatory, as skirting materials cannot be placed on water lines, water risers, gas, electrical or telephone lines.

D. Quality installation of skirting is essential. Skirting not only allows for additional storage beneath the mobile and deck, but it prevents damage from the elements, such as windstorms and ice. Skirting helps to retain heat during the winter, which decreases the possibility of pipes freezing and breaking.

E. All persons hired to install skirting must first familiarize themselves with the SVE skirting codes before construction may begin. These codes are available at the SVE Office.

F. The entire front and entire back deck skirting (all three sides) must match the mobile skirting. The following skirting materials are approved by SVEM:

i. Vinyl – must be insulated with at least a rating of “50” ii. Fiberglass Rock Panel – insulation is highly recommended with this

product iii. Concrete Siding – best product for durability and longevity; comes

with pre-manufactured insulation iv. Any materials not listed – Shiloh Village Estates Management must

give approval for any new products before installation may begin

G. Masonry or lattice for skirting is not permitted.

H. The measurements of the board that is used to frame the bottom of the skirting are either: 2’’x 4’’ or 2’’x 6’’ treated wood. The boards that are to run perpendicular to the bottom boards need to be placed every 4 feet apart to help reinforce the skirting. This prevents the skirting from blowing away.

I. The excess of the pressure-treated lumber must extend from the mobile into the yard. A 12-inch width is recommended to help secure the skirt to help protect the skirt from lawn mowers and trimmers by your next door neighbor.

J. Bricks and/or rocks are not permitted at the entrance of the water riser (a panel door should be placed here and marked with a W so that you know where your main water line is). Therefore bricks and/or rocks are not permitted seven feet on either side of the water riser entrance, making a total of 14 feet in length; they interfere with accessibility to the water riser/main water line when it comes to having repairs done.

K. All skirting must have a minimum of 8-10 air vents evenly spaced, depending on the size of the mobile. Air vents help prevent damage due to moisture, fungus and/or mold buildup, and must be opened during the spring and closed during the winter. Automatic vents are highly recommended; they are temperature-sensitive and will open and close automatically.

L. All skirting must have one removable door panel indicating the location of the City water riser. This removable panel must be labeled with a “W,” using either a marker or a pointer, for ease of access in the event that a line requires service or repair. This removable panel cannot be located next to a step, deck, or air-conditioning unit. The removable panel must have at least seven (7) feet on either side for accessibility to repair the city water riser.

M. The skirt panels must be tightly installed (highly recommend to screw this in place) against the mobile and against the pressure-treated lumber at the base to reduce heat loss and helps to stabilize the skirting during a wind storm.

N. It is highly recommended, but not required, to insulate the entire skirting – tightly-fitted skirting and insulation will help prevent freezing of the city water and sewer lines.

O. Hot tubs must be skirted to match Resident mobile and deck and be approved by SVEM.

P. It is necessary to maintain mobile’s roofs, skirting, and siding.

Q. Any modification or remodeling of the mobile is prohibited without prior approval from SVEM. Residents must first submit plans to SVEM for approval; all plans must be accompanied by a drawing.

R. Trailer hitches on mobiles must be removed and stored beneath the mobile. If hitch cannot be removed then it is the Resident’s responsibility to make cover attractive and match mobile skirting.

S. All excess construction materials must be properly disposed of, or stored beneath the mobile, front deck, or inside the shed. Removable skirting on the back and side decks creates additional space for storage.

4. Steps A. Before construction of steps may begin, Residents must discuss plans with

SVEM to ensure the steps and railings are in accordance with current building codes. Because steps and railings cannot be placed on water lines, water risers, gas, electrical or telephone lines, Residents must contact SVEM to request utility markings (7) days prior to construction. SVEM recommends that

when building steps that an overhang is considered for protection from weather.

B. Steps and railings must be completed within sixty (60) days from the move-in date of the mobile (weather permitting).

C. All steps, both front and back, must be closed in on all sides and skirted to match mobile.

D. Steps and railings must be vinyl, painted or stained. Railings may be made of iron, wood, vinyl, T-Rex®, or composite. Green wood is not permitted; only cured or treated wood is allowed. Paint and/or stain adhere only to treated or cured wood. Steps and rails must be routinely maintained; please note that Residents will receive violations for unsightly steps and/or rails.

5. Shed 5.1. Sheds with barn-style roofs that have been grandfathered into the Booklet of

Rules and Regulations may remain in SVE only if the required improvements are completed by the Resident. These improvements must be completed before a “FOR SALE” sign may be placed in either the front yard OR mounted on the side of the garage. Barn-style roof sheds are no longer permitted in SVE.

5.2. Installation of a shed is optional. Residents must discuss with SVEM any plans to install a shed before construction or the placement of a pre-built shed on the lot. Sheds cannot be placed on water lines, water risers, gas, electrical or telephone lines. To avoid hazardous placement of a shed, SVEM must mark all utility lines. Following approval of the plans to install a shed, Residents must contact SVEM to request utility markings 7 days prior to construction.

5.3. Construction and/or installation of a shed must be completed no later than ninety (90) days after construction begins (weather permitting).

5.4. Proper placement of sheds is four (4) feet behind the mobile. Please refer to pages 51, Map of Appropriate Places of Items.

5.5. Only wooden sheds are permitted, as they are the least likely to leak and do not deteriorate.

5.6. Metal or plastic sheds are not permitted.

5.7. The City of Billings regulations require all sheds to be built or placed four (4) feet from the back or side of mobile.

5.8. The dimensions of a shed must be no smaller than 8’x 10’ and no larger than 8’x 12’. The 8’x 12’ shed requires three (3) sheets of plywood for the floor plan with no waste and can be easily moved. If a mobile in SVE at this time has a shed larger than 8’x 12’ the shed is grandfathered in and may remain until the mobile is removed from SVE. It is at the discretion of SVEM whether or not a shed will remain on the premise upon sale of a mobile.

5.9. All sheds must be painted or have vinyl siding to match the mobile. A. Shed trim and walls must be painted to match the mobile.

B. Siding can be vinyl, steel, or Masonite®. C. When using vinyl or steel siding, there must be a 7/16-inch wood sheeting

under the siding for support.

5.10. All sheds must be vented with a minimum of three (3) roof vents.

5.11. Sheds are to be placed on a 2’x 6’ single rudder. All rudders must be treated wood to prevent deterioration.

A. The floor must be constructed of treated 2’x 6’ floor joists built on 16-inch

centers. B. Sheds must be mounted and leveled on 1-1/2 inch concrete blocks (highly

recommended) to prevent deterioration from wet weathered on ground. C. Sheds can have windows.

5.12. The maximum height of the shed wall is seven (7) feet high from ground level to the fascia on 16-inch centers to facilitate movement of the shed, if necessary.

