To whom it may concern:

The Executive Board of the City of Rochester, N.Y., by authority conferred upon it by Sections J.i�. l/i9, 160, 161, and other sections of the Charter of said

City, does hereby ordain and establish the followiug rules and n•gulations relating to the protection, con­trol and roanagemPnt of the RochesterWatel' Works,

and the use of water supplied therefrom, and does also establish tbe annexed schedule of rates to be paid for

the uses of water therein indicated, when supplied from said water works.

The said rules, regulations and rates shall become operative on the first day of l\fay, 18!)0, and so con­tinue during the pleasure of the Executive Board.

J.

RULES, PART OF CONTRACT.

The followinJiC rules shall be considered a part of the contract with every person who takes water supplied

by the Rochester, N. Y .. Water Works, and every such person taking the water shall be considered as having expressed his consent to be bound thereby, and whenever any one of the said rules is violated, the right is reserved to cut off the water without

notice, and the person whose water is thus cut off shall forfeit all payments made, and the water shall not be turned on again until all unpaid rents and charges are paid, together with a charge of $2 for turning the same on again. And in case the violation of any rule is discovered previous to turning on the

water, then the water shall not be turned on ·said premises until the rules are fully complied with.

II.

APPLICATION.

A. All persons desiring a wat.er supply from the

water works, must first make a written or printed application at the wa.t.er office, eta.ting fully the �evera.l and various uses for which the water is wanted and the name of the licensed plumber selrcted by the said owner to do the work of introducing the water. Such application must be signed by the owner of thfl prem­ises or his duly authorized attorney, whereupon a

permit to perform the sai<l work, and no other, will be issued to said named licensed plumber, �pecifying

the particular uses thus applied for.

B. In case the owner shall thereafter desire anyadditional service pipe or plurubing fixture, or the discontinuance of any particular use or fixture, a fur­ther application must be made by him as aforemid, when an additional permit wiJI be issued by the ,vater Registrar covering and authorizing the eatd <let.ired

change in fixtures 0r use of water.

c. In case the owner at any lime d&!ires to discon­tinue the use of water from any service, he must make an application for that purpose in writing at the water office, and after the date of said application the water rents accruing from said service Rb�ll cease for the period during which said service shall be shut off, providing the period of said discontinuance shall not

be lesa than three calendar months.

D. In case the owner at any time desires the waterturned on again to any premises after the same has been shut off on his application or from any other cause, he shall in like manner make an application in writing therefor at the water office, and water rents thereon will accrue from the date of said application.

K. Any permit issued from the Water Departmentfor the opening of the street for the introduction of a water service into any premises, shall not be construed as granting permission to lay a private lateral or other sewer in the trench thus opened, but in all cases a permit must be obtained in regular form from the Street Department for the laying of said sewer.

III.

GENERAL CONDITIONS Am> RESTRICTIONS.

A. All of the expense attending the introduction ofwater from the street main into any premises, except for tapping the main, muet be paid by the applicant.

B. The plumber thus named and designated by theowner of the premises will be considered as the agent of said owner while employed in the prosecution of the work of introducing the water into the said prem­ises and will not be recognized as in any sen se the agent of the Executive .Hoard or of the City of Roch­ester; neither will said Board nor said City hold itself responsible for the acts of said plumber.

c. The Executive Board will determine the size oftap to be inserted in any water main under any appli­cation and permit, and will furnish each of said taps

at the expense of the applicant, to be paid for on delivery.

D. The work of inserting taps in any cast iron watermain shall be performed only by persons E,ruployed by the Executive Board and designated for that duty, and the said work of tapping shall be done without cost to the applicant,

E. The work of ineerting tees, branches or taps inwrought iron water mains shall be done under the immediate direction of persons in the employment of the Executive Board, but at the expense of the owner or applicant.

F. Owners desiring to introduce a water Fervicepipe into their premises from a main paeeing said premises along any frant thereof will be required to extend said service at right angles with said pipe main to the inside of the curb line of the street, at which point a metallic curb-cock and curb-box, of such form and construction as may be approved by the Executive Board, shall be connl!<'ted and inserted, said box to contain a stub-wrench securely attached at the bottom to the handle of the curb-cock, and the top of same to extend to a point within a few icches of the under side of the cover of 1<aid box. The top of the cover of the curb-bo:-- shall be placed at the grade of the sidewalk of the street, and underneath said cover shall be placi>d a cast-iron block not less than six inches square and one half inch thick, of such form aud design as may be approved by the Executive Board, and having a hole through the cen­

ter thereof through which the barrel of the curb-box 1,hall be introduced or strung on.

o. Owners desiring to introduce water into prem­ises, along any front of which wat.er mains have not yet been laid, must make application therefor to the Executive Board and in case a permit is granted, the said Board will furnish it map or other explicit direc­tions in detail in regard to the.point of attachment to the stJ·eet main, the method of attachment, the posi­tion and depth which said service must occupy iu the Rtreet, and all the attachments and appurtenances which are required for the proper control and man­agement of said service, and also the material of which it shall be composed, all of which directions must be fully complied witl,. The owner and plumber

will also be required to see that the trench for said service is not refilled until fully inspected by an em­ployee of the Executive Board, de�ignat.ed by it for that purpose.

II. The owner receiving a permit for the introduc­tion of a water service into his premises, and the plumber domg the work, will be required to cuuse said service to be placed not less than four and one­half feet below the surface of the earth at any point between the wa�r main in the street and the inside of the foundation wall of the building into which the water Btlrvice is introduced,and, in case the final grade of the street has been officially determined and estab­lished, then said service pipe shall be laid at a depth of not less than four and one-half feet below said established grade at all points in said street, so that when tl1e street is graded there shall not be less than four and one-half feet covering of earth over it at any point. Information as to the established grade of any

street in which a service is to be introduced shall be sought at the water works engineer's office, provided there exists any doubt or question in the matter.

1. No person Rhall be allowed to open any trench in the streets of the city for the purpo�e of laying any servic�connection with the water works of i:;aid city, neither make any attachnwnt to, nor alteration in any water service pipe in advance of receiving a written or printed permit therefor from the \\'ater \Vorks Department, and if the work embraced there­in iti not completed and a return of the work done made by the plumber within four weeks from the date of the permit, the said permit will be cancelled, but may be renewed on the written request of the said plumber.

J, No water pipe which is to operate as a water

main shall be laid in the same trench with a street sewer, either public or private, and no water service pipe shall be laid in the Rame trench with a lateral sewer, unless it shall be laid at the bottom of said sewer trei: ch and arranged so as to be easily accessi­ble and to the satisfaction of the Service Pipe Inspec­tor and the Executive Board.

K. Whenever any street or public ground shall be opened for making a connection with, or for laying any water pipe or fhtures. public eafety and conven­ience shall be duly regarded and conserved by the construction of such number of bridg 0s across said trench as may be required to accommodate the public safety and business, a.nd that of adjacent ownerb,and by the erection of barricades, suspension of red signal

lights and all such other protections as may be re­quired by the Water Service Inspector or by any city ordinance. The penalty for a. violation of this rule shall be $25.

