REQUESTS FOR ADMISSION AND REQUEST FOR PRODUCTION

In Paragraph I of City of Princeton 's Evidence Regarding Douglas A. Kowalski 's

Property Ownership, filed with the Court on August 16, 2006, attorneys Kerry E. Russell and

Arturo Rodriguez, Ja state that 1 failed to respond to the City of Princeton's Amended Requests

for Admissions and Requests for the Production of Documents. This is absolutely untrue. The

City of Princeton's Amended Admissions and Requests were sent to me, according to its

attorneys' own Certificate of Service, on August 7"', 2006 with responses to be served within

seven days. On August 14`h, my responses were served by placing them in the United States

Postal Service mail In addition, on August 16'", Faith Wright, a paralegal at the firm of Russell

& Rodriguez, L.L P, phoned me at my office asking me if I had sent my responses, and I

informed her that they had been placed in the mail on Monday, August 14'h, exactly seven days

from date of receipt

PROPERTY OWNERSHIP

TO THE HONORABLE ADMINISTRATIVE LAW JUDGE:

COMES NOW Applicant, the City of Princeton ("City" of "Princeton"), and hereby

submits its Supplement to Evidence Regarding Douglas A. Kowalski's Property Ownership.

Because Mr. Kowalski does not own property located within the City's requested water or sewer

service territory and he lacks a personal justiciable interest in the City's application, Princeton

respectfully requests that Mr. Kowalski's request for party status be denied. In support of this,

Princeton presents the following:

I. MR. KOWALSKI DOES NOT OWN PROPERTY WITHIN THE CITY'SREQUESTED WATER OR SEWER SERVICE TERRITORY

Pursuant to Order No. 5, Your Honor requested evidence regarding the location of

Mr. Kowalski's property in Collin County, Texas. On August 7, 2006, the City served on

Mr. Kowalski, through the pro se party aligned group representative, Mr. Robert Gammenthaler,

• •regarding the location of Mr. Kowalski's property.' Pursuant to Order No. 5, Mr. Kowalski's

responses were due seven (7) days from date of receipt of service which would have been August

14, 2006. A copy of the discovery requests were attached to the City of Princeton's Evidence

Regarding Douglas A. Kowalski's Property Ownership as Exhibit A, which was filed on August

16, 2006. A copy of the acknowledgement of receipt of discovery request was attached to City

of Princeton's Evidence Regarding Douglas A. Kowalski's Property Ownership as Exhibit B.

The City received today Mr. Kowalski's responses, ten (10) calendar days from the date he was

served the requests.

In order to understand the location of Mr. Kowalski's property, the City asked the

following requests for admission:

REQUEST FOR ADMISSION NO. 1:

Your property is located outside of the area the City of Princeton seeks for a water certificate

of convenience and necessity in this proceeding.

RESPONSE:

ADMIT OR DENY

REQUEST FOR ADMISSION NO. 1:

Your property is located outside of the area the City of Princeton seeks for a sewer certificate

of convenience and necessity in this proceeding.

RESPONSE:

ADMIT OR DENY

The City understands that Mr. Kowalski serves as the Police Chief for the City of McKinney. Out of anabundance of caution and due to the short response time prescribed by Order No. 5, the City served theRequests for Admission on Mr. Kowalski at the McKinney Police Department. Thus, Mr. Kowalski wasdually-served with the discovery requests. Evidence of service on Mr. Kowalski via facsimile transmissionand through Mr. Gammenthaler is contained in Exhibit B, attached hereto and incorporated herein for all

purposes.

^ •Your Honor ordered that discovery on Mr. Kowalski be limited to issues regarding the

property he owns in Collin County and that responses to discovery should be served within seven

days of service. Mr. Kowalski did not respond to the City's discovery requests. Mr. Kowalski's

responses are attached hereto as Exhibit A.

II. MR. KOWALSKI HAS FAILED TO DEMONSTRATE A JUSTICIABLEINTEREST

According to 30 TEx. ADMIN. CODE § 55.256(a), each individual who is requesting party

status must demonstrate a "personal justiciable interest related to a legal right, duty, privilege,

power, or economic interest affected by the application" (emphasis added). Although

Mr. Kowalski claims to have a justiciable interest in the City's application, he has failed to

demonstrate that his interest is a personal interest. The map attached to Mr. Kowalski's

responses shows that his property is located wholly outside of the area being sought by the City

in this application. Further Mr. Kowalski makes an argument that due to elevations and the

"Law of Physics"2 his property, though not physically inside of the requested area, somehow is

included in the area the City is seeking in its application. The Texas Water Code and Texas

Administrative Code, not Mr. Kowalski's theory of the "Law of Physics", establish the standard

in this proceeding to demonstrate a personal, justiciable interest.