5.13. Roof on Sheds:

A. Sheds may not have a rolling or barn-style roof. B. The roof must have shingles or composition to match the Resident’s mobile. A

Resident may have a metal roof; however, before the installation of a metal roof, Residents must discuss plans with SVEM. Shed roofs must be vented with a minimum of three (3) roof vents.

C. The over-hang (roof ledge) must encompass the entire shed and extend (18)

inches over all the walls with gutter to prevent exterior wall sides from deteriorating.

D. Only gable roofs are accepted. Flat roofs or barn-type roofs are not acceptable (unless grandfathered in).

E. All sheds, regardless of size, must have a roof pitch of 4 feet x 12 inches.

5.14. A ramp way made of treated wood, bricks, pavers, but no concrete is recommended for ease of storing lawn mowers, bikes, etc.

5.15. The grass must be replaced if a shed is removed; a garden may not be put in its place.

5.16. A moving permit from the City of Billings is required before removing a shed from SVE that is over eight (8) feet wide.

5.17. Pre-built sheds cannot be brought into SVE once the mobile is parked on the lot. After the mobile is parked, the shed must be constructed on the lot. Following approval of the plans to install a shed, Residents must contact SVEM to request utility markings 7 days prior to construction.

5.18. SVEM will inform Residents when sheds are outdated and have to be moved out of SVE.

6. Decks 6.1. Before construction of a front deck, Residents must discuss all plans with

SVEM. Because decks cannot be placed on water lines, water risers, gas, electrical or telephone lines, utility markings must be made 7 days prior to construction. Please call SVEM to request this service. All decks must be skirted to match the mobile skirting, therefore the decks must be fully enclosed so no visible grown/concrete is showing. A door can be placed on this skirting so that more storage is created.

6.2. All mobiles are required to have a front deck, which must be completed within ninety (90) days of the move-in date of the mobile (weather permitting).

6.3. All back decks are to be no larger than 4x8’ in your next door neighbor’s yard and must be skirted. Deck steps maybe enclosed on the sides of the step or just behind the top step.

6.4. The smallest deck permitted is 8’x 10’; Shiloh Village Estates Management must approve any deck larger than 8’x 12’.

6.5. Trex® is highly recommended for deck construction. Other materials used to construct the deck must be stained or painted. If a carport is used in combination with the deck: steel, vinyl or concrete siding must be used around the sides of the deck to match the mobile’s skirting.

6.6. The City of Billings fire code requires steps on the front and rear decks. Rear steps are for the Resident’s access to exit out of the mobile for emergencies.

6.7. A 2’x 4’ railing must enclose the deck.

A. The deck enclosure must not be higher than 36” from the floor of the deck. B. Use 2”x 2” spindles, spaced 3”- 4” apart, to enclose the deck. C. Spindles must be 6” from the floor of the deck to allow for snow removal. D. Overhang roofs over front and/or back decks have to be enclosed with a ceiling

(using 1/8 ply board) and be painted so no beams or nails are visible.

6.8. Awnings on decks must be maintained.

6.9. The soffit of the roof must have vents in addition to all other types of vents.

6.10. Rain gutters are mandatory; they keep water off the steps, walkways and driveways as well as preserves your siding and windows and prevents mold and moisture within the walls which will deteriorate the structure of the mobile.

6.11. Items such as bikes, trash cans, and barbeques may be placed behind the front deck. If placed on the front deck, barbeques must be on concrete and must be covered when not in use. No items may be placed on the side of the deck.

6.12. Concrete paint is advisable for helping to preserve your rails and decks.

7. Garage and Carport

7.1. SVE does not require a garage or carport. Labor and all materials to construct a carport or garage are the Resident’s cost.

7.2. Before construction of a garage or carport, Residents must discuss plans with SVEM. A garage, carport, or concrete must not be placed on water lines, water risers, gas, electrical or telephone lines. Utility markings must be made 7 days prior to construction. Please call SVEM to request this service.

7.3. Carports may vary in size and design. The Resident must present rough drawings to SVEM for approval before beginning construction. All carports ceiling have to be finished and painted at the time of sale.

A. The largest double-car garage is 24’x 24’. Any larger will interfere with

neighbor’s lot.

B. Both single and double garages must be SET BACK 1 ½ ft. to 2 ft. away from the concrete slab that is before the pavement, not from the pavement; this allows the removal of snow from damaging garages or carports.

C. The garage should have a 3’x 3’ (or larger) window on each sidewall of the

garage that installed one-and-a-half (1.5) feet from the garage door entry. This placement is for the driver to be able to see oncoming traffic while backing out of their garage.

D. The maximum height of walls is 4’x 8’ textured siding. While no OSB or

plywood is needed, the studs must be 16” on-center. E. Vinyl and lap siding must have 7/16” OSB or plywood underneath the siding.

Studs may be 16” on-center or 24” on-center. The top plate must be double to tie all the walls together.

F. Headers for overhead garage door must be a double 2’x 10’ and constructed

with 7/16” OSB/plywood glued in-between for extra strength; it is recommended to use a laminated beam.

G. Siding on carports and garages must match the siding of the mobile. H. Roofing on carports, garages, front/back decks must match the roofing on the

mobile and the shed unless a metal roof has been approved by SVEM. Most often the mobile roof is 3-12 pitch but sometimes 4-12 pitch. All open ceiling areas must be finished and painted so the ceiling shows no beams or nails.

I. Overhang on all garages, walkways, and

carports must match the Resident’s mobile, be vented and 12 inches or better. As shown in diagram below.

J. Enclosed single-car garages must have four

(4) vents.

K. Enclosed double-car garages must have six (6) vents.

L. All carports must be finished and have four (4) vents. Finished means all

ceilings are enclosed and painted. M. Storage Items:

1. Items need to be stored in a closed garage, behind the front deck, or inside

a shed so they are not visible from the street. This includes items such as toys, lawn mowers, gardening equipment, etc. All items that are not being utilized need to be stored away/out of site.

2. If the garage does not have a door, items may not be stored inside.

3. If personal property is stored in the garage, the garage door must be kept

closed. 4. Items cannot be stored in carports. Garbage cans cannot be stored in

carports unless a bin is built inside the carport for storage; otherwise, garbage cans must be stored behind the front deck.

5. Due to safety hazards, items such as furniture, flower pots, lumber;

concrete pacers, riding- or push-lawn mowers, refrigerators, etc. cannot be stored between the shed and the mobile. Ladders are the only items that can be stored between the mobile and the shed. Hoses and wheel barrels need to be placed inside the shed or hung outside of the shed between the shed and mobile. Refer to Maps and Diagrams located at end of this booklet.

6. SVEM will give violations for miscellaneous items, such as but not limited to

toys, yard equipment, etc. not in use which and not being properly stored in a shed, under a mobile or a deck or in a closed door garage. SVEM recommend a shed.