L. The back-filling of any water service trench inany street or public ground sba.11 not be commenced until tl.ae service shall be inspected, measured a.nd accepted by some authorized agent of the \Vater Works Department. Said ha.ck-filling shall be thor­oughly settled with rammers or pounders to such an extent that all the earth which shall have been re­moved Rball be fully replaced in the trench and not

left rounded above the surface of the street, and in case the trench wi11 receive more earth than was ob­tained from the excavation therefrom, then other material of a proper and satisfactory quality shall be furnished and pounded in, and the pavement or other surface improvement shall be replaced within twenty­four hours from the time the connection is made, and the street shall be left in as good and satisfactory con­dition as before the excavation was commenced. All refuse or survlue earth, timber, stone or other mate­rial shall be fully and entirely re;moved from the street immediately by the owner or his plumber.

M. During the months of May, June, July, August,September and October, the back filling in the water service trenches must be settled by ramming and pounding: as aforesaid, as no settling by flushing or flooding with water from the water mains will be allowed. And if a water service trench is not prop­erly refilled as provided by this rule, or if it settles

thereafter, the Executive Board may cause it lo be properly repaired without notice; and if sueh repair

occurs witnin the space of six months afwr the com­pletion of the refilling by the plumber, then all the CO!'t of such repair shall bo collected of said plumber, and if he shall fail to pay the i.;ame promptly on de­

mand, his license shall be revokell. In ei:stimating the said period of six months during which the plumber shall be liable for repairs as afort•i<aid, the period between �ovember 1:ith and April 1:ith shall be excluded. If said repair becomes neces.�ry aftttr

a period of six months has elapsed from the time of refillmg the trench by the plumber, then such repair shall become a charge against the property which is supplied with water by said service.

N. The owner ot the property into which water isintroduced by a service pipe, will be required to main­tain in perfect order and repair, at hit1 own expense, the said service pipe and its fixture<i and appurten­ances, from the curb-cock controlling 88id S('rvice to

and into his premi�eff. including all fixtures therein provided for delivering or supplying water for any purpose, and in case said service and fixtures are not so kept in perfect repair. the Executive Board may cut off the supply of water therefrom without notice, or may cause said !lervice nnd fixtures to be repairt.-d and collect the expense of the same from the owner.

o. The City of Roche:;ter will maintain nnd repaireach lead water service supplying city water to prem­iaes, between the w1iter main and the curb cock con­trolling the service, pro,·id i ng the same is in the road­

way of the street; providing also, that said service has

been inserted in full compliance with the rules govern­

ing the introduction of the said water, and providing the failure of said service or the injury thereto render­ing repair necessary does not result from some im­proper act or omission on the part of the owner or occupant to protect the service inward from the curb, from injury from frost or otherwise, by which act or omiesion injury also results to that part of the service in the roadway of the street, in which latter case the owner shall pay the whole cost of the necessary re­

pairs thereto.

P. Service pipes, where extending into areas, must have the curb-cock secured against the improper use

of water, by such lock boxes or other protection as may be required by the Water Registrar, and the ex­pense thereof must be paid by the owner of the prem­ises. In all cases where the service pipe passes through areas or basements having windows, gratings or traps open to the weather, the said gratings shall be closely covered with plank, the windows kept closed with the panes of glass all properly set or the openings for same carefully stopped, and all other openings to the out11ide air fully closed during the

cold weather. In all exposed situations, whether in

areas or elsewhere, the service pipes and fixtures shall be properly WTapped with felt or other non-con­ducting substance and surrounded by a box packed also with non-conducting substance, if necessary to

protect said service from freezing. Sai<l protection shall be at the expense of the owner, and in case he

neglects to protect his service as aforesaid, the Exec­

utive Board may cut off the water therefrom without

notice, or may cause the work to be done and collect the cost thereof of the said owner.

Q. In inserting a water service into any premi�es.the following described appliances and materiah1 shall l>e used:

The said lead service shall have an excess of length of not less than six inches above the length required to connect the tap in the main anti the curb-cock, so as to produce a slack, the greater part of which �hall occur near the tap, which slack may be used up in case of any settling of the material used in back-filling

of the trench, without breaking the tap or service. The wipe, joints and nil other workmanship connected with said service shall be of the best character and Patisfnctory to the Executive Board.

:i. The m1rb-cock must be of brass of the best char­acter aDd workmanship and have a round waterway, with nut an1 wa<iber bottom, and of sucb form or pat­tern as may be approved by the Executive Board. Tbe curb-cock may be furnished b.r the plumber, but must first be taken to the Watl'r Department sbop and examined, approved and stamped or branded witb the letters R. W.W. by an agent designated by the Exec­utive Board for that purpose. In all cases, when a curb-stop exceed.I f-incb water-way, an approved double disc valve will be required to be used instead of the usual form ot'"stop.

4. Tbe curb-box must be a metallic box of a patternapproved by the Executive Board, and containing therein a. wrought iron stub-wrench, split at the bot­tom thereof and securely connected with the handle of the curb-cock as heretofore described.

5. The i;ervice from the curb-cock into the premisesmay be of lend, tin-lined lead or wrought iron pipe, of equal strength with the lead pipe heretofore df'sig­nated for �en ice pipes in the roadway of the street.

6. Just inside the basement wall of the building intowhich the service pipe extends, a stop and waste-cock shall he conveniently locited. and arranged so that tlw water may be drawn back and all the pipes within the bnihling emptied through said :.top and waste by opening the faucets at the highe,;t points therein and

allowing the air to enter said pipes. Said wnste must be kept open, in exposed situations, in cold weather, at all times when the service is not in use tor drawing water. When a water service pipe is intro­duced through exterior walls of masonry or brick work, they shall be surrouncled or pa.!'s throuih iron or , itrified tile pipe.-i of larger diameter, leaving an air t;pace all around the water service pipe.

7. All of the pipes conneded with the service insi<IPof the building shall be laid with an inclination toward the point in the basement where the stop and waste is located, without any sags or po<'kets, so that the pipes may thoroughly em.ty themselves from water when �id wattte is opened. But in cases where such sags or traps are unavoidable an additional stop and waste shall be put in.

8. The service pipes in the building should be lo­cated in the parts thereof best protected from frost, and should in no case be carried any considerable dis­tance alongside auy outside basement or cellar wall, and if practicable, should not extend any distance along said walls, but shoul<i be carried immediately under the bottom of the ba!lement or cellar to the cen­ter or least expotied point therein, previous to being carried upward into the uninhabited parts of the buildin�.

9. All of the parts of the water service inside tbebuilding, and the fixtures and appurtenances con­nected therewith, shall be of such form, character and workmanship as is hereinafter described, or as may be appro,·ed by the Executh·e Board.