Mr. Kowalski attempts to establish a justiciable interest by asserting some conflict

between the ETJ of the cities of McKinney and Princeton. Regardless of any dispute that may

exist between McKinney and Princeton, such ETJ dispute is not before the Commission in this

proceeding. Moreover, even if it were, the point would be moot as it relates to Mr. Kowalski as

Princeton is not seeking to certificate the property he owns and that he claims is within

McKinney's ETJ. Simply speaking, Mr. Kowalski's strained argument has no relevance to

^ •ascertaining whether Mr. Kowalski has a justiciable interest or not. Without doubt, the Texas

Commission on Environmental Quality has no jurisdiction to add, remove, or determine the

City's ETJ or any dispute that may arise regarding the ETJ of either the City of Princeton or the

City of McKinney. Mr. Kowalski cannot utilize this proceeding to attempt to argue an irrelevant

issue.

Lastly, Mr. Kowalski attempts to establish a justiciable interest by discussing zoning

issues which may negatively impact his property value. Mr. Kowalski, however, has failed to

establish how zoning issues have any relevance to the City's CCN application. Zoning issues are

clearly outside the scope of this proceeding. The Commission has no jurisdiction over municipal

zoning issues. The Texas Legislature has made it clear that such issues are within the exclusive

jurisdiction of municipalities. Thus, Mr. Kowalski's assertions do not establish that he has a

personal justiciable interest in this proceeding.

III. PRAYER

WHEREFORE, PREMISES CONSIDERED, the City of Princeton respectfully requests

that the Administrative Law Judge deny Mr. Kowalski's request for party status in this matter.

TO THE HONORABLE ADMINISTRATIVE LAW JUDGE:

COMES NOW Applicant, the City of Princeton ("City" of "Princeton"), and hereby

submits its Supplement to Evidence Regarding Douglas A. Kowalski's Property Ownership,

Because Mr. Kowalski does not own Property located within the City's requested water or sewcr

service territory and he lacks a personal justiciable interest in the City's application, Princeton

respectfully requests that Mr. Kowalski's request for party status be denied. Tn support of this,

Princeton presents the following:

Pursuant to Order No. 5, Your Honor requested evidence regarding the location of

Mr. Kowalski's Property in Collin County, Texas. On August 7, 2006, the City served on

Mr. Kowalski, through the pro se party aligned group representative, Mr. Robert Garnmenthaler,

regarding the location of Mr. Kowalski's property.' Pursuant to Order No- 5, Mr. Kowalski's

responses were duc scvcn (7) days from date of receipt of service which would have been August

14, 2006. A copy of the discovery requests were attached to the City of Princeton's Evidence

Regarding Douglas A Kowalski's Property Ownership as Exhibit A, which was filed on August

16, 2006. A copy of the aclaiowledgement of receipt of discovery request was attached to City

of Princeton's Evidence Regarding Douglas A. Kowalski's Property Ownership as Exhibit B.

The City received today Mr. Kowalslu's responses, tcn (10) calendar days from the date he was

served the requests.

In order to understand the location of Mr. Kowalski's property, the City asked the

following requests for admission:

Your Honor ordered that discovery on Mr. Kowalski be limited to issues regarding the

property he owns in Collin County and that responses to discovery should be served within seven

days of service. Mr. Kowalski did not respond to the City's discovery requests. Mr. Kowalski's

responses arc atTachcd hereto as Exhibit A.

t t. M I2. KO'wA><.S KY t-t AS FA I LED TO DEMONSTRATE A JUSTICIABLEINTEREST

According to 30 TEX. ADME^. CODE § 55.256(a), each individual who is requesting party

status must demonstrate a "personal justiciable interest related to a legal right, duty, privilege,

power, or economic interest affected by the application" (emphasis added). Although

Mr. Kowalski claims to have a justiciable interest in the City's application, lie has failed to

demonstrate that his interest is a personal interest. The map attached to Mr. Kowalski's

responses shows that his property is located wholly outside of the area being sought by the City

in this application. Further Mr. Kowalski makes an argument that due to elevations and the

"Law of Physics", his property, though not physically inside of the requested area, somehow is

included in the aiea the City is scclcung in its application. The Texas Water Code and Texas

Administrative Code, not Mr. Kowalski's theory of the "Law of Physics", establish the standard

in this proceeding to demonstrate a personal, justiciable interest.

Mr, Kowalski attempts to establish a Justiciable interest by asserting some conflict

between the ETJ of the cities of McKinney and Princeton. Regardless of any dispute that may

exist between McKinney and Princeton, such ETJ dispute is not before the Commission in this

proceeding. Moreover, even if it were, the point would be moot as it relates to Mr. Kowalski as

Princeton is not seeking to certificate the property he owns and that lie claims is within

McKinney's ETJ. Simply speaking, Mr. Kowalski's strained argument has no relevance to

^ •ascertaining whether Mr. Kowalski has a justiciable interest or not. Without doubt, the Texas

Commission on Environmental Quailty has no jurisdiction to add, remove, or determine the

City's ETJ or any dispute that may anse regarding the ETJ of either the City of Princeton or the

City of McKinney Mr. Kowalski cannot utilize this proceeding to attempt to argue an irrelevant

issue.