8. Insulation under Mobile and Electrical Heat Tape

Mandatory Requirements: 8.1. If Residents allow the water riser to freeze – or to become damaged in any

other way – the cost of repair is the Resident’s responsibility. Please note: such repairs, which often times involves digging up the line and connections. This can be very costly and time-consuming to repair the water riser line. The water riser line cannot be moved from side to side as this will crack it 8 feet below where it is connected to the city water line.

8.2. It is the Resident’s responsibility to insulate the top of the 8” PVC pipe that contains the city water riser, which is under your mobile. INSULATE OVER THE TOP

AND AROUND THE SIDES OF THE PVC PIPE AT GROUND LEVEL ONLY, NOT BELOW OR

INSIDE OF THE CITY WATER RISER.

8.3. DO NOT PUT INSULATION INSIDE THE 8” PVC PIPE. Insulation inside the 8” PVC pipe will inhibit management from turning off the valve. If the PVC pipe is cracked due to careless taping procedures, the Resident is responsible for the damage and for the cost of all repairs.

A. It is mandatory that all water lines under your mobile need to be covered the

entire length of the water line with heat tape to prevent freezing. Thermo-heat tape should be first checked early September before cold weather begins. Installing heat tape with a light may help determine if the heat tape is working properly. It is the responsibility of the Resident to plug in the heat tape for his or her mobile. Water lines frozen above ground are the Resident’s responsibility.

a. DO NOT run water as a method of preventing freezing. This increases the

water bill, which may cause an increase in rent.

9. AIR CONDITIONERS: DO NOT PLACE IN YOUR NEIGHBOR’S YARD!

9.1. Before an air condition is installed, Residents must discuss the location of the air conditioner with SVEM. Because air conditioners cannot be placed on water lines, water risers, gas, electrical or telephone lines, Residents must call SVEM and request utility markings 7 days prior to installation. Placement of air conditioner must be within boundary of the Resident’s lot. Refer to Section X for Maps and Diagrams. Air conditioner cannot be placed in front of the water riser panel door that is marked with a W.

9.2. Air conditioners must:

A. Be located either behind the deck and on the side of the mobile where the front door is located, or in the rear of the mobile by the shed;

B. Be located within the parameters of the Resident’s yard; and

C. Have at least 7 feet of free space of all sides of the access water panel

door marked with a W. Due to the placement of the city water riser beneath the mobile, there cannot be anything within 7 feet of all sides of the access door, including decks, stairs, air conditioners, decorative rocks, bricks, curbing or wood trim on the mobile. Shiloh Village Estates field workers must be able to freely access this area for repairs with a backhoe.

9.3. Air conditioners may not be placed in the front yard of the mobile or in the neighbor’s yard (which is often where the back door is located). If a mobile in SVE at this time has an air conditioner in the neighbor’s yard, the air conditioner is grandfathered in and can remain where it is located until the mobile is removed from SVE. If one is in the wrong place after this time it will

be at the Resident expense to remove it and put it in the correct location. The best place is behind their mobile.

10. Garbage and Waste Disposal 10.1. The proper disposal of garbage is mandatory in SVE.

10.2. Garbage is picked up as early as 7:00 a.m. on Friday. All trash bags and/or containers need to be stored until the night before trash day. Containers may be set out after 5:30 p.m. the evening before the pickup day and need to be set out no later than 5:30 a.m. on the day of garbage pickup.

10.3. Residents may use any combination of the following for trash disposal:

Up to 3 garbage containers (30-gallon maximum per container) with lids and handles.

Any number of trash bags or sacks. The maximum size of trash bags is 30-gallon.

The Solid Waste Company will not pick up a container any larger than the 30 gallons.

10.4. Garbage must be placed near the side of the street next to the driveway. If garbage is not placed in the street, it will not be removed. The garbage containers are returned back by the pickup service to the same location they were placed by Resident. Garbage containers should not block driveways.

10.5. All garbage containers must be removed from the streets by the end of the pickup day. Any Resident who misses the garbage pickup may not leave their garbage out for the next pickup date. If a Resident is unable to return garbage cans to the proper location after pickup, he or she must use plastic bags for trash disposal.

10.6. Shiloh Village Estates Management recommends Residents to label all garbage cans and lids with his or her name and/or address; labeled items will be more quickly identified and returned to owners following unruly weather conditions. To prevent unnecessary littering of SVE, garbage lids must remain chained or snapped on by expandable bands except during garbage pickup day.

10.7. The following holidays are observed by the Waste Management: Thanksgiving, Christmas, New Years, the 4th of July, Memorial Day, and Labor Day. Garbage is not picked up if these holidays fall on the specified garbage pickup days and will be picked up on the following day.

10.8. Garbage containers must be stored as follows:

A. In an inconspicuous place so they are out-of-sight from the street; B. In the storage shed, or C. Behind the front deck next to the back steps, or D. In the garage if the garage door remains closed.

10.9. Garbage containers may NOT be stored as follows: A. In carports; B. On the street or sidewalk; C. In front of the mobile; D. In between the mobile and shed.

10.10. Disposing of waste oil in the garbage or dumping waste oil on the ground is illegal and is prohibited anywhere in SVE. If your vehicles have a leak, you are required to fix the leak as well as clean up all oil stains left behind. Violations will be given for this.

10.11. Toxic or hazardous substance (e.g. motor oil, engine fluids, batteries) including any substance toxic or hazardous to animals may NOT be stored, dumped or placed in metal containers, plastic containers, or placed behind the mobile, shed, or any other areas in SVE. The Resident will receive a violation for storing or dumping oil or other toxic and hazardous substances.

11. Conduct of Children

11.1. All persons under the age of 18 must be out of the parks and off the streets by 10:00 p.m.

11.2. An adult must supervise the outside play and conduct of minor children at all times as to not disturb other Residents. Failure of a Resident to supervise children and prevent such behavior is a violation.

11.3. Toys must be picked up and stored out of view when not in use. During the winter, all toys must be stored in the shed, garage, or behind your front deck.

11.4. A Resident may have a swing set on their space at his or her own risk. The Resident accepts sole responsibility to ensure the safety of others while using the swing set.

11.5. A Resident may have a trampoline on their space at his or her own risk. The Resident accepts sole responsibility to ensure the safety of others using the trampoline.

11.6. Children must not play in the streets of SVE.

11.7. Children with bicycles must not block traffic in the streets of SVE. Bicycles are to be ridden single file on the right-hand side of the sidewalk (not on the street), and are not allowed in the common-area parks or the entrances of SVE. Children on bicycles must be supervised by an adult. When not in use, the bicycles must be stored out of view in the shed or garage, or behind the front deck.

11.8. Children are not permitted possession of knives, firearms, arrows, slingshots or similar weapons.

11.9. Children are not allowed to throw rocks or other items.

11.10. Residents, children, or their pets are not allowed to trespass through neighboring mobile home property without prior consent.