R. Water must not be allowed to run to waste to pre­vent the same from freezing in the service pipes or their attachments, or for the purpose of flushing soil pi�s or sewers, or for the purpose of procuring cooler water, or for any other purposes than those indicated in the application and permit for same, and which are allowed by the rules of the Executive Board. Any violation of this rule will subject the person violating the same to a penalty of $10 for each offense.

s. Water will be turned on to premises only afterthe plumber ha!\ made his return of the work done to the water office, as required by these rules, and after the applicant shall have signed a request for such turn-on in a book kept in the Water Registrar's office for that purpose. The curb-cock controlling any ser­vice shall not be left open by the plumber or any other person after connecting said service with the street main or after making any new extension or attachment in unoccupied premises, so that water may be supplied to said premises by said service, with· out a written permit from the water works office. But in ctUes where the work is a simple extension or additional attachment, in premises where the water is then in use, and where a permit bas been duly obtained for same, then the plumber may leave the water on the premises, and the owner will be charged for the additional use from the date of the application. The plumber, however. must promptly make his return as in other cases. The penalty for a violation of any part of this rule is $:i for each offense, and the revoca­tion of the plumber's license in the discretion of the Executive Board.

T. In all cases where boilers are supplied withwat(>r, a suitable safety or vacuum valve or other bUf­licient device must be applied, to prevent damage from collapse or explosion when the water is shut off from the street mains. It is underhtood and agreed that the Executi,·e Board and the <.:ity of Rochester will not be liable for any damage which may result to any person or premises, from the,-huttini:t off of the water from any water main or service. for any pur­pose wbq.tever, evPn in caees where no notice is given, and no deduction from water bills will be made in consequence thereof.

u. Permission will not be granted to supply two or more buildings frontin11: on the same stnet from a single tap, unless the service ehall be divided al the curb, and a separate service extended therefrom, con­trolled by a separate curb-cock for each rnrvice. In case only one of several buildings occupies the frontage of a single city lot, and the others are located in the rear of the said front building, then permission may be

granted to supply all of tLe said buildings from one service; but the owner will be required to give notice to the water office at the dale when either becomes vacant, and also the date when it i� again occupied, so that an i1ispection and verification may be made, otherwise no abatement for non-occupancy will be

made, and no abatement will be made in any such case unless the premkes on which abatement is claimed have been vacant continuously for a period of three calen(lar monthH.

v. In case a double house or other buihling frontingon any street is to be supplied with water, a separate

service to each from the curb, and controlled by a separate curb-cock will be requi1 ed, where the water renh1 are charged and collected on the basis of the 11;eneral annual schedule rates; but said double house or building may be supplied by a single ser'l'ice, in case the owner shall provide, set and maintain in good order, an approved water meter thereon, and pay for the water used at meter rates. The Executive Board, however, urgently advise separate services to each house, tenement or other building, so as to a.void future complications arising from the sale or division of the property. When water shall be sup­plied lo more than one party through a single tap, the bill for the whole supply will be made to the owner of the estate, and in case of non-payment, the water may be shut off, notwithstanding one or more of the parties may have paid their proportion to such owner or to any other party.

w. It is underdtood and agreed that the officers of the water works, their agents and assistants, may eater the premises of any water-taker, at any reason­able time, to examine the pipes and fixtures, the quantity of water u11ed and the manner of its use; and in case of fraudulent representation on the part of any water-taker, or unnecessary waste of water, the payment will be forfeited and the supply cut off.

x. In case of fire or an ala.rm of fire, or in makingrepails, or constructing new work, the Executive Board reserves the right to shut off the water from any consumer, without notice, and keep it ::;hut off as long as may be necel!Bnry.

Y. Stand-pipes, or pipeR for automatic suppressionof fires in buildings, which fixtures are only intended

for use in suppression of fires, will le permitted to be

attached to the water supply, and no charge will be

made for the use of water for that purpose; but all such pipes must be pro,ided � ith a suitable ,alve

outside of the building under the exclusi,e control of

the Water Department; also. in the case of stand­pipes, a valve must be provided, placed at the bottom of the stand-pipe, and at each hose opening, which valves shall be sealed by the ,vater Department. In case such seals shall be broken for the extinguish­

ment of any fire, the party breaking the seal shall immediately thereafter give notice at the water office, the valve be again resealed, and in case of a violation

of this rule, the party viola ting the same shall be sub­

ject to a penalty of not less than $10 for each offense. And in case such seal shall be broken for any other

purpose or use, or any tap be introduced into, or con·

nection made with said stand-pipe, the party so

offending shall be subjected to a fine of not exceeding $200. No stand-pipe or other fixture for fire protec­

tion will be allowed in premises where the water is not taken for other.than fire purposes, and the Exec­utive Board reserves the right to refuse any or aJI applications for purely tire protection uses, in its dis­

cretion.

z. The Executive Board reserves the right to liruit

the amou1,t of water furnished to any customer should

circumstances seem to warrant such action. although

no limit may be stated in the application or permit for such use; or said Board may entirely cut off the use

for any manufacturing purpose, or any use for supply­ing power, at any time, by giving reasonable notice to the consumer of such intended action.

IV.

PAYMENT OP RATES,

A. All water bills made on the basis of annual sched­ule rates, shall be p<1yable annually, in advance, on the first day of May ; but if in any case water rents shall not accrue in any year until after the first day of May, then said rents shall become due and payable at the date when the water is turned on the premises, for the period remaining from said date to the first day

of Mav following. And all bills for metered or esti­mated quantities of water shall be payable quarterly, on the first days of May, August, Novembet· and Feb­ruary, in each year; but bills for metered water will be furnished monthly for the information of owners of property in which said metered water is used. The

bills for water which is paid for at annual schedule rates, will not be sent to the owner or consumer, but will be furnished to him only on aJ,plication at the water office.

B. To the amount of all meter bills which are not paid during the calendar month in which they become

due, an addition of one per cent. shall be made on the first day of each succeeding month, up to and includ­ing May 1st, when all meter bills then due and unpaid except the meter bills for the quarter immediately pre­ceding and ending at that date, shall, with interest aduerl at the rate of ten per cent. per annum, be re-

era! city tax levy, as an assessment against the prop­erty on which said rents have accrued, as provided by the City Charter .

. J. No rebate shall be made from established rates on any bill, except with the concurrence of a majority of the Executive Bpard ; and the Clerk shall keep a record of the action of the Board in such rase11.

K. Parties in front of whose premises public water roams are laid, who take water from attachments located on and provided for other premises, or from attachments maintained by the city, shall be charged fifty per cent. in addition to regular schedule rates. But in case public water mains are not la.id in front of said premises, then the regular schedule rates shall be charged for water obtained eloewhere.

V.

METERS.