Lastly, Mr Kowalski attempts to establish a justiciable interest by discussing zoning

issues which may ncgativcly impact his property value. Mr. Kowalski, however, has failed to

establish how zoning issues have any relevance to the City's CCN application. Zoning issues arc

clearly outside the scope of this proceeding. The Commission has no jurisdiction ovor municipal

zoning issues, The Texas Legislature has made it clear that such issues are within the exclusive

jurisdiction of municipalities. Thus, Mr. Kowalski's assertions do not establish that lie has a

personal justiciable interest in this proceeding,

III. PRAYER

WHEREFORE, PREMISES CONSIDERED, the City of Princeton respectfully requests

that the Administrativc Law Judge deny Mr. Kowalski's request for party status in this matter.

PROPERTY

I own approximately 11.99 acres of land upon which is located my homestead and farm at

2935 County Road 406, McKinney, Collin County, Texas (Exhibit A).

EXTRA TERRITORIAL JURISDICTION (ETJ)

The Applicant, City of Princeton, claims that a section of my real property is within its

ETJ. Simultaneously, the City of McKinney claims that my real property is within its ETJ. Both

Cities have CCN Applications pending before this Court, both of which will affect my property

interest. While the attorney for the City of Princeton argues that this is a matter solely between

the two cities, I argue that the boundary involves real property which is owned not by either City,

but by the landowners.

The economic interest, property valuation, is directly tied to which City prevails in this

boundary dispute and the pending CCN Applications.

FUTURE LAND USE PLAN (FLUPI

The City of McKinney's FLUP indicates that this are is designated for Residential

Estates, with a maximum of one house per acre. Its CCN to provide sewer service is designed in

accordance with its FLUP.

The City of Princeton has already encroached into this area and allowed the development

of high density, single family residences, with multiple houses per acre, called "Twin Hills

Way". The attached Collin County website map depicts this development in relation to this area

(Exhibit B).

• •There are currently street cuts in this development heading north, presumably indicating

that the City of Princeton will allow this type of development to continue and have presumably

designed its CCN for sewer and water service to support this type of development. I say

presumably, as I have been, thus far, stayed from proceeding with discovery toward the

Applicant, City of Princeton.

The attorney for the City of Princeton argues that zoning is within the purview of each

city. However, it must be remembered that the area is disputed between two cities and both have

pending CCN Applications to this same area.

The real property values of the adjacent landowners will be negatively impacted if the

CCN Application of the City of Princeton proceeds.

EVOLUTION AND THE LAW OF PHYSICS

It is interesting to note that the CCN Applications for water and sewer service by the City

of Princeton include areas clearly beyond their claimed ETJ, but exclude western areas within

their claimed ETJ. One must ask, why?

High density single family residential development will undeniably generate a

considerable amount of storm water run-off, sanitary sewer effluent, and water use.

According to the laws of physics, water will seek its lowest level. The CCN Applications

of the City of Princeton indicates the western boundary of their service. This same boundary, in

a Collin County website map, indicates that, according to the contours, this western boundary is

along a ridge line which drops off dramatically to the west toward my property (Exhibit C).

A zoom-in of this same contour map indicates that the western boundary of the CCN

Application for the City of Princeton is at approximately 632 feet above sea level (Exhibit D).3

S 0Moving west, the land drops off to the dramatically lower elevations of 576 feet at the front of

my property, through 556 feet at the back of my property, which includes my homestead and all

of my real property (Exhibit E).

In short, I am an affected party, as my real property and homestead will become the

unwanted, unwelcome, and unprotected recipient of the run off, and any inevitable sanitary or

water line breaks in the City of Princeton's proposed CCN Application.

SOVEREIGN INDEMNITY AND INSURANCE

Any inevitable damage incurred on my real property and homestead will be borne only by

me, at considerable economic expense.

I have attached a copy of a recent newspaper column which clearly relates the dilemma

facing the land owner, under the current laws of the State of Texas. When a sanitary sewer line

breaks or malfunctions off of one's property, the political entity defends itself with the doctrine

of "Sovereign Immunity". The insurance companies, particularly State Far Insurance, will not

cover a loss that is a result of a problem that arose from a situation off of the insured property

(Exhibit F). The carrier for my homeowner's insurance policy is State Farm Insurance.

Additionally, I have an agricultural exemption for the production of hay. The water run

off, especially sanitary effluent, will ruin the value of the crop and prohibit any farm machinery

from operating in the flooded area.

In conclusion, I am an affected party due to the economic impact the Application for the

CCN for water and sewer service by the City of Princeton will have upon my bottom land.

I pray that I remain as a party and that my concerns by addressed.