11.11. Fireworks are not allowed in the city limit in which SVE is located. Fireworks are prohibited at all times in SVE.

11.12. Violation of an SVE rule or damage caused by their children will be deemed a violation by the Resident.

12. Pets

12.1. Pets are not allowed on the premises without prior approval from SVEM. Acquiring a pet without approval from SVEM may be grounds for termination of the Rental Agreement.

12.2. A Resident may not obtain a dog after he or she has been accepted to live in SVE without first obtaining SVEM permission.

12.3. Following approval, only two pets are permitted per mobile.

12.4. The only dogs accepted in SVE are “lap dogs” – those that weigh fifteen (15) pounds or less, FULL GROWN.

12.5. Before getting a puppy or dog, research the adult size and weight of the breed.

12.6. All pets must be licensed and have up-to-date rabies and distemper shots.

12.7. All pets must be spayed or neutered unless SVEM approves otherwise due to just cause.

12.8. Approved pets are listed on the Rental Application and Rental Agreement.

12.9. A color photograph of a Resident’s pet(s) must be on file with SVEM.

12.10. All dogs must have a chain-link or decorated black iron-rod dog run/kennel. Portable dog runs are also accessible. This needs to be completed within fourteen (14) days (weather permitting) from the move-in date of the mobile. Acceptable sizes of dog runs are: 6’x6’, 6’x8’, and 6’x10.’ SVEM must approve the location for the any dog run before construction. Dog runs must be behind the front deck, out of sight to maintain attractive yards.

12.11. Shiloh Village Estates Management must approve any pets that replace previous pets. When a cat or a lap dog that weighs 15 pounds or less passes away, the Resident may obtain another pet with written permission from SVEM.

12.12. Residents may not provide temporary pet sitting or care for animals not listed on the Rental Agreement.

12.13. Because SVE is in the City of Billings, all Residents must abide by the Billings’ leash law. All dogs and cats must be leashed – day or night – whether on or off the Resident’s space.

12.14. For the safety of both the animal and Residents, dogs and cats are not allowed to roam.

12.15. Do not tie pets to bushes, trees, steps or a stake in SVE.

12.16. Noisy or unruly pets are not permitted to remain in SVE.

12.17. Residents must replace any grass damaged by pets and all grass must be replaced if damaged at the time of sale of the mobile.

12.18. Please notify SVEM of any trees or shrubs that are damaged by pets.

12.19. Dogs must remain on leashes and are not permitted to litter the lawn of other Residents. Please carry litterbags and pick up any litter left behind by dogs in any SVE Parks, sidewalks and streets.

12.20. If animals are seen off a leash within SVE or being held by a Resident, please report the animals to the local animal shelter:

12.21. All dog runs/kennel areas must be kept clean from pet litter. Pet litter is not allowed to accumulate and should be cleaned daily. Grass must be replaced should lawn die due to litter and therefore needs to be in the same condition as it was prior to your possession of renting the lot space.

12.22. Residents who have three (2) violations within a one-twelve month period regarding their dog(s) will be asked to get rid of the dog(s) or move from SVE.

13. Security Gates

13.1 . All SVE Residents need to buy key(s) for the security gates, not to exceed 3

keys at any one time. Each key cost $50.00 which is nonrefundable. These keys become the property of the Residents.

13.2 . In the case of lost, stolen or damaged keys the Resident will be able to replace

the key(s) for an additional cost of $50 per key.

13.3. The office manager must activate each key. In order to do this the Security

Gate form must be filled out by the Resident. This form collects only one phone number (this can be a cell number and can have any US area code). Should the Resident’s phone number change for whatever reason please notify the office as soon as possible so that management can update the database and ensure that your gate keys will work. For each additional changing of a phone number, after the initial one is set, a $25 fee will be accessed for making the change. Fees will need to be collected prior to changing the phone number. Should the key not work for whatever reason you will need to bring the key into the office so that management can identify the issue with the actual key. You may place your key in a zip lock bag with your information such as a phone number and where you live and then drop it into the check box should no one be in the office.

13.4. Once the gate key(s) has been activated the office will call you and let you

know that your keys are ready to be picked up. To use the key you will need to place the key up towards the sensor pad located left of the key pad. You will need to be fairly close to the sensor pad so that the key will work. There is a red light on the sensor pad and it will turn green once the key is recognized and the gates will open.

13.5. Gates will automatically close at 7:30 pm and open at 6:30 am each day.

13.6 . When visitors come they will need to use the keypad and use the arrow keys to

scroll through a list of names until they find the Resident’s name (names are listed alphabetically by last name) in which they want to visit. Once they find the Resident they will then push the button that has a symbol of a phone on it. This will call the phone number that the Resident listed on the Security Gate form. The Resident will need to answer the phone and will then hear the person at the gate asking to be let in. The Resident will need to press “9” on their keypad of their phone to allow the gates to open.

13.7 To exit out of Shiloh Village Estates when the gates are closed a vehicle will need to drive over a yellow box marked EXIT (it requires the weight of a vehicle not a human).

E. Water Risers PLEASE CALL THE SVE OFFICE TO REPORT A SUSPECTED WATER LEAK. THIS

INCLUDES ANY SIGNS OF WATER RUNNING AT UNUSUAL TIMES.

E.1. There are two (2) types of water risers.

A. The Irrigation Water Riser is located in the rear of the yard of each lot. The irrigation water is for the following purposes: watering lawns, plants or trees, and washing off patios, sidewalks, etc.

B. The City Water Riser is underneath the mobile. All skirting must have one

removable panel indicating the location of the water riser. This removable panel must be labeled with a “W,” using either a marker or a pointer, for ease of access in the event that a line requires service or repair.

E.2. Everything above the ground is the Resident’s responsibility. The city water line below the ground is the responsibility of SVE. To repair the city water line requires digging up the water line, replacing the line and if the connections are eroded then new connections need to be replaced as well. This is time consuming and costly.

A. The city water risers must have 7 feet of free space on all sides of the

riser. This space must be free of decorative rocks, bricks, curbing/wood trim, decks, stairs, or air conditioners. No stored items may be placed near the city water riser.

B. If there is less than seven (7) free feet of space on any side of the riser, the

Resident is responsible for the cost for SVE or its agent to access the riser for repairs.

E.3. Shiloh Village Estates Management is responsible for the following repairs and/or replacement of the city water risers if:

A. The broken riser is below ground-level

B. The pipes are frozen below ground-level

C. A water leak is below ground-level

E.4. The Resident is responsible for any above-ground repairs including, but not limited to, the following:

A. Replacing a corroded or leaky spigot (used to turn the riser on and off) B. An above-ground leak in the irrigation riser C. Frozen pipes or water lines above-ground (note: heat tape is mandatory) D. Any damage to the riser beyond normal wear and tear E. Any damage to the city water riser during the moving of a mobile

F. Any damage to the irrigation water riser caused by outdoor activities (i.e.:

collision from a lawn mower, weed whacker)

E.5. The following actions must be taken by the Resident to minimize his or her responsibility for repairs, on the city water riser.