A. The Executive Board reserves the right to attacha meter to any service pipe, at any time whenever it shall deem it expedient so to do, and thereafter charge for the quantity of water measured or URed, in­stead of the yearly schedule rates before charged, but in all such cases the minimwn yearly rates thus paid shall amount to �r,. water or steam setting back from a boiler, shall be paid to the Executive Board on demand. And in case said payment is not so made, it is understood and agreed that the water may be cut off from said prem­ises without notice and will not be turned on again until all charges are paid. The Executive Board may also sue for and collect of the ow�er or tenant, the amount C!f such damage in a civil action.

B. Owners of premises may make application to theExecutive Board, to procure and set an approved meter, at their own expense, and thereafter pay for the water used at meter rates, provided that the ag­gregate rates collected for the year fror.i the water passing through the said meter, shall not be less than $5, The owner shall also be required to maintain said meter in good and perfect order and repair, at his own expense.

c. All persons are hereby forbidden to interferewith or remove a water mi,ter from any service, after it has been attached by order or permit of the Execu­tive Board, under a penalty of $10 for each offense.

D. The Executive Board will require that all metersset by it, upon any service, shall be properly boxed and protected from frost where necessary, after which the owner and tenant will be required to maintain said protection in good and effective order, and to provide means of ready and convenient acces3 to said meter, so that it may be frequemly examined and read by the agents of the Water Department. The owntir and tenant of the premises will also be required to prop­erly and fully protect the servic� pipe and its fixtures,

leading to or connected with said meter, from frost, so that said meter shall not be injured thereby. This protection shall consist in wrapping and boxing said service pipe, as heretofore described, and by prevent­ing cold air from entering thereto through windows, traps or gratings, as also heretofore enumerated, and by the construction of a vault if necessary. On failure of the owner or tenant to observe this rule the Executive Boa.rd will cut off said service.

E. In cases where a barn or stable is suppliedwith water from the same service which supplies a dwelling or other building with cellar or warm base­ment, the service shall first pass into the cellar of the dwelling or building before branching to the barn, for convenience and safety, in placing a meter to cover the whole premises.

F. When ser,•ices enter premises which the Exec­utive Board desire to meter. the owner or occupant will be required to construct at his own expense, such vaults or make such other constructions and ar­rangements as will prevent the freezing of said meter and as are satisfactory to the said Executive Board.

VI.

WATER ELEVATORS AND OTBER MOTORS.

A. Permits will be granted in certain cases, onspecial application to the Executive Board for sup­plying water from the city mains for furnishing light power for elevators, printing officPs and other pur­po>1es, under the following conditions :

and the work must be performed undor its direction. 2. In all cases a gate or valve, CO'ltrolling the ser­

vice, must be located in the roadway of the street. accessible only to the Water Department.

3. The connection with the main water pipe must inall cases be made by the emplc,ye.; of the Water Dr­partment.

4. The eervice supplying the motor must haveattached to it an approved water meter, or other appliance which shall correctly and automatically reg­ister the quantity of water which pall�es through said service.

5. All of the expense of in8erling ea.id service andits appliances, as well as the cost of maintaining the same in complete and perfect order, shall be paid by the applicant.

6. The charges for water will be at meter rates,and will be due and payable at the limes and in the manner prescribed for water supplied and measured by meter.

'i. In case the owner of the premifes, at any time, fails to cause prompt repairs to be made to said ser­vice, or to the measuring apparatus, or to any fixture connected with said service, the Executive Board will cut off said water, or cause the necessary repairs to be made, and collect the same of the owner or tenant.

USE OF WATER IN XVTll AN'O XVIT!l WARDS,

A. Parties owning property in the Fifteenth and Sixteenth \Vards, and which is not liable to taxation for the water works debt, will be allowed to use water from the city water works under the following conditions:

The senice which is intended to supply suchwater, and all the appliances and appurtenances con. nected therewith, as well a>1 the work of attaching and laying the same, must be or the character and design directed by the Executive Board, and must be put in under the direction of, and to the satisfaction of said Board.

D. The whole cost of inserting the service and making the connection with the water main must be paid by the applicant.

E. The applicant for use of said water will berequired to pay into the water office, in addition to the regular schedule rates for water, such percentage on f>ach dollar of the asseebetl valuation of the property on which the water is used, as may be determined from time to time by the City Assessors, as the per­centage necessary to be assessed on the property of the city in the old fourteen wards thereof, to provide for the water works debt.

F. Each of said owners of property making appli­cation for the use of water as aforesaid, before said application is granted, will be required to sign a peti­tion, in the usual form, addressed to the Common

Council, asking that a public water main be extended in the particular street on which said water is desired to be used ; the intention being that his said signature shall become part of a majority petition on said street in compliance with the terms of the Charter, to become operative when said public main is laid.

o. ,vhenever the Common Council or the Execu­tive Board shall deem it necessary to extend a public water main in any street in the Ftfteenth and Six­teenth Wards in advance ofa majority petition there­

for, for the purpose of securing increased fire protec­tion, or better circulation and supply of water, and said public water main is thus actually extended. thereby providing full fire protection and facilities for using the water therefrom on said street, then the city lots fronting on the street in which said main is thus laid shall be subject to the frontage tax of three cents per lineal foot, as provided by Section 5, Chapter 120, of the Laws of 1882.

VIII.

PENALTIES AND FI

NES.

A. No person or corporation shall perform any actby which any fire hydrant or fire plug connected with the Rochester Water Works shall be covered or hid­den from view by snow, ice, lumber, brick, stone, earth, ashes or any other substance or material, or by which said hydrant or fire plug shall be rendered dif­ficult of access or operation, for the purpose of attach­ing hose thereto, or for any other useful purpose; and no person shall bitch, tic, fasten or attach any horse, team or animal to any fire hydrant, or other attach-

ment or appliance of the water works, neither shall open nor interfere with the hydrants, valves, or other water works fixtures of thi!I city, for any purp06e other than for extinguishing fires, flushing sewers or

pipes, or for regular rity improvements, made under ordinances of the Common Council, or repairs or i.m. provements ordered by the Executive Board,and then only after having obtained specific authority from said

Board !or such use. Violations of this rule shall sub­ject the offender to a penalty of $25 for each offense. The Clerk of the Executive .Board, the Chief Engi­

neer of the Fire Department, the Superintendent of Streets, and the Chief Engineer of the Rochester

"'ater \Vorks, are either of them hereby authorized and directed to prosecute, in behalf of the Executive Board, any parties who may ,iolate this rule.

or detached buildings up on a singlo undivided city lot, from a. faucet, garden hydrant, hose bibb or hose attachment affixed or prop�rly belonging to only one of said buildings, a special permit for 1 he use of the city water by the occupants of such othtr buildings, will be granted by the Executive Board, only upon the following conditions:

1. Not more than one faucet, hydrant or hose bibb shall be used for this purpose.

2. This single faucet, hydrant or hose bibb shall be

securely enclosed and become accessible only by means of a proper lock and key.