A. Shiloh Village Estates requires insulation around and over the top of the 8 feet

deep PVC pipe that contains the city water riser under the mobile. This insulation must be secured to prevent it from falling inside the city riser. SVEM will not be responsible for retrieving any items from this hole. Management recommends installing the insulation one (1) foot from the top edge of the riser. Netting or chicken wire must be placed at ground level to prevent animals from falling into the city water riser hole.

B. The spigot knob on the city water riser must be replaced when it shows signs of

mineral build-up and/or begins to leak water. Such damage may result in flooding, which must be repaired at the Resident’s expense. A shutoff valve must be installed prior to replacing the spigot knob. Doing so will avoid shutting down the water flow to the street.

C. When putting the heat tape on the water riser, do not pull the riser to one side

of the 8” PVC pipe; pulling the riser can crack the lower “T” position of the water line below ground. If damage occurs, the Resident is responsible for repairs to the city water line connector below the ground.

D. At the first signs of winter, Residents should plug in the mobile heat tape to

prevent the 8-foot city water riser from freezing and all other water line under the mobile.

E. Shiloh Village Estates Management highly recommends that Residents inspect

their city water riser every three months.

F. Yard

Residents are required to maintain his or her lot in good order. Before irrigation watering is available, June 1st, please do not use city water on yards. City water can be used on trees and flowers only if the irrigation water is not turned on. Otherwise a $50 per day assessment fee will be given for violators using city water on their yards. The following are the responsibilities of the Resident for the care of the yard within his or her lot:

1. Lawn A. Fertilizing Lawn

1. Once irrigation is turned on, all yards must be fertilized every three to four week. Diligent fertilizing will be rewarded with a healthy and attractive yard. Shiloh Village Estates Management recommends using one small bag of Scotts Turf Builder Weed and Feed. A manual fertilizer applicator is an efficient and less costly method to disperse the fertilizer; otherwise, Residents maintain the right to hire an outside company to fertilize at his or her own cost. Irrigation water is turned off on September 28th of each year; this is the last day for watering.

2. If the yard is not fertilized and/or watered and begins showing signs of

deterioration, SVEM will post a notice on the door of the mobile that action must be taken within 24-hours. If the 24-hour notice period expires and the lawn is not fertilized or watered, SVEM will fertilize and/or waters the yard for a fee of $35.00. The fee must be included with the following month’s rent.

B. Mowing and Trimming

1. Lawns must be mowed and trimmed weekly to maintain the grass at a maximum height of four (4) inches. If grass exceeds 4 inches, SVEM will post a notice on the door of the mobile that the lawn must be mowed within 24-hours. If the 24-hour notice period expires and the lawn is not mowed, SVEM will mow and trim the yard for a fee of $20.00. The fee must be included with the following month’s rent.

2. Mowing is permitted between the hours of 8:00 a.m. and 8:00 p.m., as per

Billings’s city ordinance. 3. Grass and shrub clippings must be bagged for disposal by City of Billings

Solid Waste Division. 4. Grass clipping bags are not permitted on the street for trash pickup until

Thursdays after 5:00 p.m. Do NOT dispose grass or bush clippings along the concrete wall North of Swallow Street or anywhere else in Shiloh.

5. Residents may have a third 30-gallon trash can with wheels for grass

clipping bags. Grass clippings must be transferred to bags, set inside the trash can, and stored until Thursday after 5:00 p.m.

6. Riding lawn mowers or hand-pushed lawn mowers may not be parked in the

Resident’s driveway. Mowers may be kept in the shed or garage with a closed door; mowers stored behind the mobile must be covered at all times.

7. Tree branches need to be cut four feet in length and placed in bundles for

weekly solid and waste trash disposal.

2. Weeds A. Keep all chemical sprays out of the reach of children and pets. Yard chemicals

are hazardous to humans and domestic animals, injurious to eyes, harmful if swallowed, and may cause skin irritation.

B. Yards must be sprayed and fertilizer for weeds. Residents may spray for

weeds themselves or hire an outside company to perform this service. Weed-B-Gone® is recommended for spraying weeds and fertilizing.

C. Most weeds will require two spray jobs except Canadian thistle; they are the

most difficult to kill, many sprays are needed. You will need to kill the thistle before it blooms otherwise your entire lawn will be infected. It is recommended to use Roundup to kill them however please do not use on a windy day as you will kill everything the chemical touches.

D. Spraying when weeds are young and growing is most effective; however,

subsequent spraying may be required to kill any weeds that were missed.

E. Since sprays kill the flowers and trees, spray the grass areas only. When spraying around trees and flowers, keep the chemical low to the ground and with low pressure. Do not spray with chemicals when wind is blowing.

F. If weeds or plants other than grass or decorative plants are allowed to thrive in

a lot, SVEM will post a notice on the door of the mobile that the lawn must be sprayed within 24-hours. If the 24-hour notice period expires and the weeds remain unsprayed, SVEM will spray the yard for a fee of $20.00. The fee must be included with the following month’s rent.

3. Garden, Flowers and Trees A. Gardens are not permitted in SVE.

1. If a garden is grand-fathered in, the garden must be removed when the current Resident no longer resides in the mobile. SVEM will send a notice when this needs to take place should it not already happen.

2. If a garden that is grand-fathered in is not maintained, the Resident must

remove the garden the same year when the garden is not in use.

3. When a garden is removed, whether voluntarily or involuntarily, the Resident must replace the garden with grass at his or her expense.

B. Flowers are permitted in SVE.

1. Grass may not be dug up for flowers unless first approved by SVEM. Because flower beds cannot be placed on water lines, water risers, gas, electrical or telephone lines, Residents must contact SVEM to request utility markings three (7) days prior to construction.

2. Flower pots or flower beds next to the mobile are permitted. Gardens may

also be in a flower bed.

3. Unused pots may be stored in the shed or underneath the front deck, must be out of sight.

4. When a flower bed is removed, whether voluntarily or involuntarily, the

Resident must replace the flower bed with grass at his or her expense. C. Trees are watered by the Resident’s sprinkler system and/or manual watering

and therefore do not require the use of city water. 1. Residents may not plant trees or bushes unless approved by SVEM. 2. Residents may trim or remove trees, shrubs or bush on his or her lot only

and at his or her own expense.

3. Residents must maintain his or her rain gutters and downspouts prior to winter season. This includes the cleaning and removal of leaves and all other debris that occur every year. Recommended to do this as often as possible.

4. If any Residents plants trees and bushes in their yard without SEVM

approval it will be the Residents responsibility and cost to remove those prior to vacating their lot or selling their mobile.

4. Hoses and Manual (non-automated) Watering:

A. Open-ended hoses are not allowed; they decrease pressure from neighboring yards.

Open-ended hoses are defined as any hose without a sprinkler or spray nozzle attached when the water is on.

B. Hoses must be long enough to reach from the irrigation water riser in the back

of the yard to the front of the yard. This distance requires approximately 50-75 feet (or longer) of hoses.

1. Nelson sprinklers are recommended (they are inexpensive and efficient). 2. The square, four-cornered sprinklers (or similar types) are permitted.

3. Oscillating sprinklers are inefficient and are not permitted. These take

too much pressure to operate therefore creating insufficient pressure for others to water their yards.

4. If Resident uses a hose with a sprinkler head (and not a sprinkler system),

the sprinkler must be relocated every 15-20 minutes; this rule is strictly enforced by SVEM. Please use clock timers on your water riser to help reduce flooding. a. Over-watering may cause the mobile to sink, which will require re-

leveling at the cost of the Resident. Over-watering will also cause fungus and “fairy-rings” to appear in the grass. Damage to another Resident’s property, including but not limited to the mobile, skirting, sheds, decks, carport/garages, steps, air conditioners, vehicles and concrete, due to over-watering must be repaired and paid for by the responsible Resident.

b. Any Resident responsible for over-watering will be required to purchase

a crawler sprinkler or a clock timer for their hoses.

5. Irrigation/Ditch Water is NOT safe for drinking water.

A. Use of city water for lawns or any other outdoor purposes is strictly forbidden. If city water is used for lawns, the Resident will be fined $50.00 for the first and each subsequent violation. DO NOT USE CITY WATER, YOU WILL BE FINED.

1. City water may be used for watering flowers only until irrigation water is

available provided that the Resident is present and controlling the flow of water.

2. Do not leave hoses unattended while watering. Each stage should only run

15-20 minutes, not one stage from 3-7pm. If this occurs, SVEM will shut water off and Resident will be fined $25 for each occurrence.

B. The irrigation system at SVE does not use City water. C. Ditch water availability is decided by the Ditch Rider. The Ditch Rider

determines when the ditch water is delivered and discontinued to SVE. 1. Irrigation water is for outdoor use only.

2. Sprinklers should be on for 15-20 minute increments to avoid flooding your unit as well as your neighbors. If and when this occurs SVE Management or neighbors can shut your water off.

6. Sprinkler Systems:

A. Installing New Sprinkler System

1. Before planning or installing a sprinkler system, Residents must discuss plans with SVEM. Because the sprinkler system cannot be placed on water lines, water risers, gas, electrical or telephone lines, Residents must contact SVEM to request utility markings three (7) days prior to construction.

2. Shiloh Village Estates makes a one-time reimbursement per lot after

installation of a completely new (not partial or improved) sprinkler system that spans the total area of the yard. This one-time reimbursement may be up to $150.00.

3. Shiloh Village Estates does not reimburse a Resident for a sprinkler system

that does not both cover the entire yard and include a water filter and shutoff valve between the SVE water riser and the Resident’s water line to his or her sprinkler system.

4. Before reimbursement may be issued, the Resident must first submit a copy

to SVEM of the final bill that states both the work completed and the total cost of installation of the sprinkler system.

5. Shiloh Village Estates does not pay for repairs to a damaged sprinkler

system or water riser caused by the Resident or worker(s) employed by the Resident.

B. The cost of maintenance and parts for sprinkler systems are the responsibility

of the Resident, regardless of whether the Resident installed the system or the system was installed prior to the Resident moving to SVE. The Resident’s responsibilities are as follows:

1. Sprinkler systems must be repaired and maintained in full working condition.

All sprinkler lines and heads must be installed one (1) foot away from all mobiles.

2. Each water line carries only a limited flow of water, and therefore does not

support ample pressure for complete coverage at one time.

a. Only 1-2 stations of the sprinkler system are permitted to be on at the same time, depending upon the SVE water pressure.

b. The maximum use for each sprinkler station is 15-20 minutes. Those who exceed this will receive a violation.

c. If you have a filter on the irrigation water riser it may need to be cleaned

every time you water. d. A clock timer is required with all automatic sprinkler or hose systems if

the Resident is not present to manually control the system.

e. There is a $10.00 fee if SVEM must shut off a neglected sprinkler system. This fee must be included with the following month’s rent.

f. Roto-tillers are not to be used without prior approval by SVEM due to the

placement of underground utilities throughout SVE. The responsible Resident will incur all costs of repair due to damage to SVE utilities and/or property caused by the Resident and/or an outside party hired by the Resident.

C. Irrigation water may damage Resident’s property upon contact; therefore:

1. Do not allow excess water from a sprinkler system or hose to spray on

neighboring mobile, skirting, sheds, decks, carport/garages, steps, air conditioners, vehicles, concrete, etc.

2. Do not allow water to contact the mobile above the skirting. 3. Damage to another Resident’s property, including, but not limited to, the

mobile, skirting, sheds, decks, carport/garages, steps, air conditioners, vehicles and concrete, must be repaired and paid for by the Resident responsible for the damage. Be courtesy to your neighbor’s property.

D. If a mobile is wider than the previous mobile on the space, and an existing

neighbor has previously installed a sprinkler system that extends under the new mobile, the new Resident is responsible for the expense of relocating the neighbor’s sprinklers. If there is uncertainty as to whether or not a neighbor has a sprinkler system or where the sprinklers are located – find out.

E. Report to SVEM the overuse of water, such as more than two (2) automatic

sprinkler stations running at the same time (depends on the irrigation water pressure that day), hoses that are either running in excess or neglected with movable sprinkler heads. Shiloh Village Estates allows each Resident three watering days per week for yard maintenance purposes.

7. Winterizing and repairing personal sprinkler systems is the responsibility of the Resident. The sprinkler system must have a shutoff valve between the SVE water riser and the Resident’s water line to their sprinkler system. After the final watering day of the season, Residents must turn-off the water valve so

SVE can blow out the SVE water lines. Each Resident is responsible for blowing out his or her sprinkler system water lines. All Residents must install a shutoff valve. If the Resident neglects to install a shutoff valve, SVEM will install the shutoff valve at the Resident’s expense.

8. Water Schedule - SVEM wants to be “Green” and conserve water as much as possible. Please follow the water schedule and water a maximum of 20 minutes in one location. Water pressure remains in the pipelines after watering lawns. To ensure that this residual water does not leak into the yard, turn off the irrigation water riser until the pressure drops.

1. Each street is assigned specific days and hours for watering. The watering

schedule is posted on the community bulletin boards, as well as on the next page.

2. The Ditch Rider determines when water is available to SVE. Shiloh Village

Estates Management has no control if the ditch rider determines that water will not be available on your scheduled water day.