8. Acceea to said faucet, hydrant, ur hose bibb, and a key to the lock of the enclosure of the same, shall be furnished only to the parties named in the permit.

4. The owner of the premises will be held responsi­

ble for all unauthorized use or waste of the water, a.nd in case any unauthorized use or waste of the water is discovered, the permit will be at once revoked and the water cut off without notice, and the same will not again be turned on until all charges for un­authorized use or waste have been paid, together with

a charge of $3 for turning oo the water.

erence to the assessed valuation, provided that the occupants of all ol said buildings t1hall be charged for water as herein stated.

1. In cases where it becomes advisable or neces·sary to supply the city water to a number of separate or detached buildings upon a single undivided city lot, or upon several contiguous lots belonging to the same owner, a special permit for the use of said water by the occupants of all of said buildings Crom a single faucet, garden hydrant or hose-bibb, conven­iently located upon said premises, will be granted by the Executive Board, upon the same conditions as enumerated in the foregoing, under Section H.

J. The conditions under wbich such special per­mits for the use of the water will be granted are as follows:

1. When only one of the group of separate or de­

tached buildings as aforesaid fronts upon the street provided with a water main.

2. When the buildings aforesaid are constructed

without proper cellars. 3. When from any other causes such a method of

,mpplying water becomes, in the opinion of the Ex· ecuti,e Board, expedient and legitimate.

K A family is herein understood as meaning a single distinct household, consisting of two or more persons who cook, eat, wash and live apart from the other occupants of the same building or tenement.

XI.

!',HOPS ANO MANUFACTORJES.

A. In all buildings, occupied as shops and manu-

factories, fronting on any street in which public water mains have been extended, and into any por­tion of which buildings the city water is introduced, schedule rates will be charged for each employee, even though direct acceBB to said water for all employes is not provided.

B. In all shops and manufactories located in therear of other buildings in which city water has been introduced, both or all of which are located on an un­divided city lot, schedule rates will be charged for each operative in said rear shops or manufactories, even though the water has not actually been introduced therein, but a special charge for said rear shop or manufactory, in addition to the charge for each op1:,r. a1ive, shall not be made unless it shall appear that the water is actually used therein for such special purpose.

XU.

BARNS.

A. All barns or stables, having water attachmentsof any kind connected with the city water works, either inside, or outside adjacent to them, shall be charged schedule rates for the uses of water therein, including the charge for attachments.

B. In cases where no water attachments have beenspecifically provided for barns or stables, either in­side, or outside adjacent to them, and there are ex­isting accessible outside attachments connected with, or provided for dwellings or buildings on the same undivided city lot, located within 2.50 feet of said baru or stable, then schedule rates will be charged

for animals only which may be kept in said barn or stable, unless said outside accessible attachment is within fifty feet of said barn or stable, in which lalter case a charge will be made for the attachment also.

c. In cases where no water attachments have beenspecifically provided for barns or stables, either in­side, or outside adjacent to them, and there are no existing accessible outside attachments located on the same undivided city lot within 250 feet of said barn or stable, then no charge will be made for said barn or stable.

D. In cases where no water attach men ts connectedwith the city mains have been specifically provided for barns or sta,blee, either inside, or outside adjacent to them, and there are no existing accessible outside attachments located on the same undivided city lot. located within fifty feet or said barns or stables, and there !'xists inside said barn or immediately adjacent thereto, a suitabftl well,containing an unfailmg supply of goocf'water,and said well and itd, fixtures are main­tained in good working ordt'r, then no charge will be made for such barns or stables, unless it shall appear that water is actually supplied from the city water works for uses connected with said barn.

XIII.

SPRINKLL.',0. A. Permits will be granted for hose attachments to

the city water works, to be uaed for street, lawn and garden sprinkling, under the following conditions:

1. Only on premises where water is taken and pa.id for, for domf'stic or other inside use.

2. The hose used for sprinkling must have an insidediameter of not exceeding three quarters of an inch, and the nozzle shall have an orifice not exceeding one quarter of an inch, and the use of leaky or defective hose is prohibited.

8. Sprinkling with hose will be allowed only from

May 1st to November 1st, and for one hour between 5 and 9 o'clock A. M., and for one hour between 5 and 8

o'clock P. M. 4. No person will be allowed t.o sprinkle adjoining

or opposite premises, nor use the water from the said hose attachment or through said hose for ant purpose not authorized by the terms agreed upon with the

Executive Board. 5. All persons having hose attachments are ex­

pressly prohibited from using such attachments for sprinkling during the progress of a fir�. provided they have knowledge of the fact in any way.

6. Fountain sprinklers, or hose attachments set upas jets, or kept running, except as is hereinbefore

specified, are prohibited. 7. A violation of any of the foregoing provisions of

Rule XIII, will subject the owner or occupant of the

premises to a penalty of $2 for each offense. B. In case dwellings or tenements are supplied with

a hose attachment in which there is no inside use, domestic rates will be charged in addition to sprink­ling rates, and in case water is carried through a hose or other pipe from said hose attachment into a tank or cistern on said premises, special rates will be added for all special uses, such as baths, water closets, uri.

c. In case a business place or block is supplied with a hose attachment unaccompanied with inside use, domestic rates will be added if the place or block is occupied by families, as well as special rates for stores, offices, saloons, etc., as the case may be, and in case water is carried from said hose attachment through a hose or other pipe, into a tank or cistern on the prem­ises, then special rates will be charged for all special uses, such as baths, water-closets, urinals, etc.

D. In case a thread attachment to the faucet fromwhich water is drawn for domestic use on any prem­ises is desired, for the sole purpose of using the same for attaching a filter, the owner will be required to sign an appliC,f!.tion containing a stipulation to the effect that the said thread attachment shall be used for no other purpose, which stipulation, if observed, shall exempt the said thread attachment from any special charge as a hose attachment. But in case the same shall at any time be used as a hose attachment for spriilkling, or for conveying water through a hose or other pipe without special permission from the Ex­ecutive Board, the owner will be required to pay for all uses to which the water has at any time been thus supplied, from the dat.e of the application and permit, together with a penalty of $8 for ea.ch violation of this provision of the rules.

E. Two hose attachments outside of any building located on any undi vidE>d city lot will be allowed with­out extra charge beyond the regular schedule rate per foot front for sprinkling,a.nd no additional charge will be made for the hose-bibbs inside the building, where ihe;r are paid for outside the building, but for each

additional hose-bibb over two, outside of the building, an extra charge will be made, but such attachments must not be used for any other purpose than sprink­ling.

F. In case11 where streets are sprinkled by carts,with water from the city water works, under an ordi­nance of the Common C',ouncil, the Executive Board will �ause sprinkling cart hydrants of an approved de­sign to be connected with the water mains at conven­ient locations, for the furnishing of water for that pur­pose, but the cost of the erection and maintel!ance of these hydrants will be collected from the fund raised for said sprinkling.

XIV.

FOU.NTAINS AND JETS.