3. Shiloh Village Estates Management retains the right to water any neglected

lawns. Shiloh Village Estates Management will post a notice on the door of the mobile that the lawn must be watered in 24-hours. If the 24-hour notice period expires, SVEM will water the yard for a fee of $20.00. This fee must be included with the following month’s rent.

4. The water schedule is as follows:

G. Vehicles and Parking G.1. Resident’s Vehicles

A. The maximum number of vehicles allowed per rental space is TWO (2).

1. Three-car Driveway

a. Residents may have an extra concrete pad driveway for a third car;

however, before construction of an extra concrete pad may begin, Residents must discuss their plans with SVEM to ensure the driveway will not cross neighboring boundaries or cover any water lines, water risers, gas, electrical or telephone lines. Following approval of the plans, Residents must contact SVEM to request utility markings 7 days prior to construction.

b. The Resident is responsible for all costs incurred for the construction of

a third driveway. c. There is no additional third-vehicle rent for Residents with a three-car

driveway.

2. Two-car Driveway

a. Only two (2) vehicles may be parked on a two-car driveway. A violation will be issued if there are three or more cars parked on a two-car driveway.

b. Residents with a two-car driveway may have a third vehicle only if all of

the following conditions are met: i. Management approves a third vehicle for business or third driver only ii. The Resident pays a monthly fee of $35.00 iii. The third vehicle displays a SVE parking tag at all times iv. The third vehicle is parked in a parking lot in SVE (see location of

Parking Lots in SVE below) after 10:00 p.m. A violation is issued if a Resident’s third business car or third driver is parked on the streets after 10:00 p.m.

B. All vehicles must be titled to the Residents of SVE. Vehicles not titled under

the Resident’s name are not permitted to park in SVE.

C. All Resident vehicles must be registered at the office. D. All Resident vehicles must have a parking permit. This permit must be

displayed at all times in the lower right-hand corner of the passenger-side rear window.

E. Residents must park all vehicles in their specified driveways. F. Residents may park only cars, pickups, and vans in their driveway. Semi-

trucks are not allowed in the SVE community. Semi-trucks parked on the city streets may be ticketed by the city of Billings.

G. If a motorcycle is a second vehicle, it may be parked in the driveway;

otherwise, it must be parked in shed, garage, or guest parking lot. During the winter, the motorcycle must be covered if it is stored in a carport.

H. Recreational vehicles (RVs) may not be parked in driveways. The only

exception to this rule is when loading or unloading the RV. I. Unused or unlicensed vehicles are not allowed in SVE.

J. Vehicles may not be parked on SVE streets after 10:00PM. All guest vehicles

must be parked in a guest lot by 10:00 PM. K. Vehicles in violation of these Rules and Regulations may be removed at the

discretion of SVEM, and at the risk and expense of the vehicle’s owner. All charges for such removal shall be paid by the Resident before the next rental payment is due.

A. Driveways, streets, and parking lots must be kept clean from stains from oil,

gasoline, anti-freeze, windshield fluid, etc. Vehicles causing any such stains must be repaired immediately to prevent damage to the property. Residents must clean all toxic materials within twenty-four (24) hours or a violation will be issued. Cleaners such as Purple Power®, Pour N Restore®, Krud Kutter®, Dawn®, and cat litter are permitted to remove oil from concrete. Please notify the office if you find a better product for cleaning oil spills.

B. Residents are responsible for damage to SVE roads caused by their guests’

vehicles, and must clean up all fluids stains as a result of leaky guest vehicles. C. Major automotive repairs or changing motor oil is not permitted. D. Washing vehicles, trailers or boats with city water is not permitted. E. All vehicles parked in SVE must be in operable condition. Vehicles with flat

tires, broken windows and/or vehicles that are wrecked or significantly damaged (in need of repair) may not be parked in SVE.

F. Cars with damaged or missing mufflers are not permitted on SVE streets.

G.3. Parking Lots

A. Overnight parking on SVE streets is not permitted; all cars must be off the streets by 10:00 p.m.

Guest vehicles must park in the driveway of their host by 10:00 p.m.

Guest vehicles may park in SVE lots if room does not permit in the host driveway.

B. Parking lots are to be used for the following:

Visitor/guest vehicles

A third vehicle for a 2-car driveway that is approved by SVEM.

C. Shiloh Village Estates provides nine (9) parking lots for use by guests and for approved third vehicles. Please refer to pages 53 and 54 for maps of the parking lot:

D. Please inform SVEM of any guest vehicles that will be on SVE property for

more than three (3) days to ensure that the vehicles are not tagged for violation.

E. Trailers, buses, large trucks, semi-trucks, horse/boat trailers and/or equipment

from company businesses are not permitted in SVE parking lots. F. The speed limit in SVE is 15 miles per hour.

G.4. Storage for Recreational Vehicles (RVs) Shiloh Village Estates provides storage for recreational vehicles (RV) at a cost of $50.00 per month. Spaces are rented upon availability and are for Resident use only. A. Residents are responsible for their vehicles in storage. Shiloh Village Estates

assumes no liability for vehicles in storage on the premises. B. For existing Residents who currently have rented storage space and would like

to continue renting space:

1. Storage spaces continue to be available for $50.00 per month per space. 2. There is a $10.00 fee for a lost storage key.

3. The storage gates are to remain locked at all times. Please remember to

lock the gates. All vehicles are to be locked and each Resident is responsible for any theft or damage to vehicles in storage.

4. Recreational vehicles must be seven (7) spaces away from the machinery

shed on the north side.

5. Spaces are designated by SVEM.

6. Recreational vehicles must park three (3) feet away from the fence. All RV’s must have blocks behind the wheels to prevent movement while parked.

7. All storage items need to have a permit tag visible to SVEM when

being stored in the storage area.

C. Residents who no longer require the RV storage space must return the keys to the SVE Office no later than the last day of the month. 1. The Resident must return the key in an envelope labeled with Resident

name, address, and storage space number on the envelope on the last day

they want storage to stop; the envelope must be dropped off in the rent slot box.

2. If the key is not dropped off in the rent slot box by the last day of the

month, the Resident is charged for an additional month’s storage. Storage parking is not prorated for a partial month.

3. The parking tag from the stored vehicle must be removed; storage is no

longer available for this Resident. D. Recreational vehicles may not park in the Resident’s driveway, behind the

mobile, shed, or near/between the concrete wall North of Swallow lane, or in the SVE parking lots. This includes, but is not limited to, the following RVs:

Pickups/trucks with a shell or camper over 12” (inches) higher than the pickup’s cab

Boats

Trailers

Jet Skis

RV-Vans (Mobile Home)

Fifth-Wheelers

Three-Wheelers and Four-Wheelers

Snowmobiles

Horse and Utility Trailers

Canoes, pontoons, camping gear E. Recreational vehicles may be parked in a closed carport or garage. F. Residents are allowed two (2) days to prepare their RV for departure or prepare

their RV for storage upon return. Residents must respect this mandatory two-day limit. Please contact SVEM for an additional three-day extension if any problems arise (i.e.: cleaning, repairs, leaving for winter, etc.) that prevent removal of the RV. After a total of four (4) days, the RV must be removed from SVE.