A. Fountains and fountain jets outside of buildingsare allowed t.o be used for a period of not t.o exceed six hours per day, for six months in each year ; and any person using the water for this purpose for a longer period in each day, or during the year, may be charged in addition t.o the regular rates in proportion to the increased length of time in which the water it1 so used.

B. Fountain jets and aquaria inside a building willbe charged at the regular schedule of rates for a use extending during the whole year.

c. All fountains must be provided with such a dis­charge pipe for waste water, and other fixtures, as shall be satisfact.ory t.o the Executive Board.

D. The Executive Board reserves the right to dis-

continue the furnishing of water for fountain jets, at any time the public interests may seem to it, to require such action.

xv.

STEAM EXOINES AND BOILERS.

A. In all cases where steam boilers are supplied withwater from the city water works, the owner or con­sumer must see that a suitable safety valve, vacuum valve, or other proper device is applied to prevent danger from collapse or explosion when the water is shut off from the street mains.

B. The Executive Board, its employes, or the Cityof Rochester, s\)all not be liable for any damage re. sul ting from suddenly shutting off the supply of water from any stell.m boiler deriving its supply from the water works; but it is the intention of the Board, where practicable, to give suitable notice of such shuttinf off to the consumer.

c. The consumer shall, if required by the Water Department, submit and file in Faid department a verified statement from the maker of any steam boiler receiving its supply of water from the city water works, of its rated capacity in horse-power. In case this information is not accessible, however, the con­sumer may be required to furnish the certipcate of a steam expert (acceptable to the Executive Board,) as to said rated capacity or nominal horse-power, antl the charges for the use of water shall be based upon said statements. Where the foregoing requirements cannot be readily obtained, the horse-power of the steam boiler will be determined in general as follows:

every fifteen square feet of heating surface of said boiler will be considered as equivalent to one nominal horse-power. For example : In a horozontal tubular steam boiler having six hundred square feet of heat­ing surface, the rating will be for forty nominal horse­power. The heating surface will be computed as one­half the area of the cylindrical shell added to the ag­gregate area of the exterior surfaces of the tubes or flues of said boiler.

D. In oases of intermittent use of steam boilers, or where only a portion of the rated power is habitually used. the consumer may procure, attach and main­tain at his own cost, an approved meter, and there­after pay for the water used at meter rates.

XVI.

WATER CLOSETS AND C1U:s'ALS • .

A. The Executive Board recommends for use aswater closets only such appliances as are provided with waste preventing cisterns.

B. No form of hopper closet will be allowed, unlesseach such fixture or appliance shall be supplied with water from a. waste-preventing cistern or service box and the Board reserves the right to insist upon the use of such cisterns in certain other forms of closets also. While the bow ls of most closets are of the hop­per form, yet there is known to plumbers a class of closets operated in certain ways which are designated as "Hopper Closets," and a.re the subject of the fore­going rule. These closets may be kn'>wn by the fact that water is furnished to them through valves oper­ated in one or the other of the three following ways :

1. By direct pressure upon the top of the valve rod

by the hand or foot.

2. By pressure upon the top of the valve rod by pressing or sitting upon a seat which covers the valve

rod and rests upon its top ; which pressure opens the

valve and produces a continuous flow of water under pressure and which is then called a single valve.

3. By pressure caused by sitting or otherwise, upona Heat which covers the valve rod and rests upon the top, which pressure causes a slight flush ot water only and when the pressure is removed, a considerable

after-flush is produced. This is called a double act­ing valve.

c. If other fOt:"ms of water closets are used without

such waste-preventing cisterns, they shall be pro­

vided with self-closing inlet valves of such design as

shall be approved by the Executive Board.

o. Automatic flush tanks, for a single water closetor uriruw, or a series of water closets or urinals, will

not be allowed except where the water service is per­manently metered.

E. AJI urinals in public or private buildings, for

which annual shedule rates are charged, must be pro­vided with self-closing inlet valves of such design as

shall be approved by the Executive Board.

F. No bibb or faucet of any kind for general use,except self-closing, will be allowed in any premises if placed so as to stand over any urinal, unless said

premises are permanently metered. o. In case the waste water from any bath, urinal,

sink. fountain or other water works fixtures, is con-

ducted or carried to and used for flushing any water closet, then the schedule rates for water closet uses shall be collected, although such waste is the only source of supply for such water closet.

XVII.

DRINKI:s'G FOUNTAINS FOR MEN AND ANIMALS.

A. The Executive Board will provide and locatesuch number of drinking fountains and troughs in connection with the city water supply, as in its opin­ion the public need may require. These public foun­tains or troughs shall be erected and maintliined at

the public expense, but they shall in no case be locat­ed for the purpoae of subeerving private interests.

B. Io case any owner of premises may desire tohave a drinking trough located at the curb in front

of his premises, and supplied with ,vater Crom the city water mains, the Executive Board may gmnt a

permit for such use, on the following conditions : 1. The water must be taken for other purposes in­

Eide the said premises. 2. The service supplying said trough must be first

extended into the cellar or basement of the building in front of which the trough is to be set and an ap­proved meter be permanently attached,to measure the

water passing through said service. Aftex being me­tered, the service may be extended to the said trough.

8. The water is to be supplied to the trough inter­

mittently, as may be required, and not in a constant­

ly fl.owing stream. 4. The trough or basin must be of such design as

shall be approved by the Executive Board. If any

overflow or waste appliances are provided, they shall be of the kind and design approved by the engineer of the water works. Said trough shall also be located at such point as may be designated by the chief engin­eer.

5. The gutter and sidewalk adjacent to said troughshall be maintained in cleanly order and perfect re­pair, at the expense of the owner, and the water use shall be paid for at meter rates.

6. All of the expense incurred in procuring, Aettingand maintaining the meter and trough, and extend­ing the water service as directed, shall be paid by the owner or applicant.

7. The Executlve Boa.rd reserves the right Lo refusea permit for the foregoing uses in any case, and also the right to revoke a pernut of this kind at any time and for any cause, and to cut off the supply from said trough. A violation of any of the foregoing provi­sions will subject the offender to the penalty of hav­ing the.water supply cut off without notice, and also a further penalty of $2 for each and any violation of the rules relating thereto.

XYHI.

PLllMBERS.

A. No person shall make any attachment to, or con­nection with the pipes of the RochesterWaterWorks, nor make any additions to, or alteratioill! of any tap, pipe, cock or other fixture connected with the water pipes, supplying water to consumers from the said water works, unless licensed as a plumber by the

Executive Boa.rd under a. penalty of not less than $50 for each offense.

B. Any plumber wishing to do business in connec­tion with the Rochester Water Works, shall, before receiving a license to do so, file in the water works office his petition in writing, giving the name of his firm and its t>lace of doing business, and ask to be­come a licensed plumber and permitted to perform work in connection with the said water works. The sai<l petition must give satisfactory evidence that the applicant is (nr employs permanently) a regularly educated, practical and experienced plumber, that he is a. master of his trade, and that he will be governed in a.II respects by the rules and regulations which are or may be adopted by the Executive Boa.rd, and that he will pay all fines imposed upon him for the viola­tion of any of the rules or regulations of said Board. The Executive Board will then submit said applica­tion to a committee of the Master Plumbert1' Associa­tion of the city of Rochester for their examination and will receive such suggestions from them as they choose to gi""e in relation to the allegations made in such application,and also as to the competency of the applicant, and lhe propriety of granting the same.

c. If said application is granted, said plumber shallalso execute to the Executive Board, a bond in the sum of not less than $2,000, with not lees than two sureties to be approved by said Board, conditioned to indemnify and save harmless the said Board and the City of RocheFter, of and from all damages and 106ses which may result from the work of said plumber be­ing done carelessly or improperly, or in such a way

that injury or Joas results to persons or property thereby, or by reason of his failing to comply with all and singular, the regulations and rules, as they are now or may hereafter be established by said Execu­tive Board, or with any ordinances of the Common Council in relation to making excavations in the pub­lic streets, or with any provision of the Charter of the City of Rochester.

D. No plumber shall be allowed to make any ex­cavation or opening in any street, for any purpose connected with the introduction of water into any premises. neither shall he be allowed to make any at­tachment or alteration in any pipe or fixture by which water is or may � supplied to consumers. without first obtaining a written permit for the same from the Water Works Department.

E. The work embrace<!. in said permit must be com­pleted and a return made of each item of the same to the Water Registrar within four weeks from the date of safd permit, or the same will be cancelled, but may be renewed on a written application of the plumber.

F. The provisiont1 contained in Rule III., entitledGeneral Conditions and Restriction.a, are hereby made binding upon the plumber also, so far as they may be applicable.

o. In the opening of a street for the introduction ofany water service pipe or connection, under authority of a permit by the Executive Boa.rd, the plumber will be held responsible for such trench, even though the work shall be performed by the owner or some other person ; the permit for making the excavation or open-

ing in the street, being to the plumber only, and any person opening the street is supposed to do so as agent of said plumber, and by no other authority.

H. The plumber shall, ;ithin twenty-four hoursafter completing any attachment, connection or altera­tion to any pipe or fb:ture connected with the city water works, make a true, correct and detailed re­

turn in writing, on a blank furnishod him for the pur­pose of tue nature of each and every attachment, con­nection or alteration thus made and the contemplated use of water by such attachments; and when run to a tank, shall sta\.e all the uaee supplied therefrom, and file said return in the office of the Water &gistrar. The penalty attached to a non-compliance with this rule is $:i for each offense, the plumber's license to be suspended until the penalty is vaid, and the Executive Board may in its discretion also revoke the plumber's license, as a penalty for such offense•; and in all cases in which the Executive Board shall revoke a plumb­er's license, said Board will not consider an applica­tion from the same plumber for a new license within the period of one year from the date of said revoca­tion.

1. No plumber shall allow his name to be U!ied by any other person or party either for the purpose of obtaining permits or doing any work under his license.

J. Plumbers will be held responsible for any viola­tion of any of the rules of the Board by journeymen plumbers or others while in their employ.

K, The forfeiture of, or suspension of thA license of any plumber operates as a forfeiture or suspension of

the license of .any co-partner, nor will a separate license be granted to any person interested in or em­ployed by the said firm as long as they way be so in­terested or employed.

L. A license issued to a firm becomes inoperative

on a dissolution of 88.ld firm, and a separate bond

must. be filed for either party continuing in tht> busi­nellS.

!I. A license becomes inoperative whenever the part.y or parties to whom it is issued have no longer

a recognized place of business or shop.

N. A license cannot be transferred to any 1,ucces.,-;or in the business, or to any pereon whatever under any circumstances.

o. The plumber will also be required to report. to

the Water Registrar all frozt>n pipes or water fixtures that come to J1is notice <luring the winter , with the location and ownership.

P. A.ft.era permit shall ha,·e been issued to a plumberin pursuance of any application of an owner of prem­

ises, the following order shall be ob,erved by the plumber in procuring the insertion of taps.

1. .\.fter rec�iving a permit for the opening of anywater service or trench, which requires the in�ertion

of a tap in the main, with which to connect the said

service, the plumber shall file a written notice with the Water Re�istrar before O o'clock A lI, if he de­sires the tap to be inserted in the forenoon, and before

12:30 o'clock P. M., if he desires the tap to be inserted in the afternoon, on the day in which he desires the tapping to be done, of bis desire to have the tap in_

serted in the water main on that day, and such notice shall definitely designate the name of the street, and the house or lot nulllber where the tap is to be in­serted and the name of the owner or applicant, and the hour when the trench will be opened and ready for tapping.

2. The plumber shall at the same time gfre noticein writing, of the hour when he will be ready to have the whole service to the buildmg, and the fixtures, ready for inspection.

;l. Io case more than one application is made for the same hour, the one first in order of date will take precedence, unless such order shall involt.e extra travel an1I labor on the part of the tappers. The tapper will Iii! the order of the plumber as nearly at the hour named by him as is consistent with his engagements, but the Executive Board will not be held responsible for any delay in the filling of said order, or any dam­age which may resalt therefrom.

4. I ca<1e the tapper shall respond to an applica­tion of a plumber for tapping, at or later than the hour named in the notice, and said tapper shall be delayed, on account of the trench not being prepared, or it shall be nt>ee�sary for tbe tapper to make another trip to do the work, the plumber will be required to pay $1 for such delay, if it shall exceed fifteen minutes, and the same amount for each extra trip so made.un­less said delay shall be caused by unavoidable acci­den� in the performance of the work, in which case no extra charge will he made as aforesaid. In all oa'les where the tapper cannot do the work at bis first visit, the plumber must await his next turn to have the tap-

ping done, unless it can be conveniently performed in connection with other work in the same Jocamy. Ile

must, however, in all such cases, serve another notice upon the w·ater Registrar, as in the first in­stance, designating the time for said tapping.

IS. The same rules and penalties as in the preceding

shall apply and be enforced, in cases where the service inspector is delayed in his inspection or is re­quired to make a second visit.

6. Plumbers are prohibited from opening wat-er

service trenches for the introduction of new services during blustering, cold or stormy weather, and the tapper will not insert a tap in a main when the ther­

mometer registers ten degrees below freezing. The plumber will in a'll cases be helrl responsible for any

damage which may result from exposing any water pipe main or service during cold weather.

7. The Executive Board will make no charge for the work of tapping the cast iroB water mains with

the usual.screw-tap or ferule. 8. Printed forms of the notices required by the fore­

going rules will be furnished to the plumbers, on ap­

plication to the Water Rt>gistrar, and they will be re­quired to use the same as stated. The said notices will then be filed in the office of said Registrar.