During the above loading and unloading time, the RV may be parked in the following locations:

1. Resident driveway; OR 2. Shiloh’s parking lot (only if the RV does not fit in the Resident’s driveway)

G. Please inform SVEM of any guest RVs on the property. Shiloh Village Estates Management will find a parking space for the RV; however, the maximum stay for a “guest” RV is seven (7) days. Hookups for guest RVs are not provided at SVE; violations will be issued if connected to the Resident mobile.

H. Recreational Hall H.1. The Recreation Hall located at the SVE Office may only be used for coffee on

Wednesday mornings at 10:00 am by Shiloh Residents and for the Annual Christmas Dinner.

H.2. The Recreational Hall will no longer be available to rent due to liability.

I. Recreational Parks I.1. Dogs are not allowed in our recreational park.

I.2. There are a total of 10 parks in Shiloh Village Estates: 1. Gierke Park 2. Nesting Place Park (on the North and East side of the storage area) 3. Davis Park 4. Miller Park 5. Shiloh Entrance Park (South side of Shiloh road entrance) 6. Pump House Park 7. King Park (North side of Shiloh road entrance) 8. Horseshoe Park 9. South 38st West Park 10. Rec Hall and Victorian Rental House Park (between the 2 buildings) These parks can be located on the maps placed at the end of this booklet.

J. Moving from SVE or Selling

J.1. SVEM must be notified as far in advance as possible of intentions to vacate a space. A minimum 30-day notice to vacate must be provided to management when a Resident plans to move out.

J.2. The Intention to Move Out and Terminate Rental Agreement Form needs to be picked up at the office prior to moving or selling. This form must be completed and signed by the Resident and personally delivered or mailed by certificate of mailing to SVEM. This form includes the name and address of the departing Resident, the date the notice was delivered or mailed to SVEM, the departure date, a current phone number, and the Resident’s new forwarding address. Once SVEM receives this form, SVEM reserves the right to then inspect the mobile within fourteen (14) days of receiving the Intention to Move Out and Terminate Rental Agreement Form. This form determines whether or not the mobile will remain at SVE. NO FOR SALE SIGN WILL BE ALLOWED TO BE POSTED PRIOR TO INSPECTION. The Resident will then be informed of this inspection either by mail or hand delivered.

J.3. In the instance that SVEM inspects the mobile and the mobile is no longer appropriate (out of date) to stay in SVE as notified on the Inspection Form the Resident must then come to the office or fill out the Moving Out Notification form in the back of this booklet entitled Moving Out

Notification. This form is for the purpose of informing the current Resident that they are still responsible for their unit until the unit is removed from SVE property. In addition the following must be complied with: The Resident is allowed to keep their mobile on the SVE property until the mobile is sold. The Resident will remain responsible for lot rent as well as maintaining the lot. Once the mobile is sold the Resident has no more than thirty (30) days to make arrangement to have the mobile removed from SVE property. The Resident will ensure that the lot is completely cleaned and all debris is gone after the mobile is removed. A security deposit may be returned in full within thirty (30) days should SVEM find the lot space to be sufficient after the mobile has be removed from the lot. The Rental Agreement is not terminated with the current Resident until the mobile and all personal property is removed from the space. All mobiles must be maintained as per SVE Booklet of Rules and Regulations; however, if cost of improvements or renovations of a mobile is unreasonable, the mobile must then be sold and removed from SVE.

J.4. For Residents that would like to sell their mobile and keep it in SVE; the Resident will receive the Inspection Form back from SVEM informing the Resident of what updates need to happen prior to a “For Sale” sign being posted. Once the “needs” as listed on the Inspection Form have been satisfied the Resident will need to notify SVEM so that they can come out and inspect it. SVEM will let the Resident know by a phone whether or not there are any other items that need to be addressed and will then allow the Resident to post a “For Sale” either in the front window or the front yard of the mobile.

J.5. Both the Intention to Move Out and Terminate Rental Agreement and Inspection Form forms are good for one (1) year. If a mobile has not been sold within a year, new forms must be completed.

J.6. The Resident must provide written notice to SVEM at least 48 hours in advance before the Resident moves a mobile either in or out of SVE.

A. PLEASE NOTE: The 48-hour notice provides time for an employee of SVE

to be present during the removal/arrival of the mobile. This allows SVE employee time to flag the lot space and watch that sewer/city/irrigation riser to not be broken. In addition, the SVE employee must turn on/off the water below the ground so the movers can disconnect the water line from the mobile.

B. The Resident must notify SVEM the name of the moving company to be

hired by the Resident. A Mover Information Form will be provided to the Resident and must be returned to SVEM no later than 48 hours before the Resident moves a mobile either in or out of SVE. A moving company will not be allowed on SVE until a completed Mover Information Form is provided to SVEM and proof of the Mover’s Insurance. All movers must

provide a copy of their up-to-date insurance. This information must be given to SVEM before beginning the moving process.

J.7. In the event that the mover hired by the Resident causes damages to the property of SVE or property of other Residents, the Resident and the hired mover will be fully responsible for the repair and cost of the damages.

J.8. Trees, shrubs, grass, etc. are to be in good condition upon departure. The lawn must be well-maintained and the grass kept under four (4) inches. If the space is left with more than 4-inch grass, SVEM will issue a 24-hour notice. If the 24-hour notice period expires and the grass has not yet been mowed, SVE will mow and trim the yard at a fee of $20.00, which is due with the following month’s rent.

J.9. Once the mobile has been removed from the space, the departing Resident must disconnect the main electrical wire from between the pedestal and the mobile. SVE is not held responsible for supplying the 200amp breaker that is needed to be in the electrical pedestal.

J.10. Rent is not prorated for a partial month’s occupancy.

J.11. The security deposit follows the provision of Montana state law and will be mailed to a forwarding address the Resident who signed the original contract and title of the mobile gave to SVE. If a forwarding address has not been provided then SVEM will mail it to the current address.

K. Summary of SVE Resident Responsibilities:

Residents are responsible for the cost and maintenance of the following*:

Pedestal and/or electrical breakers

Individual USPS mailboxes and keys

Handicap mailboxes at their residents

Gate entrance keys and replacement of gate entrance keys

Individual lot trees, shrubs, bushes and/or grass

Sprinkler systems

Yard (NO DECORATIVE BARK OR WOODCHIPS PERMITTED)

City water riser and irrigation water riser above the ground and blow their own sprinkler system out for the system.

Street lights, including those that they convert to solar motion lights

Hook-ups to MDU, NWE, and REA