9. In case it shall be brought to the notice of the

Executive Board, that the filling or repaving of any water service trench has been improperly or care­

lessly performed, or has settled, the said Board will

cause the said trench to be ro-excavated and refilled, so far as may be necessary, and the whole put in

proper order, without previous notice to the plumber;

and the expense of the same, together with all in­spection and superintendence, shall be collected of the plumber. The penalty for non-payment shall be a revocation of his license.

10. A permit will not be issued for the inserlionof a tap in a water pipe, or for the insertion of a new water service in any street, when work is in progress on said street under a contract for the laying of a water pipe main, a main sewer, or for the improve­ment of said street, unless the written consent there­for of the contractor for such work, or improvement shall first be filed in the Water Works departp:ient.

XIX.

GREENHOUSES.

A. In furnishing water for greenhouses, the annualschedule rate per 1,000 square feet of building shall be understood to cover the use of water for sprink­ling plants through a hose attachment or otherwise within the said greenhouse, and for supplying the beating boiler which provides steam for beating pur­poses only, within said greenhouse.

B. In case additional hose attachments are locatedfor sprinkling plants outside of said grPenhouse, an additional charge of $4.00 for each of said hose at­tachments sball be made, and in case water is used through said hose attachments for other purposes, special charges shall be made in addition for such other uses.

c. No charge will be made for water used in smallconservatories attached to private dwellings, in cases where the products are not utilized for sale or profit.

D. The same schedule prices will be charged for usein large greenhouses, whether they are for private or public use.

xx.

ABATEMENTS.

A. No abatement from any water bill shall be madeundPr a claim that less water bas been used, because of a partial use from wells or cisterns.

B. No abatement from any water bill shall be madewhere the owner or consumer bas not complied with the requirements of these rnles or regulations in making application at the water office for the discon­tinuance of the use of water ; in ma.king application to have any fixture disconnected ; in making appli­cation to have the water turned off from service; or in giving the notice required under Rule III, l.)iv. U, in cases where more than one dwelling or building on an undivided city lot is suppli•·d from a single ser­vice; oi. where the claimed over charge in the bill is the result of failure on his part to perform any act required by these rules.

c. No abatement from any water bill will be madem cases where the charge for water results from a failure on the part of the owner or com.umer to promptly repair any broken or defective fixtures or service.

D. No abatement from any water bill will be madein cases where any fixture is left open for waste of water or continuous flow of same, by any tenant or occupant of any premises supplied witi1 city water.

E. No abatement in any case made shall establish

a precedent for any abatement m any following or

ensuing bill, nor for any abatement in any other case ; but l'ach case shall be determined upon its merits.

F. No abatement from any water bill will be madeafter the amount cf said bill has been returned to the

City Assessors, to be a!lllessed upon the property of the owner, in pursuance or the proviilions of the City Charter.

G. No abatement from any water bill will be con­sidered by the Executive Board unl088 the claim for such abatement shall be prl'Sented to it within six months after the owner, or his agent, attorney or ten­ant, shall have rtJceived an itemized bill t'or such use of water: and no such claim for abatement shall then be considered, if ihe amount or said bill shall have been certified to the City Assessors as aforesaid.

H. The Executive Board will make abatements in

water bills when consistent with the foregoing rulet1, in cases where it i� necessary to correct clerical er­rors, erron, in the interpretation of these rates or rules, and in all other cases which �aid Board may re­

gard as just and equitable. 1. No abatement from any water bill or remittance

of any penalty provided by these rules or the Charter of the City of Rochester, shall be made, except with

the concurrence of a majority of the members of the Executive Board and the Clerk of said Board shall keep a record of its action in each particular case.

addition to the usual or regular family, shall board and lodge, or lodge without table board, in any house, school or dormitory, the charge for domestic uses of water shall be as classified in the rates under the fore­going heading.

B. No charge shall be made for table boarders whenthey are not lodgers also in the same house or estab­lishment.

XXII.

LATRINES OR SCHOOL SINKS.

A. In cases where latrines or school sinks a.re in­troduced as 1mbstitutes for water-closets into flats, tenement houses, ma.nu!actories, stores or blocks, the Executive Boa.rd will usually require the water ser­vice to be metered.

B. In cases, however, where the same a.re paid forat annual schedule rates, the following conditions will be insisted upon :

1. Th� form, size and design of the latrine and allits fixtures shall be first submitted to the Chief Engi­net>r of the water works for his approval.

2. The latrine shall be fl.lied not to exceed twiceeach day, and then only to a depth to be designated by said engineer.

8. rhe water shall not be allowed to flow contin­uously through said latrine, but shall be flushed not to exceed twice each day, and cleansed with as eco­nomical a use of water as is practicable.

XXIlI. BUILDERS.

ing purposes, will be required to make a. written ap. plication therefor at the water office. Said applica­tion shall state in detail the uses for which water is desired, the name of the owner of the property and the number of the lot on which the water is to be used, as follows:

1. Name of owner of premises.

2. Name of architect.

3. Name of builder.

4. Number of lot on which water is used.

5. Name of street.

6. Number of brick to be laid.

7. Number of perches of stone (22 cubic feet each)to be laid.

8. Number of square yards two-coat plastering.

9. Number of square yards three-coat plastering.

10. Number of square feet of cement flooring to belaid.

B. The amount of the charges for water, at schedule

rates for work thus stated, shall be paid in advance to the \Vater Registrar, before a permit for such use shall be issued t-0 the applicant.

o. The applicant, on the completion of his work

thus applied for, shall make a return to tte Water Registrar of the amount of l'&Ch kind of work actually done by him under such permit, accompanied by a certificate of the architect (if any) in charge cf said work. In case it shall appear that more work has been done than was at fl.ret applied for, the applicant will be required to pay for such excess.

D. On receipt of said return of work the WaterRegistrar may ca.use said work to be re-measured by an inspector, under his direction, and in case it shall appear that the person receiving said permit, or the architect making the required certificate. has made fraudulent representations or returns as to the amount of work done under said permit, no further permit will be issued to said applicant, or to any other per­son for him or in his behalf, under any circumstances.

E. No contractor or builder will be allowed to usewater from any fire hydrant for building purposes, ex­cept from a sprinkling hydrant in use for street sprinkling by carts, in which case the Executive Board may grant a perp:iit to obtain water from such sprink­ling hydrant, provided that free access to said hy­drant by other contractors is maintained.

F. No consumer of water will be allowed to furnishwater for building purposes, on his own or any other premises, without first paying for the same for said purpose ilnd receiving a permit for such use from the water office.

G. The builder must in all cases procure a permit,as before provided, previous to procuring water for building purposes from any city water works fixture.

H. In case the builder is required to insert a specialtiervice or fixture to enable him to procure said water for building purposes, the application for said service must be made by the owner of the property, after which the permit for such use may be issued to the builder on his application, and he must file an appli­cation to have the said service turned off at the curh as soon as he has finished his work, and must then
